The evaluation procedures aimed at obtaining the necessary accreditation to be able to access the university teaching bodies aim to enable the universities to select the best professionals, with vocation of public service, for teaching and research at the University.

With this royal decree, it is intended to carry out regulatory simplification and a regulatory improvement of the accreditation procedures of university teachers; it is also aimed at ensuring greater objectivity and transparency in the the accreditation of university teaching staff, as well as the use of information and communication technologies in such procedures.

Organic Law 4/2007, of 12 April, amending the Organic Law 6/2001, of 21 December, of Universities, structure the university teaching staff in two bodies of officials, that of University Catedratics and that of Professors of University. In addition, it established a new model for the accreditation of teachers, in which, unlike the habilitation until then in force, the offer of a number of previously delimited places was eliminated.

Royal Decree 1312/2007, of 5 October, establishing national accreditation for access to university teaching bodies, develops this second element, inspired by the academic tradition of the evaluation by pairs.

The present modification of the national accreditation system for access to university teaching bodies is a result of the experience accumulated by the National Agency for the Evaluation of Quality and Accreditation (ANECA). during the 6 years of validity of the accreditation system. On the basis of this experience, and of the aspects that are amenable to improvement, the changes that this standard contains are presented, in addition to the model of other countries in our environment.

The first innovation introduced is the abolition of the concept of universal accreditation, according to which the stakeholders, regardless of the branch of knowledge that they would have decided to be evaluated for, were accredited to attend the posts of professors or professors of the University in any branch and area of knowledge. It is now chosen by a system in which the accreditation obtained produces effects in one of the five branches of knowledge provided for in Royal Decree 1393/2007 of 29 October: Arts and Humanities, Sciences, Health Sciences, Social Sciences and Legal, and Engineering and Architecture.

In this way, it is guaranteed that all those who obtain an accreditation in a branch of knowledge have been evaluated according to similar criteria and similar standards, which will not necessarily be the same in other branches. In any case, procedures will be made to ensure that applicants who develop a specialization of a multidisciplinary nature or in interdisciplinary scientific fields where two or more different branches are present may, as a result of the same evaluation process, to be accredited in more than one branch. Naturally, the accreditation obtained in a specific branch does not imply that the teaching and research activities in the future cannot be projected in teaching and courses where different disciplines are present, as is common in schools and faculties.

The second novelty concerns the number and composition of the accreditation commissions. It is intended to set up commissions much closer to the scientific and academic field of applicants, following in this point the practice that already exists in countries of our environment, such as France and Italy. This type of commission guarantees the principle of specialization in the evaluation of teachers, as well as the quality of the evaluation system. In addition to these commissions, 5 review commissions are established, one for each of the major branches of knowledge (Arts and Humanities; Sciences; Health Sciences; Social and Legal Sciences; and Engineering and Architecture), which will allow a more efficient operation of this stage of the procedure and will strengthen the guarantees of those interested in the complaint against negative decisions, thereby reducing the litigation.

The reform foresees that each commission consists of a number of variable members, determined mainly by the greater or less scientific-technical heterogeneity of the field. The profile and requirements to be met by those members shall not be changed.

Two measures are introduced that aim to improve the functioning of commissions. On the one hand, although the period of validity of the appointment remains two years, the possibility of renewing the appointment is established once, for the same period, on the proposal of ANECA and, obviously, with the availability of the voice or President whose appointment is intended to be renewed. Moreover, ANECA is credited with the power to appoint the President of the accreditation commissions from among the members selected by the Council of Universities, with the purpose of this role, essential for the internal functioning the organ is entrusted to persons with experience and skills for the exercise of that function, instead of assigning these functions automatically to the most academic and seniority vocal.

The third set of new developments concerns the procedure and aims at two main objectives: to strengthen the guarantees for applicants and to gain in efficiency, objectives which are achieved by simplifying the procedure, through the elimination of unnecessary formalities and the establishment of precise criteria and regulations.

