ONCE THE TRANSFERS OF FUNCTIONS AND COMPETENCES TO THE AUTONOMOUS ENTITIES IN THE FIELD OF HEALTH HAVE BEEN CARRIED OUT, IT BECOMES NECESSARY TO DEFINE THE RESPONSIBILITIES AND FUNCTIONS THAT THE HEALTH ADMINISTRATION OF THE STATE ASSUMES IN DEALING WITH TO AVOID ANY KIND OF AMBIGUITY IN THE ALLOCATION OF POWERS, THE NEED TO MAKE EVERY POINT URGENT AND UNPOSTPONED, DUE TO THE NOTORIOUS AWARENESS OF THE ENTIRE SPANISH POPULATION ON HEALTH PROBLEMS, CONCERNS WHICH HAS BEEN INCREASED IN RECENT MONTHS TO SUCH AN EXTENT THAT IT CAN BE SAID WITHOUT RESERVE ONE OF THE MAIN PROBLEMS OF NATIONAL POLITICS TODAY

IN ORDER TO DO THIS, A DETERMINATION OF THE GENERIC POWERS OF THE STATE ADMINISTRATION ESTABLISHED IN THE LAWS IN FORCE AND, IN GENERAL, IN THE CONSTITUTION, IS NECESSARY.

IN EFFECT, THE TITLE VIII OF THE CONSTITUTION DISTRIBUTES THE POWERS AND PUBLIC FUNCTIONS AMONG THE VARIOUS TERITORIAL ENTITIES BY GRANTING TO THE MUNICIPALITIES, PROVINCES AND AUTONOMOUS COMMUNITIES THE AUTONOMY NECESSARY FOR THE MANAGEMENT OF THEIR RESPECTIVE INTERESTS. THIS IMPLIES THAT THE "CRITERION OF INTEREST" CONSTITUTES THE PRIMARY AND BASIC CRITERION TO BE TAKEN INTO ACCOUNT IN THE ALLOCATION OF POWERS TO ALL TERRITORIAL AUTHORITIES AND IN THIS SENSE THE PRINCIPLE IS CONTAINED IN ARTICLE ONE HUNDRED AND THIRTY-SEVEN OF THE CONSTITUTION AS THE FIRST AND FUNDAMENTAL REGULATORY NORM OF THE TERRITORIAL ORGANIZATION OF THE STATE. ALL THIS APPEARS TO MEAN THAT THE ADMINISTRATION OF THE STATE IS RESPONSIBLE FOR THE MANAGEMENT OF THE PUBLIC INTEREST IN ALL CASES WHERE THE PUBLIC INTEREST IS, BY ITS VERY NATURE, BEYOND THE SCOPE OF THE RESPECTIVE BODIES. MANAGERS OF THE TERRITORIAL AUTHORITIES, AS IS THE CASE IN CERTAIN AREAS RELATING TO HEALTH

MOREOVER, ARTICLE ONE HUNDRED AND THIRTY-EIGHT OF THE CONSTITUTION ENTRUSTS THE STATE WITH THE TASK OF ENSURING A BALANCE BETWEEN THE VARIOUS PARTS OF THE SPANISH TERRITORY, BEING A GUARANTOR OF THE UNITY OF THE MARKET AND THAT IT DOES NOT PRODUCE ECONOMIC OR SOCIAL DISCRIMINATION IN THE DIFFERENT TERRITORIES

BUT WITH INDEPENDENCE FROM THE BASIC CRITERIA OF NATIONAL INTEREST AND SOLIDARITY, THE ARTICLE ONE HUNDRED AND FORTY-NINE OF THE CONSTITUTION ITSELF ATTRIBUTES THE STATE AS EXCLUSIVE COMPETENCE TO THE ESTABLISHMENT OF THE BASES OF THE HEALTH SYSTEM, WHOSE MATERIAL DETERMINATION HAS BEEN HIGHLIGHTED BY THE CONSTITUTIONAL COURT, AS WELL AS THE GENERAL COORDINATION OF HEALTH, EXTERNAL HEALTH, REGULATIONS ON PHARMACEUTICAL PRODUCTS, BASIC STANDARDS OF PROTECTION OF THE ENVIRONMENT AND STATISTICS FOR STATE PURPOSES

