The Organic Law 1/1990 of 3 October of General Management of the Educational System provides, in Article 23 (2) and (3), that educational administrations will ensure a sufficient supply of specific programmes of Social guarantee, aimed at those students who have left the stage of compulsory secondary education without achieving the corresponding objectives. It also provides that the purpose of such programmes is to provide such pupils with basic and vocational training which enables them to enter into active life or to pursue their studies, especially in the field of vocational training. the average degree, through the test of access to the corresponding training cycles.

The Law also points to the possibility that the local administration may collaborate in the development of these programs.

For its part, Royal Decree 1345/1991 of 6 September ("Official State Gazette" of 13), provides that the specific programs of Social Guarantee will be regulated by the Ministry of Education and Science, in its territory of management; it fixes the minimum age of the students to which they are intended for sixteen years and establishes that the Ministry of Education and Science will promote, for the implementation of these programmes, Conventions with other Administrations and Institutions, public or private, and will provide material and personal resources that contribute to its effectiveness.

Already in the early implementation phase of the second cycle of Compulsory Secondary Education, which Royal Decree 986/1991 of 14 June, allows, and which the Ministry of Education and Science will undertake from the course 92/93, in a number of Centres, it is necessary to provide for the possibility for students aged over 16 to encounter learning difficulties or personal circumstances of a different nature to prevent them from achieving the objectives of such learning. stage, and need and want to access an offer of Social Guarantee programs.

There is, on the other hand, a high number of unemployed young people over the age of 16 who have left the education system without a minimum professional qualification, with incomplete basic general training, and are unemployed and have difficulties in the job integration, due in most cases to their educational and vocational training gaps. Although their exit from the educational system has not been produced since the stage of compulsory secondary education, not yet implemented, their situation as regards their chances of job insertion or educational reintegration is similar to that of the (i) students who are defined as possible recipients of the Social Guarantee programmes by the Law on the General Management of the Education System, and therefore these programmes must also be addressed to them.

For all this, and in order to facilitate the reintegration into the education system of young people who want it, or to enable the constitutional principle of access to a job, in the best possible conditions, for those who decide to enter into active life, the Ministry of Education and Science intends with this regular order, until the generalization of the second cycle of compulsory secondary education has been completed, the implementation of the Social Guarantee programmes which, under Article 23 of the Organic Law 1/1990, of Ordination General of the Educational System; of Article 14 of Royal Decree 1007/1991, of 14 June ("Official State Gazette" of 26), and of Article 20 of Royal Decree 1345/1991 of 6 September ("Official State Gazette" of 13) in the territorial area of management that corresponds to it, through different modalities adapted to the needs of the students, in the educational centers or in the collaboration regime or the Convention of the Ministry of Education and Science with others Public or private administrations or institutions.

By virtue of the above, this Ministry has:

First. -Social Guarantee programs to be established in the territory of management of the Ministry of Education and Science, during the period of early implementation of the second cycle of compulsory secondary education, develop in accordance with the provisions of this Order.

Second. These programmes will be aimed at young people under the age of 21 who, at least, are 16 in the calendar year of the start of the programme, and have not achieved the objectives of compulsory secondary education. hold any vocational training qualifications.

Third. -1. They may access the young Social Guarantee programmes, with the age requirements set out in the previous paragraph, which meet either of the following conditions:

(a) Students in school in the second cycle of compulsory secondary education who, having agreed to a curriculum diversification program, in the opinion of the educational team that attends them, are not in a position to reach the the objectives of the stage by this route.

Exceptionally, students who have not been able to access a diversification program and are, in the opinion of the educational team, at serious risk of dropping out of school.

b) Unschooled young people who do not have an academic qualification higher than that of a school graduate, or who, having attained such qualifications, are not entitled to the degree of first-degree vocational training.

2. In the case of the students referred to in paragraph a, the access to the Social Guarantee programmes will be carried out after a psychopedagogical evaluation, the students and their parents heard, and with the report of the Educational Inspection.

Fourth. -According to the purposes laid down by the Organic Law 1/1990 of 3 October, of General Ordination of the Educational System, in its article 23.2, the Social Guarantee programmes will be oriented towards the attainment of the following objectives:

(a) to extend the training of pupils, in order to acquire the skills of basic education, in order to enable them to be incorporated into active life and, where appropriate, to pursue studies, particularly in the field of medium-grade specific vocational training.

b) Prepare them for the exercise of professional activities, in trades or occupations in accordance with their personal abilities and expectations.

c) Develop and strengthen their personal maturity by acquiring habits and capabilities that enable them to participate, as responsible workers and citizens, in the work and in social and cultural activity.

Fifth. -1. In order to achieve the objectives outlined in the previous point, the social guarantee programmes will be developed in different ways adapted to the characteristics, needs and expectations of the students.

2. Social Guarantee programmes may be implemented in educational centres providing teaching of secondary education or artistic teaching and in adult education centres, provided that they are authorised by the Ministry of Education and Science.

3. The Ministry of Education and Science will also be able to establish, with the Local Government and other administrations and institutions, public and private, collaboration agreements for the development of social guarantee programs, in those countries. modalities that require it.

4. Certain Social Guarantee programmes may be combined with the achievement of productive work related to the content of vocational training.

Sixth. -1. The Social Guarantee programmes shall have the following structure, for a total of weekly hours between twenty-six and thirty:

a) Specific Professional Training Area: Between fifteen and eighteen hours per week.

b) Training and Employment Guidance Area: Between two and three hours a week.

c) Basic Training Area: Between six and nine hours per week.

