The third final provision of Law 11/1988 of 3 May on the legal protection of topographies of semiconductor products, published in the Official Journal of the State of 5 May, authorizes the Government to amend Article 3, 3, in order to extend the right to the protection of persons originating in third countries or territories, who do not belong to the European Economic Community and who do not benefit from protection, when so established by the bodies of the European Communities.

Royal Decree 855/1989 of 7 July 1989 extending the legal protection of topographies of semiconductor products to persons originating in the countries and territories listed in the Annex thereto, was The Commission also took the view that the Commission had not yet taken the view.

For its part, the Council of the European Communities has adopted Decision 90 /510/EEC of 9 October 1990 extending the legal protection of topographies of semiconductor products on a permanent basis, to countries and territories which have appropriate national legislation to provide for such protection.

Making use of the authorization to the Government provided for in the third, first paragraph, final provision of Law 11/1988 of 3 May, and taking into account Decision 90 /510/EEC adopted by the Council of the European Communities, it is appropriate to lay down the corresponding national standard for the extension of the legal provision of topographies of semiconductor products to persons originating in the countries and territories listed in the Annex to this Regulation. provision.

In its virtue, on the proposal of the Minister of Industry, Commerce and Tourism, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting of November 13, 1992

D I S P O N G O:

Single item. Beneficiaries of protection:

1. They shall benefit from the protection provided for in Law 11/1988 of 3 May on the legal protection of topographies of semiconductor products, natural persons who are nationals of a country or territory listed in the Annex to this Regulation. (a) provision or their habitual residence in one of those countries or territories.

2. The legal persons of a country or territory listed in that Annex and having a real and effective industrial or commercial establishment in that country or territory shall also benefit from the same protection.

3. The extension of legal protection to natural and legal persons referred to in paragraphs 1 and 2 above shall be understood as from 8 November 1990.

Single end disposition.

This Royal Decree will enter into force on the day following its publication in the Official Journal of the State.
