By resolution of December 19, 2014 ("BOE" No. 86, of 10 April 2015) it was agreed to give publicity, to the fourth edition, July 2011 of Annex 18 to the Chicago Convention of 1944, Transport without the risks of dangerous goods by air, and to the Technical Instructions for Transport Dangerous Goods by Air (Document ICAO 9284 /AN/905), edition 2015 -2016, applicable from 1 January 2015.

The publication of these provisions is fully justified in order to ensure the principle of advertising of the rules and for reasons of legal certainty, given that, as foreseen, respectively, in the Regulation (EU) Commission Regulation (EC) No 965/2012 of 5 October 2012 laying down technical requirements and administrative procedures in relation to air operations pursuant to Regulation (EC) No 216/2008 of the European Parliament and of the Council Council, and in the second provision of Royal Decree 555/2014 of 27 June 2014, by the that the air regulation and common operational provisions for air navigation services and procedures are developed, and that Royal Decree 57/2002 of 18 January, which is adopted by the Air Circulation Regulation, is amended, the last applicable amendment of Annex 18 and the Technical Instructions for the Safe Transport of Dangerous Goods by Air, are applicable to all subjects involved in the air transport of dangerous goods and in all air operations.

Following the publication of these provisions, the International Civil Aviation Organization has adopted amendment 52 to Annex 18 concerning the management systems for operational safety, dangerous goods in mail and instruction programmes on dangerous goods, as well as Corrigendos 1 and 2 and Adendas 1 to 4 of the Technical Instructions, which provide for various errors and incorporate amendments to, inter alia, portable electronic devices for battery-operated smokers, electronic devices for medical use with batteries lithium or lithium ion or the new conditions applicable to lithium ion batteries.

Consequently, in order to ensure the principle of advertising of the rules and legal certainty, for reasons of general interest, as provided for in Article 60.1 of Law 30/1992, of 26 November, of Legal Regime of Public Administrations and the Common Administrative Procedure, agreement:

First.

Give publicity, as Annex I, to the fourth edition, July 2011, Amendment 52, of Annex 18 to the Chicago Convention of 1944, Transport without the risk of dangerous goods by air.

Second.

Give publicity, as Annex II, to the amendments to the Technical Instructions for the Safe Transport of Dangerous Goods by Air (Document ICAO 9284 /AN/905), edition 2015 -2016, incorporated by the Corrigendos 1 and 2 and Adendas 1 to 3, which result from immediate application.

Third.

Give publicity, as Annex III, to the amendments to the Technical Instructions for the Safe Transport of Dangerous Goods by Air (Document ICAO 9284 /AN/905), edition 2015 -2016, incorporated by Adendas 3 and 4, which they are applicable from 1 April 2016.