ALL THIS NORMATIVE SET NEEDS TO BE CONCRETIZED SINGULARLY THE KNEECAP UNDER THE CONCEPT "GENERAL COORDINATION OF THE HEALTH" AND THE "HIGH INSPECTION", DETERMINATION THAT IS PERMANENTLY DEMANDED BY THE AUTHORITIES HEALTH OF THE STATE AND THOSE OF THE AUTONOMOUS ENTITIES, AS WELL AS THE PRIVATE COMPANIES THAT REQUIRE ACTION BY THE PUBLIC ADMINISTRATION

BECAUSE OF THE GENERAL COORDINATION OF HEALTH AS A FUNCTION OF THE STATE, IT SHOULD BE EMPHASIZED THAT IT IS NOT THAT THE CONSTITUTION ORDERS THE NATIONAL HEALTH AND THE CORRESPONDING TO THE OTHER PUBLIC ADMINISTRATIONS TO ACT IN COORDINATION, AN ATTITUDE AND AN OBLIGATION OF THE OTHER IMPLICIT AND LOGICAL, BUT IT IS THE STATE, AS A PUBLIC POWER OF HIGHER ORDER, THE GUARANTOR THAT THE NATIONAL HEALTH SYSTEM WORKS IN A HARMONIOUS AND COHERENT WAY. THIS IS THE REASON WHY THIS COMPETENCE IS ATTRIBUTED TO THE STATE EXCLUSIVELY AND THAT IT MATERIALIZES EITHER IN THE PRODUCTION OF GENERAL RULES OR IN THE EXECUTION OF CERTAIN ACTS WHICH ARE NOT SUBJECT TO GENERAL BUT ESSENTIAL GUIDELINES FOR THE NATIONAL HEALTH SYSTEM WORKS IN COORDINATION. IN THIS SENSE, THE ARTICLE ESTABLISHES THE FUNCTIONS THAT ARE CONSIDERED ESSENTIAL IN ORDER TO AVOID A MISMATCH IN THE NATIONAL HEALTH SYSTEM.

AS REGARDS THE HIGH INSPECTION, THE POTESTADES OF THE SAME AS WELL AS ITS FUNCTIONAL SCOPE ARE INDICATED FROM THE ASSUMPTION THAT DIRECT AND ORDINARY INSPECTION MUST CORRESPOND TO THE TERRITORIAL ENTITIES OF LOWER SCOPE

FROM ANOTHER POINT OF VIEW, IT IS IMPORTANT TO CREATE THE NECESSARY ADVISORY AND ADVISORY INSTRUMENT IN THE ROLE OF GENERAL COORDINATION OF THE SYSTEM IN THE FIELD OF PUBLIC HEALTH, WITH WHICH THE GOVERNMENT ALSO PROVIDES THE CONTENT OF THE PROPOSAL OF NO LAW ADOPTED ON 17 SEPTEMBER BY THE CONGRESS OF THE DEPUTIES, SINGULARLY THE NINTH AND TENTH MEASURES

FINALLY, IT IS WORTH NOTING THAT THIS WORK OF FUNCTIONAL CONCRETION HAS BEEN CARRIED OUT WITH THE AUDIENCE AND THE PARTICIPATION OF THE HEALTH AUTHORITIES OF THE AUTONOMOUS ENTITIES

IN ITS VIRTUE, ON THE PROPOSAL OF THE MINISTERS OF AGRICULTURE AND FISHERIES AND OF WORK, HEALTH AND SOCIAL SECURITY, IN AGREEMENT WITH THE COUNCIL OF STATE AND AFTER DELIBERATION OF THE COUNCIL OF MINISTERS AT ITS MEETING OF THE TWENTY-SEVEN DAY OF NOVEMBER OF A THOUSAND NINE HUNDRED AND EIGHTY-ONE, I HAVE:

ARTICLE FIRST. THE STATE ADMINISTRATION, THROUGH THE MINISTRIES OF AGRICULTURE AND FISHERIES AND LABOR, HEALTH AND SOCIAL SECURITY, EXERCISES THE HEALTH FUNCTIONS OF GENERAL INTEREST FOR THE WHOLE OF THE SPANISH COMMUNITY BEYOND THE SCOPE OF ACTION OF THE OTHER PUBLIC HEALTH ADMINISTRATIONS, THE GENERAL COORDINATION OF THE HEALTH, THE EXTERNAL HEALTH AND THE HIGH INSPECTION OF THE HEALTH SERVICES OF THE AUTONOMOUS COMMUNITIES, CORPORATIONS OR ENTATIONS

ARTICLE SECOND. IN THE EXERCISE OF THE FUNCTIONS THAT BY ITS NATURE MUST BE MANAGED AT NATIONAL LEVEL AND THOSE OF THE COORDINATION OF THE NATIONAL HEALTH SYSTEM, THE HEALTH ADMINISTRATION OF THE STATE WILL DEVELOP THE FOLLOWING PERFORMANCES:

ONE. THE DETERMINATION, IN GENERAL TERMS, OF THE METHODS OF ANALYSIS AND MEASUREMENT AND OF THE TECHNICAL REQUIREMENTS AND MINIMUM CONDITIONS FOR THE HEALTH CONTROL OF THE ENVIRONMENT

TWO. THE DETERMINATION OF THE HEALTH REQUIREMENTS OF THE TECHNICAL-HEALTH REGULATIONS OF FOOD, SERVICES OR PRODUCTS DIRECTLY OR INDIRECTLY RELATED TO HUMAN USE AND CONSUMPTION

THREE. THE GENERAL HEALTH RECORD OF FOOD AND OF THE INDUSTRIES, ESTABLISHMENTS OR FACILITIES THAT PRODUCE, PRODUCE OR IMPORT THEM, WHICH SHALL COLLECT THE AUTHORIZATIONS AND COMMUNICATIONS OF THE COMMUNITIES ATUTONOMAS AND PRE-AUTONOMIC ENTITIES

FOUR. THE AUTHORISATION FOR THE HEALTH PURPOSES OF ADDITIVES AND OTHER PRODUCTS WHICH, DUE TO THEIR SPECIAL CHARACTERISTICS, REQUIRE CONTROL AT NATIONAL LEVEL. FOR THIS PURPOSE AND SUBJECT TO THE REPORT OF THE COORDINATION AND HEALTH PLANNING COUNCIL, THE COUNCIL OF MINISTERS SHALL BE DETERMINED

FIVE. THE AUTHORIZATION, REGISTRATION, CONTROL AND INSPECTION, IN ACCORDANCE WITH THE PROVISIONS IN FORCE AND IN INTERNATIONAL TREATIES RATIFIED BY SPAIN, OF DRUGS, NARCOTIC DRUGS, PSYCHOTROPIC OR SIMILAR, SPECIALTIES PHARMACEUTICAL AND ITS RAW MATERIALS, AND OTHER PRODUCTS SUBJECT TO PHARMACEUTICAL, PLANT HEALTH AND ANIMAL HEALTH RECORDS AND, IN GENERAL, MEDICAL, THERAPEUTIC OR MEDICAL EQUIPMENT OR INSTRUMENTS, AS WELL AS LABORATORIES, CENTRES OR ESTABLISHMENTS WHICH DO SO PRODUCE, PRODUCE OR IMPORT, WITHOUT PREJUDICE TO THE CONTROL AND INSPECTION FUNCTIONS TECHNIQUE WHICH, ON ITS DISTRIBUTION, SUPPLY AND CONSUMPTION, IS RESPONSIBLE FOR THE OTHER PUBLIC ADMINISTRATIONS AND HEALTH SERVICES OF THEIR COORDINATION AND MUST COLLABORATE IN THESE MATTERS

SEIS. THE GENERAL DETERMINATION OF THE TECHNICAL REQUIREMENTS AND MINIMUM CONDITIONS FOR APPROVAL, APPROVAL, APPROVAL, REVIEW OR EVALUATION OF THE FACILITIES, EQUIPMENT, STRUCTURE, ORGANISATION AND OPERATING ARRANGEMENTS OF THE HEALTH CENTRES, SERVICES, ACTIVITIES OR ESTABLISHMENTS

