Seen the text of the collective agreement of the sugar industry (agreement code No. 99000555011981) for the period 2015-2016, which was signed, dated July 30, 2015, of one part business associations General Association of Manufacturers Sugar Spain (AGFAE) and Manufacturers Association Bread (AFLE), representing companies in the sector, and another by the Federation of Industry and Agricultural Workers of UGT (FITAG-UGT) and Agrifood Federation CC unions .OO., representing workers in the sector, and in accordance with Article 90, paragraphs 2 and 3 of the Law of the workers' Statute, revised text approved by Royal Legislative Decree 1/1995 of 24 March and Royal Decree 713/2010, of May 28, registration and deposit agreements and collective bargaining agreements,

COLLECTIVE AGREEMENT OF THE SUGAR INDUSTRY 2015-2016
CHAPTER
I

1. Scope Agreement.

1. Territorial.-The collective labor agreement is state level.

2. Funcional.-The collective agreement shall apply in companies engaged in:

A) Production and refining of sugar as well as the tablet, cartoning and packaging of sugar in the case of major activities in other centers that are not factories or sugar refineries.

B) distilling alcohol from molasses.

C) Other workplaces that as of December 31 in 1990 and three had been covered by the scope of this agreement for sugar industries.

D) The production of biofuels from agricultural products.

E) The performance of any agro productive activity covered by the scope of this collective agreement for the sugar industries to December 31, 2012, in accordance with the principle of unity of business enterprises, and without prejudice in paragraph 1 of Article 84 of the Law of the Workers' Statute.

3. Personnel.-The collective agreement governs labor relations between workers and companies all fall within the areas of territorial, functional and temporal application. Fall outside the scope of the legal relationships regulated in Articles 1 and 2 of the law the status of workers.

Agreement 2. Temporal scope.

1. Entry into force The collective agreement will take effect from the day following its publication in the Official Gazette of the economic effects of the agreement is retroactive to January 1, 2015 and otherwise will start attending to what is established in each case .

2. Time.-The term of this agreement shall be two years from the entry into force, although different durations may be established for specific subjects. The economic effects agreed in this agreement shall apply during the years 2015 and 2016.

3. Prórroga.-In the event that none of the legitimate parties denounced the agreement within the collective agreement shall be extended tacitly for one year without some of its concepts, modules and remuneration modification. If the underreporting for the third time be reiterated, the collective agreement will be expired.

4. Denuncia.-The complaining party shall give written notice to the other party or within the last month of validity of the agreement or the respective issue, its intention to renegotiate it.

The complainant shall determine the subject matter of renegotiation and until a new agreement is reached the previous agreement will remain in their own terms without any of its concepts, modules and remuneration modification.

5. Also, in the event that a future legal provision modify the essential content of the agreement either party may terminate the collective agreement within the month following its publication in the Official Gazette and renegotiate attending to matters affected its content.

6. The economic values ​​contained in agreements 22, 24, 25, 26, 27, 29, 33, 34 and 38 and in the annexes have an annual economic effect, except as provided in this agreement for the years 2015 and 2016.


7. You are entitled to terminate the Agreement in any of the signatory unions and business association.

Agreement 3. Effects of the agreement.

1. Compensation and absorption.

The conditions agreed constitute an organic whole and must be taken together for the purposes of its application, it being understood that offset the improvements made by staff through previous collective agreements, legal, litigation or administrative imperative, by individual contract or by decision unilateral companies.

Future economic laws involving variation in all or some of the remuneration items have practical effect only if considered globally, exceed the total level reached by agreement and only as exceeding the mentioned level. Otherwise, they are considered absorbed by the improvements that are agreed.

Agreement 5. Structure of Collective Bargaining.

5.1 This Agreement obliges all the time of their validity, excluding any other to all companies and workers within the designated areas.

Under this Convention and in accordance with Article 83.2 of the Statute of Workers, the structure of collective bargaining in the sector, is divided into the following substantive levels of agreement:

A) State Convention Sector: Its content regulates general working conditions to apply throughout the sector level and the effect that the Convention establishes itself.

B) Collective Agreements Company: contents under negotiation in this bargaining unit, will be on the development or adaptation of materials of this State Convention, when so established by express reference. They will also be subject of negotiation by company collective agreements, matters not provided for in this State Convention. All this without prejudice to Article 84.2 of the Statute of Workers.

