FOLLOWING THE AGREEMENT OF THE COUNCIL OF MINISTERS OF 22 MARCH 1989, THEY WERE AMENDED ON 30 APRIL 1985, 10 JANUARY 1986, 6 FEBRUARY 1987 AND 21 JANUARY 1988, ON THE BASIS OF WHICH THEY WERE APPROVED AND AMENDED RESPECTIVELY. THE BASIS OF THE NATIONAL PLAN FOR VOCATIONAL TRAINING AND INTEGRATION, WHICH WERE DEVELOPED, RESPECTIVELY, BY THE ORDERS OF THE MINISTRY OF LABOUR AND SOCIAL SECURITY OF 31 JULY 1985, 20 FEBRUARY 1986, 9 FEBRUARY 1987 AND 22 JANUARY 1988.

THE YEAR 1989 IS, IN THE IMPLEMENTATION OF THE NATIONAL VOCATIONAL TRAINING AND INSERTION PLAN, A YEAR OF TRANSITION.

THIS IS MOTIVATED BOTH BY THE LACK OF SIGNIFICANT CHANGES IN THE MANAGEMENT GUIDELINES OF THE EUROPEAN SOCIAL FUND APPLICABLE IN 1989, COMPARED WITH THOSE IN FORCE IN 1988, AND BY THE PROCESSES OF TRANSFORMATION IN WHICH THERE ARE CERTAIN AREAS RELATED TO THE NATIONAL VOCATIONAL TRAINING AND INTEGRATION PLAN, IN PARTICULAR THE REFORM OF THE EUROPEAN SOCIAL FUND, WHICH IS FULLY IN FORCE FROM 1990 ONWARDS, THE REFORM OF THE TECHNICAL AND VOCATIONAL EDUCATION SYSTEM. MINISTRY OF EDUCATION AND SCIENCE AND THE NATIONAL INSTITUTE OF EMPLOYMENT, REFORMS OF WHICH THEY WILL RESULT IN SUBSTANTIAL CHANGES IN THE REGULATORY FRAMEWORK OF THIS PLAN IN 1990.

THE ABOVE CONSIDERATIONS DO NOT SUGGEST MAKING SUBSTANTIAL CHANGES TO THE BASIS OF THE NATIONAL VOCATIONAL TRAINING AND INTEGRATION PLAN, EXCEPT THOSE NECESSARY TO UPDATE THE AMOUNT OF FINANCIAL AID TO THE STUDENTS AND OTHER NEW ONES TO COVER THE COSTS OF ACCOMMODATION FOR PUPILS WHEN THEY HAVE TO MOVE AWAY FROM THEIR USUAL DOMICILE; TO STRENGTHEN THE INSTRUMENTS FOR THE VOCATIONAL INTEGRATION OF YOUNG PEOPLE BY EXTENDING THE PROGRAMME PROFESSIONAL PRACTICES IN FAVOUR OF YOUNG PEOPLE UNDER THE AGE OF 18, EXTENDING IT TO STUDENTS UNDER THE AGE OF 25; EXTENDING THE COLLECTIVE BENEFICIARIES OF TRAINING ACTIONS TO PERSONS IN SITUATIONS OF DEPRIVATION OF LIBERTY AND IMMIGRANT FOREIGN WORKERS; FACILITATING THE PARTICIPATION OF THE PARTNERS SOCIAL IN THE DESIGN AND JOINT MANAGEMENT OF TRAINING ACTIONS ESTABLISHING THE POSSIBILITY OF APPROVING JOINT TRAINING PROJECTS AND, FINALLY, STRENGTHENING THE CONTROL PROCEDURES ON THE COLLABORATING CENTERS BOTH THROUGH THE ESTABLISHMENT OF NEW OBLIGATIONS, THE FAILURE OF WHICH LEADS TO LOSS OF GRANT AND EXCLUSION FROM THE CENSUS OF COLLABORATING CENTRES, SUCH AS THE EXPRESS PROHIBITION OF THE TRANSFER OF TRAINING FACILITIES AND INSTRUMENTS BY A CENTRE FOR ANOTHER HOLDER TO REQUEST, ON THE BASIS OF THOSE MEANS, THE APPROVAL OF THE SPECIFIC SPECIALTIES AS WELL AS THE PRACTICES OF SUBCONTRACTING IN THE EXECUTION OF A COURSE PREVIOUSLY PROGRAMMED BY THE INEM TO A COLLABORATING CENTER.

IN ACCORDANCE WITH THE COUNCIL OF MINISTERS ' AGREEMENT OF 22 MARCH 1989, AND HAVING HEARD THE GENERAL VOCATIONAL TRAINING COUNCIL, I HAVE HAD THE RIGHT TO HAVE:

CHAPTER FIRST

ARTICLE 1. VOCATIONAL TRAINING AND INSERTION PROGRAMMES. THE NATIONAL VOCATIONAL TRAINING AND INSERTION PLAN IS IMPLEMENTED THROUGH THE FOLLOWING PROGRAMMES:

1. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMMES FOR YOUNG PEOPLE WHO ARE LONG-TERM UNEMPLOYED.

2. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMMES WITH PROFESSIONAL PRACTICE IN ENTERPRISES FOR YOUNG PEOPLE UNDER THE AGE OF 25.

3. PROGRAMMES FOR THE RECOVERY OF THE EDUCATION OF YOUNG PEOPLE WHO HAVE NOT COMPLETED BASIC GENERAL EDUCATION OR VOCATIONAL FIRST-DEGREE TRAINING, OF TEACHING IN ALTERNANCE OF VOCATIONAL PUPILS OVER SIXTEEN YEARS OF AGE AND UNIVERSITIES AND TRAINING OF YOUNG PEOPLE WHO ARE SERVING THE MILITARY SERVICE.

4. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMME IN RURAL AREAS.

5. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMMES IN SECTORS OR FIRMS UNDERGOING RESTRUCTURING AND FOR EMPLOYED PERSONS AND SELF-EMPLOYED WORKERS.

6.

OCCUPATIONAL VOCATIONAL TRAINING PROGRAM FOR WOMEN IN THOSE ACTIVITIES IN WHICH THEY ARE UNDER-REPRESENTED.

7. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMMES FOR THE DISABLED, MIGRANTS AND IMMIGRANTS, COOPERATIVE PARTNERS AND PUBLIC LIMITED COMPANIES, STUDENTS PARTICIPATING IN JOINT PROGRAMMES WITH TRAINING BODIES FROM OTHER MEMBER STATES THE EUROPEAN ECONOMIC COMMUNITY AND OTHER GROUPS NOT COVERED BY THE PREVIOUS PROGRAMMES.

SECTION 1. VOCATIONAL TRAINING PROGRAMMES

OCCUPATIONAL FOR YOUNG PEOPLE AND LONG-TERM UNEMPLOYED

ART.

2. PROGRAMME OF GUARANTEE OF TRAINING SUPPORT FOR YOUNG PEOPLE HIRED FOR TRAINING. 1. YOUNG PEOPLE WHO HAVE BEEN RECRUITED FOR TRAINING WILL BE PROVIDED WITH AN OCCUPATIONAL TRAINING COURSE SO THAT, AT THE END OF THE CONTRACT, THEY CAN OBTAIN AN OCCUPATIONAL VOCATIONAL TRAINING DEGREE. WHEN YOUNG PEOPLE HIRED FOR TRAINING HAD NOT COMPLETED BASIC GENERAL EDUCATION, THEY WILL BE GIVEN ACCESS TO COMPENSATORY EDUCATION COURSES, IN ACCORDANCE WITH THE PROVISIONS OF ROYAL DECREE 1174/1983, OF 27 APRIL.

THE EFFECTS MENTIONED IN THIS ARTICLE WILL BE UNDERSTOOD TO MEAN THAT A YOUNG PERSON HAS NOT COMPLETED BASIC GENERAL EDUCATION WHEN HE HAS NOT OBTAINED THE DEGREE OF SCHOOL GRADUATE.

2. FOR THE DEVELOPMENT AND IMPLEMENTATION OF THE COURSES REFERRED TO IN THIS ARTICLE, THE MINISTRY OF LABOR AND SOCIAL SECURITY WILL SIGN AGREEMENTS WITH THE MINISTRY OF EDUCATION AND SCIENCE AND WITH THE AUTONOMOUS COMMUNITIES THAT HAVE BEEN TRANSFERRED. COMPETENCE IN THIS FIELD AND DECIDE TO COLLABORATE IN THIS PROGRAMME.

3. THE VOCATIONAL TRAINING COURSES, IN ACCORDANCE WITH THE SECOND CHAPTER OF ROYAL DECREE 1992/1984 OF 31 OCTOBER, GOVERNING CONTRACTS FOR TRAINING AND TRAINING, MAY BE PROVIDED THROUGH THE NATIONAL INSTITUTE OF TRAINING. EMPLOYMENT, OF THEIR PARTNER CENTRES OR IN THE COMPANY ITSELF. IN THE LATTER CASE, THE NATIONAL INSTITUTE OF EMPLOYMENT MAY SUBSIDISE THE UNDERTAKING WITH 90 PESETAS PER WORKER AND PER DAY OF TRAINING, DURING THE TERM OF THE CONTRACT, UPON PRESENTATION BY THE INSTITUTE OF A TRAINING PLAN IN THE MODEL PROVIDED BY THAT BODY, WHICH REFERS AT LEAST TO THE CONTENT OF THE TRAINING, THE TIMETABLE IN WHICH IT IS DEVELOPED AND THE GUARDIAN OR THE PERSON RESPONSIBLE FOR THE TRAINING. THE COMPANY MAY PRESENT THE CONTENTS OR CHARACTERISTICS OF THE TRAINING IN ACCORDANCE WITH THE TYPE OF PEDAGOGICAL PLANS PROVIDED BY THE NATIONAL INSTITUTE OF EMPLOYMENT.

THE SUBSIDY REFERRED TO IN THE PRECEDING PARAGRAPH SHALL BE SETTLED ON A MONTHLY BASIS BY THE UNDERTAKINGS IN CHARGE OF THE NATIONAL INSTITUTE OF EMPLOYMENT, COMPENSATING THEM FOR ALL THE HOURS OF TRAINING WHICH THEY HAVE GIVEN TO ALL THE EMPLOYEES. CONTRACTS FOR THE TRAINING, DURING THE TERM OF THE CONTRACT, IN ACCORDANCE WITH THE PROCEDURE LAID DOWN BY THE INSTITUTE.

IF THE COMPANY PERFORMS OCCUPATIONAL VOCATIONAL TRAINING WITH A PLAN APPROVED BY THE NATIONAL INSTITUTE OF EMPLOYMENT, THE AID FOR THIS CONCEPT WILL BE THE SAME AS THAT RECEIVED BY THE COLLABORATING CENTRES IN ACCORDANCE WITH THE CHAPTER 2 OF THIS ORDER.

ALSO TRAINING MAY BE PROVIDED IN ACCORDANCE WITH WHAT IS ESTABLISHED BY THE AGREEMENTS OR CONCERTOS OF COLLABORATION WHICH THE MINISTRY OF LABOUR AND SOCIAL SECURITY OR THE NATIONAL INSTITUTE OF EMPLOYMENT WITH THE ASSOCIATIONS OF EMPLOYERS WHO, JOINTLY OR IN COLLABORATION WITH TRADE UNION ORGANISATIONS, DEVELOP TRAINING PROJECTS IN FAVOUR OF THE STAFF OF ENTERPRISES. THESE CONVENTIONS OR CONCERTS SHALL BE REPORTED TO THE PROVINCIAL EXECUTIVE COMMITTEES OF THE NATIONAL INSTITUTE OF EMPLOYMENT.

4. THE EMPLOYER SHALL PROVIDE THE LEGAL REPRESENTATIVES OF THE EMPLOYEES IN THE UNDERTAKING WITH THE TRAINING PLAN SUBMITTED TO THE NATIONAL INSTITUTE OF EMPLOYMENT IN THE MODEL PROVIDED BY THIS BODY. FAILURE TO COMPLY WITH THIS PROVISION BY THE EMPLOYER MAY RESULT, WHERE APPROPRIATE, FROM THE LOSS OF THE RIGHT TO RECEIVE THE SUBSIDY PROVIDED FOR IN THE PREVIOUS PARAGRAPH.

THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL REPORT QUARTERLY TO THE PROVINCIAL EXECUTIVE COMMITTEES OF THAT BODY ON THE TRAINING CONTRACTS REFERRED TO IN THE PREVIOUS PARAGRAPH, WITH DETAILS OF THE SECTORS TO WHICH THEY ARE THEY RELATE TO THE SIZE OF ENTERPRISES, THE DURATION OF CONTRACTS AND THE TRAINING AND CONTENT OF CONTRACTS.

5. WHERE THE CONTRACT FOR TRAINING IS CARRIED OUT BY CRAFT TRAINING WORKSHOPS, THE GRANT SHALL BE 75 PER 100 OF THE MINIMUM INTER-BRANCH SALARY CORRESPONDING TO, FOR A PERIOD OF AT LEAST SIX MONTHS, WHICH MAY BE EXTENDED, BY PERIODS NOT LESS THAN A MINIMUM OF DURATION UP TO THREE YEARS.

