To all who present it and understand,

Sabed: That the General Courts have approved and I come to sanction the following Law:

The government program has as one of the objectives of priority action the reform of the Public Administration. Within it, the reform of the Civil Service legislation is one of its basic aspects.

The government believes that the horizon of any change in the civil service legislation must be established by the bases of the Statue of Public Officials, which, under the development of Article 149.1.18 of the Constitution, is need to dictate. These bases, which refer to all the officials of all the Public Administrations, will constitute the new framework of the Civil Service arising from our Constitution. The Government intends without delay to address its elaboration and sent to the Chambers.

Nevertheless, the construction of the State of the Autonomies, on the one hand, and the very obsolescence of many of the rules governing our Civil Service, dictated nearly twenty years ago, are binding, even if they are not in part, the reform of the functionarial regime and, consequently, give a basis to some of the precepts contained in this Law that is now being presented. They have these precepts, necessarily, provisional character, until the constitutional mandate is fully developed.

The main objective of this Law is, therefore, to remove the obstacles that old legislation, prior to the Constitution, opposes to the development of the Autonomous State.

This law addresses an in-depth reform of the competence of personnel, clearly stating that the government will be the one that will effectively decide the policy of personnel and, in particular, in a specifically novel aspect, which is the negotiation of the conditions of employment of civil servants.

Congruent with this purpose must be interpreted the organic dependency of the staff to the service of the State Administration of a single ministerial department that is established, in this Law for the first time in the history of the Spanish Public Administration.

Likewise, the scope of this Law makes special reference to the so-called civil servants in the service of the Military Administration, who are integrated into the respective Civil Administration Corps. Status.

The regulation of the Superior Council of the Civil Service, as an organ of participation and meeting between all the Public Administrations and the authentic representation of the staff, configures another significant aspect of this Law; also addressing, with the regulation of the Commission for the Coordination of the Civil Service, the complex, but solvable, problem of the coordination of personnel policies of the Central Administration and the Autonomous Communities.

It is, on the other hand, in a realistic way, the problem of the administrative race, authorizing the government to deeply reform our Civil Service, its Bodies and Escalas, allowing its suppression, unification or amending and ordering the completion of the precise studies for the classification of the posts, the basis on which the authentic administrative career must be articulated.

The Law therefore modifies the current system of remuneration, clearly establishing an important primacy for those who are linked to the performance of the job.

Streamlining the structure of Public Administration Corps and Escalations is a necessary means of achieving the goal of bringing the Administration closer to the citizens. The unification of the Corps and Escalas, in addition to making it possible to better deploy the job opportunities of the officials, will improve the efficiency of the administration in the service of the general interest of the society. Therefore, without prejudice to what is provided for in Article 27, the additional provisions of this Law introduce important changes, both as regards the State Administration, and the Institutional Administration and the to that of Social Security. There is also a profound change in the structure of non-university teaching bodies, with the establishment of the Teachers 'and Secondary Teachers' Bodies. Finally, and as a result of this legal effort to adapt our Civil Service to the rules in force in the countries of our environment, the forced retirement of all civil servants is available at the age of sixty-five years. establishing a progressive timetable for its final implementation.

Article one. Scope of application.

1. The measures of this Law are applicable:

(a) To the staff of the Civil Administration of the State and its Autonomous Bodies.

b) Civilian personnel serving the Military Administration and its Autonomous Bodies.

c) Staff of the Administration of Social Security.

2. Specific rules may be introduced in application of this Law to bring it into line with the peculiarities of teaching and research staff, health care, postal and telecommunications services and staff posted abroad.

3. The following precepts are considered to be the basis of the statutory regime of civil servants, issued under Article 149.1.18 of the Constitution, and consequently applicable to the staff of all public

:

Articles: 3. º, 2, e) and f); 6. º; 7. º; 8. º; 11; 12; 13, 2, 3 and 4; 14, 4 and 5; 16; 17; 18; 19, 1 and 3, 20, 21, 1, a), b), c), e) and f) and 2; 22, 1; 23; 24; 25; 26; 29; 31; 32; 33; additional provisions third, 2 and 3; fourth, Twelfth and fifteenth; transitional provisions second, eighth and ninth.

4. Provided that this Law refers to personnel at the service of the State Administration, it is to be understood as the personnel specified in paragraph 1 of this article.

5. This Law has an additional character for all staff at the service of the State and Public Administrations not included in its scope.

Article two. Organic dependency.

All staff at the service of the State Administration referred to in the previous article, its Bodies, Escalas, Categories and Classes, shall have organic dependence on the Ministry of the Presidency, without prejudice to the functionally have with each department.

CHAPTER I

Higher Organs of the Civil Service

Article three. The Government.

1. The Government directs personnel policy and exercises the executive function and regulatory authority in matters of public function of the State Administration.

2. It is in particular the Government's responsibility:

(a) Establish the guidelines under which the various organs of the State Administration shall exercise their competence in personnel matters.

(b) Determine the instructions to which the representatives of the State Administration must comply when negotiating with the trade union representation of the public servants of their employment conditions, as well as to give validity and effectiveness to the agreements reached through their express and formal approval, laying down the conditions of employment for cases where no agreement is reached in the negotiations.

c) Establish the instructions to be followed by the representation of the State Administration in collective bargaining with personnel subject to employment law.

d) To set annually the rules and guidelines for the application of the remuneration regime of public and personal officials to the service of the State Administration.

e) Approve, after deliberation by the Superior Council of the Civil Service, the criteria for coordinating the programming of the needs of staff in the medium and long term of the Public Administrations.

f) Approve, after deliberation by the Superior Council of the Civil Service, the criteria for the coordination of the plans for the offer of employment of the Public Administrations.

g) Approve the job offer of the State Administration.

h) Approve the structure in degrees of the staff of the State Administration, the intervals of job levels assigned to each Body or Scale and the general criteria of professional promotion of the officials public.

i) The exercise of the other competencies that are legally attributed to you.

Article four. The Minister of the Presidency.

1. Without prejudice to the other functions conferred upon it by the Laws, the Minister of the Presidency shall be responsible for the general development, coordination and monitoring of the implementation of the Government's policy on personnel at the service of the State administration.

2. It is in particular the Minister of the Presidency:

(a) Propose to the Government the draft Law of Bases of the Statue of Public Officials and other draft rules of general application to the Civil Service. In the case of regulatory projects concerning officials subject to special or special arrangements, the proposal shall be at the initiative of the competent Ministry.

b) Promote, coordinate and, where appropriate, establish and implement plans, measures and activities aimed at improving performance in the service, training and promotion of staff at the service of the State Administration.

c) Care for compliance by the organs of the State Administration of the rules of general application in the field of personnel and ensure compliance with the other Public Administrations of the Laws or provisions state that they are directly applicable to them.

d) to exercise the other powers conferred upon it by the legislation in force.

Article five. The Minister of Economy and Finance.

