The basic organic structure of the Ministry of Public Works and Transport is established by Royal Decree 576/1991, of 21 April, which creates the General Secretariat of Planning and Territorial Concertation, as a support body direct to the head of the Department, and on which the new Directorates General of Intermodal Planning of Transport in the Great Cities and of Interregional Planning of Great Infrastructures, as well as the Institute of the Territory and Urbanism.

Consolidated already the operation of the General Secretariat of Planning and Territorial Concertation, it is necessary to provide it with a General Services unit that will develop its functions for the Secretariat as a whole General and serve at the same time of common administrative support and coordination of those corresponding to the three management centers that integrate it.

Similarly, it is necessary to adapt the name, organization and functions of the Institute of Territory and Urbanism to the new tasks that it has to carry out within the General Secretariat of which it depends, passing on to be called the Directorate-General for Territorial Policy and Urbanism, which is given a flexible structure according to which Royal Decree 576/1991, of 21 April, assigns to the other two Directorates-General of the General Secretariat, if either the General Subdirectorate existing at the Territory Institute is attached to it; and Urbanism.

On the other hand, Royal Decree 1125/1991 of 22 July, restructuring the Secretariat of the Ministry of Public Works and Transport, established in its article 7 the functions of the Directorate General for Housing and Architecture, its organic structure up to Subdirección General and the competencies that correspond to each of these units; as well as the membership of the State Society of Promotion and Equipment of Soil (SEPES) and the dependency functional of the executive director of the General Secretariat of Planning and Concertation Territorial, in order to guarantee the coordination of the housing policy with those relating to the spatial planning and the transports.

The new state housing policy requires a minimum functional adequacy among some of the Subdirectorates General that make up the Directorate General for Housing and Architecture, and of course the State Society for the Promotion and Equipment of Soil (SEPES) to the General Secretariat of Planning and Territorial Concertation, in order to enable this higher body to assume in a more effective way its function of providing the Department of necessary unit of criterion in the actions of the different operational areas with incidence territorial.

In its virtue, at the initiative of the Minister of Public Works and Transport, at the proposal of the Minister for Public Administrations and after deliberation of the Council of Ministers at its meeting of November 27, 1992,

DISPONGO:

Article 1.

1. The Directorate-General for Territorial Policy and Urbanism, under the General Secretariat of Planning and Territorial Concertation, of the Ministry of Public Works and Transport, is hereby established.

2. It is for the Directorate-General for Territorial Policy and Urbanism to exercise the following functions:

(a) The elaboration of the guidelines, instruments and territorial programs that fall within the competence of the State Administration and the study of the territorial impact of the plans, works and actions whose implementation corresponds to to the State and, in particular, to the Ministry of Public Works and Transport.

b) The design of urban policies within the competence of the State Administration, with particular attention to the resolution of the problems of cities and metropolitan areas, as well as the initiative, drawing up and proposing concrete action measures.

(c) The advice, initiative and proposal of activities aimed at obtaining coordinated action with other public administrations, ministerial departments, management centres and other bodies dependent on the Ministry of Public Works and Transport and collegiate bodies of urban nature, in all matters related to actions with territorial impact.

d) The formulation of programs and structures to support state participation in international organizations and the representation of the territorial and urban interests of the Ministry of Public Works and Transport. regional and local authorities responsible for the approval of urban and territorial planning, ensuring the defense of the property and property assets assigned to that department.

e) The promotion of research and teaching, the dissemination of knowledge and the treatment and coordination of information in the area of territory and urbanism.

f) The actions as a permanent body responsible for preparing the issues of the Central Committee of the Territory and Urbanism and the issuance of reports and opinions in the cases provided for in the current provisions, which request the holder of the Department or the management centres and the processing of the files of the Department's competence in these matters.

Article 2.

The Directorate-General for Territorial Policy and Urbanism will not be structured in a hierarchical manner and its functioning will be developed through working teams formed on the basis of flexible functional relationships for each of the established work programmes.

Article 3.

Directly dependent on the Secretary-General of Territorial Planning and Concertation shall be a General Services Unit, with an organic level of General Subdirectorate, which shall be responsible for the tasks of personnel, (i) recruitment, economic and budgetary management, legal and administrative support and other services of a general nature needed in the area as a whole and in the management centres that make up the area.

Additional disposition first.

The following paragraphs of Article 7 of Royal Decree 1125/1991, of 22 July, of restructuring of the Undersecretary of the Ministry of Public Works and Transport are reworded:

Four. It is the responsibility of the Subdirectorate-General for Housing Aid to exercise the functions assigned to it by the management centre in paragraph 1. 2, as well as the relationship with the financial institutions and with the local authorities in respect of refers to the application of the system of aid. >

Additional provision second.

The State Society for the Promotion and Equipment of Soil (SEPES) is attached to the General Secretariat of Planning and Territorial Concertation, without prejudice to the necessary coordination with the Directorate General for Housing and Architecture, in the fields of generic competence of this and specifically in the execution of the programs of housing construction.

Additional provision third.

The following organs are deleted:

1. Management centres with an organic level of Directorate-General:

Territory Institute and Urbanism.

2. Sub-Directorates-General or similar bodies:

a) General Secretariat of the Territory and Urban Institute.

b) Deputy Director General of the Territory and Urban Institute.

Additional provision fourth.

The Director-General for Territorial Policy and Urbanism will be the Vice President of the Plenum of the Central Committee of the Territory and Urbanism, created by the additional seventh provision of the recast text of the Law on the Regime of Land and Urban Planning, approved by the Royal Legislative Decree 1/1992, of June 26.

First transient disposition.

The Deputy Director General of the Territory and Urban Planning Institute will continue to perform its duties, under the authority of the Directorate General for Territorial Policy and Urbanism, until such time as the the employment relationship of that management centre, at which time the deletion provided for in the third, second provision of this Royal Decree will be effective.

Second transient disposition.

All units with an organic level lower than the General Subdirectorate and the existing jobs in the extinct Territory and Urban Institute, are assigned to the Subdirectorate General, mentioned in the provision Previous transitional period, dependent on the Directorate General for Territorial Policy and Urbanism, until the corresponding provisions and measures of development and implementation of this Royal Decree are adopted.

Single repeal provision.

Article 7 (9) of Royal Decree 1125/1991 of 22 July 1991, restructuring the Secretariat of the Ministry of Public Works and Transport, and Article 2 (3) of the Royal Decree, are hereby repealed. 1654/1985, of 3 July.

Final disposition first.

The Minister of Public Works and Transport is authorized to dictate, prior to the completion of the procedures that are mandatory, how many provisions and measures are necessary for the development and execution of the provisions of the Royal Decree.

Final disposition second.

The Ministry of Economy and Finance will carry out the budgetary changes that are necessary for the effectiveness of the provisions of this Royal Decree.

Final disposition third.

This Royal Decree will enter into force on the day following its publication in the Official Journal of the State.