With the new system of evaluation of teachers, decisions will always be taken in a collegial way, based on two papers drawn up by two members of the Commission, and only in cases of discrepancies between the rapporteurs the President may, by way of exception, request a report from an external expert belonging to the knowledge area of the applicant.

Another important simplification is that of the exemption procedure from the requirement to be a university-holder to apply for accreditation for the body of professors. The request for exemption is an increasingly used route for the users of the accreditation system, despite the fact that it has not yet been possible to establish clear and applied criteria in a stable, consistent and homogeneous manner, capable of provide security for applicants.

An essential aspect of the reform is the criteria and scales of evaluation; with the new scales we aim to achieve a more balanced assessment of the quantitative and qualitative aspects of the merits. of the applicant, allowing for a more fair and weighted assessment of the teaching and research of university faculty.

The reform adopted aims to enhance the overall and comprehensive nature of the assessment by establishing appropriate minimum thresholds or reference levels according to the teaching body for which accreditation is requested, and the scope of the (i) the scientific and technical At this point, the reform contains a novelty, which is very important for certain scientific areas, which consists in considering the transfer and the professional activity as an autonomous dimension. The need for this change is undoubtedly: in the current model, the transfer remained within the research and the professional activity appeared associated with the teaching. This led to an underestimation of the merits of transfer and professional activity in areas where they are particularly relevant.

Given the difficulty of simultaneously reaching a high level in all facets or dimensions of academic activity by university professors who are in a position to apply for accreditation, it seems It is reasonable to prioritise the two that are considered essential, i.e. research and teaching. In particular, a positive evaluation of these two dimensions in accordance with the provisions of this royal decree will make it unnecessary to take more merits into account in order to obtain accreditation. Where an applicant does not reach the minimum level required, and provided that the insufficiency is not serious, it may be compensated on the basis of relevant merits in the remaining three dimensions: transfer of knowledge and activity professional; management; and training, the latter evaluable only to those who apply for accreditation to the faculty of university holders.

The assessment should give rise to an alphabetical rating (A, B, C, D or E), and avoid excessive atomization of academic merits. It will be up to ANECA to approve the evaluation criteria for each of the university teaching bodies and the different fields, adjusting them for greater consistency of the overall model, although each Commission will propose those it considers appropriate in each field. Similarly to what has been happening with the annual calls of the CNEAI, the criteria for accreditation in each scientific area will be published and reviewed periodically every two years.

Similarly, the processing by electronic means of all accreditation procedures for the teaching staff of the University is established as a novelty, in accordance with the provisions of Article 27 (6) of the Law 11/2007, of June 22, of electronic access of citizens to Public Services. This measure, which will make it possible to considerably speed up the administrative procedures for such procedures, is established in view of the fact that the specific sector of the population to which this rule is addressed, by their professional dedication and capacity technical, guaranteed the access and availability of the precise electronic means to be able to carry out all the procedures foreseen in this royal decree by electronic means.

This royal decree has been reported by the Spanish Data Protection Agency, by the Superior Commission of Personnel and by the Council of Universities, and in its preparation have been consulted more representative.

In its virtue, on the proposal of the Minister of Education, Culture and Sport, with the prior approval of the Minister of Finance and Public Administrations, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting on May 29, 2015,

Single item. Amendment of Royal Decree 1312/2007 of 5 October establishing national accreditation for access to university teaching bodies.

Royal Decree 1312/2007 of 5 October, establishing national accreditation for access to university teaching bodies, is amended as follows:

One. Article 3 is amended, which is worded as follows:

" Article 3. Purpose of national accreditation.

The purpose of the procedure is to obtain the corresponding certificate of accreditation which constitutes the essential requirement to attend the competitions of access to the bodies of teaching official teaching Article 57.1 of the Organic Law 6/2001, of 21 December, in accordance with the international standards evaluators of the teaching and research quality, carrying out the assessment of the merits and competences of the aspirants, for ensure a subsequent selection of effective, efficient, and efficient teachers; transparent and objective.

