Royal Decree 758/1996, of 5 May, of restructuring of ministerial departments, dictated by the authorization granted to the President of the Government by Article 75 of Law 42/1994, of December 30, establishes various deletions and changes in the field of ministerial departments. It is therefore appropriate to provide the Ministries with a basic organisation to enable them to initiate, as soon as possible, the development of the competences and tasks assigned to them.

In compliance with the previous forecasts, the Royal Decree 765/1996, of 7 May, established the organic structure of the Ministries of Economy and Finance, Interior, and the Presidency.

By this Royal Decree the restructuring begun is completed, establishing now the organic structure of the remaining ministerial departments, with the same criteria and objectives of efficiency, rationalization of the ministerial organisation and reduction of public expenditure followed by the aforementioned Royal Decree 765/1996 of 7 May.

In this sense, all those Secretaries of State, General Secretaries or Directorates-General that are unnecessary or who, by the nature of their functions, are liable to be integrated into other structures are deleted. organic of the largest entity. In this way, the higher bodies and the resulting management centres assume, within a broad sector of the administrative activity, a set of homogeneous or afin-character functions. This solution, in addition to generating an appreciable reduction in expenditure, will enable better coordination of the services concerned.

Likewise, the government, although it does not address the reform of the autonomous organizations in this Royal Decree, announces its intention to restructure them, following the same criteria of rationality, efficiency and reduction in spending. public.

In its virtue, at the initiative of the Ministers concerned, on the proposal of the Minister of Public Administration, and after deliberation by the Council of Ministers, at its meeting of May 10, 1996,

D I S P O N G O:

Article 1.

1. The Ministry of Foreign Affairs is structured in the following higher bodies and management centres:

(a) The Secretariat of State for Foreign Policy and for the European Union, which will depend on the following higher bodies and management centres:

1. The General Secretariat for Foreign Policy and for the European Union, with the rank of Undersecretary.

2. The Directorate-General for Technical Affairs of the European Union.

3. The Directorate General for Foreign Policy for Europe and North America.

4. The Directorate General of Foreign Policy for Latin America.

5. The Directorate General for Foreign Policy for Africa, Asia and the Pacific.

6. The Directorate-General for the United Nations, Security and Disarmament.

b) The Secretariat of State for International Cooperation and for Ibero-America, which will depend on the following management centers:

1. The Directorate General of Cultural and Scientific Relations.

2. The Directorate-General for International Economic Relations.

c) The External Affairs Secretariat, which will depend on the following management centres:

1. The Technical General Secretariat.

2. The Directorate General of the Foreign Service.

3. The Directorate-General for Legal and Consular Affairs.

2. The Directorate-General for Protocol, Chancellery and Orders and the Directorate-General of the Diplomatic Information Office will be directly responsible for the Department's holder.

3. The following top bodies and management centres are deleted:

(a) The Secretariat of State for the European Union, whose functions are assumed by the Secretariat of State for Foreign Policy and for the European Union.

(b) The Secretariat-General for the European Union, with the rank of Sub-Secretariat, whose functions are assumed by the Secretariat and by the General Secretariat for Foreign Policy and for the European Union.

(c) The General Secretariat for Foreign Policy, with the rank of Undersecretary, whose functions are assumed by the General Secretariat for Foreign Policy and for the European Union.

(d) The Directorate-General for Technical Coordination for European Union Affairs and the Directorate-General for Legal and Institutional Coordination for European Union Affairs, whose tasks are assumed by the Directorate-General for European Union Legal and consular matters.

e) The Directorate-General for Foreign Policy for Europe, the Directorate-General for Foreign Policy for North America and Asia and the Directorate-General for Foreign Policy for Africa and the Middle East, whose functions are assumed by the Directorate-General for Foreign Policy for Europe and North America and the Directorate-General for Foreign Policy for Africa, Asia and the Pacific.

f) The Directorate-General for Political Affairs and the Directorate-General for International Security and Disarmament Affairs, whose functions are assumed by the General Secretariat for Foreign Policy and the European Union and by the Directorate-General for the United Nations, Security and Disarmament.

g) The Directorate General for Consular Affairs, whose functions are assumed by the Directorate General for Legal and Consular Affairs.

h) The Directorate-General of International Organizations and Conferences, whose functions are assumed by the Directorate-General for the United Nations, Security and Disarmament, and by the Directorate-General for Economic Relations International.

