Undersigned agreement of management between the Institute for the Restructuring of Coal Mining and Alternative Development of the Mining Comarcas and the General Secretariat of Industry, Energy and Tourism for the processing by the Subdirectorate General of Resources, Claims and Relations with the Administration of Justice of the Ministry of Industry, Energy and Tourism, of the resources to be brought against the acts dictated by the organs of that, as well as the complaints before the civil court, of the review files of the administrative acts and declarations of lesivity and in compliance with the provisions of Article 15 (3) of Law No 30/1992 of 26 November 1992 of the Legal Regime of Public Administrations and of the Common Administrative Procedure, the publication in the "Official Gazette of the State" of the said agreement, which is annexed to this resolution.

ANNEX

Agreement on management between the Institute for the Restructuring of Coal Mining and Alternative Development of the Mining Comarcas and the Technical General Secretariat of the Ministry of Industry, Energy and Tourism

On the one hand, Mr. Alberto Nadal Belda, in his capacity as President of the Institute for the Restructuring of Coal Mining and Alternative Development of the Mining Comarcas (hereinafter IRMC), an autonomous body attached to the Ministry of Industry, Energy and Tourism, representing it under the powers conferred on the President by Royal Decree 492/1998 of 27 March, approving the Statute of the Institute.

And from another, Mr. José María Jóver Gómez-Ferrer, Technical Secretary General of the Ministry of Industry, Energy and Tourism, appointed by Royal Decree 2010/2011, of December 30, to whom the functions indicated in the Article 8 (1) (i) and (j) of Royal Decree 344/2012 of 10 February 2012 on the organic structure of the Ministry of Industry, Energy and Tourism.

EXPOSE

The Institute for the Restructuring of Coal Mining and Alternative Development of the Mining Comarcas, is an autonomous agency attached to the Ministry of Industry, Energy and Tourism that currently lacks the personal and material resources necessary to proceed with the processing of the administrative resources which are brought against the decisions which the governing bodies have in effect.

For its part, the General Secretariat of the Ministry of Industry, Energy and Tourism, through the Subdirectorate General of Resources, Claims and Relations with the Administration of Justice, has the following functions:

The study of administrative resources, their processing and the elaboration of the motions for resolutions, as well as the complaints before the civil judicial process, of the dossiers for review of administrative acts and statements of lesivity.

Relations with the courts and courts of justice, for the purposes of the referral of the files and documentation they request, the receipt of their notifications and, where appropriate, preparation of the execution of their sentences.

The department's management body is therefore specialized in this field.

Therefore, pursuant to Article 15 of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure, and on the basis of the principle of collaboration and cooperation to preside over the actions of the public administrations bodies, agree the following

MANAGEMENT TASK

1. The Institute for the Restructuring of Coal Mining and Alternative Development of the Mining Comarcas, entrusts to the General Secretariat of Industry, Energy and Tourism, which will act through the Subdirectorate General of Resources, Complaints and Relations with the Administration of Justice, the following material actions:

The study of administrative resources, their processing and the elaboration of the motions for resolutions, as well as the complaints before the civil judicial process, of the dossiers for review of administrative acts and statements of lesivity.

Relations with the courts and courts of justice, for the purposes of the referral of the files and documentation they request, the receipt of their notifications and, where appropriate, preparation of the execution of their sentences.

2. The discharge is extended to all acts which must be carried out for the purposes of processing the administrative procedures referred to above. Therefore, as soon as the corresponding letter of the interested parties is received in the autonomous body, it should be sent to the Subdirectorate General of Resources, Claims and Relations with the Administration of Justice of the Technical General Secretariat. of the Ministry of Industry, Energy and Tourism, for its proper handling.

3. 4. The term of validity of this mandate shall be four years, being effective from its publication in the "Official Gazette of the State".