It is up to the Minister of Economy and Finance to propose to the government, within the framework of the general economic and budgetary policy, the guidelines to be used to adjust the personnel costs of the State Administration. how to authorise any measure relating to staff likely to entail changes in expenditure.

Article six. The Superior Council of the Civil Service.

1. The Superior Council of the Civil Service is the highest collegiate body for the coordination and consultation of the Civil Service policy, as well as for the participation of the staff in the service of the Public Administrations.

2. In particular, it corresponds to the Higher Council of the Civil Service:

(a) Inform within two months the preliminary draft laws relating to the staff at the service of the Public Administrations when they are consulted by the Government or the Councils of Government of the Autonomous Communities.

b) Report within two months on those provisions or decisions relevant to personnel, which are consulted by the Government, the Governing Councils of the Autonomous Communities or the Corporations Local through their representatives.

(c) On a proposal from its constituents, to take cognizance, to discuss and, where appropriate, to recommend to the competent authorities the adoption of measures aimed at improving the organization, working conditions, performance and social consideration of the staff of the Public Administrations.

d) Discuss and propose, at the initiative of its components, the necessary measures for the coordination of personnel policies of the various Public Administrations, and, in particular, regarding Personnel Records, access systems, employment relationship, remuneration, approval of officials and offer of employment.

3. The contents of the deliberations and proposals of the Superior Council of the Civil Service, reflected in the corresponding minutes, will be raised to the consideration of the Government and the governing bodies of the other Public Administrations, without in no case have a binding character.

Article seven. Composition of the Superior Council of the Civil Service.

1. Member of the Higher Council of the Civil Service:

a) By the State Administration:

-The Minister of the Presidency, who will be the President of the Council.

-The Secretary of State for Public Administration, who will be the Vice President.

-The Secretary of State for Finance.

-The Undersecretaries of all Ministries.

-The Secretary-General of the Superior Council of the Civil Service, who will be appointed by Royal Decree with the category of Director-General.

(b) by the Autonomous Communities a representative of each of them, with the right to be represented in the member of the Governing Council who is in charge of the senior management of the staff.

c) By the Local Corporations seventeen representatives of the same, designated by the Federations of Existing Local Entities, in proportion to their respective representativeness.

d) By the staff of seventeen representatives appointed by the Trade Union Organizations, in proportion to their respective representativeness.

2. The Council shall establish its rules for organisation and operation.

Article eight. The Commission for the Coordination of the Civil Service.

1. The Commission for the Coordination of the Civil Service is the body responsible for coordinating the personnel policy of the State Administration and the Autonomous Communities, to form the public employment offer plan and to propose the measures that are precise to execute what is established on the basis of the statutory regime of civil servants.

2. Member of the Commission:

a) By the State Administration:

-The Secretary of State for Public Administration, who will chair the Commission.

-The Secretary of State for Finance, who will be your Vice President.

-The Director General of the Civil Service.

-The Director General of Personnel Expenses.

-The President of the National Institute of Public Administration.

-The General Controller of the State Administration.

-The Inspector General of Public Administration Services.

-The Director General of Budgets.

-Eight representatives of the State Administration, appointed by the Government at the proposal of the Minister of the Presidency.

-The Secretary-General.

(b) By the Autonomous Communities, the heads of the management bodies responsible for the administration of personnel.

3. Working groups of the Commission, chaired by the Secretary-General of the Council, may be set up to draw up proposals to be taken into account.

4. Under the immediate dependence of the Secretary-General, there will be a Technical Cabinet, to which officials belonging to the State Administration and the Autonomous Communities may be attached.

5. The Commission shall establish its rules for organisation and operation.

Article nine. The Higher Staff Commission.

The Superior Commission of Personnel is configured as a collegiate body of coordination, documentation and advice for the elaboration of personnel policy at the service of the State Administration. It shall exercise the powers and functions conferred on it by the legislation in force. The Government, by Royal Decree, will regulate its composition and functions.

Article ten. Government Delegates and Civil Governors.

Corresponds to Government Delegates in relation to personnel who have been assigned to peripheral services at regional level, and to civilian Governors in relation to personnel assigned to peripheral services the exercise of the powers conferred on the Undersecretaries and the Directors-General in relation to the staff of the peripheral services of the State Administration, its Autonomous Bodies and the Social security, without prejudice to the superior management of the departments ministerial.

CHAPTER II

Management of the Public Service of the Autonomous Communities and regulation of the situation of the transferred officials

Article 11. Management of the Civil Service of the Autonomous Communities.

the Autonomous Communities will proceed to order, through the Law of their respective Legislative Assemblies, their own Public Service. For these purposes, and after deliberation by the Superior Council of the Civil Service, they shall group their own officials in the Bodies, Escalas, Classes and Categories that proceed, respecting in any case the groups established in Article 25 of the Law.

Article twelve. Regulation of the situation of the officials transferred.

1. The officials transferred to the Autonomous Communities are fully integrated into the organisation of the Civil Service.

The Autonomous Communities when they proceed to this integration of the officials transferred as their own officials, will respect the group of the Body or Scale of provenance, as well as the economic rights inherent to the personal level that they have recognized.

Equality between all the officials of the Autonomous Communities is guaranteed, regardless of their Administration of origin.

2. The officials transferred are officials in the administrative situation of active duty in the Public Service of the Autonomous Community in which they are integrated.

In their Bodies or Stairs of origin, they remain in a special administrative situation of services in Autonomous Communities, which allows them to maintain their rights as if they were in active service, agreement with the provisions of the respective Statutes of Autonomy.

CHAPTER III

Staff records, programming, and public employment offerings

Article thirteen. The Personal Administrative Records.

1. In the Directorate-General of the Civil Service, there shall be a Central Register in which all staff shall be entered in the service of the State Administration, and in which all acts affecting the life of the staff shall be recorded. administrative of the same.

The Government, on the proposal of the Minister of the Presidency, will approve the regulatory norms of the Central Register and the program for its progressive implementation.

2. The Autonomous Communities and Local Entities will also constitute Personnel Records. Where the Local Authorities do not have sufficient financial or technical capacity, the Autonomous Communities, by themselves, or by delegation in the Provincial Diputations, the Cabildos or the Insular Councils, shall cooperate with the such Records.

3. All Personnel Records of all Public Administrations will be coordinated. The Government, on a proposal from the Minister of the Presidency, and after deliberation by the Superior Council of the Civil Service, shall regulate the minimum homogenizer contents of the Personnel Records and the requirements and procedure for their use. reciprocal.

4. In no case shall new remuneration be included in the payroll, without prior notification to the relevant Staff Register of the decision or act for which they were recognised.

5. No data relating to their race, religion or opinion shall be included in the individual documentation of the staff of the different Public Administrations.

The staff will have free access to their individual case.

Article fourteen. Budget allocations for staff.

1. The budgetary allocation of staff shall be distributed among the expenditure programmes of the different Management Centres in such a way as to ensure the necessary balance between the material and human resources allocated to each of them.

