Regulation (EU) number 1321 / 2014 the Commission, amended by the Regulation (EU) number 2015 / 1088, establishes requirements to maintain the airworthiness of aircraft and aeronautical products, parts and appliances and on organizations and personnel involved in these tasks.

Regulation (EU) number 1321 / 2014, in its modification by the Regulation (EU) number 2015 / 1088, establishes in article 8, paragraph 2, point (b)), the possibility of Member States opting not to apply certain provisions. In particular, giving Member States the possibility not to apply until September 28, 2016, for ELA1 aircraft not used in commercial air transport, the following requirements: i) the requirement applicable to the competent authority for issuing licenses for maintenance of aircraft in accordance with annex III (Part 66), new or converted, in application of the same annex 66.A.70 point.

(ii) a requirement for certifying staff qualified in accordance with annex III (Part 66), which is contained in the following provisions:-point M.A.606 (g) and M.A.801 (b) 2 of annex I (part M).

-Points 145.A.30 (g) and (h) of annex II (part 145).

In this regard, and in accordance with the above in recital number 2 of the Regulation (EU) number 2015 / 1088, this State Agency of aviation safety, understands, like the Commission, it is necessary to reduce the complexity of the rules for the application of the mentioned Regulation (EU) number 1321 / 2014, in order to adapt to the risks associated with the different categories of aircraft and the types of operations and in particular, according to the minor risks associated with general aviation aircraft.

Therefore, and in order to simplify maintenance procedures with the intention of providing greater flexibility and allow that the owners of such aircraft to benefit from a reduction of the costs, it is necessary to make use of the possibility contained in subparagraph b of paragraph 2 of article 8, and to postpone the entry into force of the requirements for ELA1 aircraft not used in commercial air transport.

By virtue of the foregoing, the Director of the State Agency of aviation safety resolves to postpone the application of the requirements mentioned, collected in the Regulation (EU) number 1321 / 2014, for ELA1 aircraft not used in commercial air transport, until 28 September 2016.