Article 2.

1. The Ministry of Justice is structured in the following higher bodies and management centres:

(a) The Secretariat of State of Justice, which will depend on the following management centres:

1. The General Directorate of Records and Notaries.

2. The General Direction of Objection of Consciousness.

3. The Directorate General for Relations with the Administration of Justice.

4. The General Directorate of the State Legal Service.

5. The Directorate General for Religious Affairs.

(b) The Subsecretariat of Justice, on which the Technical General Secretariat will depend.

2. The following top bodies and management centres are deleted:

(a) The Directorate-General for Infrastructure for the Administration of Justice, whose functions are to be performed by the Assistant Secretary of Justice and the Directorate General for Relations with Justice.

(b) The Technical Secretariat of the Ministry of Justice and Home Affairs, whose functions are assumed by the General Technical Secretariats of the Ministries of Justice and Home Affairs, in the field of their respective competences.

c) The General Directorate of International Legal Coding and Cooperation, whose functions are assumed by the Deputy Secretary of Justice and the Technical General Secretariat.

d) The Cabinet of Religious Affairs, with the rank of Directorate General, whose functions are assumed by the Directorate General of Religious Affairs.

Article 3.

1. The Ministry of Defense, in addition to the organs of the basic structure of the General Staff of Defense, the Army of the Earth, the Navy and the Army of the Air, is structured in the following higher organs and management centers:

a) The Secretary of State of Defense, which will depend on the following management centers:

1. The General Directorate of Armament and Material.

2. The General Directorate of Infrastructure.

3. The Directorate-General for Economic Affairs.

b) The Assistant Secretary of Defense, which will depend on the following management centers:

1. The Technical General Secretariat.

2. The General Directorate of Personnel.

3. The General Directorate of Military Recruitment and Teaching.

2. The following management centres shall be directly dependent on the operator of the Department:

1. The General Directorate of Defense Policy.

2. The Higher Defense Information Center.

3. The Minister of Defense will have a Technical Cabinet, whose Director will be a General Officer or an Officer, with an organic level of Director General.

d) The Directorate General of Services, whose functions are assumed by the Directorate General for Economic Affairs, the Technical General Secretariat, the Directorate-General for Personnel and the Directorate-General for Infrastructure, in the field of their respective powers.

6. The organic levels of the Directorate-General for Defence Intervention and the General Counsel for Defence are also deleted. Both Units will be dependent on the Under-Secretary of Defense.

Article 4.

1. The Ministry of Public Works is structured in the following higher bodies and management centres:

(a) The Secretariat of State for Infrastructure and Transport, which will depend on the following management centres:

1. The Directorate General of Roads.

2. The Directorate General of Railways and Road Transport.

3. The General Direction of the Merchant Navy.

4. The Directorate General of Civil Aviation.

b) The Subsecretariat of Promotion, which will depend on the following management centers:

1. The Technical General Secretariat.

2. The Directorate-General for Economic and Budgetary Programming.

3. The Directorate General of Housing and Urbanism.

4. The Directorate General of the National Geographic Institute.

c) The General Secretariat of Communications, with the rank of Undersecretary, on which the Directorate General of Telecommunications will depend.