These affections will be previously reported by Commissions for the analysis of alternative spending programs, made up of representatives of the Ministry of Economy and Finance, the Ministry of the Presidency and the other Ministerial departments.

2. The expenditure programmes of the General Budget of the State shall include the cost of all the jobs allocated to each of them and each of the managing centres.

3. The templates of the different State Administration Corps and Scales, as well as those of the labor personnel, will be those that result from the credits established in the Budget Law.

4. The Autonomous Communities will determine in their respective Budget Laws the templates of all their staff.

5. The templates and jobs of all Local Administration staff will be fixed annually through your Budget.

Article 15. Relations of State Administration jobs.

1. The employment relations of the State Administration shall include, for each of them, in any event, the name and essential characteristics of the posts, the additional remuneration assigned to them and the requirements required for their performance. These requirements will be determined by the Ministry of the Presidency, on a proposal from the Ministries concerned, and those posts must be specified which, in the light of the nature of their content, are reserved for public officials.

2. The posts will be of indistinct affiliation for all the officials included in the scope of this Law. Only officials of a given Body or Scale may be assigned exclusively to officials of a given Body or Scale when such an assignment is necessarily derived from the nature and function to be performed in them and in that sense determines it the Government on a proposal from the Minister of the Presidency.

3. The relations of jobs will be public.

Article sixteen. Relations between the Autonomous Communities and the Local Government.

The Autonomous Communities and the Local Administration will also form the relationship of the existing jobs in their organization, which must include in any case the name and essential characteristics of the posts, the additional remuneration to them and the requirements for their performance. These positions will be public.

Article seventeen. Mobility of officials from different public administrations.

1. In order to achieve a better use of human resources, the positions of the State Administration and the Autonomous Communities may be covered by officials belonging to any of these Administrations. Public, in accordance with what the relations of jobs establish.

2. In addition, officials from the Local Administration will be able to fill jobs in other Local Corporations other than those of origin and in the Administration of its Autonomous Community.

Article eighteen. The offer of public employment.

Seats that cannot be covered by existing staff are the job offer of the State Administration.

Passed the State Budget Law, the Minister of the Presidency will propose to the Government for approval the annual offer of employment of personnel to the service of the State Administration.

The offer of employment shall necessarily contain all the places which are budgeted and which are vacant, shall also indicate which of them are to be provided for in the relevant financial year and temporary forecasts for the provision of the remaining ones.

The publication of the offer requires the competent bodies to proceed, within the first quarter of each calendar year, to the call for the selective access tests for the vacant places committed in the same and up to 10 per 100 additional. Such calls shall indicate the precise timing of the tests, which shall in any event be completed before 1 October of each year, without prejudice to the selective training courses to be established.

The Courts or the Selection Commissions may not approve or declare that they have exceeded the respective tests by a higher number of candidates for the seats convened. Any proposal for approval that contravene the above will be null and void.

Other Public Administrations shall develop and publicly propose their employment offers in accordance with the above criteria.

CHAPTER IV

Rules for objectifying the selection of staff, the provision of jobs and the professional promotion of civil servants

Article nineteen. Selection of staff.

1. The Public Administrations select their personnel, either official, already in work, according to their offer of public employment, by public notice and through the system of contest, opposition or free opposition in which they are ensure in any case the constitutional principles of equality, merit and capacity, as well as that of advertising.

The selection procedures will especially take care of the connection between the type of evidence to be overcome and the adequacy of the positions to be carried out, including the practical tests that may be carried out. precise.

In the calls for access to the civil service, the Public Administrations in the respective field of their competences should provide for the selection of duly trained officials to cover the jobs in Autonomous Communities which have two official languages.

2. The Government shall regulate the composition and functioning of the selection bodies, ensuring the specialisation of the members of the selective bodies and the agility of the selective process, without prejudice to their objectivity. In no case, and with the exception of the peculiarities of the teaching and research staff, the selection bodies may be made up mostly of officials belonging to the same Body to be selected.

3. It is up to the National Institute of Public Administration to coordinate, control and, where appropriate, to carry out the selection, training and improvement courses of the officials of the State Administration, as well as the functions of cooperation and cooperation with the centres which have assigned these powers in the other public administrations.

Article 20. Provision of jobs.

1. The posts assigned to officials shall be provided in accordance with the following procedures:

(a) Contest: It constitutes the normal system of provision, and in it only the merits required in the corresponding convocation will be taken into account only.

It will be considered as preferential merits as regulated by the assessment of the work carried out in the previous occupied posts, the courses of promotion and improvement in the Schools of Public administration, academic qualifications, if any, and seniority.

(b) Free designation with public notice: The posts to be determined in the employment relationship shall be covered by this system. For their provision, they must be announced in the "Bulletins" and "Official Diaries" by the competent authority to make the appointments. The call shall indicate the name, level and location of the post, as well as the minimum requirements required of the officials who aspire to perform them, and shall grant a period of not less than 15 days for the submission of applications.

Such requests shall be raised to the competent authority, which, after reporting by the Head of the Office, shall appoint within a maximum of one month and shall communicate it to the relevant Register of Personnel.

2. The Government, and in the field of its powers, the Councils of Government of the Autonomous Communities and the Plenary of the Local Corporations, shall determine the number of posts with their characteristics and remuneration, reserved for any possible staff, always within the budgetary appropriations entered into the effect.

The eventual staff will only perform functions expressly qualified as trust or special counsel and their appointment and cessation, which will be free, correspond exclusively to the Ministers and the Secretaries of State, and, in their the case, to the Government Directors of the Autonomous Communities and to the Presidents of the Local Corporations. The staff shall automatically cease when the authority to which it provides its function of trust or advice ceases.

3. In no case shall the performance of a job reserved for any possible personnel constitute merit for access to the public service or internal promotion.

Article twenty-one. Professional promotion.

1. The personal grade.

a) Jobs are classified into 30 levels.

(b) The Government and the Governing Bodies of the Autonomous Communities shall determine the intervals corresponding to each Body or Scale.

(c) Every official has a personal level that corresponds to any of the levels in which the positions are classified.

d) Personal grade is acquired by the performance of one or more corresponding level positions for two years continued or three with interruption. If, during the time the official performs a post, the level of the post is modified, the performance time shall be computed with the highest level at which the position would have been classified.

e) The acquisition and the changes of grade shall be entered in the Register of Personnel prior to recognition by the Deputy Secretary of the respective Department and analogous Organ of the other Public Administrations.

(f) The acquisition of the higher grades of the officials of the Corps and the Escalas of each group may also be carried out by means of the overcoming of training courses or other objective requirements, to be determined by the Government or, in the field of its powers, by the Governing Council of the Autonomous Communities and the Plenary of the Local Corporations.

2. The job level guarantee:

(a) No official may be designated for a lower job at more than two levels corresponding to his or her personal degree.