TO THIS EFFECT, TRAINING WORKSHOPS WILL BE CONSIDERED FOR COMPANIES WHICH DEVELOP CRAFT TRADES AND HAVE BEEN RECOGNISED AS SUCH BY THE NATIONAL INSTITUTE OF EMPLOYMENT, IN ACCORDANCE WITH THE PROCEDURE LAID DOWN IN THE DEVELOPMENT. THE RECEIPT OF THE SUBSIDY, AS PROVIDED FOR IN THE PRECEDING PARAGRAPH, SHALL BE CONDITIONAL UPON THE UNDERTAKING ' S PRIOR SUBMISSION OF A TRAINING PLAN WITH THE CHARACTERISTICS REFERRED TO IN THE FIRST SUBPARAGRAPH OF THE THIRD PARAGRAPH OF THIS ARTICLE.

EQUALLY, IT SHALL APPLY TO THE CRAFT TRAINING WORKSHOPS AS PROVIDED FOR IN THE THIRD AND FOURTH SUBPARAGRAPHS OF THE PREVIOUS THIRD PARAGRAPH, AND IN THE FOURTH PARAGRAPH OF THIS ARTICLE.

6. THE AID PROVIDED FOR IN PARAGRAPHS 3 AND 5 ABOVE IS COMPATIBLE WITH THOSE WHICH HAVE BEEN GRANTED UNDER THE PROVISIONS OF ROYAL DECREE 27/1986 OF 10 JANUARY 1986 ON THE EXTENSION OF THE TIME LIMIT FOR THE APPLICATION OF CERTAIN AID FROM THE FUND SOLIDARITY FOR EMPLOYMENT, IN ORDER TO PROMOTE SUCH CONTRACTS, AND WITH THE REDUCTIONS IN THE SHARE OF SOCIAL SECURITY PROVIDED FOR IN ARTICLE 11 OF ROYAL DECREE 1992/1984 OF 31 OCTOBER.

7. AT THE END OF EACH TRAINING PROCESS, YOUNG PEOPLE WILL RECEIVE A CERTIFICATION OF THE TRAINING RECEIVED. IN ORDER TO APPROVE THIS CERTIFICATION TO THE DEGREE OF PROFESSIONALISM REFERRED TO IN THE FOURTH CHAPTER OF THIS ORDER, THE NATIONAL INSTITUTE OF EMPLOYMENT MAY ESTABLISH THAT, AT THE END OF THE COURSE, PROFESSIONAL TESTS SHALL BE CARRIED OUT ON THE LEVEL REACHED FOR STUDENTS. ALL THIS, WITHOUT PREJUDICE TO ARTICLE 10 OF ROYAL DECREE 1992/1984 OF 31 OCTOBER 1984, CITED ABOVE.

ART. 3. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMME FOR YOUNG PEOPLE UNDER THE AGE OF 25. 1. THE NATIONAL EMPLOYMENT INSTITUTE SHALL ORGANISE, DIRECTLY OR THROUGH COLLABORATING CENTRES, OCCUPATIONAL VOCATIONAL TRAINING COURSES FOR YOUNG UNEMPLOYED PERSONS UNDER THE AGE OF 25, WHOSE QUALIFICATIONS ARE IN PRACTICE INSUFFICIENT OR INADEQUATE, PRIORITY SHOULD BE GIVEN TO COURSES WHOSE TRAINING CONTENT IS LINKED TO THE USE OF NEW TECHNOLOGIES.

2. THE STUDENTS ATTENDING THE COURSES WILL RECEIVE THE AID REFERRED TO IN ARTICLE 22 OF THIS PROVISION.

ART. 4. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMME FOR THE LONG-TERM UNEMPLOYED. 1. THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL ORGANISE, DIRECTLY OR THROUGH ITS PARTNER INSTITUTIONS, VOCATIONAL TRAINING COURSES FOR THE BASIC QUALIFICATION AND THE TRAINING OR RETRAINING OF THE LONG-TERM UNEMPLOYED, CONSIDERED AS SUCH THOSE WHO ARE REGISTERED AS UNEMPLOYED IN THE EMPLOYMENT OFFICES MORE THAN ONE YEAR.

2. TO PARTICIPATE IN THESE ACTIONS, PRIORITY WILL BE GIVEN TO THOSE WORKERS WHO HAVE BEEN REGISTERED AS UNEMPLOYED FOR LONGER. FOR THESE PURPOSES, SENIORITY SHALL BE COMPUTED FROM THE DATE ON WHICH THE WORKER HAD COMPLETED THE LAST COURSE OF THE PROGRAMMES PROVIDED FOR IN THIS ORDER, EXCEPT IN THE CASE OF STUDENTS PARTICIPATING IN THE COURSES PROVIDED FOR IN THIS ORDER. ARTICLE 23 (2) OF THIS PROVISION.

3. THE UNEMPLOYED PERSONS PARTICIPATING IN THIS PROGRAMME SHALL RECEIVE FROM THE NATIONAL INSTITUTE OF EMPLOYMENT, DURING THE COURSE OF THE COURSE, THE FINANCIAL ASSISTANCE PROVIDED FOR IN ARTICLE 22 OF THIS ORDER.

ART.

5. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMME WITH PROFESSIONAL PRACTICE IN ENTERPRISES FOR YOUNG PEOPLE UNDER THE AGE OF 25. 1. THE NATIONAL INSTITUTE OF EMPLOYMENT MAY PROVIDE STUDENTS UNDER 25 YEARS OF AGE WITH PARTICIPATION IN THE COURSES REFERRED TO IN ARTICLES 3. And 4. OF THIS ORDER, THE CARRYING OUT OF PROFESSIONAL PRACTICES IN COMPANIES, PUBLIC BODIES, INSTITUTIONS OR TRADE UNIONS OR EMPLOYERS WITH WHICH THE APPROPRIATE CONCERTS ARE ESTABLISHED, WITHOUT ANY WORKING RELATIONSHIP BETWEEN THEM ENTERPRISES, BODIES, INSTITUTIONS OR ORGANISATIONS AND STUDENTS CARRYING OUT THE PRACTICES.

THESE PRACTICES MAY BE PERFORMED DURING OR AFTER THE COURSE OF THE COURSE.

2. THE DURATION OF THE PERIOD OF PROFESSIONAL PRACTICE SHALL NOT BE LESS THAN TWO HUNDRED AND NO MORE THAN FOUR HUNDRED HOURS. WHERE PUPILS ARE EIGHTEEN OR OLDER, THE DURATION OF THE PRACTICE MAY NEVER BE HIGHER THAN THAT OF THEORETICAL TRAINING. IN THE CASE OF PUPILS UNDER THE AGE OF 18, THE TOTAL DURATION OF THE TRAINING ACTION, INCLUDING THEORETICAL TRAINING AND BUSINESS PRACTICE, MAY NOT BE LESS THAN EIGHT HUNDRED HOURS.

3. STUDENTS PARTICIPATING IN THIS TRAINING ACTION WILL RECEIVE THE FINANCIAL ASSISTANCE PROVIDED FOR IN ARTICLE 22 OF THIS ORDER.

THE COMPANIES IN WHICH THE PROFESSIONAL PRACTICES ARE CARRIED OUT WILL RECEIVE FROM THE NATIONAL INSTITUTE OF EMPLOYMENT, DEPENDING ON THE COSTS THAT MAY OCCUR, INCLUDING THE SUPPLEMENTARY COLLECTIVE POLICY OF ACCIDENT, A QUANTITY OF UP TO 500 PESETAS PER PERSON AND DAY OF PRACTICE.

IN THE CONCERTS WHICH THE NATIONAL INSTITUTE OF EMPLOYMENT ESTABLISHES WITH THE UNDERTAKINGS, PUBLIC BODIES, INSTITUTIONS OR ASSOCIATIONS OF UNDERTAKINGS OR TRADE UNION ORGANISATIONS, THE RELATIONSHIP OF TRAINING CENTRES SHOULD BE INCLUDED IT GIVES THE THEORETICAL PART, THE NUMBER OF PUPILS WHO WILL CARRY OUT THE PRACTICES, THE SPECIFIC CONTENT OF THE PRACTICES, THE CONDITIONS UNDER WHICH THEY WILL BE DEVELOPED, THEIR TIMETABLE AND TIMETABLE AND THE PLACE OF THE CENTRE OR CENTRES OF WORK WHERE THEY WILL BE CARRIED OUT. SUCH CONCERTS, IN THE FORM OF THE NATIONAL INSTITUTE OF EMPLOYMENT, WILL BE DELIVERED BY THE COMPANIES TO THE EMPLOYEES ' REPRESENTATIVES OF THE RELEVANT WORKING CENTRE. OF THE CONCERTS REFERRED TO IN THE PRECEDING PARAGRAPH, THE NATIONAL EXECUTIVE COMMISSION OF THE NATIONAL INSTITUTE OF EMPLOYMENT OR THE CORRESPONDING EXECUTIVE COMMISSIONS SHALL BE INFORMED, ACCORDING TO THE GEOGRAPHICAL SCOPE THEREOF. PROVINCIAL OF THAT BODY.

5. THE IMPLEMENTATION OF THE PROGRAMME IS CONDITIONAL ON THE NUMBER OF AID BEING APPROVED BY THE EUROPEAN SOCIAL FUND.

SECTION 2. PROGRAMMES FOR THE RECOVERY OF EDUCATION, TRAINING IN ALTERNANCE AND THE TRAINING OF YOUNG PEOPLE SERVING THE MILITARY SERVICE

ART. 6. COMPENSATORY TRAINING PROGRAMME FOR YOUNG PEOPLE UNDER 16 YEARS OF AGE. 1. YOUNG PEOPLE UNDER THE AGE OF SIXTEEN WHO HAVE NOT COMPLETED BASIC GENERAL EDUCATION OR FIRST-DEGREE VOCATIONAL TRAINING MAY RECEIVE COMPENSATORY EDUCATION SUPPLEMENTED BY OCCUPATIONAL SUPPORT.

2. THE OBJECTIVES AND TERMS OF DEVELOPMENT AND IMPLEMENTATION OF THIS PROGRAMME SHALL BE SPECIFIED IN THE RELEVANT CONVENTIONS TO BE SIGNED, IN ACCORDANCE WITH ARTICLE 2 (2). OF THIS ORDER, BETWEEN THE MINISTRY OF LABOR AND SOCIAL SECURITY AND THE MINISTRY OF EDUCATION AND SCIENCE OR THE AUTONOMOUS COMMUNITIES THAT HAVE TRANSFERRED COMPETENCES IN THE FIELD OF COMPENSATORY EDUCATION AND DECIDE TO COLLABORATE IN THIS PROGRAM.

3. THE REMUNERATION OF THE TEACHERS IN THE COMPENSATORY EDUCATION MEASURES PROVIDED FOR IN THIS ARTICLE SHALL BE FINANCED THROUGH THE AGREEMENTS CONCLUDED WITH THE NATIONAL INSTITUTE OF EMPLOYMENT, TO WHICH THE ORDER OF THE MINISTRY OF EMPLOYMENT IS CONCERNED. SOCIAL SECURITY OF 21 FEBRUARY 1985, WHICH LAYS DOWN THE GENERAL BASES FOR THE ESTABLISHMENT OF NATIONAL EMPLOYMENT INSTITUTE CONVENTIONS WITH ORGANS OF THE STATE ADMINISTRATION, AUTONOMOUS COMMUNITIES, AUTONOMOUS ADMINISTRATIVE BODIES, AND AUTONOMOUS COMMERCIAL, INDUSTRIAL AND FINANCIAL BODIES FOR THE CONSTRUCTION OF WORKS AND SERVICES FOR UNEMPLOYED WORKERS.

WHEN TEACHERS ARE WORKERS WHO ARE RECIPIENTS OF UNEMPLOYMENT BENEFITS, TRAINED TO TEACH THIS KIND OF TEACHING, IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 5 OF ROYAL DECREE 1445/1982 OF 25 DECEMBER. JUNE, AS AMENDED BY ROYAL DECREE 1809/1986 OF 28 JUNE, THE DIFFERENCE BETWEEN THE AMOUNT OF UNEMPLOYMENT BENEFITS CORRESPONDING TO THOSE WORKERS AND THE CORRESPONDING SALARY OF THE CONVENTION SHALL BE FINANCED FROM THE NATIONAL INSTITUTE OF EMPLOYMENT.

ART. 7. PROGRAMMES FOR THE TRAINING OF VOCATIONAL TRAINING STUDENTS OVER THE AGE OF 16 AND UNIVERSITIES. 1. UNDER THIS PROGRAMME, IT WILL BE POSSIBLE TO FINANCE ACTIONS WHICH WILL MAKE IT EASIER FOR STUDENTS OF VOCATIONAL TRAINING OVER SIXTEEN YEARS OF AGE TO CARRY OUT PROFESSIONAL TRAINING IN ENTERPRISES.

2. THE COMPETENT EDUCATIONAL AUTHORITIES MAY CONCLUDE WITH INSTITUTIONS, UNDERTAKINGS OR ASSOCIATIONS OF UNDERTAKINGS THAT PUPILS OVER SIXTEEN YEARS OF VOCATIONAL TRAINING AND THE EXPERIMENTAL PROFESSIONAL MODULES PROVIDED FOR BY THE MINISTRY OF EDUCATION EDUCATION AND SCIENCE, BELONGING TO ANY TRAINING CENTRES, CARRY OUT TRAINING COURSES FOR A MAXIMUM OF 80 DAYS OR FOUR HUNDRED HOURS A YEAR, AS AN INTEGRAL PART OF THEIR ACADEMIC STUDIES, UNDER THE LEGISLATION EDUCATION IN FORCE, AND CONSEQUENTLY NO EMPLOYMENT RELATIONSHIP WITH THOSE INSTITUTIONS, COMPANIES OR ASSOCIATIONS OF UNDERTAKINGS, IN ACCORDANCE WITH ARTICLE 3., 2, OF DECREE 707/1976 OF 5 MARCH OF PROFESSIONAL TRAINING, IN CONJUNCTION WITH ARTICLE 19 OF ROYAL DECREE 1992/1984 OF 31 OCTOBER.