2. The following top bodies and management centres are deleted:

(a) The Secretariat of State for Territorial Policy and Public Works, whose functions are assumed by the Secretariat of State for Infrastructure and Transport, except those relating to territorial planning and hydraulic works which correspond to the Ministry of the Environment.

b) The Subsecretariat of Public Works, Transport and the Environment, whose functions are assumed by the Assistant Secretary for Development and the Subsecretariat of the Environment, in the field of their respective competences.

c) The General Secretariat for Transport Services, with a rank of Sub-Secretariat, whose functions are assumed by the Secretariat of State for Infrastructure and Transport.

d) The Directorate-General for Land Transport and the Directorate-General for Infrastructure for Rail Transport, whose functions are assumed by the Secretariat of State for Infrastructure and Transport, the Directorates General of Roads, and of Railways and Road Transport, dependent on it, in the field of their respective competences.

e) The Directorate General of Concerted Actions in the Cities, whose functions are assumed by the Assistant Secretary for Development and the Secretary of State for the Environment, in the field of their respective competences.

f) The Directorate-General for Information and Management Systems and Procedures, the Directorate-General for Human Resources, and the Directorate-General for Administration and Services, whose functions are assumed by the Secretariat The Committee on the Environment, Public Health and Consumer Protection, and the Committee on the Environment, Public Health and Consumer Protection.

g) The Technical General Secretariat of the Ministry of Public Works, Transport and the Environment, whose functions are assumed by the Technical General Secretariat of the Ministry of Public Works and the Ministry of the Environment, in the the scope of their respective powers.

1. The Ministry of Education and Culture is structured in the following higher bodies and management centres:

(a) The Secretariat of State for Universities, Research and Development, which will depend on the following management centres:

1. The General Directorate of Higher Education.

2. The Directorate-General for Research and Development, whose head will also be the Secretary-General of the National Plan for Scientific Research and Technological Development.

b) The Secretary of State for Culture, which will be responsible for the following management centres:

1. The Directorate General of Fine Arts and Cultural Property.

2. The General Direction of the Book, Archives and Libraries.

3. The Directorate-General for Cooperation and Cultural Communication.

c) The Assistant Secretary for Education and Culture, which will be responsible for the following management centres:

(d) The Technical General Secretariat of the Ministries of Education and Science, and of Culture, whose functions are assumed by the Technical General Secretariat of the Ministry of Education and Culture.

e) The Directorate-General for Programming and Investments of the Ministry of Education and Science, whose functions are assumed by the Directorate-General for Economic Programming and Budgetary Control.

f) The General Secretariat of the General Secretariat of the National Plan for Scientific Research and Technological Development.

g) The Directorate-General for Scientific Research and Higher Education, whose functions are assumed by the Directorates-General for Higher Education and Research and Development.

(h) The Directorate-General for Vocational Training and Education Promotion, whose functions are assumed by the Directorate-General for Vocational Training and Educational Promotion.

i) The Directorate General of School Centres, whose functions are assumed by the Directorate-General of Educational Centres.

j) The Directorate General of Cultural Cooperation, whose functions are assumed by the Directorate General of Cooperation and Cultural Communication.

k) The General Direction of Fine Arts, and the Conservation and Restoration of Cultural Property, whose functions are assumed by the General Direction of Fine Arts and Cultural Property.

l) The Directorate-General for Pedagogical Renewal, whose functions are assumed by the General Secretariat of Education and Vocational Training and by the management centres dependent on it

m) The Directorate General of Services of the Ministry of Culture, whose functions are assumed by the Directorate General of Personnel and Services.

Article 6.

1. The Ministry of Labour and Social Affairs is structured in the following higher bodies and management centres:

a) Secretary of State for Social Security, from which the following management centers will depend:

1. The Directorate-General for Social Security Management.

2. The General Intervention of Social Security.

b) The Assistant Secretary for Labour and Social Affairs, which will be responsible for the following management centres:

1. The Technical General Secretariat.

2. The Directorate-General for Labour Inspection and Social Security.

(c) The General Secretariat for Employment, with the rank of Sub-Secretariat, of which the Directorate-General for Work and Migration will depend.