The accreditation shall have effects throughout the national territory in order to participate in the body to which it relates, in the branch or branches of knowledge in which the accredited has been evaluated in a positive way: Arts and Humanities; Sciences; Health Sciences; Social and Legal Sciences and Engineering and Architecture.

Procedures will be available, in any case, for applicants to develop a multidisciplinary specialisation or in interdisciplinary scientific areas where two or more different branches are present, as a result of the same evaluation process, be accredited to more than one branch. "

Two. Article 4 (2) and (3) are amended, which are worded as follows:

" 2. A Commission is hereby established for each academic and scientific field resulting from the grouping of related knowledge areas, in accordance with the terms set out in Annex I.

The Commissions will be administratively dependent on the ANECA department competent for teacher evaluation and will enjoy autonomy for the exercise of their duties.

The Director of ANECA may propose, every two years, the increase or reduction of the number of commissions, and the distribution of areas of knowledge that each one understands. The increase in the number of commissions will require prior reporting by the Ministry of Finance and Public Administrations.

3. To constitute such commissions, the Director of ANECA will propose to the Council of Universities a list of candidates. This list shall contain at least three proposals for each member. When research staff of the public research centres are included in the proposal, the Secretariat of State for Research, Development and Innovation will be informed. Among those proposed, the Council of Universities shall select the members and alternate members of the committees, in accordance with the criteria set out in Articles 5 and 6 of this royal selection procedure. decree. For each of the accreditation committees a number of alternate members shall be selected equal to half of the holders. "

Three. Article 5 is amended, which is worded as follows:

" Article 5. Composition of committees.

1. The committees which appraise the applications for accreditation must be made up mainly of university professors and professors of university. In addition, other research staff and experts of recognized international prestige may be part of them. Two-thirds of the total number of members of each Commission shall be university professors or researchers and experts with equivalent status, and one third shall be university-holders or researchers with equivalent status.

2. The number of members of the committee shall vary according to the internal diversity of each academic and scientific field and the foreseeable number of applications, but shall not be less than seven or more than 13. One of the members will act as president or president, another as secretary or secretary, and the others as vowels. In addition, a member of the ANECA staff will participate in the meetings of the Commission, which will provide the necessary technical support for the development of the activities of ANECA.

3. A sub-committee shall be established in each Accreditation Commission, composed of all university professors, research professors and experts of recognised international prestige of equivalent status who are part of the sub-commission, which shall have exclusive competence in the evaluation and resolution of accreditation applications for the body of University Catedratics. "

Four. Article 6 is amended, which is worded as follows:

" Article 6. Criteria for the appointment of the members of the committees.

1. ANECA shall draw up a draw among the active civil servants of the university teaching bodies meeting the requirements set out in the following paragraph. From that draw up, it will draw up a proposal for candidates to be part of the accreditation commissions.

2. In order to belong to the commissions, university professors and research staff with equivalent status must have obtained the recognition of at least three periods of research activity according to the forecasts of the Royal Decree No 1086/1989 of 28 August 1989 on the remuneration of university teachers, and teachers who hold university and research staff with equivalent status must be in possession of at least two of those periods. For these purposes, the last recognised period must have been in the last 10 years. In addition, both the official staff of the university teaching bodies and the research staff belonging to public research centers must have an age in their respective bodies of at least 2 years.

3. In any case, at least two-thirds of the members of the committee shall have a university teaching experience of no less than 10 years.

4. In drawing up the proposal, ANECA shall ensure that in the accreditation committees there are members who carry out their activities in the various areas of knowledge included in the scientific and academic field of the Commission, which belong to different Institutions and Autonomous Communities.

5. The Council of Universities shall make the selection of the members among the candidates included in the proposal by the procedure to be determined. To this end, it may take into account the experience of candidates in academic, scientific or technological assessment activities.

