Law 14/2011, June 1, the science, technology and innovation, is classified to several agencies, including the Instituto de Salud Carlos III as a public research organization.

Article 61 of law 50/1998, of December 30, measures fiscal, administrative and Social order, provides that public research organizations will take the configuration of an autonomous body, established in article 43.1. a) of law 6/1997, of 14 April, organization and functioning of the General Administration of the State, with certain peculiarities in terms of staff , economic resources, budgetary arrangements, economic financial, accounting, intervention and financial control.

By Royal Decree 345/2012, of 10 February, which develops the basic organizational structure of the Ministry of economy and competitiveness, the Instituto de Salud Carlos III is attached to this Department, through the Secretariat of State for research, development and innovation.

The Instituto de Salud Carlos III comes to provide certain public services related to its functions through national centres that are part of its organizational structure.

He Institute of health Carlos III, in them benefits of services, delivery of goods and realization of activities, according to the normative invoked, may establish prices public as consideration pecuniary by such activities in them terms that determines the law 8 / 1989, of 13 of April, of rates and prices public, since them services that lends this body presented them features required by such law so them considerations pecuniary that is meet by them same have it consideration of public prices to attend at the same time the two criteria that shape it, i.e. cash payments that are satisfied by the delivery of goods, services or activities carried out under public law, when they become compulsory reception by the managed, and that such deliveries, benefits, or activities are likely to be borrowed or carried out effectively by the private sector for there is no reserve in favour of public sector compliant with current regulations.

This activity was regulated until now in the resolution of 22 March 2013, of the Instituto de Salud Carlos III ("BOE" No. 82, April 5, 2013) by laying the public prices for the provision of services and the Agency's activities.

This resolution amends public prices for services and activities with a dual purpose: first, it is necessary to update the catalogue of services, since certain demands for services that were not covered in the existing regulation, at the same time which has been disappearing demand for other benefits which were regulated were created during the period since its publication.

Secondly, it is necessary to update the amounts in current prices in order to adjust them so that they cover the costs of the services rendered, pursuant to the provisions of article 25 of the law 8/1989, of 13 April, of rates and prices public.

Taking into account the foregoing and in accordance with the diversity of modifications to introduce, it was considered suitable to meet the changes that precise matter regulated in a new resolution allowing for greater clarity and ease of application, unifying criteria and taking into account the characteristics of the services offered from the body.

By virtue of and in accordance with the provisions of article 26.1. b) of law 8/1989 of 13 April, and according to competition which has delegated by article 13.2 of the order ECC/1695/2012, of 27 July, delegation of powers, this address resolves: first.

Establish the amount of the public prices perceived by the public body of research Instituto de Salud Carlos III by providing services or activities, included in the annex, which are carried out under public law by the National Microbiology Centre.

Second.

Access to the application standard for the realization of the services included in the annex will be through the web page https://cnm-laboratorios.isciii.es the users must be identified by means of authorization granted by the National Center for Microbiology, consisting of a personal password that will be provided upon request.

Third party.

Regardless of the prices collected in the annex, the services of special character or of special strategic interest, shall be provided free of charge, in the following cases: to) studies of outbreaks or cases of any infectious etiology that special alarm or concern from the point of view of health, whenever required, in a reasoned way, through State health authorities or autonomous communities.

(b) monitoring programmes national, European or international in which infectious agents to be confirmed and/or characterized in a reference laboratory is required. Pathogens including in these programmes will be identified in the application of telematics services portfolio of the microbiology of the Institute of health Carlos III National Centre.

The public prices payment will be made by entering the amount in the account that the Agency has authorized to effect in the Bank of Spain with IBAN ES45 9000.0001.20.0200009118.

Sole repeal provision.

Resolution of 22 March 2013, of the Instituto de Salud Carlos III, which establishes the public prices for the provision of services and the Agency's activities be repealed.

Sole final provision.

This resolution shall enter into force thirty working days after its publication in the «Official Gazette».