SIETE. THE ACCREDITATION, APPROVAL AND APPROVAL OF CENTRES OR SERVICES, IN ACCORDANCE WITH THE PROVISIONS OF LAW TREINT/MIL NINE HUNDRED AND SEVENTY-NINE, OF TWENTY-SEVEN OCTOBER, ON THE EXTRACTION AND TRANSPLANTATION OF ORGANS AND PROVISIONS IMPLEMENTING IT WITH THE COLLABORATION OF THE OTHER PUBLIC HEALTH ADMINISTRATIONS IN THE CORRESPONDING PROCESS

EIGHT. THE CATALOGUE AND GENERAL REGISTER OF HEALTH CENTRES, SERVICES AND ESTABLISHMENTS

NUEVE. THE APPROVAL OF TRAINING, TRAINING AND SPECIALISATION PROGRAMMES FOR HEALTH PERSONNEL

DIEZ. THE ESTABLISHMENT OF THE GENERAL CRITERIA FOR THE DETERMINATION OF THE HEALTH SERVICES ' JOBS, WITH REFERENCE TO THEIR DIFFERENT LEVELS, REQUIRED QUALIFICATIONS AND OTHER REQUIREMENTS AND CONDITIONS FOR THEIR PROVISION, TO END OF ENSURING THE HOMOGENEITY OF THE HEALTH SYSTEM, EQUAL OPPORTUNITIES AND THE FREE MOVEMENT OF HEALTHCARE PROFESSIONALS WITHOUT HINDRANCE OR DISCRIMINATION

ONCE. THE EPIDEMIOLOGICAL OR EPIZOOTIOLOGICAL SURVEILLANCE AND ANALYSIS SERVICES OF THE PROCESSES OR PESTS OF NATIONAL INTEREST AS WELL AS THE COORDINATION OF THE COMPETENT SERVICES OF THE DIFFERENT PUBLIC HEALTH ADMINISTRATIONS

DOCE. THE ESTABLISHMENT OF HEALTH INFORMATION SYSTEMS AND THE PERFORMANCE OF HEALTH STATISTICS OF NATIONAL INTEREST

TRECE. COORDINATION OF ACTIONS TO PREVENT OR PROSECUTE ALL FORMS OF FRAUD, ABUSE, CORRUPTION OR DIVERSION OF HEALTH SERVICES OR SERVICES FROM THE PUBLIC SECTOR

FOURTEEN. THE ELABORATION OF GENERAL REPORTS ON THE HEALTH OR CARE SITUATION

QUINCE. GENERAL HEALTH PLANNING, WHICH WILL INCLUDE:

(A) THE ESTABLISHMENT OF GENERAL INDICES OR CRITERIA FOR ASSESSING THE NEEDS OF HEALTH PERSONNEL, CENTRES OR SERVICES, THE DEFINITIVE INVENTORY OF INSTITUTIONAL AND HEALTH PERSONNEL RESOURCES AND HEALTH MAPS NATIONAL

B) THE DETERMINATION OF COMMON GOALS OR OBJECTIVES IN THE FIELD OF PREVENTION, PROTECTION AND PROMOTION AND HEALTH CARE

C) MEASURES OR PRIORITIES TO ACHIEVE A COHERENT, HARMONIOUS AND SUPPORTIVE HEALTHCARE SYSTEM

D) THE GENERAL CRITERIA FOR EVALUATING THE EFFECTIVENESS AND PERFORMANCE OF HEALTH PROGRAMMES, CENTRES OR SERVICES

ARTICLE THIRD. THE HEALTH ADMINISTRATION OF THE STATE SHALL CARRY OUT THE HEALTH SERVICES OF PORTS, BORDERS AND AIRPORTS AND SHALL CARRY OUT ALL KINDS OF INSPECTIONS, AUTHORIZATIONS, MEASURES, CONTROLS OR CERTIFICATES HEALTH RELATED TO THE IMPORT, EXPORT OR TRANSIT OF GOODS OR TRANSIT OF PERSONS BY BORDER OR CUSTOMS

ALSO, ACCORDING TO AND IN COLLABORATION WITH THE RELEVANT SERVICES OF THE MINISTRY OF FOREIGN AFFAIRS, IT SHALL MAINTAIN APPROPRIATE RELATIONS AND COMMUNICATIONS WITH INTERNATIONAL HEALTH AGENCIES AND, IN GENERAL, THE FOLLOWING: INTERNATIONAL HEALTH RELATIONS

ARTICLE FOURTH. -ONE. THE MAIN PURPOSE OF THE HIGH HEALTH INSPECTION IS TO MONITOR THE EFFECTIVENESS AND PERFORMANCE OF HEALTH SERVICES AND SERVICES AND TO ENSURE THE RIGHT TO HEALTH PROTECTION AND HEALTH CARE, IN ACCORDANCE WITH THE ESTABLISHED IN THE CONSTITUTION AND IN THE LAWS

TWO. ARE ACTIVITIES OF THE HIGH INSPECTION:

(A) MONITOR THE ADEQUACY OF HEALTH PLANS AND PROGRAMMES OF THE AUTONOMOUS COMMUNITIES AND OTHER PUBLIC ADMINISTRATIONS WITH GENERAL HEALTH PLANNING

B) ASSESS THE FULFILMENT OF COMMON OBJECTIVES AND OBJECTIVES AND IDENTIFY ANY DIFFICULTIES OR DEFICIENCIES, GENERIC OR STRUCTURAL, WHICH PREVENT THE FUNCTIONING OF A COHERENT, HARMONIOUS AND/OR A COHERENT HEALTH SYSTEM FROM BEING ACHIEVED OR DISTORTED. SOLIDARITY

C) TO ANALYSE THE LEVEL, EXTENT AND QUALITY OF HEALTH BENEFITS AND SERVICES REQUIRED, IN GENERAL, BY HEALTH AND SOCIAL PROVISIONS

D) MONITOR THE USE, DESTINATION, AND USE OF STATE OR SOCIAL SECURITY GRANTS THAT HAVE A PARTICULAR DESTINATION OR PURPOSE

(E) TO SUPERVISE THE CHARITY ' S MEMBERSHIP OF THE INSTITUTIONS, SERVICES OR ESTABLISHMENTS TRANSFERRED FOR THAT PURPOSE, WITHOUT PREJUDICE TO ANY REORGANISATIONS WHICH AGREE OR ARE ABLE TO AGREE CORRESPONDING AUTONOMOUS COMMUNITIES OR PRE-REGIONAL ENTITIES

F) TO PREVENT ANY FORM OF DISCRIMINATION IN THE SYSTEMS OF ADMISSION AND THE PROVISION OF HEALTH SERVICES AS WELL AS IN THE SYSTEMS OR PROCEDURES FOR THE SELECTION AND PROVISION OF THEIR JOBS

G) TO ENSURE THAT THE EXERCISE OF POWERS IN THE FIELD OF HEALTH IS IN ACCORDANCE WITH THE CRITERIA FOR THE DEMOCRATIC PARTICIPATION OF ALL STAKEHOLDERS, AS WELL AS THE TRADE UNIONS OF WORKERS AND BUSINESS PARTNERS, IN THE TERMS ESTABLISHED BY LAW

H) AND, IN GENERAL, TO ENSURE COMPLIANCE WITH THE POWERS CONFERRED UPON THE STATE IN THE FIELD OF HEALTH, OBSERVANCE OF CONSTITUTIONAL PRINCIPLES AND NORMS, AND OF LAWS AND OTHER GENERAL PROVISIONS IMPLEMENTING ARTICLE FORTY-THREE AND CONCORDANT OF THE CONSTITUTION

THREE. IN THE EXERCISE OF THE DUTIES OF HIGH INSPECTION, OFFICIALS OF THE STATE ADMINISTRATION SHALL ENJOY THE CONSIDERATION OF PUBLIC AUTHORITY FOR ALL PURPOSES, AND IN THEIR ACTIONS, WHICH SHALL BE OF THEIR OWN MOTION OR AT THE REQUEST OF A PARTY, MAY OF THE AUTHORITIES OF THE STATE AND OF THE ORGANS OF THE AUTONOMOUS COMMUNITY THE COLLABORATION NECESSARY FOR THE PERFORMANCE OF THE FUNCTIONS THAT ARE LEGALLY ENTRUSTED TO THEM

FOUR. THE ACTIONS OF THE HIGH INSPECTION WILL BE CARRIED OUT IN REPORTS AND MINUTES, BEING ABLE TO BE OF CONFORMITY OR OF INFRACTION OF THE LEGISLATION OF THE STATE. IF THEY ARE OF INFRACTION THEY WILL BE REFERRED TO THE GENERAL DELEGATE OF THE GOVERNMENT IN THE AUTONOMOUS COMMUNITY, WHO WILL GIVE TO THE COMPETENT ORGANS OF THE AUTONOMOUS COMMUNITY

FIVE. WHERE THE TRANSFER IS MADE BY THE AUTHORITIES OF THE STATE OF KNOWLEDGE THAT THE SITUATION WHICH HAS RESULTED IN AN ACT OF INFRINGEMENT PERSISTS, THEY MAY FORMALLY REQUEST THE COMPETENT AUTHORITY OF THE AUTONOMOUS COMMUNITY TO ADOPT SUCH A MEASURE. THE PRECISE MEASURES IN ORDER TO CORRECT THE INFRINGEMENT AND IMPOSE, WHERE APPROPRIATE, THE CORRESPONDING PENALTY. THE HEALTH ADMINISTRATION OF THE STATE MAY, IN ADDITION, TAKE THE MEASURES IT DEEMS NECESSARY TO PROTECT PUBLIC HEALTH, AS WELL AS ANIMAL AND PLANT HEALTH IN THE FACE OF ANY PROBLEMS OR PROCESSES THAT MAY HAVE AN IMPACT AT NATIONAL LEVEL

ARTICLE QUINTO. -ONE. THE HEALTH PLANNING AND COORDINATION COUNCIL IS THE HIGHEST COLLEGIATE BODY FOR INFORMATION AND ADVICE ON HEALTH PLANNING AND COORDINATION, IN THE RELEVANT AREAS OF THE MINISTRY OF LABOUR, HEALTH AND SOCIAL SECURITY, COUNCIL SHALL HAVE THE FOLLOWING TASKS AND FUNCTIONS:

A) FACILITATING INFORMATION AND LIAISON BETWEEN THE HEALTH AND CARE SERVICES OF DIFFERENT PUBLIC ADMINISTRATIONS

B) ISSUING REPORTS AND OPINIONS ON ISSUES OF A GENERAL NATURE, RELATING TO THE PREVENTION OF DISEASES, THE PROTECTION AND PROMOTION OF HEALTH, HEALTH CARE AND THE ORGANISATION, OPERATION AND EVALUATION OF HEALTH SERVICES

C) ISSUING REPORTS AND OPINIONS ON SPECIFIC ISSUES, RELATED TO THESE MATTERS, WHICH ARE SUBJECT TO THEIR CONSIDERATION BY COUNCIL MEMBERS

D) PROMOTE COORDINATION OF ALL HEALTH SERVICES AND ACTIVITIES

E) AND APPROVE GENERAL HEALTH AND CARE STATUS REPORTS

THE REPORT OF THE COORDINATION AND HEALTH PLANNING COUNCIL SHALL BE REQUIRED IN THE CASES REFERRED TO IN ARTICLE 2 (6), (10), (12) AND (15)

TWO. THE HEALTH PLANNING AND COORDINATION COUNCIL SHALL BE CHAIRED BY THE SECRETARY OF STATE FOR HEALTH AND SHALL BE COMPOSED OF:

-THE SECRETARY-GENERAL OF THE MINISTRY OF LABOUR, HEALTH AND SOCIAL SECURITY AND THE HEADS OF STATE SECRETARIAT FOR HEALTH

-THE DIRECTOR GENERAL OF THE NATIONAL INSTITUTE OF HEALTH

-A VOCAL DESIGNATED BY EACH OF THE DEPARTMENTS OF DEFENSE, EDUCATION AND SCIENCE, AGRICULTURE AND FISHERIES, INDUSTRY AND ENERGY AND TERRITORIAL ADMINISTRATION

-A REPRESENTATIVE OF EACH OF THE AUTONOMOUS COMMUNITIES AND PRE-AUTONOMIC ENTITIES