(b) No official may be appointed to perform a higher job at more than two levels to that of his or her personal degree.

c) As long as it is not designated to fill a vacancy under the conditions of the previous paragraph in the same locality, the official shall be made available to the Deputy Secretary, Director of the Autonomous Body, Government Delegate or Civil governor or similar bodies of the other Administrations, which shall attribute the provisional performance of lower level posts, as long as it corresponds to its Body or Scale. As long as he remains in such a situation, the official shall be entitled to the target supplement corresponding to a lower post at two levels to his or her personal level.

d) The Government or the governing bodies of the Autonomous Communities, after a report of the Superior Council of the Civil Service, shall establish the criteria for the calculation, for the purposes of consolidation of the personal level, of the time in that the officials remain in each case of the situation of the special services situation.

Article 22. Promotion of internal promotion.

1. The Public Administrations shall facilitate the internal promotion consisting of the promotion from the Corps or the Escalas of a group lower than the corresponding higher group. Officials shall have the required qualifications and meet the requirements and shall pass the tests which the Ministry of the Presidency or the competent body of the other public authorities shall establish for each case. For this type of promotion, up to 50 per 100 of the vacancies called may be reserved for this type of call.

2. On a proposal from the Minister of the Presidency, the Government shall establish the criteria, requirements and conditions under which State Administration officials may be integrated into other Bodies and Scales of the same group.

3. On the proposal of the Minister of the Presidency, the Government will establish the conditions and conditions for the access of the Spanish officials of the international organizations to the corresponding Bodies and Scales of the State Administration.

CHAPTER V

Remuneration regime bases

Article twenty-three. Remuneration concepts.

1. The remuneration of officials is basic and complementary.

2. These are basic rewards:

a) The salary, which corresponds to the proportionality index assigned to each of the groups in which the Bodies and Stairs, Classes or Categories are organized.

b) Trienes, consisting of an equal amount for each group, for every three years of service in the Body or Scale, Class or Category.

(c) Extraordinary payments, which shall be two per year for a minimum amount each of a monthly salary and three-year period, shall be payable in the months of June and December.

3. They are complementary rewards:

a) The target add-on for the level of the position that is performed.

(b) The specific supplement intended to pay for the particular conditions of certain jobs in the event of their special technical difficulty, dedication, responsibility, incompatibility, danger or hardship. In no case can more than one specific add-on be assigned to each job.

(c) The productivity supplement intended to pay for the special performance, the extraordinary activity and the interest or initiative with which the official carries out his work.

Your overall amount may not exceed a percentage of the total personnel costs of each program and each organ to be determined in the Budget Law. In accordance with the rules laid down in the Budget Law, the person responsible for the management of each expenditure programme shall determine, in accordance with the rules laid down in the Budget Law, the individual amount corresponding to each official.

In any case, the amounts collected by each official for this concept shall be public knowledge of other officials of the Department or the Agency concerned as well as union representatives.

d) Bonuses for extraordinary services, outside the normal day, which in no case may be fixed at their level and periodic on their accrual.

4. The officials shall receive the corresponding compensation for the service.

Article twenty-four. Determination of the amount of remuneration concepts.

1. The amounts of basic remuneration shall be equal in all public administrations for each of the groups in which the Corps, Escalas, Categories or Classes of officials are classified. The salary of the officials of group A may not exceed the salary of the officials of the group E.

2. The amount of the basic remuneration, of the allowances allocated to each job and of the specific allowances and of the productivity, where appropriate, shall be reflected for each financial year in the relevant Law of General State budgets and to be included in the budgets of other public administrations.

CHAPTER VI

Streamlining the structure of the Corps and Scales and other classifications of staff at the service of the Public Administrations

Article 25. Classification groups.

The Corps, Escalas, Classes and Categories of officials at the service of the Public Administrations shall be grouped, according to the required certification for their income, in the following groups:

Group A. Degree of Doctor, Licensed, Engineer, Architect or equivalent.

Group B. Technical Engineer Title, University Diplomat, Technical Architect, Third Degree Professional Training or equivalent.

Group C. Bachiler Title, Second Degree Professional Training or equivalent.

Group D. School Graduate Title, First Degree Professional Training or equivalent.

Group E. Certificate of Education.

Article twenty-six. Management of the membership and functions of the Public Administrations Corps and Escalations.

Officials and Escalations of officials may not be assigned the powers, functions or privileges of the administrative bodies. Only the relations of employment may determine the Bodies or Schescales of officials who are able to carry out the posts to which the exercise of those tasks corresponds.

The concrete membership of the Corps and Escalations to a Department or Body corresponds to the Government, prior to the report of the Department to which it is currently attached, and on the proposal of the Minister of the Presidency. This decision-making competence shall be exercised in its field by the Governing Councils of the Autonomous Communities and Plenos of the Local Corporations.

Article twenty-seven. Rationalization of the structure of the Corps and Escalations of the State Administration.

The Government is authorised to proceed, on a proposal from the Minister of the Presidency, to:

1. Convene unit selection tests for entry into the various Bodies or Scales.

2. Call for unit transfer contests for officials of different Corps or Escalas.

3. To unify those Bodies and Scales, of the same group, when they have assigned functions substantially coincident in their professional content and in their technical level, and whenever of the unification they derive advantages for the management of the services.

4. Declare certain Bodies or Scales to be extinguished when required by the general streamlining process.

The Government shall establish the criteria, requirements and conditions for the officers of the declared Bodies or Escalations to be integrated into other Bodies or Escalations.

Officials of the declared Corps or Escalas will perform the jobs that they regulate will be established.

Article twenty-eight. Rationalisation of workforce templates.

The government will also proceed to rationalize the workforce templates, through the instruments set out in the previous article, or those that are accurate, according to their legal nature, and, coherently, with the process of streamlining the Corps and Escalations of officials.

CHAPTER VII

Modification in the situations, disciplinary and social security regime of officials

Article twenty-nine. Officials ' situations.

1. The administrative situations of special and supernumerary leave are abolished, with special services being created.

2. Special services.

Public officials will move on to the special services situation:

(a) Where they are authorised to carry out a mission for a given period of more than six months in international bodies, foreign governments or public entities or in international cooperation programmes.

(b) When they acquire the status of officials at the service of international or supranational organizations.

(c) When appointed members of the Government or of the governing bodies of the Autonomous Communities or senior members of the Autonomous Communities who do not necessarily have to be provided by public officials.

d) When elected by the General Courts to be part of the Constitutional Organ or others whose election corresponds to the Chambers.

(e) Where they are attached to the services of the Constitutional Court or the Ombudsman.

f) When you access the status of Deputy or Senator from the General Courts.

g) When accessing the status of members of the Legislative Assemblies of the Autonomous Communities, if they receive periodic remuneration for the performance of the function.

When they do not receive such remuneration, they may choose to remain in the active service situation or move to the special services situation, without prejudice to the rules of the Autonomous Communities on incompatibilities. of the members of the Legislative Assemblies.

h) When they perform paid elective and exclusive dedication positions in the Local Corporations.

I) When they serve in the Govern ment of the Presidency of the Government, the Ministers and the Secretaries of State and do not choose to remain in the situation of active service in their Administration of origin.