3. IN THE CASE OF CONCERTS BETWEEN THE COMPETENT EDUCATIONAL AUTHORITIES AND THE INSTITUTIONS, UNDERTAKINGS OR ASSOCIATIONS OF UNDERTAKINGS, THE RELATIONSHIP OF THE TRAINING CENTRES WHOSE STUDENTS CARRY OUT THE PROFESSIONAL PRACTICE, THEIR SPECIFIC CONTENT, MUST BE RECORDED, THE CONDITIONS UNDER WHICH THEY WILL BE DEVELOPED, THE TIMETABLE AND TIMETABLE OF THE SAME, AND THE PLACE OF THE CENTRE OR CENTRES OF WORK WHERE THEY WILL BE CARRIED OUT. THE CONTENTS OF THESE CONCERTS WILL BE INFORMED BY THE COMPANIES REPRESENTATIVES OF THE WORKERS OF THE CORRESPONDING CENTER OF WORK. THEY SHALL ALSO COMMUNICATE TO THE LEGAL REPRESENTATIVES OF THE EMPLOYEES EACH MONTH THE RELATIONSHIP OF TRAINEES.

4. THE NATIONAL INSTITUTE OF EMPLOYMENT, AT THE REQUEST OF THE COMPETENT EDUCATIONAL AUTHORITIES OR THE PROCEDURE LAID DOWN IN THE CONVENTIONS WHICH THE MINISTRY OF LABOUR AND SOCIAL SECURITY SUBSCRIBES WITH THOSE AUTHORITIES, SHALL GRANT THE FOLLOWING AID:

SCHOLARSHIPS TO STUDENTS, INCLUDING THE COST OF DISPLACEMENT AND THE COST OF LIVING, UP TO 800 PESETAS PER PERSON AND DAY OF PROFESSIONAL PRACTICE:

ECONOMIC COMPENSATION TO BUSINESSES ACCORDING TO THE COSTS THAT MAY ARISE, INCLUDING AN ACCIDENT SUPPLEMENTARY COLLECTIVE POLICY OF UP TO 500 PESETAS PER PERSON PER DAY OF PROFESSIONAL PRACTICE.

THE NATIONAL INSTITUTE OF EMPLOYMENT, AT THE REQUEST OF THE UNIVERSITIES OR THROUGH THE CONCERTS THAT IT SUBSCRIBES WITH THEM, WITHIN THE FRAMEWORK OF THE CORRESPONDING COLLABORATION AGREEMENTS TO BE SIGNED BETWEEN THE MINISTRY OF LABOR AND THE SOCIAL SECURITY AND THE MINISTRY OF EDUCATION AND SCIENCE OR THE AUTONOMOUS COMMUNITIES WHICH HAVE COMPETENCE IN THE FIELD OF EDUCATION, MAY FINANCE, ON THE BASIS OF THEIR BUDGETARY RESOURCES, THE IMPLEMENTATION OF PROFESSIONAL PRACTICE, PART OF STUDENTS IN THE LAST COURSE OF UNIVERSITY TEACHING, IN COMPANIES, INSTITUTIONS OR ORGANISATIONS, FOR WHICH THEY AND THE UNIVERSITIES WILL BE REQUIRED TO CONCLUDE THE RELEVANT AGREEMENTS.

TRAINEES AND COMPANIES, INSTITUTIONS OR ORGANISATIONS IN WHICH THEY ARE ENGAGED SHALL RECEIVE THE FINANCIAL GRANTS AND COMPENSATION PROVIDED FOR IN THE PREVIOUS PARAGRAPH. IN THE EVENT THAT THE PLANNED BUDGETARY RESOURCES FOR THIS PROGRAMME WILL BE EXHAUSTED, NON-WORKING PRACTICES MAY BE DEVELOPED, EVEN IF THE STUDENTS, COMPANIES, INSTITUTIONS OR ORGANISATIONS DO NOT RECEIVE THE ABOVE GRANTS AND FINANCIAL SUPPORT.

6. THE EDUCATIONAL AUTHORITIES OR THE UNIVERSITIES, AS APPROPRIATE, WITHOUT PREJUDICE TO THE COOPERATION AGREEMENT WHICH THEY MAY CONCLUDE WITH THE MINISTRY OF LABOUR AND SOCIAL SECURITY, SHALL INFORM THE NATIONAL INSTITUTE OF QUARTERLY EMPLOYMENT AND ANNUALLY OF THE RESULTS OF THIS PROGRAM. THESE REPORTS SHALL BE BROUGHT TO THE ATTENTION OF THE EXECUTIVE COMMITTEE OF THE NATIONAL EMPLOYMENT OFFICE, THE STANDING COMMITTEE OF THE GENERAL COUNCIL FOR VOCATIONAL TRAINING AND, WHERE APPROPRIATE, THE GENERAL COUNCIL OF UNIVERSITIES OR THE SCHOOL COUNCIL. STATE. THE PROVINCIAL BREAKDOWN OF THE ACTIONS DEVELOPED AT GENERAL LEVEL SHALL BE TRANSMITTED AT THE SAME INTERVALS TO THE PROVINCIAL EXECUTIVE COMMITTEES OF THE NATIONAL INSTITUTE OF EMPLOYMENT.

ART. 8. ADULT COMPENSATORY TRAINING AND OCCUPATIONAL TRAINING PROGRAMMES DURING THE MILITARY SERVICE. BETWEEN THE MINISTRIES OF LABOUR AND SOCIAL SECURITY, DEFENCE, JUSTICE AND EDUCATION AND SCIENCE, OR, WHERE APPROPRIATE, THE AUTONOMOUS COMMUNITIES WHICH HAVE THE CORRESPONDING POWERS TRANSFERRED, AGREEMENTS MAY BE ESTABLISHED TO SUPPLEMENT THE BASIC GENERAL EDUCATION, WITH OCCUPATIONAL SUPPORT, TO YOUNG PEOPLE WHO HAVE NOT COMPLETED IT AND WHO FULFIL THE MILITARY SERVICE OR THE REPLACEMENT SOCIAL PROVISION. AGREEMENTS MAY ALSO BE ESTABLISHED BETWEEN THE MINISTRIES REFERRED TO ABOVE FOR THE PROVISION OF OCCUPATIONAL TRAINING DURING THE MILITARY SERVICE OR THE REPLACEMENT SOCIAL SERVICE, AS WELL AS THEIR APPROVAL WITH PROFESSIONAL QUALIFICATIONS.

SECTION 3. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMME IN RURAL AREAS

ART. 9. OCCUPATIONAL VOCATIONAL TRAINING IN RURAL AREAS. 1.

THE NATIONAL INSTITUTE OF EMPLOYMENT WILL ORGANIZE, DIRECTLY OR THROUGH COLLABORATING CENTRES, OCCUPATIONAL VOCATIONAL TRAINING COURSES AIMED AT RURAL WORKERS, FOR THEIR BASIC QUALIFICATION, THE IMPROVEMENT OF TRAINING PROFESSIONAL IN NEW AGRICULTURAL OR LIVESTOCK TECHNIQUES OR THE PROFESSIONAL CONVERSION RESULTING FROM THE PROCESSES OF ADAPTATION OF THE AGRICULTURAL STRUCTURES AND THE SECTORAL MOBILITY OF THE WORKERS.

BY THE CONVENTIONS PROVIDED FOR IN ARTICLE 20 OF THIS ORDER, THE AUTONOMOUS COMMUNITIES OR OTHER INSTITUTIONS MAY BE FINANCED TO CARRY OUT THESE COURSES.

2. STUDENTS TAKING PART IN THE COURSES WILL RECEIVE THE FINANCIAL SUPPORT PROVIDED FOR IN ARTICLE 22 OF THIS ORDER.

SECTION 4. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMMES IN FIRMS OR SECTORS UNDERGOING RESTRUCTURING AND FOR EMPLOYED PERSONS AND SELF-EMPLOYED WORKERS

ART. 10. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMME IN SECTORS OR FIRMS UNDERGOING RESTRUCTURING. THE NATIONAL INSTITUTE OF EMPLOYMENT DIRECTLY, THROUGH ITS COLLABORATING CENTRES OR IN COLLABORATION WITH THE FUNDS FOR THE PROMOTION OF EMPLOYMENT, ENTERPRISES, ASSOCIATIONS OF COMPANIES OR TRADE UNIONS, WILL DEVELOP VOCATIONAL TRAINING COURSES OCCUPATIONAL RETRAINING AND RETRAINING OF WORKERS WHO ARE ELIGIBLE FOR EMPLOYMENT PROMOTION FUNDS BELONGING TO FIRMS UNDERGOING RESTRUCTURING OR WHO ARE AFFECTED BY THE EMPLOYMENT REGULATION FILE, AS WELL AS THOSE WHO, FINDING THEMSELVES IN A LEGAL SITUATION OF UNEMPLOYMENT, HAVE HAD THEIR CONTRACT EXTINGUISHED IN ACCORDANCE WITH THE ABOVE CASES, THE WORK IS DONE IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE DATE OF THE START OF THE COURSE.

WHEN TRAINING IS CARRIED OUT BY THE COMPANIES THEMSELVES BY MEANS OF A PLAN APPROVED BY THE NATIONAL INSTITUTE OF EMPLOYMENT, THEY SHALL RECEIVE COMPENSATION EQUAL TO THAT RECEIVED BY THE COLLABORATING CENTRES IN ACCORDANCE WITH THE PROVISIONS OF THE CHAPTER 2 OF THIS ORDER.

ART.

11 OCCUPATIONAL VOCATIONAL TRAINING PROGRAMMES FOR THE STAFF OF COMPANIES AND SELF-EMPLOYED WORKERS. THE NATIONAL INSTITUTE OF EMPLOYMENT, ITS PARTNER INSTITUTIONS AND COMPANIES, THROUGH THE COLLABORATION AGREEMENTS ESTABLISHED WITH THEM OR WITH THE EMPLOYERS ' AND TRADE UNION ORGANIZATIONS, WILL DEVELOP COURSES OF AT LEAST 100 HOURS OF DURATION, WHICH ENABLES THE CONTINUOUS PROFESSIONAL TRAINING OF THE STAFF OF ENTERPRISES, WHATEVER THEIR LEVEL, OR OF THE SELF-EMPLOYED, TO FACILITATE THEIR ADAPTATION TO THE OCCUPATIONAL CHANGES CAUSED BY THE INTRODUCTION OF NEW TECHNOLOGIES IN PRODUCTION PROCESSES OR THE INTRODUCTION OF NEW BUSINESS MANAGEMENT TECHNIQUES. PRIORITY WILL BE GIVEN TO STAFF BELONGING TO COMPANIES WITH A WORKFORCE OF LESS THAN 500 WORKERS AND, AMONG THEM, THE SMALLER ONES.

UNDERTAKINGS WHICH CARRY OUT THESE COURSES, WHEN SUBMITTING THE TRAINING PLAN FOR APPROVAL BY THE NATIONAL INSTITUTE OF EMPLOYMENT, MAY INCLUDE IN THE SAME VARIOUS TRAINING MODULES CONNECTED AND COMPLEMENTARY TO EACH OTHER, INCLUDING THOSE ENGAGED IN TRAINING IN THE FIELD OF SAFETY AND HYGIENE AT WORK, ALTHOUGH THE LATTER MAY NOT BE COUNTED FOR THE PURPOSE OF ACHIEVING THE MINIMUM DURATION PROVIDED FOR IN THE PRECEDING PARAGRAPH AND THEIR DURATION MAY NOT EXCEED ONE THIRD OF THE TOTAL OF THE CURSO.

ART. 12. COMMON RULES FOR OCCUPATIONAL VOCATIONAL TRAINING PROGRAMMES IN FIRMS OR SECTORS UNDERGOING RESTRUCTURING AND FOR EMPLOYED PERSONS AND SELF-EMPLOYED PERSONS. 1. WHERE THE COURSES PROVIDED FOR IN ARTICLES 10 AND 11 OF THIS PROVISION, EXCEPT THOSE FOR SELF-EMPLOYED WORKERS, ARE PROVIDED WITHIN THE ORDINARY WORKING DAY, THE UNDERTAKING MAY RECEIVE FROM THE NATIONAL INSTITUTE OF EMPLOYMENT, IN ADDITION TO THE AID REFERRED TO IN THE SECOND CHAPTER OF THIS ORDER, A SUBSIDY WHICH COMPENSATES PART OF THE WAGE COST OF THAT DAY, AS LAID DOWN IN ARTICLE 27 (4) OF THAT PROVISION. THE GRANT BY THE NATIONAL INSTITUTE OF EMPLOYMENT OF THIS GRANT WILL BE CONDITIONAL ON SUCH PERMITS FOR TRAINING, WITHIN THE ORDINARY WORKING DAY, TO HAVE BEEN AGREED UPON IN COLLECTIVE AGREEMENT OR AGREED WITH THE LEGAL REPRESENTATIVES. OF THE EMPLOYEES, AS REFERRED TO IN ARTICLE 22.2, OF LAW 8/1980 OF 10 MARCH, OF THE STATUS OF WORKERS, OR IN THE CONTEXT OF CONVENTIONAL CLAUSES RELATING TO THE REDUCTION OF WORKING HOURS.

2. COMPANIES WHOSE EMPLOYEES PARTICIPATE IN ANY OF THE TRAINING MEASURES PROVIDED FOR IN THIS SECTION SHALL INFORM THE LEGAL REPRESENTATIVES OF THE EMPLOYEES OF THEIR CONTENT.

