Article 49 of Law 24/2013 of 26 December of the Electricity Sector provides for the power of the Administration to take measures, including the provision of the service of interruptibility managed by the system operator. This provision replaced the provisions of Article 46 of Law 54/1997 of 27 November of the Electrical Sector in respect of the service of interruptibility.

Order IET/2013/2013, of 31 October, which regulates the competitive mechanism for the allocation of the service of management of the demand for interruptibility, develops a competitive mechanism for the allocation of the resource interruptible made available to the electrical system through the service of management of the demand for interruptibility, ensuring the effective delivery of said service and its performance at the lowest cost for the electrical system.

Article 4 of the aforementioned order relates to the allocation mechanism of the interruptibility service, pointing out that it will be an auction procedure managed by the system operator. Among other aspects, it determines that the Secretary of State of Energy of the Ministry of Industry, Energy and Tourism will decide to take into account the proposal of the system operator and the report issued by the National Commission of the Markets and the Competence, determining at least the following aspects:

a) The range of amounts to be awarded for each auction and product type.

b) The output price, which will be set after analysis of the amount of interruptible resource.

c) The rules to apply at the auction.

d) The date of each auction.

e) The delivery period of the interruptible power.

On the other hand, Article 12 of Order IET/2013/2013 of 31 October regulates the remuneration of the service for the management of the demand for interruptibility, establishing that the system operator will send to the Secretariat of State The Commission shall, together with the information referred to in Article 4 thereof, submit a proposal for the values of the coefficients ka, kb and kc for each delivery period necessary for the determination of the remuneration associated with the execution of the power reduction options.

dated May 4, 2015, entered the Ministry of Industry, Energy and Tourism, written by the System Operator which collects, pursuant to Articles 4.2 and 12.3 of Order IET/2013/2013, of 31 October, Proposals for an uninterruptible power requirement, the timetable for milestones to be made, the values of the coefficients ka, kb and kc, and various considerations relating to the conduct of the interruptibility auctions.

The aforementioned proposal was forwarded to the National Commission of the Markets and Competition on May 28, 2015 for the issuance of a report in accordance with Article 4.2 of Order IET/2013/2013, dated October 31. The Commission has issued a report dated 11 June 2015, entitled 'Agreement on a report on the proposal of the System Operator for the auctions of interruptibility for the 2016 electricity season'.

In the light of that report, the Directorate-General for Energy Policy and Mines requested the system operator, by letter of 29 June 2015, to provide further information on the power requirement. interruptible, the determination of the coefficients ka, kb and kc, as well as a new proposal for the calendar of milestones to be carried out for the celebration of the auctions. The quoted operator replied by letter of 3 July 2015, providing additional information on the above aspects. This information was completed by letter dated July 24, 2015.

By Resolution of the Secretary of State of Energy of 9 July 2015 the calendar of the competitive procedure of auctions for the allocation of the service of management of the demand for the interrupted interrupcibility has been approved Order IET/2013/2013 of 31 October.

Additionally, on July 30, 2015, the Resolution of the Secretary of State of Energy approving the rules of the competitive procedure of auctions for the allocation of the management service has been approved of the demand for interruptibility and the model of adherence to the legal framework established for participation in the auctions.

In its virtue, I resolve:

First. Object.

This resolution aims to establish the characteristics of the auction procedure for the allocation of the service of management of the demand for interruptibility in the electric season 2016 defining, among others aspects, the ranges of quantities to be auctioned for each product type, the output price and the delivery period of the interruptible power.

Also, in Annex I the value of the coefficients ka, kb and kc is fixed for the calculation of the remuneration associated with the execution of a power reduction order in the 2016 electricity season.

In Annexes II and III of a confidential nature, the budget allocated and the maximum total requirement of uninterruptible power for the auction process and the confidential rules of application are determined respectively. the case of non-competitive conditions occurring in the course of the auction.

Second. Auction rules for the allocation of the interruptibility service.

According to Order IET/2013/2013 of 31 October, the rules of application to the auction procedure for the allocation of the service of interruptibility in the season 2016 and to the consumers of electric power enabled to participate in it, shall be those included in Annex I to the Resolution of 30 July 2015 of the Secretariat of State of Energy approving the rules of the competitive auction procedure for the allocation of the service of management of the demand for interruptibility and the model of adherence to the legal framework established for the participation in the auctions.

Third. Consumer adherence to the Rules of the Auction Procedure.

In accordance with Article 7.2 of Order IET/2013/2013 of 31 October, the consumer will be understood to be adhering to the rules of the auction procedure for the allocation of the service interruptibility from the date on which it formally acceded to the legal framework established for the auction.

For these purposes, the model of accession to the legal framework of the competitive mechanism for the allocation of the service for the management of the demand for interruptibility shall be that corresponding to Annex II to the Resolution of 30 July 2015 of the Secretariat of the State of Energy approving the rules of the competitive procedure of auctions for the allocation of the service of management of the demand for interruptibility and the model of adherence to the legal framework established for the participation in the auctions.