(b) The General Secretariat for Employment and Industrial Relations, with the rank of Deputy Secretary, and the Directorate-General for Employment, whose functions are assumed by the General Secretariat of Employment.

(c) The General Secretariat of Social Security, with the rank of Undersecretary, whose functions are assumed by the Secretary of State for Social Security.

(d) The Technical Secretariats of the Ministry of Labour and Social Security, and the Ministry of Social Affairs, whose functions are assumed by the Technical General Secretariat of the Ministry of Labour and Social Affairs.

e) The Directorate-General for Services and the Directorate-General for Personnel, both of the Ministry of Labour and Social Security, and the Directorate-General for Services of the Ministry of Social Affairs, whose functions are assumed by the Ministry of Social Affairs. Article 8.

1. The Ministry of Agriculture, Fisheries and Food is structured in the following higher bodies and management centres:

(a) The Deputy Secretary for Agriculture, Fisheries and Food, on which the Technical General Secretariat will depend.

(b) The General Secretariat for Maritime Fisheries, with the rank of Sub-Secretariat, which will depend on the following management centres:

1. The Directorate General of Fisheries Resources.

2. The Directorate General of Fisheries Structures and Markets.

c) The General Secretariat of Agriculture and Food, with a rank of Sub-Secretariat, of which the following management centers will depend:

1. The General Directorate of Agricultural Productions and Markets.

2. The General Directorate of Livestock and Livestock Markets.

3. The Directorate-General for Health of Agricultural Production.

4. The Directorate General for Rural Planning and Development.

d) The Directorate-General for Services and the Directorate-General for Economic and Budgetary Analysis, whose functions are assumed by the Under-Secretary for Agriculture, Fisheries and Food.

e) The Directorate General for Food Policy and the Directorate General of Agricultural and Food Industries, whose functions are assumed by the Directorate General for Food Policy and Agricultural and Food Industries.

f) The Directorate General of Fishing Structures and the Directorate General of Fisheries Markets, whose functions are assumed by the Directorate General of Fisheries Structures and Markets.

g) The Directorate-General for Rural and Natural Planning, and the Directorate General for Rural Development, whose functions are assumed by the Directorate-General for Rural Planning and Development, to which they also belong. the competences in agricultural, hunting and forestry matters previously attributed to the Directorate-General for Conservation of Nature, whose competence in the field of conservation of nature has been assumed by the Ministry of the Environment.

(a) The Directorate-General of Legal Regime and the Directorate-General for Territorial Economic Action, whose functions are assumed by the Directorate of Legal and Economic Territorial Regime.

b) The Directorate General of Services, whose functions are assumed by the Secretariat of Public Administrations.

c) The Directorate-General for Organization, Jobs and Informatics, whose functions are assumed by the Directorate-General of Administrative Organization.

Article 10.

1. The Ministry of Health and Consumer Affairs is structured in the following higher bodies and management centres:

(a) The Health and Consumer Secretariat, which will depend on the following management centres:

1. The Technical General Secretariat.

2. The Directorate General of Public Health.

3. The Directorate General of Pharmacy and Healthcare Products.

b) The General Secretariat for Health Care, with a rank of Sub-Secretariat, on which the National Institute of Health will depend.

2. The following top bodies and management centres are deleted:

(a) The General Directorate of High Inspection and Institutional Relations, whose functions are assumed by the Department's Secretariat.

b) The General Directorate of Services and Informatics, whose functions are assumed by the Technical General Secretariat.

c) The Directorate General for Economic Programming, whose functions are assumed by the General Secretariat for Health Care.

d) The General Directorate of Health Insurance and Planning, whose functions are assumed by the General Secretariat for Health Care.

e) The Directorate-General for Professional Management, whose functions are assumed by the Department's Secretariat.

Article 11.