SECTION 5. VOCATIONAL TRAINING PROGRAMME FOR WOMEN IN THOSE ACTIVITIES IN WHICH THEY ARE UNDER-REPRESENTED

ART. 13. VOCATIONAL TRAINING PROGRAMME FOR WOMEN IN THOSE ACTIVITIES IN WHICH THEY ARE UNDER-REPRESENTED.

1. THE NATIONAL INSTITUTE OF EMPLOYMENT, WITH THE COLLABORATIONS WHICH, IF NECESSARY, WILL BE AGREED WITH THE INSTITUTE OF WOMEN, OR WITH THE MOST REPRESENTATIVE EMPLOYERS 'AND EMPLOYERS' ORGANIZATIONS, WILL DEVELOP COURSES FOR WOMEN STOPS THAT FAVOR THEIR OCCUPATIONAL INTEGRATION OR REINTEGRATION IN THOSE SECTORS, ACTIVITIES OR OCCUPATIONS IN WHICH THE FEMALE COLLECTIVE IS UNDER-REPRESENTED. THESE COURSES MAY BE CARRIED OUT EITHER DIRECTLY BY THE NATIONAL INSTITUTE OF EMPLOYMENT OR THROUGH ITS COLLABORATING CENTRES.

2. STUDENTS TAKING PART IN THESE COURSES WILL RECEIVE THE AID PROVIDED FOR IN ARTICLE 22 OF THIS ORDER.

3. WHERE TRAINING IS PROVIDED IN THE PARTNER CENTRES OF THE NATIONAL INSTITUTE OF EMPLOYMENT, THIS BODY SHALL FINANCE THE TRAINING COSTS IN ACCORDANCE WITH THE PROVISIONS OF THE SECOND CHAPTER OF THIS ORDER. IN THE EVENT OF THE COLLABORATION BEING CARRIED OUT WITH THE INSTITUTE OF WOMEN, IT WILL BE PROVIDED FOR IN THE CORRESPONDING CONVENTION, AS REFERRED TO IN ARTICLE 20.

4. THE NATIONAL INSTITUTE OF EMPLOYMENT, WITHIN THE FRAMEWORK OF THE AGREEMENT SIGNED BETWEEN THE MINISTRY OF LABOUR AND THE MINISTRY OF SOCIAL AFFAIRS FOR THE DEVELOPMENT OF THE PLAN FOR EQUAL OPPORTUNITIES FOR WOMEN, IN THE FIELD OF EMPLOYMENT AND RELATIONS WORKING WITH THE INSTITUTE OF WOMEN IN THE DEVELOPMENT OF TRAINING MEASURES IN FAVOUR OF WOMEN WITH FAMILY RESPONSIBILITIES, WHO, OWING TO THEIR ECONOMIC AND FAMILY SITUATION, NEED A PROFESSIONAL QUALIFICATION PRIOR TO THEIR WORK. INTEGRATION INTO THE LABOUR MARKET, UNDER CONDITIONS TO BE DETERMINED BY THE MINISTRY OF SOCIAL AFFAIRS.

SECTION 6. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMMES FOR THE DISABLED, MIGRANTS AND IMMIGRANTS, COOPERATIVE PARTNERS AND PUBLIC LIMITED COMPANIES, STUDENTS PARTICIPATING IN JOINT PROGRAMMES WITH TRAINING BODIES FROM OTHER MEMBER STATES EUROPEAN ECONOMIC COMMUNITY AND OTHER GROUPS NOT COVERED BY THE ABOVE PROGRAMMES

ART. 14. VOCATIONAL TRAINING PROGRAMME FOR THE DISABLED. THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL COLLABORATE WITH THE NATIONAL INSTITUTE OF SOCIAL SERVICES, IN THE TERMS TO BE AGREED, IN THE DEVELOPMENT OF COURSES FOR OCCUPATIONAL VOCATIONAL TRAINING OF DISABLED WORKERS IN ORDER TO ENABLE THEM INCORPORATION INTO THE ORDINARY LABOUR MARKET.

ART.

15. OCCUPATIONAL TRAINING PROGRAMME FOR MIGRANT AND MIGRANT WORKERS. THE DIRECTORATE-GENERAL OF THE SPANISH INSTITUTE OF EMIGRATION, IN COLLABORATION WITH THE NATIONAL INSTITUTE OF EMPLOYMENT OR WITH OTHER ENTITIES OR INSTITUTIONS ACTING ABROAD OR IN SPAIN, WILL CONDUCT OCCUPATIONAL VOCATIONAL TRAINING COURSES FOR THE MIGRANT WORKERS AND THEIR FAMILIES, AS WELL AS FOR THOSE RETURNED TO SPAIN, FAVOURING

IN THIS WAY ITS INSERTION INTO THE ORDINARY LABOUR MARKET.

THE NATIONAL INSTITUTE OF EMPLOYMENT, THROUGH THE COLLABORATIONS THAT, IF ANY, ARE AGREED WITH THE GENERAL DIRECTION OF THE SPANISH INSTITUTE OF EMIGRATION OR WITH INSTITUTIONS OR NON-GOVERNMENTAL ORGANIZATIONS WITH EXPERIENCE ACCREDITED IN THIS FIELD, IT WILL DEVELOP, IN NATIONAL TERRITORY, ACTIONS OF GUIDANCE AND OCCUPATIONAL VOCATIONAL TRAINING IN FAVOR OF FOREIGNERS WHO, RESIDING LEGALLY IN SPAIN, ARE ENTITLED, IN ACCORDANCE WITH THE CURRENT LEGISLATION, TO ACCESS A JOB IN THAT STATE.

ART. 16. OCCUPATIONAL TRAINING PROGRAM FOR COOPERATIVE PARTNERS OF COOPERATIVES AND PUBLIC LIMITED COMPANIES. THE DIRECTORATE-GENERAL OF COOPERATIVES AND INDUSTRIAL COMPANIES, WITH THE PARTNERSHIPS TO BE AGREED WITH THE NTIONAL INSTITUTE OF EMPLOYMENT, WILL DEVELOP COURSES OF AT LEAST ONE HUNDRED HOURS FOR THE OCCUPATIONAL VOCATIONAL TRAINING OF PARTNERS. COOPERATIVES AND PUBLIC LIMITED LIABILITY COMPANIES, OR FOR PERSONS WISHING TO CONSTITUTE OR INTEGRATE INTO SUCH COMPANIES.

ART. 17. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMME FOR SOCIAL AND ETHNIC MINORITIES.

THE MINISTRY OF LABOUR AND SOCIAL SECURITY, EITHER THROUGH THE NATIONAL INSTITUTE OF EMPLOYMENT OR THROUGH OTHER BODIES OR MANAGEMENT CENTRES, WILL ORGANISE OCCUPATIONAL VOCATIONAL TRAINING PROGRAMMES AIMED AT FACILITATING THE INTEGRATION INTO THE LABOUR MARKET OF PERSONS IN SITUATIONS OF SOCIAL EXCLUSION OR BELONGING TO ETHNIC MINORITIES.

THE NATIONAL INSTITUTE OF EMPLOYMENT WITH PARTNERSHIPS TO BE AGREED WITH THE DIRECTORATE-GENERAL OF PENITENTIARY INSTITUTIONS, MAY DEVELOP ACTIONS OF GUIDANCE AND OCCUPATIONAL VOCATIONAL TRAINING, AIMED AT PEOPLE IN SITUATION OF DEPRIVATION OF LIBERTY.

ART. 18. JOINT VOCATIONAL TRAINING PROGRAMMES WITH TRAINING BODIES ESTABLISHED IN OTHER MEMBER STATES OF THE EUROPEAN ECONOMIC COMMUNITY. THE NATIONAL INSTITUTE OF EMPLOYMENT DIRECTLY OR THROUGH ITS COLLABORATING CENTRES MAY DEVELOP JOINT PROGRAMMES WITH BODIES OR VOCATIONAL TRAINING BODIES OF ANOTHER MEMBER STATE OF THE EUROPEAN ECONOMIC COMMUNITY, CO-FINANCED WITH THE EUROPEAN SOCIAL FUND, INCLUDING, WHERE APPROPRIATE, PERIODS OF STAY OF PUPILS AND TEACHERS OUTSIDE THE COUNTRY OF ORIGIN.

PUPILS WILL RECEIVE THE AID PROVIDED FOR IN ARTICLE 22 OF THIS PROVISION, INCLUDING THOSE WHICH COMPENSATE THEM FOR TRANSPORT, ACCOMMODATION AND MAINTENANCE COSTS OUTSIDE THE NATIONAL TERRITORY.

ART. 19. OCCUPATIONAL VOCATIONAL TRAINING PROGRAMME FOR OTHER GROUPS. THE NATIONAL INSTITUTE OF EMPLOYMENT, WITH ITS OWN RESOURCES OR THROUGH THE PARTNER INSTITUTIONS, WILL DEVELOP COURSES TO ENABLE THE OCCUPATIONAL VOCATIONAL TRAINING OF NON-UNEMPLOYED JOBSEEKERS, OF THE WORKERS OF THE UNEMPLOYMENT BENEFITS, EXCEPT THOSE PROVIDED FOR IN ARTICLES 3., 4., 9. 13 OF THIS PROVISION, AND OF THE UNEMPLOYED OVER THE AGE OF 25, WHO ARE REGISTERED AS UNEMPLOYED IN A JOB OFFICE LESS THAN ONE YEAR.

SECTION 7. COMMON RULES FOR THE PROGRAMMES OF THE NATIONAL VOCATIONAL TRAINING AND INTEGRATION PLAN

ART. 20. COLLABORATION AGREEMENTS FOR THE IMPLEMENTATION OF THE PROGRAMMES. THE MINISTRY OF LABOUR AND SOCIAL SECURITY SHALL ENCOURAGE THE HOLDING OF CONCERTS AND COLLABORATION AGREEMENTS, FOR THE IMPLEMENTATION AND MONITORING OF THE VARIOUS PROGRAMMES PROVIDED FOR IN THIS PROVISION, WITH BODIES OF THE DIFFERENT ADMINISTRATIONS. PUBLIC, BUSINESS AND TRADE UNIONS AND PRIVATE INSTITUTIONS, WHOSE PARTICIPATION IS ADVISABLE IN THE PLANNING AND IMPLEMENTATION OF ACTIONS. THE RELEVANT CONVENTION SHALL INCLUDE ALL ACTIONS IN RESPECT OF WHICH COOPERATION, RECIPROCAL COMMITMENTS AND PROCEDURES FOR MANAGEMENT AND MONITORING ARE ENVISAGED.

ART. 21. DURATION OF COURSES. THE MINIMUM DURATION PROVIDED FOR IN THE FIRST, SECOND, THIRD AND FIFTH SECTIONS, AS WELL AS IN ARTICLE 10 OF SECTION 4. OF THIS CHAPTER, WILL BE 200 HOURS, OF WHICH AT LEAST 40 WILL BE DEVOTED TO TRAINING LINKED TO NEW TECHNOLOGIES.

ART. 22. RIGHTS AND OBLIGATIONS OF PUPILS. 1.

THE UNEMPLOYED PARTICIPANTS IN OCCUPATIONAL VOCATIONAL TRAINING COURSES CORRESPONDING TO THE PROGRAMMES COVERED BY ARTICLES 3., 4., 5.

, 9., 13, 14, 15, 16, FIRST PARAGRAPH OF ARTICLE 17 AND ARTICLE 18, WILL RECEIVE FROM THE NATIONAL INSTITUTE OF EMPLOYMENT AN INDIVIDUAL SCHOLARSHIP PER DAY OF 572 PESETAS, WHEN THEY ARE OF AN AGE OF LESS THAN TWENTY-FIVE YEARS, AND A MONTHLY AID EQUIVALENT TO 75 PER 100 OF THE MINIMUM INTER-PROFESSIONAL SALARY IN FORCE AT ANY TIME, WHEN THEY ARE OLDER THAN THAT AGE AND HAVE MORE THAN ONE YEAR REGISTERED AS UNEMPLOYED IN THE EMPLOYMENT OFFICE OR AS JOBSEEKERS, IN THE MEMBER STATE. WORKERS WHO HAVE EXHAUSTED THE UNEMPLOYMENT ALLOWANCE PROVIDED FOR IN ROYAL DECREE 2298/1984 OF 26 DECEMBER, A PERIOD OF MORE THAN ONE YEAR HAS NOT ELAPSED SINCE THE DAY OF THE BIRTH OF THE RIGHT. THE PERCEPTION OF GRANTS AND GRANTS BY STUDENTS WILL BE CONDITIONAL ON THE DAILY DURATION OF THE COURSES NOT BEING LESS THAN 4 HOURS AND THE WEEKLY DURATION BEING LONGER THAN 20 HOURS, AS WELL AS THE AVAILABILITY OF BUDGETARY RESOURCES. FOR SUCH CONCEPTS.

THE NATIONAL INSTITUTE OF EMPLOYMENT, WHEN THE EXISTING BUDGETARY RESOURCES FOR THE GRANTS OR GRANTS REFERRED TO IN THIS PARAGRAPH HAVE BEEN EXHAUSTED, MAY PROVIDE TRAINING ACTIONS TO PERSONS WHO REQUEST THEM WITHOUT ECONOMIC COMPENSATION, PROVIDED THAT THEY COMPLY WITH THE REQUIREMENTS SET OUT IN THE PREVIOUS PARAGRAPH AND THAT APPROPRIATE COURSES HAVE BEEN SCHEDULED FOR THEIR CHARACTERISTICS. IN SUCH CASES, STUDENTS SHALL NOT RECEIVE THE GRANT OR AID PROVIDED FOR IN THIS PARAGRAPH.