(j) When appointed to any position of political character from which incompatibility is derived in order to exercise the public function.

k) When they comply with the military service or equivalent replacement provision.

l) When they hold elective positions at the provincial, regional or state level in the most representative trade union organizations.

Officials in special services will be counted on the time they remain in such a situation for the purposes of promotions, trienes and passive rights, and they will be entitled to the reservation of place and destination that they occupy. In all cases, they shall receive the remuneration of the post or effective charge they perform and not those that correspond to them as officials, without prejudice to the right to the perception of the trienes which may be recognised as civil servants.

Deputies, Senators and Members of the Legislative Assemblies of the Autonomous Communities who lose that condition by dissolution of the corresponding Chambers or the termination of their mandate may remain in the situation of special services until their new constitution.

3. Voluntary leave.

(a) to declare in a situation of voluntary leave to civil servants when they are in active service in another Body or Scale of any of the Public Administrations, or to pay services in public sector bodies or entities and do not correspond to them in another situation.

b) Officials shall be entitled to a period of voluntary leave of absence, not exceeding three years, in order to take care of each child's care from the date of birth of the child. Successive children shall be entitled to a new period of leave of absence, which shall, where appropriate, end the period for which they are enjoying themselves. When the parent and the parent work, only one of them can exercise this right.

(c) Voluntary leave may also be granted to officials upon request of a particular interest.

The situation provided for in this paragraph (c) may not be declared until three years of effective service have been completed since the Body or Scale has been accessed or since re-entry, and in it no more than ten years can be held continued for no less than two years.

Surplus officials shall not pay remuneration, nor shall the time spent in such a situation be computable for the purposes of promotions, trienes and liabilities.

Article thirty. Permissions.

1. Permissions will be granted for the following justified causes:

(a) By the birth of a child and the death or serious illness of a relative up to the second degree of consanguinity or affinity, two days when the event occurs in the same locality, and four days when in different location.

b) By home move without change of residence, one day.

c) To perform trade union, union training or personnel representation functions, in terms that are determined to be regulated.

d) To attend final examinations and other final tests of fitness and evaluation at official Centers, during the days of their celebration.

e) The official with a child of less than nine months shall be entitled to a daily time of absence from work. This time period may be divided into two fractions or replaced by a reduction of the day in half an hour.

f) Who, for reasons of legal guardian, has a direct care of a child of less than six years or a mental or physical diminished who does not carry out paid activity, shall be entitled to a reduction in the working day by a third or a means, with the proportional reduction of their remuneration.

2. Permits may be granted for the time required for the fulfilment of an inexcusable public or personal duty.

Article thirty-one. Disciplinary regime.

1. They shall be considered to be very serious:

(a) Failure to comply with the duty of fidelity to the Constitution in the exercise of public function.

(b) Any action involving discrimination on the basis of race, sex, religion, language, opinion, place of birth or neighbourhood, or any other personal or social condition or circumstance.

c) Abandonment of the service.

d) The adoption of manifestly illegal agreements that cause serious harm to the Administration or to citizens.

e) The publication or misuse of official secrets, as declared by law or classified as such.

f) The notorious lack of performance that is inhibiting in the fulfillment of the tasks assigned.

g) The violation of political neutrality or independence, using the powers conferred to influence electoral processes of any nature and scope.

h) Failure to comply with rules on incompatibilities.

i) The obstruction of the exercise of public freedoms and trade union rights.

j) The performance of acts aimed at the free exercise of the right to strike.

k) Participation in strikes, to which they are expressly prohibited by law.

(l) Failure to comply with the obligation to attend essential services in the event of a strike.

m) The limiting acts of free expression of thought, ideas and opinions.

n) Haber has been sanctioned by the commission for three serious fouls in a period of one year.

2. The lack of punctuality and the lack of assistance, when they constitute minor faults, shall be punishable by the proportional deduction of remuneration.

Article thirty-two. Social Security.

1. From the entry into force of this Law, for the purposes of Social Security, there shall be no discrimination on grounds of sex.

The official woman will cause the same passive rights as the male, however, recognizing, however, economic effects only from 1 January 1984 to those previously caused.

2. From the entry into force of this Law, the rights to the relatives of the perpetrators will be extinguished when they are married, without being able to recover.

3. The orphan's pensions which are caused from the entry into force of this Law shall be extinguished when the beneficiary is satisfied, irrespective of his sex, the age of twenty-one years, with the exception of the total incapacity for work.

4. As of the publication of this Law, pensions for orphans over the age of twenty-one years, unless they have been declared unfit before the age of this age and are entitled to the benefit of free justice in accordance with the laws in force, they shall be incompatible with the perception of assets for active employment which permit the inclusion of the holder in any public social security scheme.

5. The loss of the Spanish nationality of the deceased will not result in the loss of the right to widower and orphan's pensions.

Officials who, having lost Spanish nationality, will regain their rights in the field of social security.

6. The determination of the status of beneficiary of health care in the Special Regiments of Social Security of civil servants shall be in accordance with the provisions of the General Regime.

Article thirty-three. Forced retirement.

Forced retirement will be declared on the job when the official is 60 and five years of age.

ADDITIONAL DISPOSITION FIRST

1. They declare themselves to extinguish all non-scaled-down positions of officials. The Government, by means of Royal Decree, shall carry out its reordering, grouping and classification by integrating them, where appropriate, in the Bodies and Escalations which have assigned the same academic qualification and similar functions and remuneration.

2. The staff at the service of the State Administration who receives the total of their remuneration from the staff appropriations varied unclassified from the General Budget of the State shall be classified by the Government, by means of Royal Decree, determining, where appropriate, its integration, in accordance with the nature of its functions and academic qualifications required, in the Corps or Escalations of officials or workforce staff.

ADDITIONAL DISPOSITION SECOND

It is created, with the character of the General and Inter-ministerial Corps, the Management Body of the State Civil Administration. Its budget template will initially be made up of 3,000 seats.

It will be financed without an increase in public expenditure, with the depreciation of non-scaled-down places and vacant Corps or Scales with functions of a predominantly bureaucratic nature.

For the entry into the Body it will be required to be in possession of the degree of university diploma or equivalent.

Without prejudice to the provisions of this Law, it may be possible to integrate into the Management Body who, at the time of entry into force of this Law, are career officials of the General Administrative Corps or those other Bodies or Scales which are regulated by regulation, and which are in possession of the required qualification and exceed the relevant selective tests. At least 50 per 100 of the newly created places will be covered by this system.

ADDITIONAL THIRD DISPOSITION

1. The Government is authorised to, in accordance with the public nature of the MUFACE, proceed to the formation or restructuring of its governing bodies, administration and representation in the same way as the Security Management Entities. Social, determining its composition, functioning and attributions.

2. The General Staff Regulations of the Autonomous Communities, as well as the senior officials who are not public servants, shall be applicable to the officials in practice and to the officials who are newly entered by the Autonomous Communities.

