Article 42 of Law 3/2001, of 26 March, of Maritime Fisheries of the State, states that the Government, on a proposal from the Minister of Agriculture, Fisheries and Food, will regulate the qualifications of professionals in the sector, in the framework of the general education system, establishing the suitability requirements and the professional privileges corresponding to each title, without prejudice to the competences of the Ministry of Public Works.

Royal Decree 36/2014 of 24 January, which regulates professional titles in the fisheries sector, sets out the privileges of each professional title on fishing vessels.

After its entry into force, a legal loophole has been established in the treatment of the historically recognized privileges of a fishing nautical graduates, who had been carrying out their first position in the first place. (a) a bridge officer on fishing vessels, being in possession of the immediately lower title of multi-purpose coastal or second-class coastal fishing pattern. These professionals have long held these privileges with a guarantee of security and full professionalism, they enjoy a wide experience of work exercising the job of first officer and therefore it is considered appropriate. grant them the necessary powers to enable them to remain on board the vessels in which they are engaged.

On the other hand, the Kingdom of Spain is a party to the International Convention on Standards of Training, Certification and Watchkeeping for the Personnel of Fishing Vessels, made in London on July 7, 1995. In September 2012, which recognises the situations in fact prior to its entry into force, it is therefore considered necessary to recognise the privileges when those professionals were already in charge of the entry into force of the referred to as international convention.

In order to carry out the aforementioned extension of privileges, it is considered that it is appropriate to introduce a new additional provision in Royal Decree 36/2014 of 24 January, which regulates professional qualifications in the sector fishing.

This royal decree has been submitted to the hearing of the most representative professional and trade union associations of the shipowners and workers of fishing vessels. The autonomous communities with littoral have also been consulted. The Ministry of Public Works has also been informed.

In its virtue, on the proposal of the Minister of Food and Environment, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting of June 19, 2015,

DISPONGO:

Single item. Amendment of Royal Decree 36/2014 of 24 January on the regulation of professional titles in the fisheries sector.

It is added to Royal Decree 36/2014 of 24 January, which regulates professional titles in the fisheries sector, an additional provision thirteenth, worded as follows:

" Additional Disposition thirteenth. First bridge officers.

The multi-purpose coastal patterns and patterns of second-class coastal fishing which, prior to September 29, 2012, were normally occupying the position of first officer of the bridge on a fishing vessel In the case of a Spanish, with the title immediately lower than the one necessary to fill that post, they shall retain the assignment in order to be able to be wound up as the first bridge officer on the same vessel in which they are habitually engaged.

"

This royal decree is of a basic standard of management of the fisheries sector and is dictated by the provisions of Article 149.1.19. of the Constitution.

Final disposition second. Entry into force.

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