6. The composition of the accreditation committees, in accordance with the provisions of Article 57.2 of the Organic Law 6/2001 of 21 December 2001, shall provide for a balanced composition between women and men, unless it is not possible for reasons of substantiated and objective, duly substantiated. "

Five. Article 7, which is worded as follows, is amended as follows:

" Article 7. The Presidency of the Commission.

1. The Director of ANECA shall appoint the members selected by the Council of Universities to integrate the committees, and shall appoint and appoint from among them the President and the Secretary of each Commission, on the basis of such criteria. as antiquity, experience in management or evaluation, or scientific-technical merits. The President must be part of the body of university professors.

2. Such appointments shall not be effective until the designated persons have formalized the affidavit or promise referred to in Article 8 of this royal decree.

3. In the event of absence, vacancy or illness, he shall act as President of the longest-standing university professor among those who integrate the commission. "

Six. Article 8 is amended, which is worded as follows:

" Article 8. Ethical Code.

1. The Code of Ethics, which will be approved by the ANECA Rector Board, will include at least the following contents: rights and duties of members of the accreditation commissions, rights of applicants in their relationship with ANECA, and means to ensure compliance with the provisions of Law 19/2013, of December 9, of transparency, access to public information and good governance.

Among the duties of the members of the committees, the Code of Ethics will have to make mention, at least, of the following: the duty to act with objectivity, independence and professional rigor; duty to respect the confidentiality of the personal data of the applicants for accreditation of whom they have been informed by reason of their participation in the Commission; duty to keep secret of the deliberations of the Commission; and a commitment to ensure the dedication necessary for the proper performance of the tasks that are of their own.

2. The members of the accreditation committees shall make written an affidavit or promise to comply with the Code of Ethics before they begin to perform their duties.

3. Failure to comply with the Code of Ethics shall give rise to the instruction of an official, by the Director of ANECA, of a separation file from the Accreditation Commission.

This file does not, in any case, be disciplinary in nature and will be dealt with in accordance with the provisions of Articles 68 et seq. of Law 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations. and the Common Administrative Procedure. However, the competent bodies shall be transferred so that, where appropriate, they shall take the disciplinary measures which may eventually result. The Director of ANECA is the body responsible for issuing the resolution ending the separation procedure.

4. The Code of Ethics shall be consistent with the provisions of Chapter VI of Law 7/2007 of 12 April of the Basic Staff Regulations. "

Seven. The reference referred to in the last paragraph of Article 9 is replaced by the "Annex on assessment criteria" by the "Annex on evaluable merits".

Eight. Article 10 (4), which is worded as follows, is amended as follows:

" 4. In cases of resignation, abstention or recusal preventing the action of the Commission, they shall be replaced by the alternates. In the case of the alternate member attending any of the cases of abstention or recusal referred to above, his replacement shall be made by another alternate, in accordance with the order established by the Commission itself, which shall take into account affinity criteria within the academic or scientific field. If these substitutions are not possible either, new members and alternate members will be appointed ad hoc for the same procedure as the remaining vowels. "

Nine. Article 11 (1), (2) and (3) are amended as follows:

" 1. The accreditation fees shall be of a permanent nature, without prejudice to the provisions of Article 4.2

2. The appointment of the members and alternate members of the committees shall be made for a period of two years. On a proposal from ANECA, they may be appointed as members of the same commission for another immediate period only once in a row, without prejudice to the provisions of the first renewal. The composition of the committees shall be published in the Official Gazette of the State where the change is made.

3. The accreditation committees shall meet, by means of a call from their chairman, as many times as necessary. The commissions will be able to meet to act in a collegiate session, through computer media, without the need for a physical presence in the headquarters of ANECA. The constitution of each committee shall be held at its first meeting and thereafter after each renewal. This constitutive meeting will be in-person. "

Ten. The last indent of Article 12 (1) is replaced by the following: "to be assessed in accordance with the provisions of this Royal Decree and Annex II."

Also, in Article 12 (2), the reference to the Council of Universities is replaced by "ANECA".