2. STUDENTS PARTICIPATING IN OCCUPATIONAL VOCATIONAL TRAINING COURSES, WHO HAVE TO MOVE FROM THEIR PLACE OF RESIDENCE TO ATTEND THE COURSES, WILL RECEIVE AN AID OF 891 PESETAS PER DAY IN THE FORM OF TRANSPORT AND MAINTENANCE. PROVIDED THE DURATION OF THE COURSE IS LONGER THAN 20 HOURS PER WEEK.

WHEN POSTING IS CARRIED OUT ON NATIONAL TERRITORY AND INVOLVES ACCOMMODATION OUTSIDE ITS USUAL PLACE OF RESIDENCE, STUDENTS TAKING PART IN THE COURSES PROVIDED FOR IN THIS ORDER MAY RECEIVE FROM THE NATIONAL INSTITUTE OF EMPLOYMENT, FOR THE DURATION OF THE TRAINING ACTION, AN AID OF UP TO 4,922 PESETAS PER DAY FOR TRANSPORT, ACCOMMODATION AND MAINTENANCE, WHICH REPLACES THE AID PROVIDED FOR IN THE PREVIOUS PARAGRAPH.

WHEN, FOR REASONS OF RECOGNISED INTEREST, PUPILS OR TEACHERS, WHO PARTICIPATE IN THE COURSES PROVIDED FOR IN THIS ORDER, ARE TO BE MOVED TO OTHER MEMBER STATES OF THE EUROPEAN ECONOMIC COMMUNITY IN THE FRAMEWORK OF PROGRAMMES ASSEMBLIES REFERRED TO IN ARTICLE 18, THE NATIONAL INSTITUTE OF EMPLOYMENT MAY GRANT THEM AN AID OF UP TO 15,759 PESETAS PER DAY FOR THE DURATION OF THE TRAINING ACTION, FOR THE CONCEPTS OF TRANSPORT, ACCOMMODATION AND MAINTENANCE. THIS AID REPLACES THOSE PROVIDED FOR IN THE PRECEDING PARAGRAPHS OF THIS PARAGRAPH.

IN THE CASES REFERRED TO IN THIS PARAGRAPH, THE AID SHALL BE ADDITIONAL TO THOSE PROVIDED FOR IN THE FIRST PARAGRAPH OF THIS ARTICLE.

3. THE STUDENTS PARTICIPATING IN THE TRAINING COURSES COVERED BY THIS CHAPTER WILL BE REQUIRED TO ATTEND THE COURSES, WHICH IS THE CAUSE OF EXCLUSION FROM THE COURSES AND THE LOSS OF THE CORRESPONDING GRANT OR ECONOMIC AID, FROM THE DATE ON WHICH THEY WERE AWARDED. SUCH EXCLUSION OCCURS, HAVING THREE NON-JUSTIFIED ASSISTANCE FAULTS IN THE MONTH OR NOT FOLLOWING THE COURSE WITH USE AT THE DISCRETION OF THEIR RESPECTIVE DECISION-MAKERS.

4. GRANTS OR FINANCIAL SUPPORT SHALL NOT BE AWARDED TO STUDENTS WHO RECEIVE UNEMPLOYMENT BENEFITS OR BENEFITS, EXCEPT THOSE CORRESPONDING TO THE CONCEPTS OF TRANSPORT, ACCOMMODATION AND MAINTENANCE.

STUDENTS WHO HAVE EXHAUSTED THE UNEMPLOYMENT BENEFIT THEY ARE RECEIVING WILL BE ABLE TO START RECEIVING, FROM THAT DATE, THE CORRESPONDING GRANT OR ECONOMIC AID, IF THEY ARE FOUND IN THE CASES. REFERRED TO IN THE FIRST PARAGRAPH OF THIS ARTICLE.

5. STUDENTS PARTICIPATING IN THE COURSES PROVIDED FOR IN THIS ORDER SHALL HAVE THE RISK OF AN ACCIDENT WHEN THE ACCIDENT OCCURS AS A RESULT OF THEIR ATTENDANCE.

6. STUDENTS PARTICIPATING IN THE COURSES PROVIDED FOR IN THIS PROVISION SHALL BE ENTITLED TO RECEIVE INFORMATION AND PROFESSIONAL GUIDANCE ON THE TERMS TO BE DETERMINED BY THE IMPLEMENTING RULES. IN THIS RESPECT, THE INEM WILL TAKE THE APPROPRIATE MEASURES FROM 1989 ONWARDS, IN ORDER TO DEVELOP THIS TYPE OF ACTION, PREFERABLY USING FORMULAS FOR EVALUATION AND INDIVIDUAL COUNSELLING FOR FIRST-JOB APPLICANTS, LONG-TERM UNEMPLOYED AND UNEMPLOYED PERSONS. GROUPS WITH SPECIAL DIFFICULTIES IN ACCESS TO VOCATIONAL TRAINING AND EMPLOYMENT. SUCH ACTIONS MAY BE CARRIED OUT PRIOR TO THE START OF THE COURSE OR DURING ITS DEVELOPMENT, AS AN ACCOMPANYING MEASURE AND SUPPORT FOR THE TRAINING ACTION.

THE NATIONAL INSTITUTE OF EMPLOYMENT WILL BE ABLE TO SIGN CONCERTS WITH THE MOST REPRESENTATIVE BUSINESS AND UNION ORGANIZATIONS, AS WELL AS WITH PUBLIC OR PRIVATE NON-PROFIT INSTITUTIONS SO THAT THEY CAN COLLABORATE IN THE IMPLEMENTATION OF THE ACTIONS REFERRED TO IN THE PRECEDING PARAGRAPH OF THIS PARAGRAPH.

THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL INFORM THE STANDING COMMITTEE OF THE GENERAL COUNCIL OF VOCATIONAL TRAINING, THE NATIONAL EXECUTIVE COMMISSION AND, WHERE IT AFFECTS THE RELEVANT FIELD, THE PROVINCIAL EXECUTIVE COMMITTEES OF THE THE INSTITUTE REFERRED TO THE PLANS FOR THE IMPLEMENTATION AND IMPLEMENTATION OF THE MEASURES REFERRED TO IN THIS PARAGRAPH.

7. THE NATIONAL INSTITUTE OF EMPLOYMENT MAY, BY MEANS OF THE PROCEDURE LAID DOWN BY IT, CLAIM TO THE PUPILS THE AMOUNTS WHICH, IN THE FORM OF A GRANT OR ECONOMIC AID, WOULD HAVE BEEN UNDULY PERCEIVED.

ART. 23. NEW MANAGEMENT INSTRUMENTS. 1. IN ORDER TO DEVELOP AND MANAGE THE ABOVE PROGRAMMES, THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL ORGANISE A GROUP OF GUIDANCE AND PROFESSIONAL INTEGRATION PROMOTERS TO BE IN CHARGE OF:

(A) TO PROMOTE OCCUPATIONAL VOCATIONAL TRAINING INITIATIVES AND THEIR SUITABILITY FOR THE NEEDS IDENTIFIED.

B) CARRY OUT CONTINUOUS PROSPECTING OF THE NEEDS OF PROFESSIONAL QUALIFICATION IN ENTERPRISES.

C) TO PARTICIPATE IN THE SELECTION AND CONTROL OF THE COLLABORATING CENTERS.

D) TO COLLABORATE IN THE ALLOCATION OF TRAINING MEANS BY TRYING TO ACHIEVE THE HIGHEST SOCIAL PROFITABILITY OF THE PUBLIC RESOURCES AVAILABLE.

E) TO ANALYZE THE RESULTS ACHIEVED BY THE STUDENTS AT THE END OF THE COURSES, AS WELL AS THEIR EFFECTS ON THE PROFESSIONAL INSERTION OF THE STUDENTS.

F) PROMOTE AND, WHERE APPROPRIATE, CARRY OUT THE ACTIVITIES OF GUIDANCE AND PROFESSIONAL INFORMATION IN ORDER TO FACILITATE THE PROFESSIONAL INTEGRATION OF WORKERS.

2. THE NATIONAL INSTITUTE OF EMPLOYMENT, IN ORDER TO ENHANCE THE AVAILABILITY OF OCCUPATIONAL VOCATIONAL TRAINING TEACHERS WHO DEVELOP THE COURSES OF THE NATIONAL VOCATIONAL TRAINING AND INSERTION PLAN, WILL ORGANISE, DIRECTLY OR THROUGH OTHERS INSTITUTIONS, THE FOLLOWING ACTIONS OF TRAINING OR TECHNICAL-METHODOLOGICAL UPDATING AIMED AT THE TEACHERS WHO PARTICIPATE IN THE SAID PLAN OR THE PROFESSIONALS THAT CAN BE INCORPORATED INTO THE IMPLEMENTATION OF THE PLAN:

(A) TRAINING ACTIONS OF AT LEAST FOUR HUNDRED HOURS, AIMED AT PERSONS WITH A MINIMUM OF THREE YEARS OF PROFESSIONAL EXPERIENCE.

B) TECHNICAL-PEDAGOGICAL REFRESHER COURSES, WHICH DO NOT MEET THE REQUIREMENTS SET OUT IN (A).

DURING THE PERIOD OF ASSISTANCE TO THESE ACTIONS, UNEMPLOYED STUDENTS, NOT RECIPIENTS OF UNEMPLOYMENT BENEFITS, WILL RECEIVE MONTHLY AID EQUAL TO 75 PER 100 OF THE MINIMUM WAGE. INTERPROFESSIONAL.

PROFESSIONALS WHO HAVE TO RESIDE OUTSIDE THE PLACE OF THEIR HABITUAL RESIDENCE FOR THE DURATION OF SUCH ACTIONS MAY RECEIVE, IN ACCOMMODATION AND MAINTENANCE, AN ADDITIONAL AID EQUIVALENT TO 6,280 PESETAS PER DAY.

3. IN ORDER TO SPEED UP THE PROCESS OF TEACHER PLANNING TO SET UP AND ADAPT THE OCCUPATIONAL VOCATIONAL TRAINING OFFER TO SOCIO-ECONOMIC REALITY, THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL, ON A REGULAR BASIS, PUBLICLY CONVENE OR AGREE WITH INSTITUTIONS, TRADE UNIONS AND EMPLOYERS ' ORGANIZATIONS, EXPERTS, CENTRES AND COMPANIES COLLABORATING IN THE STRUCTURING OF PROFESSIONAL FAMILIES, TRAINING OF TEACHING AIDS, ANALYSIS OF NEW TRAINING METHODS, INCLUDING THE DISTANCE LEARNING, AND IN THE CORRESPONDING TECHNICAL TRAINING FOR THE TEACHING COLLECTIVE INVOLVED IN THE NATIONAL VOCATIONAL TRAINING AND INSERTION PLAN.

IN ALL THESE WORKS, THE AGREEMENTS TO BE ADOPTED ON THE COMPARABILITY OF QUALIFICATIONS BETWEEN MEMBER STATES OF THE EUROPEAN ECONOMIC COMMUNITY SHALL BE TAKEN INTO ACCOUNT.

4. THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL CONSTITUTE A FILE OF TEACHERS APPROVED FOR THE PURPOSE OF PROVIDING COURSES IN THE NATIONAL VOCATIONAL TRAINING AND INSERTION PLAN AND CARRYING OUT THE TECHNICAL-TEACHING TASKS REFERRED TO IN POINT 3.

THE ABOVE INSTITUTE INFORMS THE NATIONAL EXECUTIVE COMMISSION OF THAT BODY, IT SHALL ESTABLISH THE PROCEDURE FOR THE INCLUSION IN SUCH A FILE OF PERSONS WHO, GATHERING THE DUE PROFESSIONAL QUALIFICATIONS, ARE SUITABLE FOR THE DELIVERY OF THE VARIOUS TRAINING SPECIALTIES.

5. THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL SUPPORT EXPENDITURE ARISING FROM THE DEVELOPMENT OF THE MEASURES PROVIDED FOR IN POINTS 2, 3 AND 4 ABOVE.

CHAPTER II

PARTNER CENTERS AND COURSE PROGRAMMING

ART. 24. APPROVAL AND REGISTRATION OF COLLABORATING CENTRES.

1. THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL PERIODICALLY PUBLISH A CALL FOR THE APPROVAL OF TRAINING CENTRES AS PARTNERS IN THE PROVISION OF OCCUPATIONAL VOCATIONAL TRAINING COURSES IN SPECIFIC FIELDS TO BE DETERMINED. IN ACCORDANCE WITH THIS CHAPTER, WHICH MAY BE USED BY ALL INSTITUTIONS, ORGANISATIONS, CENTRES AND UNDERTAKINGS WISHING TO DO SO, WITH THE EXCEPTION OF PUBLIC ADMINISTRATIONS, INSTITUTIONS OR PRIVATE ORGANISATIONS WITH WHICH THE MINISTRY WORKING AND SOCIAL SECURITY OR THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL SIGN AN AGREEMENT IN THE EVENT OF SUCH APPROVAL, THE PROCEDURES AND CONDITIONS LAID DOWN IN THE RELEVANT CONVENTION SHALL BE CARRIED OUT ON THE BASIS OF THE AVAILABLE MEANS OF EACH CENTRE.

THE NATIONAL INSTITUTE OF EMPLOYMENT WILL REPORT TO ITS PROVINCIAL EXECUTIVE COMMISSIONS, ON A MONTHLY BASIS, ON CHANGES IN THE CENSUSES OF COLLABORATING CENTERS AND APPROVED SPECIALTIES.

