Article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, establishes the criteria and guidelines in which the offer of public employment, conceived as an instrument of rationalization, must be framed. of the processes of selection of personnel in the service of the Public Administrations, in which the constitutional principles of equality, merit and capacity must prevail.

In this context, the offer of public employment can be seen as an effective mechanism for carrying out the above objectives and, in particular, to make progress in achieving a coherent and effective policy on resources. Humans within the Administration.

This ultimate objective has led to the elaboration of the present offer, which has had among its fundamental criteria the non-increase of public expenditure and priority attention to the qualitative aspects against the quantitative.

In this sense, it should be noted that the present offer is financed in its entirety with the credit released by the losses of personnel, experienced by the ministerial departments, representing, therefore only the (a) the amount of expenditure incurred during the previous financial year and, in sum, a replacement offer.

Also, the recent Administration-Trade Union Agreement for the modernization of the Administration and the improvement of working conditions in it establishes as objectives of the public employment policy the selective growth of job opportunities in some basic public services, the proper sizing of the templates and the creation of job opportunities for the professional promotion.

The special attention to basic public services, which is required by the adequate satisfaction of the needs experienced by the current Spanish society, is fundamentally materialized in the high number of places offered for the Penitentiary Administration, as a consequence of the current Plan for the Depreciation and Creation of Prison Centers, as well as for the teaching administration, area on which the provisions contained in the Law significantly affect 1/1990, of 3 October, of General Management of the Educational System.

Thus, in order to satisfy satisfactorily the needs of new personnel deriving from the application of the Organic Law, this Royal Decree collects the requests of the Ministry of Education and Science required by the setting up of new schools and educational projects.

In parallel, the offer of public employment for 1992 seeks to achieve the objective of stabilizing and adequately sizing up the current staff of teaching staff, facilitating the access of interim officials to the role of the Teaching public, as provided for in the transitional provision fifth of the LOGSE.

This preferential orientation towards certain areas of activity means a much more connected offer with the reality of the Public Administration and with the needs of the citizens, which is also evident in the (i) attention to the selection of staff entitled, given that the current process of modernisation in which the Spanish authorities are involved inexcusably leads to the existence of qualified professionals who are sufficiently qualified as engine of the refresh process.

At the same time, the priority in the selection of groups A and B is accompanied by a decrease of the places offered in group D, in order to gradually implement an adequate sizing of the current ones. templates, in many cases over-sized, and with an inadequately operational composition to adequately meet the required activities.

At the same time, the systems of selection of such staff established in Article 19 of Law 30/1984, of 2 August, and developed in Title III of Royal Decree 2223/1984, of December 19, will be maintained.

Finally, in terms of the internal promotion, referred to in Article 22.1 of Law 30/1984, of 2 August, in accordance with the wording given by Law 23/1988, of July 28, this Royal Decree represents an advance in how much future lines to follow.

It should be noted that the total number of vacancies expressed in Annex I of this Royal Decree includes those corresponding to internal promotion. A sufficient number of seats shall be reserved in the respective calls to be provided by such a system, depending on the number of potential candidates.

Moreover, and as in previous offers of public employment, the procedure for the incorporation of persons with disabilities to the Public Administration is continued, establishing quotas for such persons. in different selective testing of access to Bodies or Escalations of officials, as well as to job vacancies.

Similarly, the relevant selective tests will not establish discrimination on grounds of sex, in accordance with the provisions of Article 14 of the Spanish Constitution and in Council Directive 76 /207/EEC of 9 February (a) 1976 on the application of the principle of equal treatment between men and women and with regard to access to employment, training and professional promotion and working conditions.

The number of vacancies set out in Annex I may be added to the number of places resulting from the fulfilment of the provisions of the transitional provision 15th of Law 30/1984 of 2 August, added by the Law 23/1988, July 28.

For these purposes, the selective testing of access to the Corps, Escalas or Specialties to which seats corresponding to positions served by labor personnel that have been classified as classified as personal staff may include a shift which shall be referred to as "Pashes affected by Article 15 of the Law of Measures", in accordance with the terms laid down in Article 37 of the General Budget Law for 1991 and the Agreement of the Council of Ministers of 27 March of the same year.

Finally, the necessary dedication to the selective tasks and the strictly professional character of the selection bodies advise to exclude those who have the consideration of high positions, according to the established in Law 25/1983 of 26 December on incompatibilities of senior officials.