With the aforementioned structure, the signatory parties consider sufficiently covered within the statutory framework, collective bargaining in the sector.

5.2 Concurrence of agreements.

This Agreement is applicative priority in each and every one of its contents, compared to other bargaining units lower level, without prejudice to the provisions of Article 84.2 of the Statute of Workers.

Therefore, given the nature of exclusive norm and attention of its unique nature, the matters in this Agreement are established, may not be traded in units of lower trading either sectoral or company, except as provided in the preceding paragraphs.

Agreement 6. Commission interpretative agreement.

1. A Joint Committee is established whose functions will be:

A) mediation, arbitration and conciliation in individual groups that are submitted to them or conflicts.

B) The interpretation and application of the agreement.

C) set out in Articles 41.6 and 82.3 of the ET.

D) The monitoring of all agreements, including those for Employment and Collective Bargaining (NCSA).

2. The resolutions adopted by the Joint Commission on matters of general interest will be considered part of this collective agreement and have the same binding force. Such agreements shall be forwarded to the Labour Authority for registration.

3. The Commission shall consist of 5 representatives of trade unions and 5 representatives of the Business Association signatory to the Convention.

4. Regulation of operation.

A) Meetings. The Joint Commission shall meet:


- For the exercise of the functions are listed in the previous agreement, a), b) and c) when its intervention is required.

- In the case of paragraph d) every three months.

B) Convocatoria.-The Joint Commission shall be convened by any of the signatory organizations, it being sufficient written communication in which the points are expressed to be discussed in the agenda, as well as the proposed date.

The Joint Committee will meet within the term that circumstances depending on the importance of the issue, but in no case exceed ten days from the request.

E) Domicilio.-The address is set for notification purposes and calls at the headquarters of the General Association of Sugar Manufacturers Spain, on Calle Almagro, 15, CP 28010 Madrid.

5. Mandatory submission to the Joint Commission. The parties undertake to submit to the Joint Committee all questions of general interest arising prior to the judicial or administrative authority, without prejudice to the subsequent exercise of individual rights or collective character.
CHAPTER II


Agreement 7. Organization of work.

The management and organization of work is faculty of management of the company in each of its centers within the tax framework in this basic general agreement and the legal provisions in force for the purpose.

8.
Ranking's Agreement.

The companies formulate every three years echelon staff work center, classified by professional groups, rank and seniority. Such ladder shall be submitted to the knowledge of the staff and their legal representatives. In case there were complaints, they should be formulated within ten days and the company will decide. Against the decision rejecting the company the employee may exercise the appropriate legal action.
9. Agreement

Agreement.

1. Transfers and displacements.

Transfers of workers who conduct change of residence and travel shall be governed by the provisions of art. 40 of the law of the Workers' Statute, unless that companies have agreed more favorable terms.

2. Service fees.

11. Limitation Agreement

CHAPTER III



Joined the company
Agreement 12. General rule.

Companies can use any of the methods recognized by law for hiring workers.

For the purpose of this agreement is defined as:

A) fixed the employee with permanent full-time contract worker. Excluded from this definition, temporary by work or service, as well as those linked to the company for a defined activity temporarily permanent seasonal workers, part-time, temporary.

Agreement 13. Probationary period.

Staff Admission is considered provisional during a trial period, which will be:

- Graduates: six months

- Rest: one month.

During this period, both the worker and the company may, respectively, to terminate the employment relationship without notice and without any of the parties entitled to compensation.
14. Permanent staff
Agreement discontinuous.


1. The discontinuous permanent staff will be called at the beginning of each marketing year. The call will be made according to become operational sections or departments according to business needs. The order of call is as follows:

A) they will be called workers belonging to each section or department.

B) Within each section or department shall address the specialty.

C) Within the specialty will take into account the age therein.

15. Interim Agreement
Personal.

16. Promotion Agreement and promotions.

17. Recognition Agreement

18. Healthcare
Agreement.

19. Termination of Agreement

CHAPTER IV

Professional classification


Agreement 20. Professional groups and categories.

The professional classification of personnel affected by this agreement will be framed within three professional groups:

Professional Group B, which fits the technical and commercial administrative staff.

The different roles and functions that define the categories of each professional group are merely declarative and all workers in the industry are required to carry out the work and operations be told their superiors within the general duties of their own professional group, try as campaign period or intercampaña.

