He article 3.10 of the law 24 / 2013, of 26 of December, of the Sector electric, sets, among them competencies that correspond to the Administration General of the State, regular them terms in that is has of develop it management economic and technical of the system electric, approving them rules of market and them procedures of operation of character instrumental and technical necessary.

Moreover, article 31 of the Royal Decree 2019 / 1997, of 26th December, that organizes and regulates the electricity production market, establishes that the operator of the system and the National Energy Commission, currently National Commission of markets and competition, may be proposed for approval by the Ministry of industry, tourism and trade Ministry of industry, energy and tourism, the operation of technical and instrumental procedures necessary to perform adequate technical management of the system, who will solve the abovementioned Commission report.

The Royal Decree 216/2014, 28 March, which establishes the methodology of calculation of prices volunteers for the small consumer of electric power and its status of recruitment, determines in its eleventh additional provision that proposals for operation of technical and instrumental procedures proposed by the system operator shall be accompanied by the report of the representatives of all the subjects of the system defined in article 6 of the Law 24 / 2013, of 26 of December, of the Sector electric. This forecast was contained earlier in the third additional provision of the Royal Decree 485/2009, of 3 April, which regulates implementation of supply of last resort in the electric power sector, repealed by the quoted Royal Decree 216/2014, of 28 March.

It present resolution has by object it approval of the procedure of operation that allows the estimation of the cost of them components that integrate the price voluntary for the small consumer (PVPC), attending to the methodology established by the Real Decree 216 / 2014, of 28 of March, by which is sets it methodology of calculation of them prices volunteers for the small consumer of energy electric and his regime legal of recruitment.

Article 7 of said Royal Decree 216/2014, 28 March, collects the general structure of volunteers prices to small consumers. In paragraph 7, is set by the system operator will perform the calculations of those values of the components of the voluntary price for small consumer laid down in the Royal Decree, and shall publish on its website the day before the supply for each of the 24 hours of the next day, the information pursuant to annex I of the same.

Furthermore, annex I contains information published by the operator of the system for the calculation of the voluntary price for small consumer and in the second paragraph provides that the following aspects shall be determined by resolution of the Secretary of State for energy: to) the time of publication of the values of the components required for the calculation of the voluntary price for small consumers who must be published the day before the supply , for each of the 24 hours of the day.

(b) the method of estimation of them components of them terms Pmh (price half time), SAh (services of adjustment in the hour h) and OCh (others costs associated to the supply).

(c) any other matter necessary for the estimation of the components of the voluntary price for the small consumer.

This way, in the thirteenth additional provision of Royal Decree 216/2014, of 28 March, is given the mandate to the system operator to introduce, within the period of one month from the entry into force of the Royal Decree, the Ministry of industry, energy and tourism a proposal for estimation procedure of each of the components of the voluntary price for small consumers for the purposes of the adoption of the planned resolution in the (2) Annex I of Royal Decree.

In this sense, electrical network of Spain, S.A., as the system operator, referred dated April 30, 2014 proposed adoption of a new procedure of operation named «Estimation of the components of the voluntary price for small consumer».

This proposal was submitted to the National Commission of markets and competition for the issuance of the report in accordance with that laid down in article 5(2) and the tenth transitional provision of law 3/2013, June 4, creation of the National Commission of markets and competition, and considering the provisions of article 31 of the Royal Decree 2019 / 1997 , on December 26, which organizes and regulates the electricity production market.

On August 4, 2014 Hall of monitoring regulatory of the Commission national markets and the competition agreed to issue report requested by the Secretary of State of energy, on the proposal of the system operator of new operation procedures for the estimation of the components of the voluntary price for small consumer.

This Secretary of State resolves: first.

Approve the procedure for the operation of the system electric P.O.-14.12 «estimation of them components of the price voluntary for the small consumer», whose text is inserted below.

Second.

This resolution shall take effect on the day following its publication in the "Official Gazette".

ANNEX I procedure of operation 14.12: ' estimate of the cost of the components of the price volunteer for the small consumer» 1. Object.

The object of this procedure is to establish the method of estimation of the cost of those components of the voluntary price for small consumers (PVPC) that are not known at the time that the system operator must publish them the day before the supply for the 24 hours of the next day.

2. scope of application.

This procedure is applicable to the operator of the system (OS) and marketers (COR) reference.

3. time of publication of the PVPC components.

Before 20 h 30 each day, the system attendant will publish the values of the components required for the calculation of the PVPC for each of the 24 hours of the next day, according to the provisions in this proceeding.

4. estimation of the cost of the components of the PVPC.

4.1 estimation of the average hourly price component.

For the calculation of the average hourly price component Pmh, shall be considered, as well as the results of the daily market, the values of marginal price and power married in the first session of the intraday market.

4.2 estimation of adjustment services in time h.

The value of the corresponding cost to system setting services associated with the supply in the hour h, Shah, is calculated according to the following formula provided for in article 11 of Royal Decree 216/2014, 28 March: SAh = PMASh + CDSVh be: PMASh: hourly price of all services of system setting whose cost is assigned to the demand.