Once. Article 13 is amended, which is worded as follows:

" Article 13. Accreditation for access to the University Catedratics Corps.

1. A university professor may choose to be accredited to a university professor by one or more branches of knowledge, by submitting an application to which he will accompany the justification of the merits of the university. relationship to their research, teaching, professional and transfer activities, as well as academic and scientific management, to be assessed in accordance with the provisions of this Royal Decree and the Annex.

2. The exemption from the requirement to belong to the Faculty of Professors of University referred to in art. 60.1 of the Organic Law 6/2001, of 21 December, will be granted to those who credit to have the condition of doctor with, at least, eight years old, and have obtained positive report in the accreditation for professor holder of university with the 'Exceptional' rating (A) in the assessment of its research activity.

3. Those who have obtained accreditation for the Faculty of Professors of University without having attained the qualification of "Exceptional" (A) in the evaluation of their research activity may request a new evaluation to qualify for this qualification, provided that they have been transferred at least 18 months after the accreditation has been obtained.

4. You may apply for accreditation to a professor without the need to apply for accreditation to a full professor or to be a member of the staff of the titular teachers, provided that you have the status of a doctor with at least eight years of age:

(a) Official personnel belonging to bodies or scales of research personnel for whose entry it is required to be in possession of the title of Doctor.

(b) The teachers of the universities of the Member States of the European Union who have reached the equivalent position, at least, to that of a university-holder.

5. The teaching and research staff of other non-Spanish universities, as well as non-university research institutions, not included in the previous section, may request that an evaluation be carried out to give evidence to the professor. At the same time, you can obtain the latter without the need to belong to the body of the titular professors, provided that you have the status of a doctor with at least eight years of age. The Commission shall decide on accreditation only to the titular professor, or to a joint professor and professor. "

Twelve. Article 14 is amended, which is worded as follows:

" Article 14. Requests.

1. In the application submitted by the candidates to ANECA's electronic headquarters, the teaching body for which they intend to obtain the accreditation and the Commission for which they want to be evaluated must be included, according to the model that ANECA establishes. In the event that the selected Accreditation Commission considers that the applicant's profile is more akin to another academic-scientific field, it shall forward the file to the Director of ANECA for reallocation. Before it is resolved, the Directorate shall give an audience to the person concerned.

2. The parties concerned must, in any event, provide the justification for the following merits, in accordance with the provisions of ANECA:

a) Mandatory research merit, consisting of:

1. º A minimum number of scientific contributions in the form of articles, books, book chapters or results of published scientific, technical or artistic production. Each commission shall propose that minimum number, taking into account, where appropriate, accredited national and international standards and bibliometric indices.

2. Also, within the required research merits, they will present the four contributions that they consider most relevant in their scientific trajectory, so that the commissions can evaluate the quality and the impact of your work in your area of expertise.

b) Mandatory teaching merit, requiring a number of years of experience, which will vary according to the teaching body for which accreditation is requested, as well as a positive assessment of the teaching activity. However, those applicants who have developed their career mainly in a non-university institution dedicated to scientific or technological research, or at a non-Spanish university in which the computer and the instruments of measurement of the quality of the teaching activity is difficult to move to the Spanish system, and credit exceptional research results, both in quantity and quality, will be able to obtain the accreditation without having the minimum time of teaching experience to be established, nor to present specific merits of the teaching activity and as described below.

c) To obtain accreditation for the body of university professors will be required, as specific merits, for applicants to provide significant indications of a leadership trajectory and external recognition to the institution where they provide services, both in relation to the teaching activity and the researcher.

3. Applicants shall also provide, as complementary merits, other merits relating to the teaching and research activities, including those described in Annex II, as well as relevant merits related to their professional activity. and transfer of knowledge, their academic training, and their experience in educational, scientific and technological management and administration, which are likely to be taken into account in accordance with the provisions of ANECA. The latter will be taken into account in the case of compensable inadequacies in research activity and/or teaching activity. "

Thirteen. Article 15 is amended, which is worded as follows:

" Article 15. Instruction.

