Article 49 of Law 24/2013 of 26 December of the Electricity Sector provides for the power of the Administration to take measures, including the provision of the service of interruptibility managed by the system operator.

Order IET/2013/2013, of 31 October, which regulates the competitive mechanism for the allocation of the service of management of the demand for interruptibility, develops a competitive mechanism for the allocation of the resource interruptible position at the disposal of the electrical system through the interruptibility demand management service.

Article 4 of the aforementioned order relates to the allocation mechanism of the interruptibility service, pointing out that it will be an auction procedure managed by the system operator. Among others, it determines that the Ministry of Industry, Energy and Tourism's Secretary of State for Energy will decide to take into account the proposal of the system operator and the report issued by the National Markets Commission and the Competition, on certain aspects, including the date of each auction.

The aforementioned proposal was forwarded to the National Commission of the Markets and Competition on May 28, 2015 for the issuance of a report in accordance with Article 4.2 of Order IET/2013/2013, dated October 31. The Commission has issued a report dated 11 June 2015, entitled 'Agreement on a report on the proposal of the System Operator for the auctions of interruptibility for the 2016 electricity season'.

In the light of that report, the Directorate-General for Energy Policy and Mines requested the system operator, by letter of 29 June 2015, to provide additional information on certain aspects, including a new proposal for the timetable of milestones to be carried out for the conclusion of the auctions. The quoted operator replied by letter of 3 July 2015, including a new timetable proposal.

In your resolute virtue:

First. Object.

This resolution aims to establish the timing of the auction procedure for the allocation of the interruptibility demand management service in the 2016 electric season.

Second. The timing of the auction process.

1. The auction process for the allocation of the service of management of the demand for interruptibility for the season 2016 will take place from 31 August to 4 September 2015, being carried out through several calls according to the sequence set in the Auction Procedure Rules.

2. For the 2016 electricity season the time limit for the submission of applications referred to in Article 7.1.b) of Order IET/2013/2013 of 31 October 2015 shall end on 12 August 2015.

3. Before 24 August 2015, the system operator, in the light of the information submitted and following the analysis of the information:

(a) It shall enable consumers to demonstrate compliance with the requirements set out in Order IET/2013/2013 of 31 October 2013 and shall notify the consumer of the decision on their authorisation in a reasoned and transparent.

(b) Communicate to the Ministry of Industry, Energy and Tourism the parameters and conditions of consumers that are enabled in the auction process in a spreadsheet format that allows for their electronic processing.

Any modification shall also be communicated by the system operator to the Ministry of Industry, Energy and Tourism within one week, and collected in the report referred to in Article 16.2 of the IET/2013/2013 of 31 October.

4. The preceding calendar shall be without prejudice to the provisions of the Rules of the Auction Procedure for the case where the interruptible power requirement is modified or a power requirement is deemed necessary. additional interruptible.

5.