CDSVh: Cost of hourly offsets per MWh consumed from marketers of reference.

4.2.1 estimation of the hourly price of adjustment (PMASh) services.

The hourly price of services of system setting whose cost is assigned to the demand will be calculated with the following formula: PMASh = PMAS1h + PMAS2h as: PMAS1h: component of the hourly price of services adjustment, PMASh, whose cost is known before the time of publication of the PVPC the day before of the supply, given in paragraph 3 of the present procedure.

This component is the result of dividing the cost of the technical constraints to program Base of operation (PBF), fixed of the band of secondary regulation cost and the cost of the extra climb, power reserve enters the market with known data at the time of publication of the PVPC scheduled demand.

This cost not known includes, among others:-variation of the cost of restrictions by boots not made and by breaches of power scheduled by restrictions;

-variable cost of the band of secondary regulation in real time;

-variation of the cost of the power reserves additional to climb by defaults and by allocation of part of the cost to production measured deviations;

-cost of technical restrictions in real time;

-cost for deviations between systems;

-income/cost of the balance of the detours.

The estimation of the schema component PMAS2h will be, for each of the hours of the month m, the sum of two terms: PMAS2h = PMAS2Am + PMAS2Bm PMAS2Am: estimated price of the components of services of setting an amount in euros does not depend on demand and liquidated in the last twelve months with closed settlement month full:-technical restrictions on the PBF and real-time - reserve power to climb, - high school band - offsets between systems.

In accordance with it willing in the article 12 of the Real Decree 216 / 2014, of 28 of March, the value of the cost corresponding to others costs associated to the supply in the period tariff p, OCh, is calculated in accordance with the following formula: OCh = CCOMh + CCOSh + CAPh + INTh them values CCOMh, CCOSh and CAPh will be them existing in accordance with the normative of application and known in the time of the publication of them components of the PVPC the day before to the supply.

The term INTh, hourly amounts for the financing of the service of interruptibility, shall be estimated in accordance with provisions in this proceeding.

4.3.1 the interruptibility service cost estimates.

The estimate of the hourly amount for the financing of the service of interruptibility, INTh will be, for each of the hours of a month m, the result of dividing the fixed cost of the month interruptibility service m between the best estimate of the demand in the month central bars available m before the Thursday prior to the first day of the month m.

Where: CFINTDm: cost fixed monthly total in euros of the remuneration of the service of interruptibility associated to the availability of power and defined in the article 12.2 of the order EIT / 2013 / 2013, of 31 of October, by which is regulates the mechanism competitive of assignment of the service of management of the demand of interruptibility.

EDEMBCm: Best estimate of demand in the month central bars available m before the Thursday prior to the first day of the month m, in MWh.

5. estimation of the coefficient of loss of toll access.

5.1 mainland system.

For the purposes of the application of provisions in the fourth additional provision of the Royal Decree 2016 / 2014, the coefficient of loss of toll access application to supply the hour h, PERDh, defined in the Royal Decree, shall be calculated with the following formula: PERDh, pa, nt = KEST * CPERNpa, nt where: KEST: estimated time adjustment coefficient.

CPERNpa, nt: coefficient of loss of supply points consumers with toll's access pa and nt in the tariff period voltage level which corresponds the time h.

These loss coefficients shall be those laid down in the regulations concerned, to transfer the power supply to consumers to power supplied in bars of central.

KEST estimated an hour adjustment coefficient shall be calculated as: a) arithmetic mean of the coefficients of adjustment Schedule K of the same time and day of the week of the same month of the previous year with positive K-value and less than 2, except at times of national holidays non-replaceable with fixed date.

(b) arithmetic mean of the coefficients of adjustment Schedule K of the same time and same day holiday national not replaceable with date set for the three previous years with positive K-value and less than 2 hours of non-replaceable national holidays with fixed dates.

c) if in an hour all the historical values of K are negative or zero, KEST is equal to 0. If in one hour all the historical values of K are greater or equal to 2, KEST is equal to 2. If in one hour all the historical values are negative, zero, equal to 2 or greater than 2, KEST shall be equal to 1.

Where: PERTRA: losses time measures in the network of transportation.

PERDIS: losses time measures in all the networks of distribution.

PEREXP: losses time assigned to all the units of export.

5.2 systems electrical of the Territories not peninsular.

The value of KEST in the electrical systems of the non-peninsular territories will be the same that laid down in paragraph 5.1 for the Mainland system until it develops the rules and regulations governing the activity of production of electrical energy and the procedure for clearance in those territories with the particular conditions which, where appropriate, be established.

The value of KEST in the electrical systems of the non-peninsular territories will be the same that laid down in paragraph 5.1 for the Mainland system until it develops the rules and regulations governing the activity of production of electrical energy and the procedure for clearance in those territories with the particular conditions which, where appropriate, be established.
