The organic law 15/1999, of 13 December, of protection of data of a personal nature and its regulation of development, approved by Royal Decree 1720 / 2007, of 21 December, establishes a set of measures to guarantee and protect, with regard to the processing of personal data, the liberties and fundamental rights of individuals and especially, the right to their honor and personal and family privacy.
Article 20 of the organic law 15/1999, of 13 December, establishes that the creation, modification or deletion of files of public administrations only may be through general provision published in the «Official Gazette» or in the relevant official journal.
Article 53.1 of the rules of development of the organic law 15/1999, of 13 December, approved by Royal Decree 1720 / 2007, of 21 December, indicates, in addition, that, when the provision relates to the organs of the General Administration of the State or entities or organizations linked or dependent on it, you must take the form of ministerial order or resolution of the owner of the structure or corresponding body. Furthermore, article 54 of that regulation establishes the ends which shall contain such provision or agreement, determining the minimum content of this standard.
In this way, the files of personal data managed by the Ministry of agriculture, food and environment are listed in order ARM/1683/2011, 2 June, which regulates files with data of character personal of the Ministry of environment and Rural and marine.
The Ministry of agriculture, food and environment, through the General direction of the food industry, is developing the "programme for integral sustainability of the agri-food industry", whose objective is the improve environmental, social and economic conditions in the sector, promoting the efficiency and value creation, through an improvement of the sustainability of the agri-food industry in these three aspects. One of the objectives of this program is to facilitate the contact and dialogue on sustainability among companies and administrations of the agri-food sector, for which it created the network for food sustainability (REDSOSTAL), which is configured as a solid and structured web, in addition to reporting, has the work serve puente and contact between companies and public entities related or involved with the sector who wish to give their opinion , or wish to discuss aspects related to the integral sustainability of the agri-food industry.
The development of the above-mentioned platform entails the need to create a new file with personal data whose responsibility lies with the General direction of the food industry, which involves the modification of the annex I to order ARM/1683/2011, 2 June.
This order is issued under the protection of article 20 of the organic law 15/1999, of 13 December, and complies with the provisions of article 54 of the regulations implementing the organic law 15/1999, of 13 December.
By virtue, following a report from the Spanish protection agency data and the Ministerial Committee on electronic administration of the Ministry of agriculture, food and environment, have: single article. Modification order ARM/1683/2011, 2 June, which regulates files with personal data managed by the Ministry of environment and Rural and marine affairs.
In accordance with the provisions of article 20 of the organic law 15/1999, of 13 December, of protection of data of a personal nature, is added a new file called 'Network for food sustainability (REDSOSTAL)', under the heading General Sub-Directorate for Industrial development and innovation, in the General direction of the industry and markets food section , current direction General of food industry, of annex I to order ARM/1683/2011, June 2, with the following specifications: ' a) (identification of the file, indicating its name, as well as the description of their purpose and intended use: a.1) identification of the file: network for food sustainability (REDSOSTAL).»
