Article 12.1 of Law 30/1992 of 26 November 1992 on the Legal Regime of Public Administrations and the Common Administrative Procedure provides that 'competition is indispensable and will be exercised precisely by the Member States'. administrative bodies which are assigned to it as their own, except for cases of delegation or endorsement, where they are carried out in accordance with the terms laid down in this or other laws. '

Article 13. 6 of the Law of Legal Regime of Public Administrations and of the Common Administrative Procedure provides that the delegation shall be revocable at any time by the body that has conferred it.

By Resolution of the Presidency of this Body of 20 July 2000, published in the "Official State Gazette" of 9 November 2000, No. 269, the following functions were delegated to the Commissioner for Water:

First.

Authorization for the execution of works that affect the public hydraulic domain of repair of the facilities for the use of public water.

Second.

Derivatives of waters of a temporary nature that do not claim a right to the private use of the same, according to the provisions of article 76 of the Regulation of the Public Domain Hydraulic and whenever the waters are destined for the construction of public works.

Third.

The navigation and flotation and the establishment of passing boats and their jetties, in accordance with the provisions of Article 51 et seq. of the Regulation of the Hydraulic Public Domain.

The reasons and causes that advised such a delegation have disappeared so we consider it appropriate to recover these functions, in use of the privileges that are legally conferred on me and the provisions of the legislation.

By virtue of the foregoing, and in accordance with the provisions of Article 13.6 of the Law on the Legal Regime of Public Administrations and the Common Administrative Procedure, you shall:

Revoking the delegation of duties to the Commissioner for Water by resolution of 20 July 2000, published in the Official Gazette of the State of 9 November 2000, number 269, which have since returned to be taken over by the Presidency of the Guadalquivir Hydrographic Confederation, recovering the following functions:

First.

Authorization for the execution of works that affect the public hydraulic domain of repair of the facilities for the use of public water.

Second.

Derivatives of waters of a temporary nature that do not claim a right to the private use of the same, according to the provisions of article 76 of the Regulation of the Public Domain Hydraulic and whenever the waters are destined for the construction of public works.

Third.

The navigation and flotation and the establishment of passing boats and their jetties, in accordance with the provisions of Article 51 et seq. of the Regulation of the Hydraulic Public Domain.

This resolution shall enter into force from the date of its date, without prejudice to the subsequent publication of this resolution in the "Official State Gazette".