3. The officials transferred to the Autonomous Communities will continue with the Social Security system or the system of security they originally had, assuming the Autonomous Communities all the obligations of the State or the Local Corporation. corresponding to them.

FOURTH ADDITIONAL DISPOSITION

1. From the date of entry into force of this Law, temporary collaboration contracts may not be concluded by the General Administration under administrative law.

2. Contracts to be concluded exceptionally by public authorities with staff for the performance of specific and specific non-standard work shall be subject to the law of State contracts, without prejudice, where appropriate, to the application of civil or commercial law.

FIFTH ADDITIONAL DISPOSITION

The Government will determine by Royal Decree the reciprocal computation of contributions between the Social Security Regime of civil servants and the various Social Security System Regulations.

ADDITIONAL PROVISION SIXTH

1. In accordance with the provisions of Law 10/1983 of 16 August of the organization of the Central Administration of the State, the inspection functions corresponding to the Presidency of the Government on all the services of the State Administration, Entities, Agencies and Companies of which are dependent, shall be exercised by the Ministry of the Presidency.

2. The Government, within six months, shall determine by means of Royal Decree, the superior function of inspection of services referred to in the preceding paragraph, and shall regulate the powers in the matter of the Government's Delegates in the Communities. Stand-alone.

Likewise, the Government through Royal Decree, will determine and regulate the functions of the general inspection of services of the Public Administration, attached to the Secretariat of State for Public Administration as an organ specialised in the inspection, direction and coordination of the inspection of services referred to in paragraph 1 of this additional provision.

The government will also establish the legal regime for such inspections.

ADDITIONAL SEVENTH DISPOSITION

Without prejudice to Article 33, the Government shall regulate the figure of the University Professor Emeritus.

EIGHTH ADDITIONAL DISPOSITION

1. The Bodies and Escalas declared to be extinct that currently have assigned the indices of proportionality 10, 8, 6, 4 and 3, will be integrated respectively, starting from the validity of this Law, in the groups A, B, C, D and E established in the Article 25.

2. For the entry into the newly created Corps and Escalas will be required the academic qualification necessary for the entrance into the Bodies and Scales that are integrated in them. In the case of the integration of Bodies or Escalas with different levels of certification for the purpose of new revenue, the requirement shall be that corresponding to the body or scale of the integrated ones for which the highest level of qualification is required.

NINTH ADDITIONAL DISPOSITION

One. -The following Corps of officials are created in the State Administration:

1. Superior Body of Civil Administrators of the State, in which the officials belonging to the Technical Information and Tourism Corps of the State Civil Administration are integrated.

2. Higher Body of State Finance Inspectors, in which the officials belonging to the Technical Corps of Insurance and Savings Inspection are integrated; Inspectors of Customs and Excise; Intervention and Accounting of the State Civil Administration and Financial and Tax Inspectors.

3. Superior Body of Commercial Technicians and State Economists, in which the officials belonging to the Special Corps of State Commercial Technicians and State Economists are integrated.

4. Superior Body of State Letrates, in which the officials belonging to the State Bar Corps, Technical of Letters of the Ministry of Justice, Letrados of the General Directorate of Records and Notaries and Letrados of the State State Council.

5. Corps of Doctors of the National Health, in which the officials belonging to the Medical Corps of the National Health and Doctors of the General Beneficence (Group of Doctors of Number) are integrated.

6. Body of Medical Doctors of the National Health, in which the officials belonging to the Corps of Medical Specialists are integrated; Medical and Maternological Physicians; Doctors of the National Antivenereal Struggle, and the Inspectorate Doctor-School.

7. Higher Body of Inspectors of Work and Social Security, in which the officials belonging to the Technical Scale of the National Labour Inspection Corps are integrated, and regardless of what is established in the additional provision sixteenth of this Law, the official staff of the Body of Social Security Controllers who is in possession of the corresponding higher academic qualification at the time of the entry into force of this Law.

8. Administrative General Body of the State Administration, in which the officials belonging to the General Administrative Corps of the State Civil Administration are integrated; Administrative Security and Administrative General of the State Military Administration.

9. Body of Delineants, in which the officials belonging to the Cadastro Delineantes Corps and Cartographic Delineants are integrated.

11. Deputy General Body of the State Administration, in which the officials belonging to the Deputy General Corps of the State Civil Administration and General Subalternate of the Military Administration are integrated.

f) Officials of the Secondary and Master Teaching Escalas shall be integrated into the respective Bodies by obtaining the title required for entry into the respective Bodies, provided that the degree obtained is the corresponding to the teaching he teaches.

4. From the degree of teaching career to be determined by regulation, the officials of the Secondary School Teachers ' Corps shall be referred to as Secondary Teaching Catedratics.

5. To the officials of the Corps and the teaching scales that are integrated into the Secondary School Teachers ' Corps, from the Corps or Scales that currently have a recognized proportionality index 10, grade 2. This situation shall be recognised for the purposes of the award of the degree of teaching career, which shall be higher than the one assigned to the rest of the Corps and the Scales integrated in the said Body. Such officials shall be entitled to the designation of Secondary Education Catedrants.

6. The Government shall develop the basic standards of the teaching role set out in this provision.

7. In the light of the needs of the service, and in accordance with the relations of the posts to be determined by the competent educational administration, the inspection function in the field of education shall be carried out by officials with qualifications. higher than the Corps and Escalas in which the teaching service is ordered.

The public offering of educational inspection posts will be covered by public tender, in accordance with the principles of merit and capacity and after the completion of a specialization course, the organization of which will be the competent educational administration. The membership of the officials selected for the inspection function shall be for non-consecutive periods, which shall in no case be less than three years and no more than six years. The officials appointed for these posts will not consolidate any personal grade, but the performance of the inspector will be valued as merit for the purposes of their teaching career.

After the period of the educational inspection function, officials will have the right to occupy a place corresponding to their Body or Scale in the locality of their destination as a teacher.

As of the entry into force of this Law, the provision of educational inspection function posts may only be performed by the procedure laid down in this paragraph

8. The current Corps of Basic Education Inspectors, Baccalaureate Inspectors and Technical Inspectors of Vocational Training are integrated into the Body of Inspectors to the Service of the Educational Administration, whose staff will be constituted by the current members of the Deleted Bodies, the vacancies which are subsequently to be written down.

Officials from the Inspectorate Corps to the Education Administration Service will have the right to perform jobs belonging to the inspector's function. They may also access the other posts of the administrative career in accordance with the principles of professional promotion laid down in this Law. For the purposes of the public supply of inspection, the competent educational administration shall reserve a certain percentage of posts for its provision by those officials.

9. Within the framework of the competences in educational matters attributed by their respective Statutes of Autonomy, the Autonomous Communities shall order their teaching public function in accordance with the provisions of this additional provision.