1. The Ministry of the Environment is structured in the following higher bodies and management centres:

(a) The Secretary of State for Water and Coasts, which will depend on the following management centres:

1. The Directorate General of Water and Water Quality.

2. The General Directorate of Costs.

b) The General Secretariat of the Environment, with the rank of Sub-Secretariat, of which the following management centers will depend:

1. The Directorate General of Conservation of Nature.

2. The General Directorate of Environmental Quality and Evaluation.

c) The Subsecretariat of the Environment, which will depend on the following management centres:

1. The Technical General Secretariat.

2. The Directorate General of the National Institute of Meteorology.

2. The following top bodies and management centres are deleted:

(a) The Secretary of State for the Environment and Housing, whose functions are assumed, in the field of their respective competences, by the Secretary of State of Water and Coasts and by the General Secretariat of the Environment, except the competences relating to housing and urban planning, which correspond to the Ministry of Public Works.

b) The General Directorate of Water Quality, whose functions are assumed by the Directorate General of Water and Water Quality.

c) The Directorate General of Territorial Planning, whose functions are assumed by the Secretary of State for Water and Coast.

d) The Directorates-General for Environmental Information and Evaluation, and Environmental Policy, whose functions are assumed by the General Secretariat of the Environment.

Article 12.

1. The Cabinets of the Vice-Presidents of the Government shall be composed of a Director, with the rank of Deputy Secretary, an Information Director, with the rank of Director-General, and the advisers, with the rank of Deputy Director-General, to be determined by the Board of Directors. Ministers, within the budget appropriations. The Vice-Presidents of the Government who hold the ownership of a ministerial department at the same time shall not have the Cabinet referred to in the following paragraph.

2. The Cabinets of Ministers shall be composed of a Director, with the rank of Director-General, and a maximum of seven advisors, with the rank of Subdirector-General.

3. The Cabinets of the Secretaries of State shall be composed of one Director and a maximum of three advisors, all of them with an organic level of Deputy Director General.

4. Posts corresponding to the offices or units of the press or social relations may be covered, within the budget appropriations, by any staff who shall be governed, in all matters relating to their appointment and termination, by the same persons. provisions applicable to staff of the Ministers ' Gaffers.

Single additional disposition.

The current divisions and dependencies of the autonomous agencies and public entities will continue in force with the modifications that are derived from the forecasts contained in this Royal Decree.

First transient disposition.

Organs of lower rank than those regulated in this Royal Decree shall be understood to be subsisting and shall retain their present name, structure and functions, as long as the appropriate organic modifications are not made.

Second transient disposition.

The Secretary General of Health Care shall exercise the functions attributed to the Director General of INHEALTH, as long as the restructuring of that Agency is not appropriate.

Transitional provision third.

The Autonomous Body Park of Machinery, without prejudice to its membership of the Directorate General of Water Works of the Ministry of the Environment, will exercise its activity under the supervision and instruction of the Assistant Secretary of Promotion, in coordination with the Director General of Hydraulic Works, until the relevant division is established.

Single repeal provision.

As many provisions of the same or lower rank are repealed, they oppose the provisions of this Royal Decree.

Final disposition first.

The Ministry of Economy and Finance will carry out the necessary budgetary changes for the fulfillment of the provisions of this Royal Decree.

Final disposition second.

The Minister of Public Administration, within three months and on the initiative of the Ministries concerned, will raise to the Council of Ministers the projects of Royal Decrees for which the organic structure of the different ministerial departments to the forecasts contained in this Royal Decree.

Final disposition third.

The Government, in use of the authorization conferred by Article 76 of Law 42/1994 of 30 December 1994 on fiscal, administrative and social measures, will proceed within six months of the enactment of the present Royal Decree, to abolish or modify the autonomous bodies or public entities whose functions may be attributed to the organs of the General Administration of the State or to other Entities.

Final disposition fourth.

This Royal Decree will enter into force on the day of its publication in the "Official Gazette of the State".