ALSO, THE INSTITUTE WILL REPORT ON THE RESULTS OF THE EVALUATION OF THE ALREADY REGISTERED COLLABORATING CENTERS, AS WELL AS OF THE APPROVED TRAINING PROJECTS.

2. IN THE RESPECTIVE CALLS, A LIST OF THE SPECIALTIES THAT SHOULD PREFERABLY BE INCLUDED IN THE CENSUS OF COLLABORATING CENTERS, AS WELL AS, SHOULD BE INCLUDED IN THE REPORT OF THE GENERAL DIRECTION OF EMPLOYMENT OF THE MINISTRY OF LABOR AND SOCIAL SECURITY. WHERE APPROPRIATE, THE CONDITIONS AND REQUIREMENTS WHICH MAY BE LAID DOWN FOR CERTAIN SPECIALITIES.

FOR THE SELECTION OF THE SPECIALTIES REFERRED TO IN THE PRECEDING PARAGRAPH, THE MINISTRY OF LABOUR AND SOCIAL SECURITY SHALL PROMOTE, BY MEANS OF THE CONVENTIONS PROVIDED FOR IN ARTICLE 20 OF THIS ORDER, THE PARTICIPATION OF THE VARIOUS PUBLIC ADMINISTRATIONS, EMPLOYERS ' AND TRADE UNIONS AND PRIVATE INSTITUTIONS, IN ORDER TO COLLABORATE IN THE IDENTIFICATION OF PRIORITIES THAT MAY ARISE FROM THE STUDIES OF THE LABOUR MARKET.

3. THE CENTRES WHICH ARE APPROVED BY THE NATIONAL INSTITUTE OF EMPLOYMENT TO PROVIDE CERTAIN TRAINING COURSES WILL BE INCLUDED IN THE CENSUS OF THE COLLABORATING CENTRES EXISTING IN THE INSTITUTE.

4. THE MOST REPRESENTATIVE EMPLOYERS 'AND EMPLOYERS' ORGANISATIONS MAY COOPERATE WITH THE NATIONAL INSTITUTE OF EMPLOYMENT AND PROVIDE VOCATIONAL TRAINING THROUGH THE APPROVAL OF JOINTLY SUBMITTED OR MANAGED TRAINING PROJECTS OR PLANS. FOR THESE SOCIAL PARTNERS.

THE IMPLEMENTATION OF THESE PLANS WILL BE CARRIED OUT IN THE FRAMEWORK OF COLLECTIVE AGREEMENTS OR AGREEMENTS IN THE VARIOUS AREAS OF COLLECTIVE BARGAINING.

5. THE APPROVAL OF THE COLLABORATING CENTRES, THE JOINT TRAINING PLANS REFERRED TO IN THE PREVIOUS PARAGRAPH, AND THE TRAINING PLANS OF THE UNDERTAKINGS REFERRED TO IN ARTICLE 2 (3) AND ARTICLE 10 OF THIS ORDER, IT SHALL CARRY OUT, WITHOUT PREJUDICE TO THE PROVISIONS OF PARAGRAPH 2 OF THIS ARTICLE, ON THE BASIS OF TRAINING FACILITIES, TEACHING TECHNIQUES, TECHNICAL AND PEDAGOGICAL CHARACTERISTICS OF THE TEACHING STAFF AND CONTENT OF THE TEACHING. IN THE CASE OF THE AGREED PRIVATE VOCATIONAL TRAINING CENTRES WHICH APPLY FOR APPROVAL AS A PARTNER, THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL OBTAIN FROM THE COMPETENT EDUCATIONAL AUTHORITIES THE INFORMATION ON THE CHARACTERISTICS. TEACHERS AND THE FUNCTIONING OF SUCH CENTRES.

6. THE COLLABORATING CENTRES MAY NOT BE TRANSFERRED TO A DIFFERENT HOLDER FOR THE PURPOSE OF APPLYING FOR THE TYPE-APPROVAL OF TRAINING COURSES.

ART. 25. PROGRAMMING OF THE COURSES BY THE NATIONAL INSTITUTE OF EMPLOYMENT OR ITS COLLABORATING CENTERS. 1. THE COLLABORATING CENTRES SHALL APPLY AT THE PROVINCIAL ADDRESSES OF THE NATIONAL INSTITUTE OF EMPLOYMENT TO BE INCLUDED IN THE PROGRAMME OF COURSES, IN ACCORDANCE WITH THE PROCEDURE AND WITHIN THE TIME LIMITS DETERMINED BY THE GENERAL DIRECTORATE OF THE INSTITUTE.

2. THE NATIONAL EMPLOYMENT INSTITUTE, AFTER REPORTING THE DIRECTORATE-GENERAL FOR EMPLOYMENT, SHALL SUBMIT TO THE STANDING COMMITTEE OF THE GENERAL VOCATIONAL TRAINING COUNCIL THE CRITERIA TO BE FOLLOWED FOR THE PROGRAMMING AND THE OBJECTIVES AND GUIDELINES. IN THE ALLOCATION OF RESOURCES IN THE VARIOUS SPECIALTIES.

THE PROVINCIAL ADDRESSES OF THE NATIONAL INSTITUTE OF EMPLOYMENT, ON THE BASIS OF THE GUIDELINES LAID DOWN BY THE GENERAL COUNCIL FOR VOCATIONAL TRAINING AND WITHIN THE OBJECTIVES SET OUT FOR ITS PROVINCE, WILL RAISE THE DIRECTORATE-GENERAL OF THE INSTITUTE, PRIOR TO THE PROVINCIAL EXECUTIVE COMMISSIONS, A REASONED PROPOSAL FOR PROVINCIAL PROGRAMMING. IN THE CASE OF PUBLIC ADMINISTRATIONS, INSTITUTIONS OR PRIVATE ORGANISATIONS WITH WHICH THE MINISTRY OF LABOUR AND SOCIAL SECURITY OR THE NATIONAL INSTITUTE OF EMPLOYMENT SUBSCRIBE TO A COOPERATION AGREEMENT, THE PROCEDURE TO BE FOLLOWED THE PROGRAMMING PROPOSAL WILL BE THE ONE PROVIDED FOR IN THESE CONVENTIONS.

3. THE PROPOSAL FOR PROVINCIAL PROGRAMMING SHALL INCLUDE THOSE CARRIED OUT BY THE PUBLIC AUTHORITIES, INSTITUTIONS OR PRIVATE ORGANISATIONS WITH WHICH THE MINISTRY OF LABOUR AND SOCIAL SECURITY OR THE NATIONAL INSTITUTE OF EMPLOYMENT SUBSCRIBE TO A COLLABORATION AGREEMENT. TO THIS EFFECT THE JOINT COMMISSIONS OF THE CONVENTIONS WILL COMMUNICATE TO THE PROVINCIAL DIRECTORS OF THIS BODY THOSE PROPOSALS.

PROPOSALS FOR PROGRAMMING MADE BY NATIONAL PROMOTERS, WITH WHICH THE NATIONAL INSTITUTE OF EMPLOYMENT HAS NOT SIGNED AN AGREEMENT, WHICH HAVE BEEN SUBMITTED IN THE GENERAL DIRECTION OF THE INSTITUTE AND AIM TO DEVELOP IN THE PROVINCIAL FIELD.

4. THE DIRECTOR-GENERAL OF THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL APPROVE THE NATIONAL PROGRAMME OF COURSES TO BE PROVIDED IN HIS OWN CENTRES AND IN THE CENTRES OF STAFF WITHIN THE NATIONAL VOCATIONAL TRAINING AND INSERTION PLAN TO WHICH THE INSTITUTIONS ARE TO BE DISTRIBUTED. COURSES BY PROVINCES AND SPECIALTIES.

ALSO, IN THE NATIONAL PROGRAMMING OF COURSES, THE COURSES TO BE PROVIDED BY EACH OF THE COLLABORATING CENTRES REFERRED TO IN PARAGRAPH 3 OF THE PREVIOUS ARTICLE SHALL BE ALLOCATED, BY SPECIALTIES.

PRIORITY WILL BE GIVEN TO THE PROGRAMMING OF COURSES DEVELOPED WITHIN THE FRAMEWORK OF TRAINING PLANS JOINTLY MANAGED BY EMPLOYERS ' ASSOCIATIONS AND TRADE UNIONS THAT ARE MORE REPRESENTATIVE TO MEET TRAINING NEEDS. BUSINESS, SECTORAL OR TERRITORIAL.

THE NATIONAL INSTITUTE OF EMPLOYMENT, WITHIN A MAXIMUM OF ONE MONTH, SHALL INFORM THE NATIONAL EXECUTIVE COMMISSION OF THE NATIONAL INSTITUTE OF EMPLOYMENT AND THE STANDING COMMITTEE OF THE GENERAL COUNCIL FOR THE VOCATIONAL TRAINING OF THE PROGRAMME. 5. HOWEVER, IN CASES WHERE THE OBJECTIVES LAID DOWN IN THE NATIONAL PLAN FOR VOCATIONAL TRAINING AND INTEGRATION HAVE NOT BEEN ACHIEVED, OR IN CASES WHERE THE OBJECTIVES OF THE NATIONAL PLAN FOR VOCATIONAL TRAINING AND INTEGRATION HAVE NOT BEEN MET, THE GENERAL DIRECTORATE OF THE THE NATIONAL EMPLOYMENT INSTITUTE MAY ORGANISE REGULAR OR EXTRAORDINARY COURSES OF COURSES FROM WHICH THE NATIONAL EXECUTIVE COMMISSION OF THE NATIONAL INSTITUTE OF EMPLOYMENT AND THE STANDING COMMITTEE OF THE GENERAL COUNCIL OF VOCATIONAL TRAINING.

6. THE COLLABORATING CENTERS MAY NOT SUBCONTRACT WITH A THIRD PARTY THE PERFORMANCE OF THE COURSES WHICH, AS PROVIDED FOR IN THIS ARTICLE, HAVE BEEN PROGRAMMED. THIS BAN EXTENDS TO TRAINING PLANS OR PROJECTS.

ART. 26. SELECTION OF STUDENTS. THE SELECTION OF PUPILS FOR THE CENTRES WILL BE CARRIED OUT BY THE PROVINCIAL DIRECTORATE OF THE NATIONAL INSTITUTE OF EMPLOYMENT IN COLLABORATION WITH THE CENTRE.

WHEN THE TRAINING IS CARRIED OUT BY THE COMPANIES AND THEIR EMPLOYEES, THE SELECTION WILL BE CARRIED OUT BY THE COMPANY ITSELF, AFTER CONSULTATION WITH THE WORKERS ' REPRESENTATIVES AND IN COLLABORATION WITH THE NATIONAL INSTITUTE OF EMPLOYMENT.

IN ANY CASE, THE SELECTION OF THE STUDENTS WILL TAKE INTO ACCOUNT THE CONDITIONS AND CONDITIONS REQUIRED IN THIS PROVISION FOR EACH OF THE RESPECTIVE PROGRAMMES, AS WELL AS THE LEVEL OF KNOWLEDGE, SKILLS OR, WHERE APPROPRIATE, PROFESSIONAL PRACTICE, REQUIRED TO FOLLOW THE COURSE ' S TEACHING AND SUBSEQUENTLY TO PERFORM THE RELEVANT OCCUPATION OR OCCUPATION.

ART. 27. GRANT TO COLLABORATING CENTRES. 1. THE COST OF OCCUPATIONAL VOCATIONAL TRAINING COURSES FOR THE COLLABORATING CENTRES WILL BE BORNE BY THE NATIONAL INSTITUTE OF EMPLOYMENT AND WILL BE FINANCED BY GRANTS FROM THE INSTITUTE TO THE CENTRES TO COMPENSATE THEM FOR THE COSTS INCURRED.

THESE GRANTS WILL BE INDEPENDENT OF GRANTS THAT CAN BE AWARDED DIRECTLY TO STUDENTS IN CERTAIN TRAINING PROGRAMMES.

2. THE AMOUNT OF THE GRANTS FROM THE PARTNER ' S COURSES WILL BE DETERMINED BY THE NATIONAL INSTITUTE OF EMPLOYMENT PER PUPIL AND HOUR OF COURSE, DEPENDING ON THEIR RELATIONSHIP WITH THE NEW TECHNOLOGIES OR THE NEW BUSINESS MANAGEMENT SYSTEMS. TRAINING LEVEL OF THE COURSES AND THE DEGREE OF DIFFICULTY OF THE TECHNIQUE TAUGHT. THE AMOUNT OF THESE GRANTS SHALL BE APPROVED BY THE INSTITUTE EACH YEAR, SUBJECT TO A REPORT BY THE DIRECTORATE-GENERAL FOR EMPLOYMENT OF THE MINISTRY OF LABOUR AND SOCIAL SECURITY AND AFTER CONSULTING THE STANDING COMMITTEE OF THE GENERAL COUNCIL OF TRAINING. 3. THE GRANT SHALL, IN GENERAL, COMPENSATE FOR THE COSTS OF SCHOOL SUPPLIES, ACCIDENT INSURANCE, DEPRECIATION OF FACILITIES AND EQUIPMENT, CONSUMER MATERIALS, TEACHING STAFF AND TEACHING AIDS FOR COURSES IN COLLABORATION WITH THE NATIONAL INSTITUTE OF EMPLOYMENT, AS WELL AS OTHERS WHICH THE GENERAL DIRECTORATE OF THE INSTITUTE MAY CONSIDER JUSTIFIED.