ADDITIONAL SIXTEENTH DISPOSITION

1. For the purposes of this Law, it is understood by official staff of the Administration of Social Security that he understood in the Statutes of Personnel of the extinct National Institute of Social Security, Labor Mutualism, Service of Assistance to Pensioners, Work Accident Reinsurance Service, Recovery and Rehabilitation Service for Physical and Psychic Disabled Persons, Institute of Health and Social Security Studies and the Social Institute of the Navy, as well as the members of the Intervention and Accounting Corps and the Escalations of Inspectors and Pharmacists Inspectors of the Sanitary Corps, with the exception of the Sanitary Corps and Scales and Medical Advisors that are regulated in the aforementioned Statutes.

2. Without prejudice to the approval granted by the Government, in accordance with the powers granted to it by this Law, the officials of the Social Security Administration shall be integrated into the form set out below in the Following Bodies and Escalations:

2.1 Technical Corps of the Administration of Social Security: The officials who, having the degree of Licentiate, Superior Engineer or Superior Architect, belong to one of the Corps or Escalas will be integrated into it. following:

-Technical Body. General Scale, of the extinct National Forecasting Institute.

-Body of Letrates of the extinguished Work Accident Reinsurance Service, unless the integration into the Body of Letters of the Administration of Social Security, as provided for in paragraph 2.6 of the This provision.

-Technical Advisor to the Extinguished Reinsurance, Work Accident Service.

-Body of Tertiary Graduates, Administration and Assistance Scale, Training and Employment of the Extinct Physical And Psychological Disability Recovery and Rehabilitation Service.

-Administrative Technical Scale of the Technical Body of the Administration of Social Security, referred to in the Ministerial Order of 4 July 1981.

2.2 Management Body of the Social Security Administration: The officials will be integrated into it, having the degree of University Diplomacy, Technical Engineer, Technical Architect or Third-Party Professional Training. Grade, belong to any of the following Bodies or Scales:

-Media Body, Administration Scale of the Extinguished Pensioner Assistance Service.

-Body of Titled Media, Management Scale of the Extinguished Physical And Psychological Handicapped Recovery and Rehabilitation Service.

-Officials of the Deputy Corps of the Social Institute of the Navy who, in accordance with the provisions of Article 12 of the Staff Regulations, shall perform the functions of Conductors on 31 December 1979.

2.6 Body of Letters of the Administration of Social Security: The officials who, having the degree of Law Degree, belong to some of the following Bodies or Scales, will be integrated into it:

-Letrates body of the extinct National Forecast Institute.

-Special Corps, Letrates Scale, from the Social Institute of the Navy.

-Body of Letrates of Extinct Labor Mutualism.

-Body of Letrates of the extinguished Reinsurance Service of Work Accidents, provided that at the entry into force of this Law they are performing jobs of Letrados, thus classified in the organic structure.

-Single Scale of the Letrates Body referred to in the Ministerial Order of 4 July 1981.

2.7 Body of Actuaries, Statistics and Economists of the Social Security Administration.

2.7.1 Scale of Actuaries: The officials who, having the title of Actuario de Seguros or Licenciado en Ciencias Económicas y Empresariales, specialty Actuarial or Rama Actuarial and the Company, will be integrated into it. Financial, belong to any of the following Bodies or Scales:

-Body of Mathematical Advisors, Scale of Actuarial Advisors, Statistical Advisors and Economic Advisers, of the extinct National Institute of Forecasting.

2.7.2 Scale of Statistics and Economists: Officials will be integrated into it, with the degree of Licentiate in Economic and Business Sciences, except the Actuarial or Actuarial branch and the Company. Financial, belong to any of the following Bodies and Scales:

2.8 Intervention and Accounting Corps of the Social Security Administration: The officials of the current Social Security Intervention and Accounting Corps will be integrated into it. Senior Engineer or Senior Architect.

2.9 Officials who, for failure to meet on the date of entry into force of this Law, the required qualification requirements cannot be integrated into the related Social Security Administration Corps or Escalations, remain in the Corps or Escalations to be lost at the date of entry into force of this Law, which are declared to be extinguished.

3. The Government is authorised to assimilate and approve the regime of the staff of the State Administration of Social Security Administration (I) of the State Administration and its Autonomous Bodies.

4. As provided for in this Law, the staff of the Social Security Administration shall be governed by its statutory rules until the Government has been granted approval with the rest of the staff of the State Administration, and their subsequent integration into the corresponding staff or employment staff at the initiative of the Ministry of Labour and Social Security, prior to the report of the Higher Staff Committee.

The assimilation and approval of the official staff of the Administration of Social Security shall be carried out, in accordance with the criteria laid down in this Law in conditions of equality with the rest of the public officials.

5. The Staff Committee shall inform the Commission of the provisions which are laid down in the field of staff of the Social Security Administration.

TRANSIENT DISPOSITION FIRST

As long as the governing bodies and the participation of the MUFACE are regulated by the government, the Governing Council, which will assume the functions of the General Assembly, the Governing Board, will be held with its present composition and powers. and the Management.

SECOND TRANSIENT DISPOSITION

1. Officials affected by the administrative situation provided for in this Law shall, within six months, request their regularisation.

The time limits provided for in Article 29.3 shall begin to be computed from the entry into force of this Law.

2. The officials who are in the administrative situation of supernumerary to the entry into force of this Law, will move to the situations of active service, or of special services and, if necessary, to the service in Autonomous Communities, according to is determined to be regulated.

When they have to move to the active duty situation and there are no vacancies in the Body or Scale of provenance, they may choose to move on to the voluntary leave or remain in the supernumerary until it becomes vacant.

THIRD TRANSIENT DISPOSITION

The Bodies, Escalas, Categories, Classes or situations belonging to or integrated into the Entities referred to in number 1 of the additional sixteenth provision, declared to be extinguished prior to entry into This Law will remain in this situation of "to extinguish" its entry into force.

FOURTH TRANSIENT DISPOSITION

1. The staff of the Social Security regulated in the Legal Staff Regulations of the Medical Staff of Social Security, in the Staff Regulations of the Health Care Unit entitled and Auxiliary of the Social Security Clinic, in the Staff Regulations of the Non-Sanitary Personnel at the service of the Sanitary Institutions of Social Security, as well as that of the Medical and Medical Advisory Bodies and Scales referred to in the additional sixteenth provision shall be governed in accordance with the provisions of Article 1. of this Law, by the legislation that is dictated in this respect.

2. The staff referred to in this transitional provision may occupy the posts in the health field in accordance with the determination of the respective employment relations.

FIFTH TRANSIENT DISPOSITION

For the purposes of this Law, it will be considered equivalent to the degree of university diploma having passed three full undergraduate courses.

SIXTH TRANSIENT DISPOSITION

1. Within six months from the date of entry into force of this Law, the Government shall carry out the classification of the functions performed up to that time by the staff employed administratively by the Administration. of the State.

The classification will determine the positions to be carried out by public officials, by labor personnel, and by staff in temporary employment.

The classification may be derived from the extension or reduction, where appropriate, of the templates of civil servants or of work staff.

