The Organic Law 6/2001, of 21 December, of Universities, configures the University Institutes of Research as centers dedicated to scientific and technical research or artistic creation being able to organize and to develop doctoral and postgraduate programmes and studies and to provide technical expertise in the field of their skills. These Institutes may be made up of one or more universities, or jointly with other public or private entities by means of conventions or other forms of cooperation, in accordance with their statutes, and the possibility of the universities, together with the Public Research Bodies, with the centers of the National Health System and with other public or private research centers without profit, promoted or participated by an administration public, may constitute Joint Research Institutes.

With regard to the National University of Distance Education and under the aforementioned Organic Law, Article 66 of its Statutes, approved by Royal Decree 1239/2011 of 8 September, provides that, by means of a convention with other universities or scientific institutions, universities may be set up for research of an interuniversity or mixed character, respectively, which shall be governed by the rules laid down in their convention creation.

For its part, Article 4 of the Statutes of the Health Institute Carlos III, approved by Royal Decree 375/2001, of 6 April, points out among the powers and powers of this Public Research Agency to promote by means of conventions establishing associated centres and joint research and/or training units with public or private institutions.

According to the previous legal and regulatory forecasts, the National University of Distance Education and the Institute of Health Carlos III, in its desire to provide a greater and better service to society in general and to the In particular, the scientific community in particular, and for the purpose of strengthening the collaboration which in the field of academic and research activities have been developing in recent years, promoted, by means of a convention signed on July 1, 2010, the creation of the University Institute of Research "National School of Health" with the objective of improving the health and health services of citizens through the generation and dissemination of knowledge, carrying out research and teaching activities in the different areas of knowledge of Public Health, through the organization and development of official postgraduate and continuing training programs, as well as the provision of public health advisory, Health Administration and Biomedical Research to the National System of Spanish Health, to Organisms International and other institutions of the Spanish System of Science and Technology.

The proposal, on the other hand, is in line with the current European movement of public health schools from the Administration to the University. The National School of Health, which will continue to have the legal status of organ belonging to the structure of the Carlos III Health Institute, will have the consideration of the base of the new organ that is created since, according to the provisions of the The additional provision of Law 14/2007, of 3 July, of Biomedical Research may provide postgraduate courses in Health in the Framework of the European Higher Education Area.

In the new Institute, the requirements mentioned in the aforementioned Organic Law are met and it is constituted as a center dedicated to the research and teaching of postgraduate in the area of knowledge of Public Health and of the Biomedical Research, as well as other areas concurrent to the health sciences, social sciences and humanities.

The proposal is part of the initiative carried out by the Governing Council of the National University of Distance Education and has the favorable report of its Social Council, having met all the legal forecasts and implementing regulations, as well as those contained in the draft internal rules of procedure and, in particular those provided for in the Statute of the University, in order to provide the relevant supporting documents and (i) it is clear that the establishment of the centre will not be an increase in the budget or additional costs for the proposing entities.

This standard is dictated in accordance with the provisions of Articles 8 and 10 of the Organic Law 6/2001 of 21 December, of Universities; in Article 58 of the Statutes of the National University of Distance Education, approved by Royal Decree 1239/2011 of 8 September and in Article 4 of the Statutes of the Institute of Health Carlos III, approved by Royal Decree 375/2001 of 6 April.

For the elaboration of the standard, the report of the Ministry of Health, Social Services and Equality has been reported.

In its virtue, on the proposal of the Ministers of Education, Culture and Sport and of Economy and Competitiveness, and with the prior approval of the Minister of Finance and Public Administrations, I have:

Article 1. Establishment of the Joint Research Institute "National School of Health".

1. The Joint Research Institute "National School of Health" is created, which is assigned as a research and specialized teaching center to the National University of Distance Education and the Carlos III Health Institute in the terms provided for in the collaboration agreement signed by both entities.

2. The membership of the "National School of Health" through the Carlos III Health Institute is part of the functional dependency of the Ministry of Health, Social Services and Equality.

Article 2. Nature and legal status.

1. The Joint Research Institute 'National School of Health' is set up as a joint university research institute as provided for in the second subparagraph of Article 10 (2) of the Organic Law 6/2001 of 21 December 2001. Universities, and in Article 66 of the Statutes of the National University of Education at Distance approved by Royal Decree 1239/2011, of 8 September, with no legal personality or own patrimony.

2. The Joint Research Institute "National School of Health" will be governed by the Organic Law 6/2001, of 21 December, of Universities, by Law 14/2011, of 1 June, of Science, Technology and Innovation, by the Statutes of the National University of Distance Education approved by Royal Decree 1239/2011, of 8 September, by the Statutes of the Institute of Health Carlos III approved by Royal Decree 375/2001, of 6 April, by the agreement of collaboration concluded July 1, 2010 between the National University of Distance Education and the Institute of Health Carlos III and by the Rules of Procedure adopted by its Governing Council.

Article 3. Period of validity of activities.

The duration of the activities of the Joint Research Institute "National School of Health" shall be five years, from the entry into force of this order, renewable for equal periods, as long as accredit the fulfillment of the circumstances that have advised its creation. To this end, the Institute, through the National University of Distance Education, will bring to the attention of the Ministries of Education, Culture and Sport, Economy and Competitiveness and Health, Social Services and Equality, the annual memory of activities drawn up in accordance with the provisions of Article 43 of the Statutes of the said university.

Article 4. Human resources.

The Joint Research Institute "National School of Health" will be provided by the staff who are functionally assigned, for the coordination and implementation of its activities and for its administration, the National University of Distance education and the Carlos III Health Institute, without any modification of the organic or labor affiliation of the same, nor net increase of structure or personnel.

Article 5. Material resources.

The Joint Research Institute "National School of Health" will have a set of basic resources for the development of its activity belonging to the Carlos III Health Institute, attached to the current National School. Health, and those of the National University of Distance Education and institutions, agencies and universities that may eventually be incorporated into it.

Article 6. Funding.

The creation of the Joint Research Institute "National School of Health" will not entail any additional costs or increase the economic allocations that the General State Budget assigns to the National University of Distance Education and the Carlos III Health Institute.

Single additional disposition. Adaptation of the collaboration agreement.

Within one year from the date of entry into force of this order and prior to the report of the Ministries of Education, Culture and Sport, Economy and Competitiveness and Health, Social Services and Equality, the National University Distance Education and the Carlos III Health Institute shall adapt the content of the collaboration agreement for the establishment of the Joint Research Institute "National School of Health" to the provisions of the Joint Research Institute.

Single end disposition. Entry into force.

This order shall enter into force on the day following that of its publication in the "Official State Gazette".
