Law 3/2013, of 4 June, of the creation of the National Commission of the Markets and Competition, has introduced a new distribution of regulatory functions affecting the postal sector and the management of the property benefits linked to it.

The additional eleventh provision and the additional fourteenth provision of that law assign to the Ministry of Development, among other functions, the granting of the singular administrative authorizations, the receipt of the responsible statements, the management of the General Register of postal service providers and the voluntary management and collection of fees payable on the occasion of the development of such activities.

In this way, the Ministry of Public Works assumes the responsibilities of management and collection on a voluntary basis of the fees referred to in paragraph I. 1, in its headings A) and B), of the Annex to the aforementioned Law 3/2013, of 4 June: the registration fee in the General Register of postal service providers and the fee for the issue of registration certificates.

While these rates were already regulated in Order FOM3447/2010 of 29 December, approving the printed models for the payment of the rates established and regulated in Law 23/2007, of 8 October, of creation of the National Commission of the Postal Sector, the modifications introduced by Law 3/2013 in the regulatory functions of the postal sector oblige to reform some aspects related to the models of printed, the place and the form of income of such fees.

This order is issued in accordance with the provisions of the final provision of Law No 3/2013 of 4 June, which enables the Government to lay down the regulatory provisions necessary for its development and the I. 1, in its headings (A) and (B), of the Annex to the same law, in which it is established that the liquidation of these fees by the Ministry of Public Works shall be in accordance with the provisions of the ministerial order given for that purpose.

By virtue of the above, I have:

Article 1. Object.

This order has the purpose of regulating certain aspects of the registration fee in the General Register of postal service companies and of the fee for the issue of registration certificates, to which refers to paragraph I. 1, in its headings A) and B) of the Annex to Law No 3/2013 of 4 June of the establishment of the National Commission on Markets and Competition.

Article 2. Printed.

The voluntary liquidation of both charges will be carried out using the form of form 790 set out in the Order of 11 December 2001 amending the Order of 4 June 1998 governing the certain aspects of the collection of charges which constitute the rights of the public treasury.

The models for self-validation of postal charges will be available at the electronic headquarters of the Ministry of Public Works, which can be accessed through the electronic reference address. https://sede.fomento.gob.es or the http://www.fomento.es website.

Article 3. Settlement.

The payment of the registration fee in the General Register of postal services companies will be made at the time when the registration or renewal of the registration is requested in the General Register of companies postal services providers.

The payment of the fee for the issue of registration certificates shall be made at the time when the issue of the registration certificate is requested in the General Register of postal service companies.

The procedure for the entry of the two charges will be in line with the order of 11 December 2001 amending the Order of 4 June 1998 governing certain aspects of the management of tax revenues. of the fees that constitute the rights of the Public Finance.

The presentation and payment may be made by telematic means through the electronic headquarters of the Ministry of Public Works, as set out in Order HAC/729/2003, of March 28.

Single repeal provision. Regulatory repeal.

Order FOM3447/2010, dated 29 December, is hereby repealed, approving the forms for the payment of the rates established and regulated in Law 23/2007, of 8 October, of the creation of the National Commission of the Postal Sector.

Also, any other provisions of equal or lower rank are repealed as set forth in this order.

Single end disposition. Entry into force.

This order will take effect the day following your publication in the "Official State Bulletin".
