Law 15/2014, of 16 September, of rationalisation of the Public Sector and other measures of administrative reform, amends Law 7/2007, of 12 April, of the Basic Staff Regulations and Law 39/2007, of 19 of November, of the Military Race, introducing in the latter a new administrative situation for the military of career that is defined as "Service in the Civil Administration" and that it is developed in a new article 113 bis.

Reasons for effectiveness suggest that these responsibilities of the Assistant Secretary of Defense be assumed by the Directorate General of Personnel and by the Mandos or Chief of Staff of each Army and Navy, in their respective field. According to article 9.2.e of Royal Decree 1287/2010, of 15 October, the Directorate General of Personnel is responsible for the development of the basic organic structure of the Ministry of Defense, management, with respect to the military personnel of the common bodies, of the powers conferred on the Deputy Secretary of Defense. For their part, the Mandos or Chief of Staff, under the organic dependence of the Chief of Staff, have, in accordance with Article 12.2 of Law 39/2007, among other functions, to participate in the planning and programming of the policy of military personnel, as well as in how many matters the military race conditions. Therefore, this delegation would be in line with its current remit.

Therefore, and by virtue of the powers conferred on me by Article 13 of Law 30/1992, of 26 November of the Legal Regime of Public Administrations and of the Common Administrative Procedure, as amended by Law 4/1999, of 13 January, amending Law No 30/1992, after the Minister of Defence's approval, I have:

First. Purpose.

Delegating certain competencies attributed to the Assistant Secretary of Defense regarding the career military's transition to the administrative situation of "services in the civil administration."

Second. Delegation of powers.

One. They are delegated to the Mandos and Chiefs of Staff of the Armies and the Navy to the staff of their respective Armies and to the Director General of Personnel for all matters relating to the staff of the Common Corps and the General/Admirals Personnel of the Armies and the Navy for the personnel of their respective Armies, the competence for the issuance of certificates for participation of the military in the positions of the positions of the job in the Administration Article 113 bis of Law 37/2009 of 19 November of the military career, provided for in point 2 of Article 113 (2) of the Treaty as amended by Law 15/2014 of 16 September.

Two. It is delegated to the Director-General of Personnel, the competence to resolve the career military's pass to the situation of "services in the civil administration."

Third. Administrative resolutions.

Administrative resolutions adopted pursuant to this delegation shall expressly indicate this circumstance, stating in the foreword the expression "By delegation", by appointment of this Resolution.

Fourth. Vocation.

In accordance with the provisions of Article 14 of Law 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and of the Common Administrative Procedure, by means of a reasoned agreement, the delegating authority shall be able to inform and resolve any matters covered by this delegation.

Single end disposition.

This Resolution shall enter into force on the day of its publication in the Official Gazette of the State.