1. Requests from ANECA are received, this will verify that the documentation provided includes the certification of the legally established requirements to request the accreditation of the requested body, as well as the justification of the merits aduced. Once the verification has been carried out, the documentation shall be made available to the committees. If any essential document is left to be provided or the necessary requirements are not met, the person concerned shall be notified of this and shall be granted a period of 10 working days for his/her remedy. If you do not perform the remedy in the above term, you will be given a withdrawal of your request, filing without further processing. Also, if the procedure is brought to an end by reason of the interest of the person concerned, after three months, the person concerned shall be revoked.

2. The accreditation committees shall examine the documentation submitted for the purpose of issuing their resolution. If necessary, they may obtain additional clarifications or justifications from the applicants, which shall be delivered in writing within 10 working days. In the event that the requested justification or clarification is not presented within that period, the merits of which the justification or clarification has been given shall not be assessed.

3. Applications for accreditation for the body of university professors shall be examined and resolved by the subcommittees referred to in Article 5 of this royal decree.

4. The accreditation commissions shall evaluate the applications in accordance with the provisions of this royal decree and its annexes. Each application shall be informed by at least two members of the Commission who shall act as rapporteurs. The Commission will adopt the decision in a collegial manner, in the light of the documentation submitted and the reports of the rapporteurs. In cases of discrepancy between the rapporteurs which the Commission is not satisfied with, the President may, by way of exception, request a report from an external expert belonging to the knowledge area of the applicant, whose Report shall not be binding. Research activity and teaching activity will preferably be valued. Academic training, the transfer of knowledge and professional activity, as well as the management activity, will be valued only to compensate for non-serious inadequacies in one of the two dimensions of preferential valuation.

5. In the case of a negative assessment, and as a matter of prior to the decision, the accreditation committees shall forward their motions for resolutions to the interested parties, duly substantiated, so that, within 10 working days, they shall address the President of the Commission the arguments which they consider relevant, which must be assessed by the Commission.

If the applicant, in the light of the motion for a resolution and before the final decision is made to terminate the procedure, has rejected his request or waives the assessment, the Commission shall terminate the procedure, dictating the corresponding administrative resolution.

6. When completing the procedure referred to in the first subparagraph of paragraph 1, the Commission shall decide on the application for accreditation within a period not exceeding six months from the date of entry of the application into the ANECA register. Such a decision shall be reasoned and may be favourable or unfavourable to accreditation. When the resolution is favourable, ANECA shall issue the relevant accreditation certificate.

The resolution shall be notified to the data subject by electronic means within 10 working days of the date on which it is issued.

The duration of the maximum period of six months without dictating and notifying the decision shall have an adverse effect, without prejudice to the positive obligation to resolve the decision of the evaluating body.

7. In the case of a negative decision, the person concerned or interested party may not apply for further accreditation until eighteen months have elapsed since the application was submitted in an unfavourable manner. '

Fourteen. Article 16 is amended, which is worded as follows:

" Article 16. Complaints.

1. Against the decisions referred to in the previous Article, applicants may, within one month, submit a complaint to the Council of Universities which shall be assessed and, where appropriate, accepted by the Commission of the Complaints by that body. This Commission shall consist of members who meet the same requirements as the members of the Accreditation Commissions.

2. The Council of Universities ' Claims Commission will examine the accreditation file to ensure the guarantees established and will be able to ratify the resolution or, if appropriate, accept the complaint, all within a maximum period of time. three months. The period of the maximum period laid down without issuing and notifying the decision shall have an adverse effect, in accordance with the provisions of Article 66.1 of the 6/2001 of 12 December 2001, of universities, in accordance with the wording of Law 4/2007, April 12.

3. The examination of the complaint shall be made on the basis of the application for evaluation and all the documentation contained in the dossier.

4. In the event of the complaint being estimated, the Committee on Claims of the Council of Universities will forward to ANECA its resolution, indicating in concrete terms the aspects of the evaluation that must be reviewed. Such review shall be carried out by review committees.

