Article 18 of law 30/1984 of 2 August, of measures for the reform of the public function, set the standards and guidelines to which must be framed public employment offer, conceived as an instrument for streamlining processes of personnel selection at the service of the public administrations, in that the constitutional principles of equality should prevail merit and capacity.
In this context, it can be considered to public employment offer an effective mechanism to implement the above objectives and, in particular, advance gradually in the achievement of a coherent and effective human resources policy at the heart of the administration.
This last objective has presided over the preparation of the present offer, which has had among its fundamental criteria do not increase public expenditure and priority attention to the qualitative aspects against the merely quantitative.
In this regard, it should be noted that this offer is financed in its entirety with credit released by the losses of troops, experienced by the various ministerial departments, representing, therefore only the permanence of part of the expenditure effected during the preceding financial year and constituting, in short, a range of replacement.
Also, the recent Administracion-sindicatos agreement for the modernization of the Administration and the improvement of working conditions in the same sets as objectives of public employment policy the selective growth of employment opportunities in some basic public services, the right sizing of templates and the creation of employment opportunities for the professional development.
Special attention to basic public services, required for the adequate satisfaction of needs experienced by the current Spanish society, is embodied mainly in the number of prison places to the prison administration, as a result of the current Plan of redemption and creation of centers, as well as for educational administration, area on which significantly affect the provisions contained in Act 1/1990 , 3 October, General Organization of the educational system.
Thus, in order to satisfactorily the needs new staff arising from the implementation of such a law, this Royal Decree collects the requests of the Ministry of education and science required by the commissioning of new hospitals and educational projects.
At the same time, the supply of public employment for 1992 is the goal of stabilizing and properly sizing the current templates of teaching staff, facilitating access for interim officials to teaching public service, as provided for in the fifth transitional provision of the LOGSE.
This orientation preference towards certain areas of activity involves an offer much more connected with the reality of public administration and the needs of the citizens, which is also evident in the attention given to the selection of personnel entitled, since the ongoing process of modernization that the Spanish Government is immersed entails inexcusably the existence of graduate professionals sufficiently qualified as an engine of the renewal process.
Simultaneously, the priority in the selection of groups A and B is accompanied by a decrease in vacancies offered in Group D, with a view to gradually exploit a proper dimensioning of the current templates, in often oversized, and insufficiently operational composition to adequately meet the required activities.
With regard to the workforce, the EPO this year is make an approximation of the requests to the real needs of the departments, for the fulfilment of the objectives that are assigned, the realization of an adequate management of its forces and coverage of their vacancies.
The complementarity of the workforce on the officer in a comprehensive management of human resources in the management centres has determined that the same criteria applicable to the personal officer have been used for the workforce: the replacement of vacancies caused by low and retirements and the selective growth of certain public services; to them must be added two specific objectives for this group: the streamlining of the selective processes and the proper sizing of templates of the centers.
At the same time, will remain the labour recruitment systems set out in article 19 of the law 30/1984 of 2 August, and developed in the title III of Royal Decree 2223 / 1984, of 19 December.
Finally, in terms of internal promotion, to which refers article 22.1 of law 30/1984 of 2 August, in accordance with the wording given by law 23/1988, of 28 July, this Royal Decree is a step forward in terms of future lines to follow.
It should be noted that the figures total vacancies that are expressed in annex I of this Royal Decree are those corresponding to internal promotion. In the respective notices will be reserved one sufficient number of seats to be provided by this system, the number of potential candidates.
On the other hand, and as in previous offers of public employment, continued the procedure aiming at the incorporation of people with disability to public administration, establishing quotas of seats intended for such people in different selective checks of access to bodies or scales of officials, as well as places of work person.
Similarly, the selective tests not established discrimination on grounds of sex, in accordance with the provisions in article 14 of the Spanish Constitution and the Directive 76/207/EEC of the Council of 9 February 1976 on the implementation of the principle of equal treatment between men and women and as regards access to employment training and professional promotion and working conditions.
The number of vacancies listed in annex I may be added the number of seats resulting from compliance with the provisions in the fifteenth transitional provision of law 30/1984 of 2 August, added by law 23/1988, of 28 July.

In his virtue, a proposal from the Minister for public administrations, with the favorable report of the higher Committee on Personal and prior deliberation of the Council of Ministers at its meeting of March 20, 1992, have: article 1. ° adoption of the public employment offer.
Pursuant to the provisions of article 18 of law 30/1984 of 2 August, measures for the reform of the public function, approves the offer of public employment for 1992 in the terms established in the present Royal Decree.
Article 2. ° quantification of the public employment offer.
Vacancies at in the General State budget for 1992, with the following details are included in the public employment offer: Annex i. bodies squares and scales of officials included in the scope of the law 30/1984 of 2 August.
Annex II. Spaces of labour staff included in the scope of the law 30/1984 of 2 August.
Article 3. ° internal promotion.
One sufficient number of seats for their provision through the system of internal promotion, depending on the number of potential candidates, according to the recent Administracion-sindicatos agreement for the modernization of the Administration and the improvement of working conditions in the same will be reserved in each call. These squares will be covered in your case, in accordance with the provisions of the regulation General of Provision of jobs and of professional promotion of officials of the administration of the State approved by Royal Decree 28/1990, of 15 January.