In its virtue, on the proposal of the Minister for Public Administrations, with the favorable report of the Higher Commission of Personnel and after deliberation of the Council of Ministers at its meeting of March 20, 1992,

DISPONGO:

Article 1. ° Approval of the public employment offer.

In compliance with the provisions of Article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, the offer of public employment for 1992 is approved in the terms established in the present Royal Decree.

Art. 2. Quantification of the supply of public employment.

The offer of public employment includes vacancies provided in the General Budget of the State for 1992, in the following detail:

Annex I. Body and Scales of Officials included in the scope of Law 30/1984 of 2 August.

Annex II. Places of work staff included in the scope of Law 30/1984 of 2 August.

Art. 3. "Internal Promotion".

In each call, a sufficient number of seats will be reserved for their provision through the internal promotion system, depending on the number of potential candidates, according to the recent agreement. These places will be covered as appropriate, in accordance with the provisions of the General Regulations for the Provision of Jobs and the Professional Promotion of State Administration officials approved by Royal Decree 28/1990 of 15 December 1990. Art. 4. No fixed employment staff in official posts.

The places listed in Annex I may be increased with those resulting from the precept in the transitional provision 15th of Law 30/1984, of 2 August, added by Law 23/1988, of July 28.

For these purposes, the selective testing of access to the Corps, Escalas or Specialties to which seats are attached to posts served by employees who have been classified as their own (a) official staff may include a shift which shall be referred to as 'Pashes affected by Article 15 of the Measures Act', in accordance with the terms laid down in Article 37 of the General Budget Law for 1991 and the Council Agreement of Ministers of 27 March of the same year.

Seats not covered for this shift will in no case be cumulative to those of the remaining shifts.

The specific characteristics of the selective calls for tests to be carried out pursuant to the said transitional provision fifteenth shall be in accordance with the provisions of the said Council of Ministers Agreement. of 27 March 1991.

In addition, where compliance with the said transitional provision requires, selective testing for the entry of Bodies or Scales not included in Annex I may be convened.

Also, according to the Council of Ministers ' Agreement, on a proposal from the Ministry of Public Administrations, prior to the Ministry of Economy and Finance, the Departments will be able to extend their offer of public employment once (a) the corresponding selective processes, when obtaining the status of a career official by the eventual staff or acting official would lead to significant shortages of staff, and in any case they should be generated budgetary resources for this purpose.

Art. 5. Admission of people with disabilities.

In the selective testing for entry into Bodies and Escalations of officials and categories of labour personnel, including those for internal promotion, persons with disabilities on equal terms will be admitted. conditions with other applicants.

Calls shall not establish exclusions for physical and/or physical limitations, without prejudice to incompatibilities with the performance of the relevant tasks or functions.

In selective testing, including training courses or traineeships, the possible adaptations of time and means for their realization will be established for people with disabilities who request it. This possibility should be expressly stated in the calls, as well as the need for the interested parties to make a specific request in the request for participation.

To this end, the Courts or Selection Commissions may require a report and, where appropriate, collaboration of the technical bodies of the Administration of Labour, Health or the competent bodies of the Ministry of Social.

Arl. 6. Places for people with disabilities.

Of the total number of places offered will be reserved a 3 per 100 to be covered by those with the legal status of people with disabilities.

The distribution by Corps, Escalas or categories of work personnel will be carried out in the respective call for selective tests heard by the Ministry of Social Affairs.

The option for reserved places shall be made in the request for participation in the calls, with the express declaration of the persons concerned to meet the condition required in this respect, which shall be credited, if the place is obtained, by certification of the competent bodies of the Ministry of Social Affairs and in their case of the Autonomous Community concerned.

The selective tests shall be carried out on an equal basis with applicants for free access, without prejudice to the adaptations provided for in Article 5. of this Royal Decree.

If in the performance of the same questions the Tribunal will be raised with respect to the ability of the aspirant for the performance of the activities usually developed by the officials of the Body or Scale, or category of The competent authority may, in accordance with the third paragraph of this Article, obtain the relevant opinion of the competent body.

In the initial allocation of the job, the competent authority or the Commission of Valuation may require, in respect of persons entered by this reserve quota, the opinion of the body referred to above on the compatibility of the candidate to the post or the adaptations of the post.

Art. 7. Selection of work staff.

The selective tests corresponding to the places of work staff set out in Annex II to this Royal Decree shall relate to posts which, as referred to in Article 15 of Law 30/1984, of 2 August, in the version given by Law 23/1988, of July 28, can be performed by labor personnel.