5. Five review commissions are created, one for each of the following branches of knowledge: Arts and Humanities; Sciences; Health Sciences; Social and Legal Sciences; and Engineering and Architecture.

The number of members of the commissions shall not be less than seven and no more than 11. It shall be ensured that its members have been experienced as evaluators in the accreditation committees.

Review Commissions will be administratively dependent on the ANECA body competent for teacher evaluation, and will enjoy autonomy for the exercise of their duties.

6. The review commissions will be made up of university professors. The research staff belonging to public research centres of category equivalent to that of a university professor, as well as experts of recognised international prestige, may also be part of them. The members of these committees shall meet the requirements set out in Article 6.2, in addition to having experience in the evaluation of teachers. All members of these commissions, including the President and the Secretary, will be selected by the Council of Universities on a proposal from ANECA, and appointed by the Director of ANECA on a proposal from the Council of Universities. The period of his appointment shall be two years, which may be extended by two years.

7. Before issuing its assessment, the review committees may collect the report of an external expert belonging to the knowledge area of the applicant. That report shall not be binding.

8. Received the assessment, the Board of Universities will dictate the resolution. The assessment report of the review commission shall be binding.

9. The decision of the Council of Universities shall put an end to the administrative route and may be brought before the administrative court or be brought before the administrative-administrative jurisdiction. "

" Additional disposition first. Accreditation of university-school teachers.

1. In the accreditation procedure for teachers who are university holders, teachers belonging to the Body of University Schools who hold the title of Doctor, the research, management and, in particular, the teaching.

2. Applicants whose teaching merits have been qualified with an A will be assessed positively, even if their research merits do not qualify for qualification C.

3. In any event, they shall obtain the accreditation referred to in this provision by applicants who fulfil either of the following conditions, which shall be verified only by the relevant Commission:

(a) Two periods of teaching and a period of research activity recognised in accordance with the provisions of Royal Decree 1086/1989 of 28 August 1989.

(b) Two periods of teaching recognised in accordance with the provisions of Royal Decree 1086/1989 of 28 August 1989 and six years in the performance of the single-person academic bodies collected in the statutes of the universities or which have been assimilated to these.

c) Two periods of research activity recognised in accordance with the provisions of Royal Decree 1086/1989 of 28 August 1989.

4. The assessment of the applications shall be carried out by the commissions set out in Annex I, as well as the relevant review where appropriate. "

• Mobility: stays in research centres with verifiable results.

2. Teaching activity

• Teaching dedication: amplitude, diversity, intensity, responsibility, cycles, type of university teaching, directed doctoral theses (if not claimed as merit of research activity).

B. Baremo

The assessment of the substantiated and duly justified merits will result in an alphabetical rating of the A to E. In each of the dimensions this rating will have the following meaning:

-A, exceptional.

-B, well.

-C, compensable.

-D, insufficient.

-E, special circumstance.

In the accreditation for the College of University Catedratics, academic training will not be taken into consideration, and applicants whose assessment will obtain at least the combination of ratings that are detailed in the following table:

Additional disposition first. Establishment and renewal of the first accreditation commissions provided for in this standard.

1. The accreditation fees provided for in Annex I and the review fees provided for in Article 16.5 shall be lodged within two months of the date of entry into force of this royal decree.

2. To this end, ANECA may propose, without the need to proceed to a new drawing, the appointment as members of the new commissions of vowels and presidents of the existing accreditation commissions before the entry into force of the actual present decree. If they are appointed, they will retain their status as members of both committees until the previous ones are dissolved.

3. After two years after the appointment of the members of each Commission, half of its members and alternates shall necessarily be renewed. In this first renewal they may be proposed only for a second period, in accordance with the provisions of Article 11 of this royal decree, up to a maximum of half of the members and alternate members of the committees.

Additional provision second. Electronic processing of procedures.