To unify criteria and guideline in Annex I, interim tables of correspondence between categories and jobs of each of the three professional groups are collected. CHAPTER V

Remuneration


Agreement 21. Characteristics of remuneration.

1. General principles. The remuneration systems set out in this agreement, fully replace the wage system of law and fact, companies apply at the time of entry into force.

The total remuneration of each professional category is meant understood that twenty five percent of the base wage required by law, at least in the work with incentive provided they do not exceed normal performance.

2. Structure of remuneration. During the term of this agreement, the remuneration scheme for staff shall consist of the following:

3. wage levels. By 2016 wage increases will be expressed in the corresponding additional provision.


5. Discontinuous permanent staff salaries, part-time, casual, temporary and fixed-term. The liquidation of assets of discontinuous permanent staff, part-time, casual, temporary and fixed-term time fee per working day, multiplying the number of hours worked, within normal working hours, by the respective wage-hour 2015 in Annex 3. for 2016 wage increases will be expressed in the corresponding additional provision. 6. Streamlining payroll. Given the dispersion of workplaces of companies, and in order to achieve the greatest possible efficiency in the mechanized processing of payroll and payment of salaries of staff, companies can compute the variable items for monthly periods due different the calendar month and practice the settlement at the end of it, or calculating those concepts in the calendar month, practicing the settlement thereof in currencies other than the completion date of the month and can receive advances on account thereof. In any case, the fixed remuneration items is calculated by calendar months.
22. Personal Accessories
Agreement.

Personal supplements will increase according to the percentages agreed in the present agreement for workers to level 14 inclusive. 2015 and 2016 increases in this concept will be expressed in the corresponding additional provision.

Companies may stop applying the review provided in the preceding paragraph to workers with levels 15, 16 and 17, without prejudice to establish another system update personal accessories based on responsibility and professional qualification. The review of personal accessories for the above levels can contemplate the absorption and compensation increases agreed in this agreement. In any case, the implementation of this agreement will mean a decrease in total worker's salary, calculated annually, corresponding to preceding the review year.
23. Supplement
Agreement old.

Biennium 2014-2015
:

The permanent staff will receive an amount of 396 euros, fixed and equal for all categories during the years 2014 and 2015. These amounts may not be added, so that the December 31, 2015 only strengthen the amount of 396 euros. These amounts will be distributed at the rate of 26.40 euros on 15 pay during each of the years 2014 and 2015, under the concept of seniority 2014-2015.

The discontinuous permanent staff, part-time, casual, temporary and fixed-term, receive, in respect of seniority, where applicable, from 1 January 2014 and the date for person 730 workers come due days of actual work until 31.12.2015, calculated from fulfilling his last two years, the amount of 0.22 euros per hour actually worked and equal for all categories, which will be consolidated.
Biennium 2016-2017
:

The permanent staff will receive an amount of 100 euros, fixed and equal for all categories during the years 2016 and 2017. These amounts may not be added, so that the December 31, 2017 only strengthen the amount of 100 euros. These amounts will be distributed at the rate of 6.66 euros on 15 pay during each of the years 2016 and 2017, under the concept of seniority 2016-2017.

The discontinuous permanent staff, part-time, casual, temporary and fixed-term, receive, in respect of seniority, where applicable, from 1 January 2016 and the date for person 730 workers come due days of actual work until 31.12.2017, calculated from fulfilling his last two years, the amount of 0.057 euros per hour actually worked and equal for all categories, which will be consolidated.
24. Special Agreement
Plus for certain arduous, toxic or hazardous work.


Qualified Workers performing arduous, toxic or hazardous activities will receive a bonus of 0.97 euros / day during 2015. For 2016 the increases in this concept will be expressed in the corresponding additional provision.

The rating of a job as toxic, painful or dangerous, be up to the competent labor court, ruling in the case of lack of agreement between the representation of workers and company management. The resource system which will be legally established in each case.

Agreement nocturnality 25. Plus.

The amount of plus night shift for each level and category in 2015 is contained in Annex 4. For 2016 increases this concept will be expressed in the corresponding additional provision.

The shift working the night of 24 and 31 December and 5 January will receive a bonus of 30 euros / night.

Agreement 26. Plus Plus Sundays and holidays.

Staff working in regular normal day during Sunday receive in 2015 a bonus of 2.17 euros per hour actually worked in that circumstance. 2016 increased this concept will be that expressed in the corresponding additional provision.

Working time