Consumers who would have formally adhered to the legal framework for their participation in the competitive mechanism for the allocation of interruptibility prior to the use of the above mentioned resolution of 30 July 2015 of the Secretariat of State of Energy, shall formalise a new formal accession in accordance with the Model of Accession provided for in this paragraph.

Fourth. Products to be auctioned.

In the auctions for the allocation of the interruptibility service in the 2016 season two different products are included, as defined in Article 5 of Order IET/2103/2013, of 31 October:

a) Product 5 MW: 5 MW demand reduction blocks.

b) 90 MW product: 90 MW demand reduction blocks, with very high availability.

Fifth. Amounts to be auctioned.

1. The uninterruptible power requirement to be auctioned, equivalent to the number of product blocks of 5 MW and 90 MW to be awarded, shall be the sum of the quantities to be auctioned for the product 5 MW and the product 90 MW for the delivery period corresponding to the electricity season 2016, expressed in MW.

For both the 5 MW and 90 MW product, the interruptible power requirement to be auctioned will be divided into 5 MW and 90 MW product blocks, respectively.

Each product block will be auctioned in a separate, top-down-price auction.

2. The amount of uninterruptible power requirement to be auctioned and the product blocks in which that quantity is disaggregated will be among the following ranges:

3. The number of product blocks to be auctioned corresponding to the uninterruptible power requirement to be auctioned for each of the two products shall be set by the Secretary of State for Energy, and published by the system operator through the web page of the auction process for the interruptibility service, including on the e-sios website (www.esios.ree.es).

4. The above ranges of uninterruptible power requirement to be auctioned and the particular value of the requirement to be published subsequently shall be without prejudice to the provisions of the Resolution of the Secretary of State for Energy. the rules of the competitive auction procedure for the allocation of the service for the management of the interruptibility demand and the model of accession to the legal framework established for participation in the auctions are approved.

Sixth. Delivery period.

The delivery period for the products to be auctioned will be the 2016 electric season, from January 1 to December 31, 2016, both included.

Seventh. The output price.

1. The output price for each of the product block auctions for each product type and for the delivery period is specified in the following table:

2. The price drop step shall be EUR 1,000 /MW.

3. In the case of a tiebreaker auction, the price drop step shall be one-tenth of that set out in the preceding paragraph.

Eighth. The timing of the auction process.

1. In accordance with the provisions of the Resolution of the Secretary of State of Energy of 9 July 2015 approving the timing of the competitive auction procedure for the allocation of the service for the management of the The auction process for the allocation of the service of management of the demand for interruptibility for the season 2016 will take place from 31 August 2015 to 4 September 2015, from 31 October 2015 to 4 September 2015, performing through multiple calls according to the sequence set out in the Rules of Procedure of auctions.

Within a maximum of two working days following the publication of this resolution, the Auction Manager shall make public through the auction process website of the Interruptibility Service, included in the Website e-sios (www.esios.ree.es), the specific data of the auction calls to be held, as provided for in the Rules of the Auction Procedure. The updating of such data shall also be performed in accordance with the provisions of those rules.

For the purposes set out in the Rules of Procedure for the auctions referred to in the second paragraph, the Saturdays, Sundays and public holidays of the Madrid square, as well as the 24 and 31 of the December.

2. The preceding calendar shall be without prejudice to the provisions of the Rules of the Auction Procedure for the case where the interruptible power requirement is modified or a power requirement is deemed necessary. additional interruptible.

Ninth. Other aspects of the auction procedure.

The Secretary of State for Energy shall establish by resolution any other aspect that has not been determined in this resolution, in accordance with the provisions of Order IET/2013/2013 of 31 October 2013.

10th. Incident solution.

The incidents that may arise before, during and after the development of the auction, in connection with the application of the Rules of the Auction Procedure, will be solved by the representatives of the National Commission of Markets and Competition.

13th. Coefficients for the calculation of the remuneration associated with the execution of a power reduction order.

For the electricity season 2016, the coefficients ka, kb and kc referred to in Article 12 of Order IET/2013/2013 of 31 October 2013 for the calculation of the remuneration associated with the execution of a reduction order Power, corresponding to each of the implementing options set out in Article 5 of Order IET/2013/2013 of 31 October 2013, shall be as set out in Annex I.

The system operator shall publish on its website the reference price PReoi indexed at the estimated price of the tertiary regulatory reserve as defined in Article 12.3 of Order IET/2013/2013 of 31 October 2013. application for the 2016 electric season.

12th. Publication.

This resolution will be notified to the National Markets and Competition Commission and to the system operator. The latter will publish it on its website and make it known through the information system.

Also, this resolution will be published in the "Official State Gazette".

13th. Effects.

This resolution shall have effect from the day following that of its publication in the "Official State Gazette".
