The Resolution of 16 July 2004, of the General Treasury of Social Security, on the determination of functions in the field of management of social security, establishes in its third statement:

" They shall be competent to resolve applications relating to the establishment of statutory time limits for the reimbursement of benefits unduly received, other than those referred to in general in the relevant debt claim:

The provincial addresses of the General Treasury of Social Security: up to a maximum of 36 months.

The General Subdirectorate of Executive and Special Procedures for the Collection of the General Treasury of Social Security: 37 to 60 months. "

The exercise of the jurisdiction currently corresponds to the General Subdirectorate of Executive and Special Procedures for the Collection of the General Treasury of Social Security, when the maximum period is set from 37 to 60 months.

The experience acquired by the General Social Security Treasury has shown that it is appropriate to amend the criterion of entrustment of jurisdiction, in such a way as to ensure that competition is hereinafter, exclusively in the provincial addresses of the General Treasury of Social Security for the entire period up to the age of 60 months.

This measure avoids the delay in processing the procedure that currently involves the displacement from the provincial addresses of a large amount of documentation that has entry into its dependencies, to which the procedure for the referral of the decision adopted by the competent general sub-directorate to the relevant provincial directorate is added, in order for the person concerned to be notified later. Both procedures would disappear with the change of competence by simplifying the procedure.

The management of the provincial directorates, which is not concentrated within the prescribed period, allows for greater and more efficient use of the territorial information resources. In addition, since it is closer to the person concerned, it allows for the elimination of existing administrative procedures and, consequently, a considerable reduction in the processing time.

The change of competence in favor of the provincial addresses will make it possible to optimize its material and computer resources and, therefore, increase the productivity in the use of the personal means, obtaining a more effective, fast and lower cost, which will have a positive impact on the data subject, significantly reducing the waiting time for the notification of the administrative decision to resolve the application submitted.

All of the above advises to modify the repeated Resolution of 16 July 2004, in the sense and with the above criteria.

In its virtue, this Directorate-General, in accordance with the powers conferred on it, resolves:

First. Amendment of the Resolution of 16 July 2004, of the General Treasury of Social Security, on the determination of functions in the field of management of social security.

The third statement of the Resolution of 16 July 2004, of the General Treasury of Social Security, on the determination of functions in the field of the management of social security, is drafted in the following terms:

" Third. Refund of benefits unduly received.

They shall be competent to resolve applications relating to the establishment of statutory time limits for the reimbursement of benefits unduly paid, other than those referred to in general in the relevant debt claim, up to a maximum of 60 months, the provincial addresses of the General Treasury of Social Security. "

Second. Entry into force.

The provisions of this resolution shall enter into force on the day following that of its publication in the "Official Gazette of the State".