Art. 8. Procedure for the selection of work staff.

When, by application of Collective Agreements or Specific Regulations, the places announced for job vacancies are to be covered by internal promotion systems, those previously to those of the General system of free access. Seats that are vacant will then be offered on such free access systems.

The places of work staff referred to in Annex II must be convened, necessarily, within the period of validity of this Royal Decree, and no calls may be made as of the date of entry into force of the Royal Decree approving the offer of public employment for 1993.

Prior to the authorization by the Ministry for Public Administrations of the call for selective tests for admission to the places of work staff listed in Annex II of this Royal Decree, the Proposers shall present accreditation of the Ministry of Economy and Finance with respect to the existence of budgetary allocation.

Art, 9. º Interim Officials.

Interim officials shall not be appointed, except for replacements, in places that have not been announced in the public employment offer.

Interim officials of the State Administration, its autonomous organizations and the Social Security Administration shall automatically cease, as appropriate, upon joining their posts. (a) to replace or to take possession as race officials of the candidates approved in the respective calls for selective testing, as well as in the case of the place being deleted in the list of posts approved and published by the Inter-Ministerial Committee on Remuneration or is deemed to no longer exist the reasons for urgency which motivated their interim coverage.

In all of these cases, the cancellation of your registration in the Central Personnel Registry will be automatically made.

However, the educational administration may appoint interim officials to meet new needs, duly justified and provided that it accredits the inadequacy of career officials to address the needs of the same.

Art. 10. º Requirements for participation.

In no case will the prior registration in the Employment Offices be necessary to participate in the selective processes derived from the present offer of public employment.

The application models to participate in the entrance procedures and the systems for the credit of the examination rights will be those approved by the Secretariat of State for Public Administration.

Art. 11. Unselect Unit Tests.

Unit selection tests will be called for the Bodies and Escalations that are related grouped in the following sections:

1. Assistant General Body of the State Administration, Auxiliary Body of the Administration of Social Security.

2. Body of Industrial Engineers. Body of Mines Engineers.

Art. 12. Geographical distribution of Auxiliary Corps squares.

In the unit selective tests for admission to the General Auxiliary Corps of the State Administration and Auxiliary of the Administration of Social Security, the places to be offered will be distributed territorially. according to the geographical areas to be determined in the call. These places will be linked to the respective geographical areas throughout the selection and provision process. The selection body shall act and shall evaluate the evidence and publish the approved relationships independently for each geographical area.

Art. 13. Participation in selective testing courts.

They may not be part of the Selection Commissions or the Courts of selective testing for admission to the State Administration or of the State Administration or of categories of labor personnel who have the consideration of high In accordance with the provisions of Law 25/1983 of 26 December on incompatibilities of senior officials.

Additional disposition first. Staff of Autonomous Communities.

With the independence of the places detailed in the Public Employment Offer approved by this Royal Decree, the State Administration, on a proposal from the Autonomous Communities, may select personnel to fill seats of these Communities, including them in the corresponding calls for entry.

Additional provision second. University Administration and Services staff.

The State Administration, at the request of the Universities, may select administration personnel and services to fill seats in the same.

Additional provision third. Local Administration Staff.

In order to address the needs of the Local Administration, the Ministry for Public Administrations may call for selective testing for access to the Scale of Local Government Officials with National rating on the basis of existing vacancies on the various Subscales.

Additional provision fourth. Teaching staff.

The places corresponding to the teaching staff included in Annex I of this Royal Decree include the forecasts made as from the provisions of the transitional provision of the Organic Law 1/1990, of 3 of October, General Management of the Educational System.

Additional provision fifth. Essential public services.

By Agreement of the Council of Ministers, at the proposal of the Ministry for Public Administrations and prior report of the Ministry of Economy and Finance, the number of places included in the annexes of this Royal Decree may be If the provision of essential public services to the citizen so requires, it should be extended during the period of validity of the same.

FINAL PROVISIONS

First.

The rules on the coordination and preparation of public employment offers contained in Royal Decree 352/1986 of 10 February 1986 shall be understood as valid.

Second.

No appointments of career officers may be made or contracts of employment personnel are to be formalised for places that lack budgetary allocation or do not appear in the relations of jobs.

Third.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State" and shall remain in force until the entry into force of the Royal Decree approving the offer of public employment for 1993.
