The Superior Council of sports is an autonomous body attached to the Ministry of education, culture and sport, whose skills and governing bodies are regulated in the law 10/1990 of 15 October, the sport.

From the publication of the Real Decree 2195 / 2004, of 25 of November, by which is regulates the structure organic and the functions of the Council top of sports, is have produced important changes in them institutions with skills in matter sports.

So, the Council top of sports has seen modified its structure and skills through the Real Decree 185 / 2008, of 25 of November, by which is approves the Statute of the Agency State anti-doping, that assumes certain powers exercised until that time by the Council upper of sports in matter of doping. By Royal Decree 257/2012, 27 January, which develops the organic basic structure of the Ministry of education, culture and sport, are abolished the General Sub-Directorate of major sporting events and the General Directorate of sports infrastructures, assuming the powers of the first Cabinet of the President, and the second the General direction of sports. Royal Decree 87/2013, 8 February, collects the modification of Royal Decree 811/2007, of 22 June, by which determines the structure, composition, functions and mode of operation of the health and doping control and supervision Committee, attributing the designation of the Chairman of the Committee to the President of the Superior Council of sports hitherto attributed normatively to the Director General of sports.

Also, more recently, law 3/2013 June 20, for the protection of the health of the athlete and fight against doping in sport, has been the assumption by the renamed agency Spanish protection of health in the sport of competences which, until then, was the Superior Council of sports in the field of protection of the health of athletes.

From another perspective, the current economic situation has manifested itself in sport, as in other sectors, it has forced a resizing of the policies pushed by the Higher Council for sports, and has prompted the need for a review of its structure.

In that sense, looking for a better coordination and control of budget appropriations, both the personal and material resources assigned for the purposes of the Higher Council for sports, it has estimated necessary to unify functions horizontal and ordinary management into a single unit, compared to the existing model to date of separation in two General sub-directorates with matching competencies both horizontal , as vertical.

An aspect that also has to be taken into account in updating the structure of the Higher Council for sports, is derived from the organic law 3/2007 of 22 March for the effective equality of women and men, which motivates the appropriateness of mechanisms that give coverage to the same, so that the Superior Council of sports has a unit specializing in the role of women in the world of sport.

On the other hand, the necessary coordination that must exist in the field of sports between the different public administrations with competence in the matter, mainly the Government, through the Higher Council for sports, and the autonomous communities and cities with statutes of autonomy, the law 10/1990 of 15 October, sport, requires the regulation of the Interterritorial Conference for sport , as organ Collegiate of cooperation of them planned in the article 5 of the law 30 / 1992, of 26 of November, of regime legal of them administrations public and of the procedure administrative common, under the Presidency of the President of the Council upper of sports.

Therefore, it is necessary to adapt the structure of the Higher Council for sports, in order to ensure greater efficiency and effectiveness in the management of assigned responsibilities.

In his virtue, to initiative of the Minister of education, culture and sport, to proposal of the Minister of Hacienda and administrations public, in accordance with the Council of State and prior deliberation of the Council of Ministers in its meeting of the day 5 of June of 2015, HAVE: article only. Adoption of the Statute of the Superior Council of sports.

Approves the Statute of the Higher Council of sports whose text is then inserted.

First additional provision. Excision of organs.

(1.Quedan excised organs with subdirectorate-general for organic level: to) the General Sub-Directorate of inspection.

(b) the Subdirectorate General of promoting sports and sport Paralympic.

(c) the General Sub-Directorate of sport and health.

(d) the General Sub-Directorate of sports infrastructures and economic management.

Fourth additional provision. Limitation of compensation and compensation by reason of the service.

1. the members belonging to the colleges affiliated with the Higher Council for sports, shall not charge any remuneration derived from their status as members of those bodies, or by the performance of the duties inherent in their membership in the same.

Fifth additional provision. Regulation of the Interterritorial Conference for sport.

1. the Inter-territorial Conference for sport is the collegiate body for coordination and cooperation between the General Administration of the State, the autonomous communities and the cities of Ceuta and Melilla, in the field of sport, those provided for in article 5.7 of the law 30/1992, of 26 November, legal regime of public administrations and common administrative procedure.

Second transitional provision. Processing files initiated previously.


Records and proceedings initiated prior to the entry into force of this Royal Decree, will be continued by the units who have assumed jurisdiction over the matters to which they refer, after the adoption of the resolution of the President of the Agency referred to in paragraph 2 of the first transitional provision.

Third transitional provision. Functioning of the Board of Directors.

The current members of the Board of Directors will continue to perform the duties, until the appointment of the members pursuant to article 6 of the Statute and the effective Constitution of the body, which must be carried out within a maximum period of three months from the entry into force of this Royal Decree.

Sole repeal provision. Repeal legislation.

They are hereby repealed many provisions of equal or lower rank are contrary to the provisions of this Royal Decree and in the statute that virtue is approved and, specifically, the Royal Decree 2195 / 2004 of 25 November, which regulates the organizational structure and functions of the Superior Council of sports, as well as the Royal Decree 1242 / 1992 , of 16 October, which regulates the composition and operation of the directive Committee of the higher Sports Council.