2. All staff who have served as a temporary joint administrative contractor or as an interim employment officer may participate in the access tests to cover the newly created places.

In any case, these access calls must respect the criteria of merit and capacity, by means of the selective tests that are regulated, in which the effective services provided by the latter will be assessed. personnel.

3. The Autonomous Communities shall apply the above rules to the administrative contracted staff of temporary collaboration dependent on them for access to the respective autonomous public functions.

4. The Governing Councils of the Autonomous Communities may call for specific tests for personnel who, under the provisions of general provisions enacted by the relevant Autonomous Communities, have, with the Prior to 15 March 1984, the condition of administrative contractors, in expectation of access to their respective Civil Service. Contracts shall be deemed to be covered by public calls before 15 March 1984.

5. Exceptionally, and up to and including the academic year 1986-1987, the universities may conclude temporary cooperation contracts under administrative law for the teaching staff in the contractual categories referred to in the Transitional provision 10. No. 2 of Law 11/1983, of 25 August, of University Reform.

SEVENTH TRANSIENT DISPOSITION

1. The allocation of the personal degrees provided for in this Law to officials providing services at the time of their entry into force will not result in the automatic termination of the job they have been carrying out and will begin to acquire their (i) personal grade, meeting the requirements laid down in this Law, as from 1 January 1985.

2. An official who is considered to be injured in the assignment of his or her personal degree may request the review of such assignment in accordance with objective criteria based on the time of effective service provided in his/her Body or Scale and at the level of the posts performed. The proposals for the resolution of the degree allocation must be informed in any case by the Superior Commission of Personnel.

EIGHTH TRANSIENT DISPOSITION

1. During the period of transfers of personal means to the Autonomous Communities, the granting of a commission of services to the staff assigned in the peripheral services to the central services affected by those transfers shall be prohibited.

For the purposes of transfers of officials, personnel currently on secondment will be considered to be assigned to their post of origin.

2. Pending the conclusion of transfers of personal means to the Autonomous Communities, no vacancies may be called in the central services to be covered by personnel with a destination in the peripheral or new income services, except for where the vacancies correspond to central services not affected by the transfers and cannot be covered by officials of the same locality, after a report from the Staff Committee.

3. During the period of transfers of personal means to the Autonomous Communities, in the competitions called by them, they shall be given preference among the officials from the State Administration who participate in those competitions, those who are intended for central services.

To the officials of the State Administration who, through these procedures, pass on to the Autonomous Communities, the same rules will apply to them as to the officials transferred, and those of them from the central services shall enjoy the financial assistance provided by the government to compensate for the costs of the transfer and the new installation, without any other exception than those provided by the Autonomous Community of Madrid.

4. Upon request of the Autonomous Communities, the State Administration may grant its staff of the central services commissions of up to two years of service in order to cooperate, or to provide technical assistance, to the Administration of the Autonomous Communities.

5. The competent bodies of the State Administration are hereby authorized to convene restricted selection tests for their respective Bodies and Escalations. Officials and contracted staff members of the central services shall be eligible for the same. The places convened and the vacancies subsequently produced in the central services shall be transferred to the Autonomous Communities.

6. Until the Government, in accordance with the legal provisions, of the end of the period of transfers of personal means to the Autonomous Communities, a singular regime of voluntary leave applicable to the officials is established intended for central services. This surplus, which shall be granted for a period of at least five years, shall include the preferential recognition of re-entry and an allowance equivalent to eight full amounts.

During the same period of time, the Government may, at the request of the person concerned and after the report of the Higher Staff Commission, grant early retirement to the official belonging to a Body or Scale affected by the the transfer process and the system of passive rights, intended for the central or peripheral services of Madrid, which is more than sixty years old and at least three trienes completed, or thirty-five years of effective service.

This retirement will entitle the 150 per 100 of the basic remuneration to a maximum of 80 per 100 of its active remuneration and for the period of time remaining until the age of Forced retirement.

7 Staff members who, coming from the central services, must be transferred to the Autonomous Communities, and who cannot be obtained by them through the procedures provided for in this provision Transitional arrangements shall be made by means of the forced removal system.

Staff affected by such transfers who do not wish to move may choose to move to the administrative situation of forced leave without any right to pay.

NINTH TRANSIENT DISPOSITION

1. In application of the provisions of Article 33, officials shall retire as follows:

(a) On 1 January 1985, those who are 60 and eight years old.

(b) From 1 January 1985 to 30 June 1985, those who are serving sixty-eight years.

c) On June 30, 1985, those who are sixty-seven years old.

d) From 1 July 1985 to 31 December 1985, those who are serving sixty-seven years.

e) On December 31, 1985, those who are sixty-six years old.

f) During 1986 those who are serving sixty-six years.

g) On 31 December 1986, those who are aged sixty-five years.

(h) From 1 January 1987 to the end of the year, retirement will be fully implemented by the age of sixty-five years.

2. In application of the provisions of Article 33, the teaching staff shall be retired as follows:

(a) On 30 September 1985, those who are 60 and eight and sixty-nine years old.

(b) On 30 September 1986, those who are 60 and six and sixty-seven years old.

c) On 30 September 1987, those who are in their sixties and five years of age.

(d) From 1 October 1987 to the end of the year, retirement shall be fully applied in the sixties and five years.

TRANSIENT DISPOSITION TENTH

Officials who, as a result of the application of the remuneration scheme set out in this Law, experience a decrease in the total of their annual remuneration, excluding the current remuneration concept In the case of the Commission, the Commission has taken the view that, in the light of the Commission's proposal, the Commission will be able to take the necessary measures to ensure that the the difference, which will be absorbed by any future retributive improvement according to the criteria establish successive budget laws.

15TH TRANSIENT DISPOSITION

As long as the relations of the posts referred to in Article 15 of this Law are approved, the posts thus qualified shall be provided by means of competitions at the time of their entry into force.

TWELFTH TRANSIENT DISPOSITION

The entry into force of Articles 21, 22 and 23 until 1 January 1985 is postponed.

TRANSIENT DISPOSITION THIRTEENTH

As long as the Superior Council of the Civil Service is not constituted, the functions of the Civil Service will be performed by the Commission for the Coordination of the Civil Service in what is affecting the personnel policy of the Communities. Autonomous.

TRANSIENT DISPOSITION FOURTEENTH

Until the entry into force of the Organic Law referred to in Article 104.2 of the Constitution, the officials of the Security Forces and Corps shall continue to be governed by the rules applicable to them, without prejudice to the application of this Law.

FINAL DISPOSITION FIRST

The Government, by Royal Decree, will establish the compensation scheme to be received by the administrative staff employed who, after the classification of jobs, is regulated in the Transitional Disposition Sixth of this Law, do not have a place in the corresponding templates.

FINAL DISPOSITION SECOND

The first offer of public employment to be made as a result of the provisions of Article 18 of this Law will be made in 1985.

REPEAL PROVISION

1. The following provisions of the provisions cited are hereby repealed:
