Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of the agricultural markets and laying down specific provisions for certain agricultural products (Regulation (EC) No 1234/2007) Article 61 (b) provides that the sugar produced in a given marketing year in excess of the production quota referred to in Article 56 may be transferred to the quota production of the following marketing year, as provided for in Article 63.

Article 63 (2) of that Regulation provides that undertakings which take the decision to carry out such a transfer shall communicate to the Member State, before a date to be fixed by the Member State, between 1 February and 15 April of the current marketing year, the quantities of sugar to be moved.

Royal Decree 461/2002 of 24 May 2002 laying down certain aspects of the Community rules in the sugar sector, in Article 14 (e) of the Treaty, provides that the sugar undertakings to be transferred sugar, the production of which has been previously established, must communicate the transfer decision before 15 April for the production of beet sugar.

On the other hand, Commission Implementing Regulation (EU) No 319/2013 of 8 April 2013 providing for an exemption from the marketing year 2012/2013 to the provisions of Article 63 (2) (a) of the Treaty on the European Union (OJ L 31, 28.2.2013, p. (a) Council Regulation (EC) No 1234/2007, as regards the dates for the communication of the transfer of surplus sugar, lays down in Article 1 that, in the marketing year 2012/2013, the undertakings which decide to relocate quantities of sugar as provided for in Article 63 (1) of Regulation (EC) No 1234/2007, inform the Member State concerned before a date to be fixed by that Member State between 1 February and 15 August 2013.

It is therefore necessary to amend the deadline for the sugar companies to report to the Ministry of Agriculture, Food and the Environment, the transfer of the quantities of sugar that exceed their quota in the marketing year. In order to take account of the sugar beet production of the summer marketing year and to make it easier for companies to react to the unforeseen changes in demand in the last months of the year, the following marketing year will be available for the following marketing year: campaign.

This Order is issued under the provisions of the final provision of Royal Decree 461/2002.

In its virtue, I resolve:

Single item. Amendment of Article 14 of Royal Decree 461/2002 of 24 May 2002 on certain aspects of Community legislation in the sugar sector.

The e) is modified as follows:

" e) That the company communicates the decision of the shipment before April 15 for the production of beet sugar and June 20 for the production of cane sugar. In the case of companies producing cane and beet sugar, the communication of the shipment, between 15 April and 20 June, may not be carried out by a quantity of cane sugar higher than that produced in the marketing year. However, for the 2012/2013 marketing year, the communication of the decision on the transfer of beet sugar production by the undertakings shall be made before 15 August 2013. '

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette" and shall apply from 1 October 2012.
