Article 20.1 of the organic law 15/1999, of 13 December, of protection of data of a Personal nature, provides that the creation, modification or deletion of files of public administrations only may be through general provision published in the «Official Gazette» or corresponding official journal.

By this order, is to modify the order of 21 July 1994, which regulates the files with personal data managed by the Ministry of health and consumption, creating a new file named 'The EAMI network alerts distribution lists' with data of a personal nature, managed by the Ministry of health, social services and equality.

This file consists of different data of those persons or groups they subscribe to the mailing lists of warnings from the authorities in Latin America drugs (EAMI) network in order to receive information about public alerts about safety, quality or counterfeit medicines issued by the authorities in the countries of Latin America that drugs make up the network.

In the processing of this command has issued mandatory report the Spanish Agency of data protection.

By virtue, I have: article 1. Creation of file.

Expand the contents of annex 1 "files of health" of the order of 21 July 1994, by governing files with personal data managed by the Ministry of health and consumption, with the creation of a new file called 'The EAMI network alerts distribution lists', whose data are contained in the annex to this order.

Article 2. Management and organization of the file.

The owner of the file responsible shall take the measures of management and organization needed, ensuring, in any case, the confidentiality, security and integrity of the data, as well as the leading to make effective warranties, obligations and rights established in the organic law 15/1999, of 13 December, of protection of data of a Personal nature, and in Royal Decree 1720 / 2007 , of 21 December, which approves the regulations implementing the organic law 15/1999, of 13 December, of protection of personal data.

Article 3. Transfer of data.

The data contained in this file only may be assigned in the cases expressly provided for by law.

Sole final provision. Entry into force.

This order shall enter into force the day following its publication in the "Official Gazette".

Bodies of administrations responsible for the file: General Secretary of the Spanish Agency of medicines and health products.