HOWEVER, COMPENSATION FOR THE COST OF OCCUPATIONAL VOCATIONAL TRAINING COURSES GIVEN BY COMPANIES WHICH ARE LISTED AS COLLABORATING CENTRES AND WHEN THEY ARE EXCLUSIVELY AIMED AT THEIR OWN WORKERS, ONLY IT SHALL FINANCE THE EXPENDITURE OF TEACHERS AND TEACHING MATERIALS, UNLESS THESE COURSES BELONG TO ONE OF THE SPECIFIC TRAINING PROGRAMMES PROVIDED FOR IN THIS ORDER, IN WHICH CASE IT WILL BE IN ACCORDANCE WITH THE RELEVANT PROGRAMME.

4. COMPANIES WHOSE EMPLOYEES PARTICIPATE IN COURSES UNDER THE PROGRAMMES PROVIDED FOR IN ARTICLES 10, 11 AND 16 OF THIS PROVISION, WHETHER THE TRAINING IS PROVIDED DIRECTLY BY THE UNDERTAKING, THE NATIONAL INSTITUTE OF EMPLOYMENT OR ANY OF ITS WHEN THE COURSES TAKE PLACE WITHIN THE ORDINARY WORKING DAY, A GRANT WILL BE AVAILABLE TO COMPENSATE FOR PART OF THE WAGE COST OF THE DAY, EQUIVALENT TO 50 PER 100 OF THE MINIMUM INTER-PROFESSIONAL SALARY IN FORCE IN EACH TIME, IN PROPORTION TO THE NUMBER OF WORKING HOURS SPENT ON TRAINING. THIS SUBSIDY IS CONDITIONAL ON THE NUMBER OF AID WHICH, FOR THE PROGRAMMES REFERRED TO IN ARTICLE 10, 11 AND 16 OF THIS ORDER, GRANTS THE EUROPEAN SOCIAL FUND.

THE COMPANY, FOR THE GRANT OF THE GRANT PROVIDED FOR IN THE PRECEDING PARAGRAPH, MUST PROVE THE EXISTENCE OF A COLLECTIVE AGREEMENT OR AGREEMENT WITH THE LEGAL REPRESENTATIVES OF THE WORKERS IN THE TERMS TO WHICH IT REFERS ARTICLE 12 (1) OF THIS PROVISION OR AGREEMENT OF THE CORRESPONDING GENERAL ASSEMBLY IN THE CASE OF COOPERATIVES.

5. IN THE CASE OF ENTERPRISES WHICH, AS COLLABORATING CENTRES OF THE NATIONAL INSTITUTE OF EMPLOYMENT, PROVIDE VOCATIONAL VOCATIONAL TRAINING COURSES TO THOSE WHO ATTEND AS STUDENTS, AS WELL AS OTHERS WHO ARE IN EMPLOYMENT. UNEMPLOYMENT, THE AMOUNT OF THE SUBSIDY SHALL BE IN ACCORDANCE WITH THE SECOND SUBPARAGRAPH OF THE THIRD PARAGRAPH OF THIS ARTICLE IN ORDER TO COMPENSATE FOR THE COSTS INCURRED BY ITS OWN WORKERS AND SHALL BE EQUAL TO THAT LAID DOWN BY GENERAL CHARACTER FOR THE PARTNER INSTITUTIONS IN THE PART CORRESPONDING TO THOSE STUDENTS WHO DO NOT BE WORKERS OF THESE COMPANIES.

THE SELECTION OF STUDENTS WILL BE PERFORMED, FOR EACH OF THE TWO GROUPS PARTICIPATING IN THE COURSES, AS SET OUT IN ARTICLE 26 OF THIS ORDER.

6. THE PAYMENT OF THE AMOUNT OF THE GRANTS WILL BE CARRIED OUT BY THE NATIONAL INSTITUTE OF EMPLOYMENT DIRECTLY TO THE CENTRES COLLABORATING TO THE COMPLETION OF THE COURSES, OR IN QUARTERLY PERIODS IF THE COURSES ARE LONGER THAN FOUR MONTHS. SUBJECT TO COMPLIANCE WITH THIS ORDER AND STANDARDS WHICH DEVELOP IT, AS WELL AS TO THE DELIVERY OF COURSES UNDER THE CONDITIONS IN WHICH THEY WERE APPROVED. ANY CHANGE TO THESE CONDITIONS WILL REQUIRE PRIOR AUTHORISATION FROM THE NATIONAL INSTITUTE OF EMPLOYMENT. NOTWITHSTANDING THE FOREGOING, THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL FORWARD, IN ADVANCE, AFTER THE PROGRAMMING HAS BEEN APPROVED AND BEFORE THE BEGINNING OF THE COURSES, 50 PER 100 OF THE TOTAL GRANT, AND MAY REQUIRE THE SUPPORTING DOCUMENTS PREVIOUS TO ENSURE THE GOOD END OF THE ACTION. THE 50 PER 100 REMAINING OF THE GRANT SHALL BE PAID IN ACCORDANCE WITH THE FIRST SUBPARAGRAPH OF THIS PARAGRAPH AND, WHERE APPROPRIATE, QUARTERLY PAYMENTS SHALL BE MADE AS FROM THE END OF THE FIRST HALF OF THE YEAR.

THE FAILURE TO COMPLY WITH THE CONDITIONS LAID DOWN FOR THE DELIVERY OF THE COURSES WILL ENTAIL THE OBLIGATION, ON THE PART OF THE COLLABORATING CENTRE, TO RETURN THE AMOUNT WHICH THEY HAVE RECEIVED IN ADVANCE OF THE GRANT, IN ITS ENTIRETY OR IN THE PROPORTION WHICH THE NATIONAL INSTITUTE OF EMPLOYMENT DETERMINES IN THE LIGHT OF THE PERIOD OF THE COURSE GIVEN.

THE PAYMENT OF THE GRANTS OF THE COLLABORATING CENTRES WITH WHICH THE MINISTRY OF LABOUR AND SOCIAL SECURITY OR THE NATIONAL INSTITUTE OF EMPLOYMENT HAS CONCLUDED AN AGREEMENT OR A CONCERT OF COLLABORATION, ACCORDING TO THE ESTABLISHED IN ARTICLE 24 OF THIS ORDER, IT WILL BE DONE IN THE FORM AND WITH THE PERIODICITY THAT IS AGREED IN THE RESPECTIVE CONVENTIONS OR CONCERT OF COLLABORATION.

7. THE ASSISTANCE OF WORKERS TO COURSES PROVIDED BY PARTNER INSTITUTIONS SUPPORTED BY THE NATIONAL EMPLOYMENT INSTITUTE SHALL BE FREE OF CHARGE.

THE PERCEPTION OF ANY NUMBER BY THE CENTERS WILL CAUSE LOSS OF THE CONDITION OF THE COLLABORATING CENTER AND WILL INVOLVE THE OBLIGATION TO RETURN THE AMOUNT UNDULY PERCEIVED.

8. THE REGISTERED CENTRES MAY MAKE ADVERTISING OR ADVERTISING, STATING THEIR STATUS AS COLLABORATORS ONLY AND EXCLUSIVELY FOR THE ACTIONS SUPPORTED BY THE NATIONAL INSTITUTE OF EMPLOYMENT AND, CONSEQUENTLY, PREVIOUSLY INCLUDED IN THE PERIODIC OR EXTRAORDINARY COURSES OF COURSES.

ART. 28. INSPECTION AND CONTROL OF THE COLLABORATING CENTRES. 1. THE CENTRES SHALL COMMUNICATE TO THE PROVINCIAL ADDRESSES OF THE NATIONAL INSTITUTE OF EMPLOYMENT, WITHIN 15 DAYS BEFORE THE BEGINNING OF THE COURSE, THE DATES FOR THE OPENING AND CLOSING OF THE COURSES, SCHEDULES AND TEACHING PLANS AND THE NOMINAL RATIO OF THE TEACHERS, WHO WILL HAVE TO BE VISAS BY THE INSTITUTE AND EXPOSED IN THE BULLETIN BOARDS OF THE CENTER, AS WELL AS IN THE DOORS OF THE CLASSROOM WHERE THE COURSE IS DELIVERED.

2. ANY CHANGE IN SCHEDULES, TEACHER PLANS AND TEACHERS WILL REQUIRE PRIOR AUTHORIZATION FROM THE NATIONAL INSTITUTE OF EMPLOYMENT. IN THE EVENT OF SUCH AN AMENDMENT WITHOUT PROPER AUTHORIZATION, THE COLLABORATING CENTRE SHALL BE OBLIGED TO REFUND THE AMOUNTS RECEIVED IN ADVANCE, THE SUBSIDY BEING DEEMED TO BE EXTINGUISHED.

EQUALLY, IT WILL BE THE CAUSE OF LOSS OF THE SUBSIDY AND THE RETURN OF THE AMOUNT RECEIVED IN ADVANCE, THE REMUNERATION OF THE TEACHERS AT A LOWER LEVEL THAN THAT ESTABLISHED IN THE ECONOMIC MODULES OF GRANTS PROVIDED FOR IN THE IMPLEMENTING RULES OF THIS ORDER, EXCEPT WHERE THIS DIFFERENCE IS JUSTIFIED BY THE COLLABORATING CENTRE TO THE NATIONAL INSTITUTE OF EMPLOYMENT, AS WELL AS THE LACK OF EMPLOYMENT AND AFFILIATION AND/OR HIGH SOCIAL SECURITY EMPLOYMENT OF THE MENTIONED TEACHERS.

3. THE CENTRES MUST INFORM THE NATIONAL INSTITUTE OF EMPLOYMENT, BOTH THE REJECTION OF STUDENTS AND THE LACK OF USE DURING THE COURSE AND THE LACK OF ASSISTANCE FOR THE COURSE, FOR THE PURPOSES SET OUT IN ARTICLE 22. THIRD PARAGRAPH.

THE CENTRES ARE OBLIGED TO PROVIDE THE INSTITUTE WITH INFORMATION REQUESTED ON THE COURSE OF THE COURSES.

TO THIS END, THEY MAY BE REQUIRED TO PRESENT THE JUSTIFICATION FOR ALL THE COSTS INCURRED BY THE RECEIVED GRANT.

4. IT IS UP TO THE NATIONAL EMPLOYMENT INSTITUTE ' S PROVINCIAL DIRECTORATES TO ENSURE THAT THE GRANTS AND AIDS GRANTED ARE PROPERLY TERMINATED, AS WELL AS TO TAKE CARE OF THE FUNCTIONAL AND TEACHING ASPECTS OF THE DELIVERY OF THE COURSES.

ART. 29. LOSS OF CONTRIBUTING CENTER CONDITION. 1. THE DIRECTORATE-GENERAL OF THE NATIONAL INSTITUTE OF EMPLOYMENT, WITH A MINIMUM OF THREE MONTHS ' NOTICE, MAY EXCLUDE FROM THE CENSUS THE SPECIALTIES OF THE CENTRES IN WHICH SOME OF THE FOLLOWING CIRCUMSTANCES ARE PRESENT:

A) NOT MAINTAINED BY THE CENTER OF THE TECHNICAL-PEDAGOGICAL REQUIREMENTS, MATERIALS AND PERSONNEL THAT SERVED FOR THE INCLUSION OF THE CORRESPONDING SPECIALTY IN THE CENSUS.

B) DOES NOT FIT THE NEEDS OF EMPLOYMENT AND OCCUPATIONAL VOCATIONAL TRAINING BASED ON THE CONTINUOUS STUDIES OF THE EVOLUTION OF THE DEMAND FOR EMPLOYMENT AND OCCUPATIONAL REQUIREMENTS AND THE PERIODIC EVALUATION OF THE TRAINING OFFER OF THE CENTER.

(C) NO PROGRAMMING BY THE NATIONAL INSTITUTE OF EMPLOYMENT, IN A PERIOD OF THREE CONSECUTIVE YEARS, OF ANY COURSE CORRESPONDING TO A TYPE APPROVED.

2. IN ADDITION, THE GENERAL MANAGEMENT OF THE NATIONAL INSTITUTE OF EMPLOYMENT MAY EXCLUDE FROM THE CENSUS THE COLLABORATING CENTRES REGISTERED AS SUCH, FOR ONE OF THE FOLLOWING REASONS:

(A) USE OF THE DESIGNATION OF THE PARTNER OF THE NATIONAL INSTITUTE OF EMPLOYMENT FOR OTHER PURPOSES OR ACTIVITIES OTHER THAN THOSE REFERRED TO IN ARTICLE 27 (8) OF THIS ORDER.

B) FAILURE TO COMPLY WITH ARTICLE 27 (6) AND (28).

(C) PERFORMANCE BY THE CENTRE WHICH REPRESENTS A DEVIATION FROM THE ECONOMIC AID TO OTHER PURPOSES OTHER THAN THOSE ENVISAGED, WITHOUT PREJUDICE TO THE RESPONSIBILITIES TO WHICH IT SHOULD TAKE PLACE.

D) NO PROGRAMMING OF COURSES IN THE CENTER, BY THE NATIONAL INSTITUTE OF EMPLOYMENT, IN A PERIOD OF THREE CONSECUTIVE YEARS.

E) DISPOSAL OF INSTALLATIONS AND OF THE MEANS OR TRAINING INSTRUMENTS OF AN APPROVED CENTRE, ACTING AS AN INTERMEDIARY, IN ORDER FOR A DIFFERENT HOLDER TO APPLY FOR THE TYPE-APPROVAL OF SPECIALTIES IN THE SAME CENTRE.

F) SUBCONTRACTING WITH A THIRD PARTY FROM THE MANAGEMENT OF THE COURSES THAT HAVE BEEN SCHEDULED FOR THEM.