(d) Complementary activities: Between two and three hours per week.

e) Tutoring: Between one and two hours a week.

2. The Specific Vocational Training Area shall be designed to prepare pupils for the entry into active life in the performance of jobs which do not require the qualification of a medium-grade vocational training technician, and understand the practical activities and knowledge necessary to acquire the relevant skills. In order to facilitate accreditation and validation, where appropriate, with the specific vocational training of other types of offer, their contents will be organised by adopting a modular structure.

3. The Training and Employment Guidance Area shall be aimed at familiarizing the student with the legal framework, working conditions and working relations of the professional field concerned and providing him with the necessary resources and guidance. for the search for a job and for self-employment.

4. The Basic Training Area will aim to provide students with the possibility of acquiring or strengthening basic general knowledge and skills related to the objectives and content of compulsory education, which are necessary in order to achieve its satisfactory social and employment integration and, where appropriate, for the continuation of its studies, especially in the vocational training courses of medium-grade vocational training. Its contents and methodology will be adapted to the particular conditions and expectations of each student, in so far as the system of imparting the corresponding modality permits.

5. The aim of the complementary activities will be to provide the student with the possibility of maintaining sports and cultural activities which, while contributing to the achievement of the objectives of the Social Guarantee programmes, will promote the acquisition of positive habits in relation to the enjoyment of leisure and leisure time. These activities will be programmed according to the characteristics of each group of students and, whenever possible, with their participation.

6. The tutorial action is an integral part of the educational activity and will be continuously developed throughout the training process of young people. This action will include specific group activities, in the established time frame, with objectives and content that facilitate personal development, especially in relation to aspects such as self-esteem and motivation, integration and social involvement and the acquisition of social skills and self-control.

Seventh. -1. The duration of the programmes will be variable, depending on the time and levels of access and the students ' expectations. In any case, it will be between six months (seven hundred and twenty hours) and two academic courses (one thousand eight hundred hours).

2. Where the Social Guarantee programme is accompanied by a productive work relating to the professional field of the programme, this work shall be regarded as part of the programme for the purposes of training.

Consequently, the contents of the Specific Vocational Training area referred to in paragraph 6 shall be suitably adapted, and their schedule may be reduced in such a way as to be given at least four hours per week.

Eighth. The evaluation of the students participating in Social Guarantee programs will be continued and will be made by reference to the objectives established by the educational team in the didactic programs of the areas referred to in paragraph 6, as well as the degree of maturity achieved in relation to the objectives referred to in the fourth paragraph.

Ninth. -1. The student who has participated in a Social Guarantee programme will receive a certificate in which he will be present, for the areas of Basic Training and Training and Employment Guidance and for each of the modules in the area of vocational training. Specifies, the total number of hours spent and the qualifications obtained.

2. Ratings shall be expressed by means of a numerical scale of one to ten, without decimals, with qualifications equal to or greater than five being positive.

3. The certificate referred to in point 1 of this paragraph shall be accompanied by an orientation on the academic and professional future of the student, confidential and non-prescriptive.

Tenth. -1. The qualifications referred to in the ninth paragraph shall be taken into account in the assessment of the test of access to the training cycles of average professional training provided for in Article 32.2 of the Law on General Ordination of the Educational System.

2. In addition, the qualifications obtained in the areas of specific vocational training and training and employment guidance may be taken into account for the purpose of validating those modules of the medium-grade training cycles which are determines.

11th. -1. The Centres or Institutions responsible for the development of a Social Guarantee programme shall draw up the general programming of the programme, as well as the didactic programmes of the areas and activities referred to in paragraph 6, and send them for its approval to the Provincial Directorate for Education and Science, in accordance with the guidelines and deadlines that are due to be established.

2. The general programming referred to in the previous point shall include the weekly schedule of the different areas and activities, the time of dedication of the teachers, the organization of the spaces and envelopes used and the forecast of expenditure of operation, and shall, where appropriate, form part of the Centre's Annual General Programming.

3. The educational inspectorate shall supervise these programmes, in order to ensure their suitability for the purposes of this Order and, where appropriate, of the rules which it develops.

4. The Ministry of Education and Science will make available to the Centers and Entities mentioned in the previous section the curricular proposals and supporting documentation necessary for the preparation of these programs.

Twelfth. -At the end of each Social Guarantee program, the faculty responsible for the program will draw up a memory that includes:

Progress report for students who have followed the program.

Overall program assessment and proposals for optimization.

This memory will be forwarded to the Provincial Directorate of Education and Science.

13th. -Social Guarantee programmes will be developed in groups of up to fifteen students.

Fourteenth. -A young people who are studying a program of social guarantee in an educational center, will apply the Royal Decree 1543/1988, of October 28, on the rights and duties of the students.

15th.-The conditions for the implementation of the Social Guarantee programs, in their different modalities, will be regulated in a timely manner by the Ministry of Education and Science.

TRANSIENT DISPOSITION

The Training Guarantee programs that are developed in accordance with the Order of 19 February 1992 ("Official State Gazette" of 26), will be considered Social Guarantee programs and will be regulated by the Agreement signed in the day between each Local Corporation and the Provincial Directorate of the Ministry of Education and Science.

FINAL PROVISIONS

First.-The Directorate-General for Vocational Training and Education Promotion and the Directorate-General of School Centres are authorised to lay down detailed rules for the application of this Order.

Second. -This Order shall enter into force on the day following that of its publication in the Official Journal of the State.
