Law 25/1970 of 2 December, Statute of the Wine, Wine and Spirits, in its fifth additional provision, grants authorization to the Government, on a proposal from the FORPPA, to be able to include in the Denominations Origin, Generic and Specific, established therein, those agricultural products whose quality protection is of particular economic or social interest.

At present, agro-food production processes are being practiced, which are fundamentally based on the non-use of synthetic chemicals.

This has led to the emergence of a new and important national and international market for products obtained in the form described above, and it is therefore appropriate to protect consumers, the number of which increases. progressively, as for the various producers and their existing groupings and those that may arise in the future, who wish to take advantage of the great potential of our country for this type of production. To this end, the creation of harmonised control and production frameworks is essential in order to guarantee the authenticity of the products offered to consumers and to create conditions of fair competition between producers. In turn, commercial transparency will also be facilitated, thus avoiding the possible creation of short-cuts to the free movement of these products.

Consequently, it is considered that it is not only appropriate, but also necessary, to protect the productions obtained by the systems described by applying the procedures provided for in the legislation in force.

Thus, in line with the above, once the sectors concerned have been heard and the agreements adopted in the FORPPA have been seen, on a proposal from the Ministry of Agriculture, Fisheries and Food and after deliberation by the Council of Ministers at their meeting on 15 July 1988,

DISPONGO:

Article 1.or

The system of designations of origin, generic and specific, established in Articles 95 et seq. of Law 25/1970 of 2 December 1970, is extended to agri-food products obtained without the use of synthetic chemicals.

It is understood, for the purposes of this Royal Decree, for agro-food products obtained without the use of synthetic chemicals, those in whose production, transformation and conservation have not been used chemical products of synthesis, in addition to the existing Technical-Health Regulations and the specific rules established for each particular product.

Art. 2.or

1. The basic regulation of the production, processing and conservation of the products covered by this Royal Decree will be established, the fulfillment of which will be necessary to obtain the protection and defense of the State at the national and international levels.

2. The wording of these rules shall include at least the following data:

2.1 Nature of agri-food products.

2.2 Conditions to be met by plots for production.

2.3 Planned production, transformation and conservation methods.

2.4 Systems to be used for monitoring and monitoring compliance with each specific regulation.

Art. 3.or

They may only be used in the production, processing and preservation of the products referred to in Article 2.or, The following products:

1. Mineral products obtained from natural deposits and which, after extraction, have undergone only mechanical treatment of washing or solubilization in water or dried, excluding any chemical treatment or chemical products of synthesis.

2. Organic products derived from wild animals or plants, derived from breeding animals or crop plants and which, after collection, slaughter or harvesting, have undergone only mechanical, thermal or drying treatments, with the exclusion of any chemical treatment or chemical synthesis products.

3. Those that are synthetic chemicals are used exceptionally as drugs in veterinary, collective or individual treatments, in cases where the existence of problems associated with the onset of diseases is shown. for which no other type of treatment may be applied, provided that the period of removal of the medicinal product ensures complete disposal of the waste.

FINAL DISPOSITION

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