3. IN THE CASE OF PUBLIC ADMINISTRATIONS, INSTITUTIONS OR PRIVATE ORGANISATIONS WITH WHICH THE MINISTRY OF LABOUR AND SOCIAL SECURITY OR THE NATIONAL INSTITUTE OF EMPLOYMENT SUBSCRIBE TO A PARTNERSHIP AGREEMENT OR CONCERT, THE PROCEDURE TO BE FOLLOWED FOR THE INDIVIDUAL LOSS OF THE CONDITION OF THE COLLABORATING CENTER IT WILL BE THE PREVIEWED ONE IN THE MENTIONED CONVENTIONS OR CONCERTS OF COLLABORATION. IF THE SAID PROCEDURE IS NOT REGULATED, THE PROVISIONS OF THIS ARTICLE SHALL APPLY.

CHAPTER III

STATISTICS

ART. 30. STATISTICAL TREATMENT. 1. THE STATISTICS OF OCCUPATIONAL VOCATIONAL TRAINING COURSES SHALL BE BROKEN DOWN BY PROGRAMMES AND TYPES OF CENTRES AND COURSES. STUDENTS WILL ALSO BE CLASSIFIED ACCORDING TO THEIR PERSONAL, PROFESSIONAL AND OCCUPATIONAL CHARACTERISTICS.

2. THE APPLICANTS WHO ARE REGISTERED IN THE EMPLOYMENT OFFICES AS REGISTERED UNEMPLOYED WHO REFUSE, UNJUSTIFIABLY, TO PARTICIPATE IN THE OCCUPATIONAL INTEGRATION OR VOCATIONAL TRAINING MEASURES APPROPRIATE TO THEIR PROFESSIONAL CHARACTERISTICS, SHALL BE CLASSIFIED IN THE ABOVEMENTIONED OFFICES WITHIN THE GROUP OF CLAIMANTS EXCLUDED FROM THE REGISTERED UNEMPLOYMENT, FOR THE PURPOSES OF THE SINGLE ARTICLE OF THE ORDER OF 11 MARCH 1985 LAYING DOWN CRITERIA FOR THE MEASUREMENT OF REGISTERED UNEMPLOYMENT. FOR THESE PURPOSES, THE GENERAL VOCATIONAL TRAINING COUNCIL SHALL DRAW UP GUIDELINES FOR DETERMINING THE ADEQUACY OF THOSE MEASURES TO THE OCCUPATIONAL CHARACTERISTICS OF THE UNEMPLOYED.

CHAPTER IV

DEGREES OF PROFESSIONALISM

ART. 31.

DEGREES OF PROFESSIONALISM. 1. THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL ISSUE TO STUDENTS WHO EXCEED THE OCCUPATIONAL VOCATIONAL TRAINING COURSES, TAUGHT BY HIM OR HIS OR HER PARTNER INSTITUTIONS, DEGREES OF PROFESSIONALISM WITH THE EFFECTS WHICH, IN TERMS OF QUALIFICATIONS LABOUR, PROVIDES FOR ARTICLE 1 OF ROYAL DECREE 1992/1984 OF 31 OCTOBER. THE CONTENTS OF THE ABOVE PROFESSIONAL QUALIFICATIONS SHALL BE INFORMED BY THE GENERAL COUNCIL OF VOCATIONAL TRAINING, IN ACCORDANCE WITH THE PROVISIONS OF THE SINGLE ARTICLE OF LAW 1/1986 OF 7 JANUARY.

2. STUDENTS WHO CARRY OUT MODULES OR ISOLATED TRAINING AREAS WILL BE ABLE TO COLLECT THE RELEVANT SUPPORTING DOCUMENTS AND TAKE ADVANTAGE OF THEM UNTIL THEY COMPLETE A TRAINING ITINERARY IN AN OCCUPATION AND THEN OBTAIN THE TITLE OF CORRESPONDING PROFESSIONALISM.

3. PROFESSIONAL QUALIFICATIONS MAY BE USED BY STUDENTS TO CARRY OUT THE ACCREDITATION PROVIDED FOR IN ARTICLE 2, 3, OF ROYAL DECREE 2598/1979 OF 28 SEPTEMBER, IN ORDER TO OBTAIN THE CORRESPONDING TITLE OF VOCATIONAL TRAINING.

ADDITIONAL PROVISIONS

FIRST. THE NATIONAL INSTITUTE OF EMPLOYMENT MAY SUBSIDISE THE CONSTRUCTION OR ACQUISITION OF PREMISES, EQUIPMENT, TEACHING FURNITURE OR TEACHING EQUIPMENT FOR TRAINING CENTRES IN WHICH JOINT TRAINING PROJECTS ARE TO BE CARRIED OUT. COMPANIES, ASSOCIATIONS OF COMPANIES, SECTORIAL OR TERRITORIAL, OR TRADE UNION ORGANIZATIONS WITH THE COLLABORATION, IF ANY, OF PUBLIC OR PRIVATE INSTITUTIONS OF VOCATIONAL TRAINING.

THE AMOUNT OF GRANTS SHALL BE DETERMINED BY APPLYING THE FOLLOWING MAXIMUM PERCENTAGES TO THE BUDGET AMOUNT:

A) UP TO 80 PER 100 OF THE BUDGET WHEN IT COMES TO THE PURCHASE OF EQUIPMENT, TEACHING FURNITURE AND DIDACTIC EQUIPMENT.

(B) UP TO 80 PER 100 OF THE BUDGET IN THE CASE OF THE ACQUISITION OR CONSTRUCTION OF BUILDINGS AND FACILITIES DEDICATED TO OCCUPATIONAL VOCATIONAL TRAINING CENTRES.

(C) UP TO 60 PER 100 OF THE BUDGET IN THE CASE OF THE UPGRADING OF OCCUPATIONAL VOCATIONAL TRAINING CENTRES.

THE PROCEDURE FOR OBTAINING THESE GRANTS WILL BE THE ONE INDICATED IN THE ORDER OF THE MINISTRY OF LABOR AND SOCIAL SECURITY OF JUNE 5, 1987 ( OF 9), A NORM THAT WILL HAVE AN EXTRA CHARACTER. WITH REGARD TO WHAT IS SET OUT IN THIS ADDITIONAL PROVISION.

SECOND. THE PERMANENT COMMISSION OF THE GENERAL COUNCIL FOR VOCATIONAL TRAINING SHALL BE REGULARLY INFORMED OF THE RESULTS OF THE PROGRAMMES ESTABLISHED IN THIS ORDER, OF THE COOPERATION AGREEMENTS WHICH THE MINISTRY OF LABOUR AND SOCIAL SECURITY OR OF THE NATIONAL INSTITUTE OF EMPLOYMENT WITH UNDERTAKINGS, PUBLIC BODIES, INSTITUTIONS OR ORGANISATIONS, AS WELL AS ANY OTHER EXTREME RELATED TO THE DEVELOPMENT OF THE NATIONAL VOCATIONAL TRAINING AND INSERTION PLAN.

THIRD. THE INFORMATION RECEIVED BY THE PROVINCIAL EXECUTIVE COMMISSIONS OF THE NATIONAL INSTITUTE OF EMPLOYMENT, IN THE TERMS INDICATED IN THIS ORDER, SHALL BE RAISED BY THE DIRECTOR GENERAL OF THE NATIONAL INSTITUTE OF EMPLOYMENT. EMPLOYMENT FOR TRANSFER TO THE NATIONAL EXECUTIVE COMMISSION OF THE SAME.

FOURTH. THE NATIONAL INSTITUTE OF EMPLOYMENT SHALL INFORM THE NATIONAL EXECUTIVE COMMISSION OF THAT BODY OF THE EXTENT TO WHICH THOSE PROGRAMMES ARE SUBJECT TO THE EXISTENCE OF BUDGETARY RESOURCES.

QUINTA. THE GRANTING OR REFUSAL OF THE AID PROVIDED FOR IN ARTICLES 2 (3), EXCEPT THAT LAID DOWN IN THE THIRD SUBPARAGRAPH OF ARTICLE 22 (1) AND (2) AND (2) AND (2), SHALL BE THE RESPONSIBILITY OF THE PROVINCIAL DIRECTORS OF THE INEM.

AGAINST THE DECISIONS OF THE PROVINCIAL DIRECTORATES, WHICH MUST BE REASONED, MAY BE BROUGHT, WITHIN 15 DAYS OF NOTIFICATION TO THE PERSON CONCERNED, AN APPEAL TO THE DIRECTOR-GENERAL OF THE INEM, RESOLUTION WILL EXHAUST THE ADMINISTRATIVE ROUTE.

ALSO, IT IS FOR THE PROVINCIAL DIRECTORS TO DEMAND THE RETURN OF THE AMOUNTS OR AID UNDULY PAID BY THE CONCEPTS MENTIONED IN THE FIRST PARAGRAPH ABOVE.

THE PROVINCIAL DIRECTORATE, WHICH HAS DETECTED THE ORIGIN OF THE REFUND, SHALL BE SENT TO THE PERSON CONCERNED IN WRITING, SHOWING THE IRREGULARITIES ASCERTAINED AND REQUIRING HIM TO MAKE, WITHIN 15 DAYS, THE ALLEGATIONS THAT HE CONSIDERS APPROPRIATE.

SUBMITTED OR AFTER THE SAID PERIOD HAS ELAPSED WITHOUT ANY ARGUMENTS BEING MADE, THE PROVINCIAL DIRECTORATE OF THE IMEM WILL DICTATE THE APPROPRIATE RESOLUTION, AGAINST WHICH THE DIRECTOR GENERAL OF THE INEM MAY MAKE AN APPEAL.

TRANSIENT PROVISIONS

FIRST. DURING 1989, A COURSE OF OCCUPATIONAL VOCATIONAL TRAINING SHALL BE ENSURED FOR FIRST-JOB APPLICANTS WHO HAVE AT LEAST ONE YEAR REGISTERED IN THE EMPLOYMENT OFFICE, HAVE FAMILY RESPONSIBILITIES AND HAVE NO INCOME OF ANY KIND. HIGHER THAN THE INTER-PROFESSIONAL MINIMUM WAGE.

THE PUPILS REFERRED TO IN THE PRECEDING PARAGRAPH, WHERE THEY ARE LESS THAN 25 YEARS OF AGE, SHALL RECEIVE AN AID EQUIVALENT TO 75 PER 100 OF THE MINIMUM INTER-PROFESSIONAL SALARY IN FORCE AT ANY TIME, REPLACING THE GRANT. INDIVIDUAL OF 572 PESETAS PER DAY, UNDER THE CONDITIONS LAID DOWN IN ARTICLE 22 OF THIS ORDER.

TO THIS EFFECT, IT IS UNDERSTOOD BY FIRST-EMPLOYMENT CLAIMANT THAT HE HAS NOT WORKED FOR A PERIOD OF MORE THAN THREE MONTHS.

SECOND. BY WAY OF DEROGATION FROM ARTICLE 4 (2) OF THIS ORDER, WORKERS WHO, IN COMPLIANCE WITH THE REQUIREMENTS LAID DOWN IN ARTICLE 13 (1) OF THE LAW, SHALL HAVE PRIORITY TO PARTICIPATE IN VOCATIONAL TRAINING COURSES. 31/1984, OF 2 AUGUST, ARE IN THE SITUATION REFERRED TO IN POINT (A) OF THAT NUMBER AND HAVE EXHAUSTED BEFORE 1 JANUARY 1989 THE UNEMPLOYMENT BENEFIT COVERED BY THAT LAW.

REPEAL PROVISION

THE ORDER OF THE MINISTRY OF LABOUR AND SOCIAL SECURITY OF 22 JANUARY 1988, FOR WHICH THE AGREEMENT OF THE COUNCIL OF MINISTERS IS BEING DEVELOPED, IS HEREBY REPEALED, LAYING DOWN THE BASIS OF THE NATIONAL TRAINING AND INTEGRATION PLAN VOCATIONAL TRAINING AND VOCATIONAL TRAINING COURSES TO BE PROVIDED BY THE COLLABORATING CENTRES OF THE NATIONAL INSTITUTE OF EMPLOYMENT. THE ORDER OF 23 MARCH 1988 ESTABLISHING THE JURISDICTION AND THE PROCEDURE FOR THE GRANTING OF AID PROVIDED FOR IN THAT OF 22 JANUARY 1988 IS ALSO HEREBY REPEALED.

FINAL PROVISIONS

FIRST. THE EXPENDITURE OF ALL THE PROGRAMMES PROVIDED FOR IN THIS ORDER SHALL BE CONDITIONAL ON THE EXISTENCE OF BUDGETARY RESOURCES FOR SUCH PROGRAMMES ARISING FROM THE BUDGET OF THE NATIONAL INSTITUTE FOR EMPLOYMENT AND THE GRANTING OF SUCH PROGRAMMES. CORRESPONDING AID BY THE EUROPEAN SOCIAL FUND.

SECOND.

THE GENERAL SECRETARIAT FOR EMPLOYMENT AND INDUSTRIAL RELATIONS AND THE DIRECTORATE-GENERAL OF THE NATIONAL INSTITUTE OF EMPLOYMENT IS HEREBY AUTHORISED, AFTER CONSULTING THE PERMANENT COMMISSION OF THE GENERAL COUNCIL FOR VOCATIONAL TRAINING, TO ISSUE A NUMBER OF RULES ARE NECESSARY FOR THE DEVELOPMENT AND IMPLEMENTATION OF THE PROVISIONS OF THIS ORDER IN THE FIELD OF THEIR SPECIFIC POWERS.

THIRD. THIS ORDER WILL TAKE EFFECT THE DAY AFTER YOUR PUBLICATION IN THE .
