Approval of the order DEF/166/2015, of 21 January, which develops the basic organization of the armed forces, involved the partial development of Royal Decree 872/2014, on 10 October, whereby the basic organisation of the armed forces. This degree of development allowed the repeal of the 10 ministerial orders which was scattered the Organization of the armed forces, collecting the contents of all of them and adapting it in the middle of what is necessary in accordance with the laws in force; in particular, to the organic law 5/2005 of 17 November, national defense and the aforementioned Royal Decree.

However, the units described in this ministerial order do not imply total which, pursuant to its article 3.3, are the responsibility of the holder of the Department, so it is necessary to enact this provision to complement to the above, allowing that the Chief of defence staff to develop their own organization.

On the other hand, in the time that has elapsed since the entry into force of the above-mentioned ministerial order and in the constant cycle of planning, implementation, evaluation and improvement to entire organization must undergo has been considered necessary restructuring of the Office of the defence staff to make your organic responsive to the needs of the Chief of the defence staff for the exercise of its powers eliminating redundancies identified ex post on the Joint Chiefs headquarters support to joint action and command of operations, for the benefit of a greater efficiency and effectiveness of this organization. In this same line, felt the need to bring together all the tasks concerning human resources in a single unit, again, avoiding redundancies and giving comprehensive treatment to these resources in all the State of the defence.

In addition, once posted the order DEF/1642/2015, of 30 June, which develops the basic Navy organization, has been detected an error by omission not to include the head of facilities in San Fernando so it is necessary to amend the ministerial order to rectify the error mentioned within the Arsenal of Cadiz.

The explanatory memorandum of the order DEF/166/2015, of 21 January, details the aspects that have been taken into account in its drafting, that they have been, also applied to the drafting of this ministerial order.

By virtue, I have: single article. Approval of the Organization of the Office of the defence staff.

According to what is established in the Royal Decree 872/2014, of 10 October, which establishes the basic organization of the armed forces, and in accordance with the order DEF/166/2015, of 21 January, which develops the basic organization of the armed forces, approved the Organization of the defence staff, which is then inserted.

Sole additional provision. No increase in public spending.

Enforcement of this ministerial order, including the modification of the existing units and the creation of those that may be necessary, will be no increase in cost of operation of the Office of the defence staff and does not imply increased public expenditure.

Sole transitional provision. Existing units.

1. the units referred to in this ministerial order they perform their duties and committed as the necessary organic adaptations are occurring and be transferred such functions and committed.

2 units not covered by this ministerial order, will depend on the units set forth herein, pursuant to which the Chief of the defence staff has and will continue to exercise their functions and committed until entry into force of the statement issued by the authority that will develop this ministerial order, the necessary organic adaptations occur and those functions and duties transferred to new units.

Provision repealing only. Repeal legislation.

With the entry into force of this ministerial order is made effective the repeal of the Royal Decree 1249 / 1997, of 24 July, which regulates the Organization of the upper center of studies of the national defense, preceptuada in the single repealing provision of Royal Decree 872/2014, on 10 October, whereby the basic organisation of the armed forces.

First final provision. Modification of the order DEF/166/2015, of 21 January, which develops the basic organization of the armed forces.

The order DEF/166/2015, of 21 January, which develops the basic organization of the armed forces, is hereby amended as follows: one. Article 6 is worded in the following way: «article 6. The whole of the defence.

1 the Joint Chiefs of Defense (CHIEF) is divided into: to) the headquarters.

(b) the Secretary General of the Assembly of the defence (SEGEMACON)).

Also, it will be responsible for developing and coordinating the position of the FAS to international organizations on security and defence (OISD) in the logistics field.

5. the DIVESTRA will be responsible for drawing up and developing military strategy and the concept of employment of the FAS. Also, it will be responsible to develop and coordinate the position of the FAS before the OISD where the JOINT has responsibilities, plan, coordinate and control the activities derived from bilateral and multilateral military relations which this and make military response options to support the JOINT planning and strategic leadership of the operations.»

Two. 3. Four. Added a second paragraph to article 14.7 of the order DEF/1642/2015, of 30 June, which develops the basic organization of the Navy, with the following wording:


«Arsenal of Cadiz will depend on the head of facilities in San Fernando that will provide logistical support to the units of the Navy in its scope.»

Third final provision. Schools of development.

It empowers the Chief of defence staff to develop this ministerial order in accordance with the terms set out in article 3.4 and article 4, both the order DEF/166/2015, of 21 January.

Article 2. The command of operations.