Also, by agreement of Council of Ministers, on a proposal from the Ministry for public administrations, following a report of the Ministry of economy and finance, departments may expand their offerings of public employment once surpassed the corresponding selective processes, when obtaining status career by eventual personnel officer, or acting official cause significant shortages of personnel being necessary, in any case, generated budgetary availabilities for this purpose.
Art. 5. ° admission of disabled people.
In the selective tests for admission to bodies and officials scales and categories of staff, including those for internal promotion, will be admitted persons with disability on equal terms with other applicants.
The calls shall not adopt exclusions by psychic or physical limitations subject to the incompatibilities with the performance of the tasks or functions.
In the selective tests, including the courses of training or internship, will be established, for people with disabilities who request it, adaptations possible time and means for their realization. The calls shall indicate expressly this possibility, so that stakeholders should be made by the corresponding specific request in the application for participation.
For this purpose, the courts or selection committees may require report and, where appropriate, cooperation of the technical bodies of the labour, health administration or of the competent bodies of the Ministry of Social Affairs.
ARL. 6. ° places for disabled people.
Of the total number of places offered a 3 by 100 to be covered by those who have the legal status of disabled people will be reserved.

If in the realization of these doubts to the Court with respect to the capacity of the applicant to carry out the activities usually carried out by the officials of the body scale, or category of staff that it opts is wrestle, it may request the relevant opinion of the competent authority, in accordance with the provisions of the third paragraph of this article.
In the initial allocation of job, competent organ or the valuation Committee may require, with respect to persons who entered by this quota of reservation, opinion of the body previously mentioned about compatibility of the candidate to the job or adaptations of the latter.
Article 7. Labour recruitment.
The selective tests on workforce vacancies listed in annex II of this Royal Decree shall refer to positions which, according to stated in article 15 of the law 30/1984 of 2 August, in the version given by law 23/1988, of July 28, may be carried out by staff.
Article 8. ° selection procedure for staff.
When by application of collective agreements or specific regulations should be filled by internal promotion systems announced to staff vacant squares, those will be made previously to the general system of free access. Squares resulting vacancies will be offered below in such free access systems.
The squares of staff referred to in annex II shall be convened, necessarily, within the period of validity of the present Royal Decree, and may not be calls from the date of entry into force of the Royal Decree that approved the offer of public employment for 1993.
Prior to the authorisation by the Ministry for public administrations of the call of selective tests for entry into the workforce places listed in the annex II of this Royal Decree, the proponent agencies must present accreditation from the Ministry of economy and finance with respect to the existence of budgetary allocation.
Art, 9th interim officials.
Not may appoint interim officials, except for replacements, in places that have not been announced in the public employment offer.

Article 10 requirements for participation.
In no event shall required prior registration at the employment offices to participate in the selective processes arising from the present public employment offer.

Article 12. Geographical distribution of seats of auxiliary bodies.

Article 13. Participation in courts of selective evidence.
They may not form part of selection committees or courts of selective tests for admission to bodies or scales of the administration of the State or of categories of staff who have the consideration of high office in accordance with the law 25/1983, of 26 December, on incompatibilities of officials.
First additional provision. Staff of autonomous communities.
Regardless of the squares outlined in public employment offer approved by this Royal Decree, the administration of the State, on a proposal from the autonomous communities, you can select personnel to cover places of these communities, including them in the corresponding calls for income.
Second additional provision. Personnel of administration and services of the universities.
The administration of the State, at the request of the universities, you can select personnel of administration and services to cover places in them.
Third additional provision. Staff of Local Administration.
In order to meet the needs of the Local Administration, the Ministry for public administrations may be called selective tests for access to the scale of Local administration officials with enabling national character depending on vacancies in the various subscales.
Fourth additional provision. Teaching staff.
Corresponding to the teaching staff vacancies listed in annex I of the present Royal Decree include forecasts made from provisions of the fifth transitional provision of the organic law 1/1990 of 3 October, General Organization of the educational system.
Fifth additional provision. Essential public services.
By agreement of Council of Ministers, proposed by the Ministry for public administrations and following a report of the Ministry of economy and finance, the number of places included in the annexes of the present Royal Decree may be extended if the period of validity of the same public services essential to the citizen so requires.
FINAL provisions first.
The rules on coordination and preparation of the offers of public employment contained in Royal Decree 352/1986, of 10 February shall be in force.
They may not be career appointments or formalize contracts of labour staff to places that lack of budgetary provision, or do not appear in the relationships of jobs.
This Royal Decree shall enter into force the day following its publication in the "official State Gazette" and remain in force until the entry into force of the Royal Decree that approved the offer of public employment for 1993.
