The Undersecretary of the Ministry of Culture and Sport and the Director of the Spanish Autonomous Agency for the Internationalization of Education have signed an agreement for the incorporation of this body to the Education, Culture and Sport Ministry of Education.

For general knowledge and in application of Law 11/2007, of June 22, of Electronic Access of Citizens to Public Services, and its regulations of development, the publication of the said convention is available as an annex to This resolution.

ANNEX

Convention between the Undersecretary of the Ministry of Education, Culture and Sport, and the Autonomous Body Spanish Service for the Internationalization of Education, for the incorporation of this agency into the electronic headquarters of Education of the Ministry of Education, Culture and Sport

UNITED

On the one hand, Don Fernando Benzo Sainz, Undersecretary of the Ministry of Culture and Sport, by delegation of competences of the Ministry of Education Culture and Sport, under cover of the article 3.3 of Royal Decree 1671/2009 of 6 November 2009, for which the Law 11/2007, of 22 June, of electronic access of citizens to public services is partially developed.

On the other hand, don Pablo Martín González, Director of the Spanish Autonomous Agency for the Internationalization of Education, attached to the Ministry of Education, Culture and Sport, according to Law 15/2014, 16 of September, for the rationalization of the Public Sector and other measures of administrative reform (BOE of 17 September 2014) and with the provisions of Royal Decree 903/2007, of July 6, for which the Statute of the Autonomous Body "Programs" is approved European Education ".

Both parties, recognizing the legal capacity and competence necessary to formalize this Convention,

EXPOSE

I. That Law 11/2007, of 22 June, of Electronic Access of Citizens to Public Services, created the concept of "electronic headquarters", justified by "the need to clearly define the" headquarters " electronic administrative with which establish relations, promoting a system of identification, authentication, minimum content, legal protection, accessibility, availability and responsibility. " Article 10.1 of the same law defines the electronic headquarters as " that electronic address available to citizens through telecommunications networks whose ownership, management and administration corresponds to a Public Administration, the administrative body or body in the exercise of its powers. ' Paragraph 3 of the same Article states that "each Public Administration shall determine the conditions and instruments for the creation of electronic venues".

II. That the Royal Decree 1671/2009, of November 6, for which the Law 11/2007, of June 22, of Electronic Access of Citizens to Public Services is partially developed, in addition to regulating this figure in its articles 3 to 9, indicates specifically in Article 3.2, that "electronic venues shall be created by Order of the corresponding Minister or resolution of the holder of the public body, which shall be published in the" Official State Gazette ", minimum of this approval rule. This brings to the citizens guarantees of full certainty and security that only partially reached the virtual offices that have so far been channeling the electronic relations with the citizens. However, article 3.3 of the same royal decree authorizes the incorporation of a public body into a pre-existing headquarters by means of a collaboration agreement.

III. That by Order of 30 December EDU/3607/2009, the electronic headquarters of Education was created. Article 3 (a) provides that, in accordance with the provisions of Article 3.3 of Royal Decree 1671/2009 of 6 November 2009, by means of the relevant collaboration agreement, the incorporation of a body may be determined. public attached to the Department to the electronic headquarters of Education.

IV. Both sides consider that it is appropriate to engage with citizens through a single electronic seat, both for reasons of economy and efficiency, as soon as the Autonomous Body Spanish Service for the Internationalization of the Education, attached to the Ministry of Education, Culture and Sport, will benefit from the experience and infrastructure of the Ministry of Education, Culture and Sport for these types of instruments.

While both parties are interested in seeking the best and most economical provision of electronic services to citizens, thereby fulfilling the principles and rights contained in Law 11/2007 of June 22, the formalisation of this agreement is carried out in accordance with the following

:

CLAUSES

First. Purpose of the Convention.

It is the object of this agreement to determine the incorporation of the Spanish Autonomous Agency for the Internationalization of Education, attached to the Ministry of Education, Culture and Sport, to the electronic headquarters of Education of the Ministry of Education, Culture and Sport, set up by the Order of 30 December 2009 of 30 December 2009, in accordance with the provisions of Article 3.3 of Royal Decree 1671/2009 of 6 November 2009, for which the Law 11/2007, of June 22, of Electronic Access of Citizens to Public Services, with the aim of giving way through the same to the management and services that are the responsibility of the Autonomous Agency Spanish Service for the Internationalization of Education, attached to the Ministry of Education, Culture and Sport.

Second. Scope of application.

The scope of the management and services of the competence of the Spanish Autonomous Agency for the Internationalization of Education, attached to the Ministry of Education, Culture and Sport, to be provided through the headquarters Education of the Ministry of Education, Culture and Sport shall be exclusively related to the citizens of the Ministry of Education, Culture and Sport, in accordance with the definition given in point (h) of the Annex to Law 11/2007, of 22 June, provided that management or services of compulsory provision through an electronic venue as provided for in the Article 4.1 of Royal Decree 1671/2009 of 6 November 2009.

Third. Features of the onboarding.

The incorporation of the Spanish Autonomous Agency for the Internationalization of Education, attached to the Ministry of Education, Culture and Sport, to the electronic headquarters of Education of the Ministry of Education, Culture and Sport is carried out without the establishment of a secondary or sub-headquarters, in accordance with the definition given to this concept by Article 4.2 of Royal Decree 1671/2009 of 6 November 2009 and does not entail the modification of the characteristics approved for the sport in question. Fourth. Term of duration.

This agreement will last for one year from its formalization, being tacitly renewed for equal periods, if no complaint is made by either party.

Fifth. Review and Monitoring Commission.

At the request of either party, a Joint Committee may be set up for the examination, monitoring, coordination and, where appropriate, proposed amendment of the Convention.