1. All accreditation procedures for the University's teaching staff will be processed by electronic means, as provided for in article 27.6 of Law 11/2007, of June 22.

2. The complaints lodged against the decision terminating the accreditation procedure for the university's teaching staff shall be processed by electronic means in accordance with the provisions of Article 27.6 of Law 11/2007, June 22.

Additional provision third. No increase in public spending.

The measures included in this rule may not result in an increase in appropriations or remuneration or other personnel costs.

Additional provision fourth. Gender references.

All the references contained in this royal decree in male gender will be understood also to the female gender.

Single transient arrangement. Procedures initiated.

1. The applications for accreditation submitted before the entry into force of this royal decree will be resolved in accordance with the provisions in force at the time of their submission.

The complaint procedures that are not yet completed after the termination of the current complaints commissions will be examined and resolved by the commissions provided for in the new article 16.5 of this royal decree.

2. Applicants with files initiated and not finalised before the entry into force of this royal decree may withdraw the procedure and request the assessment in accordance with the new provisions.

3. Those who have completed applications for accreditation in accordance with the provisions prior to the entry into force of this royal decree, and have obtained a negative decision, will not be subject to the temporary restriction of 18 months for the submission of your first application in accordance with the new forecasts.

4. The accreditations obtained according to the previsions of this royal decree will retain their universal character; the accredited ones will be able to opt for the exemption of belonging to the Body of Teachers of University in the conditions that establishes the new Article 13.3.

Final disposition first. Transparency in the assessment criteria.

1. The Director of ANECA, acting on a proposal from the accreditation committees, shall specify the application to each branch of activity of the criteria for the assessment of the merits referred to in Article 14.2 and shall, in particular, establish:

(a) The minimum thresholds or reference levels of the teaching and research activity and of quality required for the required merits, and specific in their case, required to obtain accreditation from a professor or professor the holder of a university, referred to in Article 12 (2), ensuring that the various scientific fields are consistent with the appropriate homogeneity.

(b) The exceptional characteristics that must be present in the research results to permit the exemption of the requirement to belong to the University of Teachers ' Body as referred to in Article 60.1 of the Organic Law 6/2001 of 21 December, as set out in Article 11.2.

These evaluation criteria will be approved by resolution of the ANECA director, they will be published in the electronic headquarters of the Ministry of Education, Culture and Sport and reviewed every two years.

2. ANECA shall make public the guidance documents to the applicants, which shall contain precise information on the thresholds or reference levels in the different dimensions, as well as the compensation rules applicable in each academic and scientific fields. These documents shall provide the self-assessment to potential applicants, shall have exclusively informative effects and shall be published in the ANECA website, without being subject to administrative or judicial challenge.

Final disposition second. Creation, modification and deletion of accreditation and review fees.

1. The creation of new commissions for accreditation and review shall be carried out by order of the person holding the Ministry of Education, Culture and Sport, with the formalities and requirements laid down in Articles 38 to 40 of Law 6/1997, of April 14, Organization and Functioning of the General Administration of the State.

2. The holder of the Ministry of Education, Culture and Sport is hereby authorised to amend, by order, the name and the areas of knowledge allocated to the accreditation commissions set out in Annex I, provided that his/her name is not increased. number.

Final disposition third. Ethical code.

The Governing Council of ANECA, within six months of the entry into force of this royal decree, shall approve the Code of Ethics as set out in Article 8.1 of Royal Decree 1312/2007 of 5 October 2007.

Once the Code of Ethics has been approved by the Rector Council, it will be published in the "Official State Gazette" and on the Agency's website.

Final disposition fourth. Entry into force.

This royal decree will enter into force when the royal decree that approves the statutes of the Autonomous Body ANECA enters into force, as provided for in article 8.5 of Law 15/2014, of 16 September, of rationalization of the Public Sector and other measures of administrative reform, except for the realization of all those actions preparatory to the formation of the accreditation and review commissions regulated in this royal decree, which will be able to start to be held from the day following the publication in the "Official State Gazette" of this royal decree.
