Law 14/2011, of June 1, of Science, Technology and Innovation, classifies various organisms and among them the Carlos III Health Institute as a public research body.

Article 61 of Law 50/1998, of 30 December, of Fiscal, Administrative and Social Order Measures, provides that public research bodies shall adopt the configuration of an autonomous body established in the Article 43 (1) (a) of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State, with certain peculiarities in the field of personnel, economic resources, budgetary, financial and financial accounting, intervention and financial control.

By Royal Decree 345/2012 of 10 February, which develops the basic organic structure of the Ministry of Economy and Competitiveness, the Carlos III Health Institute is attached to this department, through the Secretary of State for Research, Development and Innovation.

The Carlos III Health Institute is providing certain public services related to its functions through the national centers that are part of its organic structure.

The Carlos III Health Institute, in the provision of services, the supply of goods and the performance of activities, in accordance with the rules invoked, may establish public prices as a financial consideration for such services. activities in the terms laid down in Law 8/1989 of 13 April of Fees and Public Prices, since the services provided by this body present the characteristics required by that Law for the financial compensation to be paid they satisfy themselves for the consideration of public prices at the time at the same time, the two criteria which make it up, that is, pecuniary contracts which are satisfied by the supply of goods, services or activities carried out under public law, where they are not (a) compulsory receipt by the administered authorities, and that such supplies, services or activities are likely to be provided or carried out effectively by the private sector, in the absence of the public sector reserve in accordance with the rules in force.

This activity was regulated so far in the Resolution of 22 March 2013 by the Carlos III Health Institute ("BOE" n. 82 of 5 April 2013) laying down public prices for the provision of services and services. activities of the body.

This resolution modifies public prices for the provision of services and the performance of activities with a dual purpose:

First, it is necessary to update the catalogue of services provided, since during the period since its publication certain demands for services that were not covered by the regulation have been created. in force, while the demand for other benefits that were regulated has been disappearing.

Second, it is necessary to update the amounts of the prices in force for the purpose of adjusting them to cover the costs of the services provided, in compliance with the provisions of Article 25 of Law 8/1989, of 13 April, for Public Fees and Prices.

In view of the above and in view of the diversity of changes to be made, it has been considered appropriate to bring together the changes required by the subject matter in a new resolution allowing for greater clarity and ease of application, unifying criteria and taking into account the characteristics of the services offered from the body.

In its virtue, and as provided for in Article 26.1.b) of Law 8/1989, of 13 April, and in accordance with the jurisdiction conferred by it by Article 13.2 of Order ECC/1695/2012 of 27 July 2012, competencies, this Address resolves:

First.

Set the amount of public prices to be collected by the public research body Carlos III Health Institute for the provision of services or for the performance of activities, included in the Annex, that are carried out under public law by the National Center for Microbiology.

Second.

Access to the standard application for the performance of the services listed in the Annex will be made through the website https://cnm-laboratorios.isciii.es

Users must be identified by authorization granted by the National Center for Microbiology, consisting of a personal key that will be provided upon request.

Third.

Regardless of the prices listed in the Annex, services of a special nature or of a special strategic interest shall be provided at no cost, in the following cases:

a) Studies of outbreaks or cases of any infectious etiology that are of particular alarm or concern from the point of view of health, provided that they are requested, in a reasoned manner, through the health authorities state or autonomous communities.

(b) National, European or international surveillance programmes where infectious agents are required to be confirmed and/or characterised in a reference laboratory. The pathogens included in these programs will be identified in the telematics application of the services portfolio of the National Center for Microbiology of the Health Institute Carlos III.

Fourth.

The payment of the public prices will be made by the income of its amount in the account that the agency has authorized to the effect in the Banco de España with IBAN ES45 9000.0001.20.0200009118.

Single repeal provision.

The Resolution of March 22, 2013, of the Carlos III Health Institute, which establishes public prices for the provision of services and activities of the agency, is repealed.

Single end disposition.

This Resolution shall enter into force within thirty working days after its publication in the "Official State Gazette".