First final provision. Modification of paragraph 5 of article 2 of the Royal Decree 53/2014, of 31 January, which develops the composition, organization and functions of the Administrative Tribunal of sport.

Second final provision. Modification of article 5 of the Royal Decree 971/2007, of July 13, on high-level and high-performance athletes.

The Minister of Hacienda and administrations public, CRISTOBAL MONTORO ROMERO STATUTE OF THE COUNCIL SUPERIOR OF SPORTS CHAPTER I nature and assignment article 1. Nature and organic assignment.

Article 2. Regime legal.

Article 3. Competencies.

CHAPTER II structure organizational of the body section 1st organs of the Council Superior of sports item 4. Organs of the Council Superior of sports.

(2. organs of direction and productivity: to) the direction General of sports.

(b) the subdirectorates general.

Section 2 organs governing article 5. The President of the Council Superior of sports.

1. the President of the Council top of sports, with range of Secretary of State, is appointed and separated by the Council of Ministers, to proposal of the Minister of education, culture and sport.

(g) authorize the multi-year expenditure of sports federations in the cases provided for by regulation, determine the fate of its heritage, in the event of dissolution, and authorize the assessment and disposition of their property when these have been financed total or partly with public funds from the State.

(h) authorize the acquisition of securities of corporations sports in the terms established by the Act 10/1990 of 15 October, sport, and exercise the powers to impose penalties provided for with respect to sports corporations.

(i) grant the distinctions, decorations, and other sports awards of the Higher Council for sports.

(j) administer the assets of the Higher Council for sports, authorize and provide costs of the Agency, as well as recognize the obligations and direct payments; authorize credit modifications which may be applicable; the characteristic of the activity of the agency contracts; and issuing administrative acts on its behalf.


(k) formulate and approve the annual accounts, as well as its accountability to the Court of Auditors through the General intervention of the administration of the State and adopted the preliminary draft budget of the Agency.

(l) exercise the other powers and prerogatives that attributed to them by the legal provisions in force and, in particular, carry out other functions that are not expressly assigned to the Board of Directors.

3. the President of the Consejo Superior de Deportes will exercise, also in the management of the Agency, any other function, faculty or prerogative which attributed to the Ministry of education, culture and sport the provisions in force in the field of personnel, budget, facilities and hiring, with the exception of the office of institutional relations with the Parliament and the Government corresponding to the incumbent Minister of the Department.

Article 6. Commission directive.

1. the Board of Directors of the Consejo Superior de Deportes is the governing body of the same, in accordance with article 7(3) of law 10/1990 of 15 October, the sport, and their actions will put end to the administrative procedure.

(c) vocal: 1 on behalf of the General Administration of the State, three members appointed directly by the President of the Superior Council of sports, among holders of organs of the General Administration of the State and its public agencies, with a minimum level of Deputy Director general or equivalent.

Article 7. Functioning of the Board of Directors.

(f) develop annually, for approval by the President, the relations of high level athletes in collaboration with the Spanish sports federations and, where appropriate, with the autonomous communities, in accordance with the criteria established by law and develop programmes to facilitate the technical training, incorporation into the education system and the full social and professional integration of them during his career sports and especially , at the end of this.

(g) to exercise skills in mediation and coordination of the professional leagues with the respective Spanish sports federations and elevate the President proposal of resolution of conflicts of competences which may arise between them.

(h) managing the high performance centers that are owned by the Consejo Superior de Deportes, and coordinate with sports associations and federations its use, as well as the development of plans and programs of sports modernization, in coordination with the Spanish sports federations.

(i) planning, design, and build sports facilities of the Higher Council for sports, and the Administration and management of the heritage of the organism, conservation and maintenance. (l) collaborate with the autonomous communities in the elaboration of plans of promotion of physical education and sport in all the groups of population, as well as promote the values inherent to the sport educational.

(m) promote them actions organizational and of promotion developed by them associations sports, and program, in collaboration with the communities autonomous, competitions sports school and University of scope national e international.

(n) cooperate with high performance and sports technification centers or others intended for the same purposes, that are owned by the autonomous communities, local authorities, or Spanish sports federations, proposing the corresponding collaboration agreements for this purpose.

(s) propose to the Board of Directors of the Agency: 1 the approval of the statutes and regulations of sports federations, clubs and sports promotion of State-level entities, as well as the approval of its registration in the register of sports associations and the recognition of new sports.

(w) to manage the interior of the Consejo Superior de Deportes regime and the security of its facilities.

(x) organize and manage it services, as well as to develop studies and proposals of rationalization of activities and methods of work.

and) propose, within the framework of the educational skills of the General Administration of the State, regulation and management of the sports teaching of special regime; propose the resolution procedures of expedition founded degrees, as well as approval, validation, professional equivalency and correspondence training of sports studies; propose procedures for the accreditation of competences not relating to the national catalogue of professional qualifications, acquired through professional and sports experience, or non-formal ways of learning; development of permanent training of coaches and technicians, professional and sporting fields; e promote and develop the remaining actions that correspond to the body in this field.
