In exercise of the powers conferred by Article 10.2.b) of Law 10/1990, of 15 October, of the Sport, the Commission of the Council of the High Sports Council in its session of 30 June 2015, has approved definitively the amendment of Articles 88, 105, 110 and 111 of the Statute of the Royal Spanish Federation of Esgrima, authorizing their registration in the Register of Sports Associations.

In compliance with the provisions of article 31.7 of the Law of Sport and article 12.3 of Royal Decree 1835/1991 of 20 December, on Spanish sports federations and the Register of Sports Associations, I have the publication of the amendment of the Statutes of the Royal Spanish Federation of Esgrima, contained in the Annex to this Resolution.

ANNEX

Statutes of the Royal Spanish Federation of Esgrima

Article 88.

1. The integration into the RFEE will be produced by the granting by the autonomous federations, of the corresponding Autonomous Sports License.

A) Licenses for individuals:

Shooters license.

Technical-trainers license.

License of judges-referees.

B) Licenses for legal persons.

Club license.

2. Rules for the application of licences for natural persons. For participation in any official sports competition, in addition to the fulfilment of the specific requirements that are required in each case, it will be necessary to be in possession of a regional sports license, which will be issued by the Regional sports federations that are integrated into the RFEE, according to the conditions and requirements that will be regulated. The licence shall produce effects in the state and regional areas, from the moment it is registered in the register of the autonomous federation, which must be made available to the RFEE.

In the cases of non-existence of the autonomous federation, material impossibility, when determined by the autonomous federation itself, or when the autonomic federation is not integrated into the RFEE, the expedition of licences shall be taken over by the RFEE. It shall also be for the issue of licences for which a visa or prior authorisation from the relevant international sports federation is required, and in particular where it comes out of the provisions of the the statutes of those international federations.

The requirements for the issuance of the RFEE licenses shall be collected in the General Regulation in the terms set out in Article 110 et seq. of these Statutes.

The RFEE is responsible for the development and permanent updating of the federal license census, which must be available to all the autonomous federations.

They will be disabled to obtain a sports license that will enable them to participate in the competitions referred to in the first paragraph by athletes who have been sanctioned for doping, both at the state level as in the international, while they are complying with the respective sanction.

Athletes who try to obtain a sports licence may be subject, prior to their granting, to a doping control, in order to determine compliance with the requirements laid down in this Directive. rules.

Likewise, those persons who are disabled may not be granted a federal license, as a result of the violations provided for in the Organic Law 3/2013 of 20 June, protecting the health of the athlete and the fight against doping in sport.

3. Rules for the application of licences for legal persons. For participation in any official sports competition, in addition to the fulfilment of the specific requirements that are required in each case, the clubs must be in possession of a sports license that will be issued by the federations. Regional and national sports activities that are integrated into the RFEE or, as the case may be, the Spanish Federation.

The conditions and requirements for the issuance of the RFEE licenses shall be included in the General Regulation in the terms set out in Article 110 et seq. of these Statutes.

The RFEE is responsible for the development and permanent updating of the federal license census, which must be available to all the autonomous federations.

Article 105.

The RFEE, without prejudice to the provisions of Articles 98 to 104 of the present Statutes, recognizes the following functions to the Federations of Esgrima of autonomy:

1. Represent the authority of the RFEE in its functional and territorial scope.

2. Promote, order and direct fencing, within its territorial scope, through the exercise of its own powers and those expressly delegated by the RFEE.

3. Control, direct and develop the various activities within its scope.

4. Constitute the highest immediate sporting authority for all its affiliated clubs and members.

5. Issue the corresponding autonomic sports license, as set out in Article 88 of these Statutes.

Item 110.

For the participation in official national activities or competitions organized by the RFEE, as well as for the access to the competition zone, it will be necessary to be in possession of the corresponding autonomous sports license issued by the corresponding autonomic federation.

Annually the General Assembly of the RFEE may review the amount of the economic amount corresponding to the RFEE. The revenue produced by the issue of licences shall be primarily aimed at financing the structure and operation of the RFEE.

The application and issue of any license implies the voluntary transfer of the licensed data of your personal data, as soon as they are necessary for the management of the RFEE and will be incorporated in a file automated, duly registered with the Spanish Data Protection Agency, and to which the security measures required by law must be applied. The purpose of this file is the management of data to maintain appropriate administrative, economic and formative management, as well as its publication in rankings, classifications or indicative states. Those affected, expressly authorize the publication of such data for sports information, as well as the sending of documentation, information or publicity that could be of interest to them, by their sporting nature or to maintain a appropriate administrative management, and may revoke such authorization at any time.

Also, images obtained within the scope of the competition of the sportsmen, technicians and federal judges participating in competitions or events organized by the RFEE or other organizing entity delegated by the RFEE, may be published on the website of the RFEE or on other means of dissemination which the RFEE or the organising organisation is editing, as well as the fixing, reproduction, distribution and public communication, arising from its participation in any competition official, without the RFEE being responsible for the processing of images that the press can carry out, television or any other means of communication.

In any case, the RFEE undertakes to respect the exercise of the rights of access, rectification, cancellation and opposition, in accordance with the procedures and limitations established in the law itself. For the exercise of these rights, the affected party must write to the Royal Spanish Federation of Esgrima, Calle Ferraz, 16, 28008 Madrid.

Article 111.

The licences issued by the Eesgrima Federations of regional scope, shall enable the participation referred to in Article 110, when they are integrated in the RFEE, to be issued within the minimum conditions of economic character as approved by the General Assembly, and formally established in the General Regulation, and communicate their issue to the General Assembly.

For the above purposes, the rating will take place once the Federation of Esgrima of regional autonomy pays the corresponding economic quota to the RFEE within the deadlines fixed regulatively.

The licenses issued by the Federations of Esgrima of autonomy, shall record the corresponding data, at least, in the official Spanish language of the state.

These licenses will reflect three economic concepts:

1. Compulsory insurance referred to in Article 59.2 of the Law of Sport, in the licences for natural persons.

2. Fee for the RFEºE.

3. Quota for the Federation of Esgrima in the autonomous area.
