Commission Regulation No 445/2015 of 17 March 2015 amending Regulation (EU) No 1178/2011 laying down technical requirements and administrative procedures relating to the flight staff of the European Union civil aviation, means the establishment of derogation approvals with respect to certain requirements in accordance with Article 14 (6) of Regulation (EC) No 216/2008.

In accordance with the provisions of that Regulation, the requirements laid down in Regulation (EU) No 1178/2011 should be amended in order to introduce derogations which have a clear regulatory effect and a certain degree of flexibility for general aviation, as well as for correcting certain drafting errors.

The entry into force of that Regulation takes place on 8 April 2015. However, after detecting that certain requirements, in particular those of Annexes VI and VII, could be disproportionate to the activity and the associated risk of the training bodies providing instruction only for the licences of the Light aircraft pilot, private pilot, aerostatic balloon pilot and glider pilot, Regulation (EU) 445/2015 itself has seen the need to extend the deadline of application until 8 April 2018 for these activities of the pilot sector without prejudice to safety standards.

In this regard, in order to give the time needed for the preparation of those rules, Regulation (EU) 445/2015 provides that the date of application of the provisions of Annex VII to Regulation (EU) No 1178/2011 to the training bodies which provide instruction only for the obtaining of national licences for glider pilots suitable for conversion into licences of the Parte-FCL should be deferred until 8 April 2018.

In this way, it is laid down in Article 3.3 of Regulation (EU) No 445/2015 that " (...) Member States may choose not to apply the provisions of Annexes VI and VII to a training body providing instruction only for a national licence which, pursuant to Article 4 (3) of Regulation (EU) No 1178/2011, is eligible for conversion into a light aircraft pilot (LAPL), glider pilot (SPL), or balloon pilot licence aerostatic (BPL) of the Parte-FCL until 8 April 2018.

In accordance with this possibility, it is necessary to opt for the delay in the application of Annexes VI and VII to the training bodies which provide instruction only for the obtaining of national pilot licences. glider (SPL) of the Parte-FCL until April 8, 2018; for the following reasons: facilitate a more progressive transition to the structure of an ATO for schools that currently conduct instruction for obtaining a national license of a non-powered flight pilot.

Regarding the requirements for the training, evaluation and issuance of pilot licenses and associated ratings and certificates for the glider pilot (SPL) license, as well as the conditions of their validity and use, be subject to the provisions of Annex I to Commission Regulation (EU) No 1178/2011 of 3 November 2011 laying down technical requirements and administrative procedures relating to the flight crew of civil aviation in Regulation (EC) No 216/2008 of the European Parliament and of the Council.

However and in relation to this Annex I, and in accordance with the provisions of Article 1 (3) (b) of Commission Regulation (EU) No 445/2015, which includes the new paragraph 2a of Article 12 of the Regulation Commission Regulation (EU) No 1178/2011 provides for the possibility to also choose to delay the application of the provisions of Annex I until 8 April 2018, referred to in point FCL 805 of that Regulation, provided for in the Air carrier glider and drag trailer.

In the event of circumstances that enable the implementation of the provisions of Annexes I, VI and VII to be brought forward, prior to 8 April 2018, adoption and publication of the provisions of these Annexes I, VI and VII will be necessary. 'Official State Gazette' of a new Resolution of the State Aviation Safety Agency declaring the application of those Annexes.

Under all of the above, the Director of the State Aviation Safety Agency resolves:

(a) Declare the application of the provisions of Annexes VI and VII to the training bodies which provide instruction only for a national licence which, pursuant to Article 4 (3) of Regulation (EU) No 63/2014, is not applicable; 1178/2011 is eligible for conversion into a glider pilot (SPL) licence, from the Parte-FCL until 8 April 2018;

b) Declare the non-application of the provisions of Annex I to the air-advertising glider and drag trailer (FCL 805) towing entitlements until April 8, 2018.
