The Epizootic Law Regulation adopted by Decree of 4 February 1955, in Articles 4 and 5 thereof, included the list of diseases of animals to be the subject of official declarations and of rigorous measures. Given its diffusible character and, where appropriate, zoonosic.

The technological advances achieved since that year, which have allowed the eradication of several of those listed in the aforementioned Regulation, and our incorporation into the European Community, were the causes of the publication of the Royal Decree 959/1986 of 25 April 1986 establishing the list of diseases of compulsory declaration animals and giving the rules for their notification.

This Royal Decree was the first rule incorporating all the part of the Community secondary legislation adopted in this field into the internal legal order, as set out in Annex I, paragraph A of the (a) a compulsory declaration of diseases in the European Community and in paragraph B of the same Annex, which must be declared in Spain.

The list of notifiable diseases in the European Community was subsequently extended by Commission Decision 89 /162/EEC of 10 February supplementing the Annexes to Directive 82/894/EEC, the Directive on the which added the following diseases: equine species, vesicular stomatitis, plague of small ruminants, Rift Valley fever, lumpy skin disease, sheep pox and goat pox and infectious haematopoietic necrosis, and by the Commission Decision 92/450/EEC of 30 July amending for the third time the Directive 82 /894/EEC and for which bovine spongiform encephalopathy was added.

The direct applicability of these decisions has in practice delayed the work of codification to be carried out by any legislator in order to overcome the existing regulatory dispersion in a matter. For this reason, one of the purposes of this Royal Decree is to incorporate the provisions of these Decisions into a new standard, so that the diseases of compulsory declaration in the European Union are collected in a single provision.

Another of the objectives of this standard is to bring together in it the relation of all diseases of compulsory declaration in Spain adding to those of section B of Annex I of Royal Decree 959/1986 those that advise the situation health at any time and those which have been declared as such in the Royal Decrees 434/1990 of 30 March 1990 laying down the health conditions applicable to intra-Community trade in live bovine animals and swine; 2121/1993, of 3 December, concerning the animal health rules governing the intra-Community trade in and imports from third countries of ovine and caprine animals; 650/1994 of 15 April 1994 laying down general measures for the control of certain animal diseases and measures specific to swine vesicular disease; 1347/1992 of 6 November 1992 amending the rules for the control of African horse sickness and laying down the animal health conditions governing intra-Community movements of equidae and imports of these animals from third countries; 1488/1994 of 1 July, for which the laying down minimum measures for the control of certain fish diseases and 1881/1994 of 16 September 1994 laying down the animal health conditions applicable to intra-Community trade and imports from third countries of animals, semen, ova and embryos not subject to the conditions laid down in Section 1 of Annex A to Royal Decree 1316/1992 of 30 October 1992.

Finally, the need to comply with the obligations that Spain has as a member of the International Office of Epizootics (OIE), justifies the inclusion of a paragraph C in Annex I in which the diseases listed in List B of the OIE.

In the proceedings of this Royal Decree, the Autonomous Communities have been consulted and the sectors affected by it have been consulted.

This Royal Decree is dictated by the jurisdiction attributed to the State by Article 149.1.16. of the Constitution, in the field of bases and general coordination of health.

In its virtue, on the proposal of the Minister of Agriculture, Fisheries and Food, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting of 29 November 1996,

D I S P O N G O:

Article 1. Object.

This Royal Decree is intended to determine the diseases of animals subject to compulsory declaration at the level of the European Union, Spain and the International Office of Epizootics, as well as the requirements for notification.

Article 2. Official declaration and annual communication of animal diseases.

1. The competent bodies of the Autonomous Communities shall make the official declaration of the diseases of the animals listed in paragraphs A and B of Annex I to this Royal Decree.

In addition, those bodies shall, for information purposes, carry out an annual communication on the diseases referred to in Annex I (C)

2. All the diseases listed in Annex I shall be subject to the general and specific measures referred to in Community legislation, the Law and the Epizootic Regulation and other relevant rules.

Article 3. Communication to the Ministry of Agriculture, Fisheries and Food.

1. The competent bodies of the Autonomous Communities shall communicate to the Ministry of Agriculture, Fisheries and Food the official declaration of the animal diseases referred to in paragraphs A and B of Annex I to this Royal Decree. through the Directorate-General for Health of Agricultural Production, for the purpose of coordinating the measures to be taken and, in the case of diseases listed in List A, of their notification to the European Commission and to the Member States.

This communication should be made immediately after the official declaration is produced, providing all the data included in Annex II. The information set out in Annex III shall be sent weekly until the outbreak of the outbreak. These data will be supplied by individualized foci.

In the case of classical swine fever the information provided shall be given to the data set out in Annex V, and a report shall also be sent as soon as possible in accordance with the data set out in Annex VI.

The extinction of disease outbreaks shall be notified immediately after the occurrence of the disease, by completing the model set out in Annex IV. 2. The annual communication of the diseases listed in Annex IV. Paragraph C of Annex I, the competent bodies of the Autonomous Communities shall forward it to the Ministry of Agriculture, Fisheries and Food, through the Directorate-General for Health of Agricultural Production, before 15 February each year, the effects of its notification to the International Office of Epizootics and the coordination of the measures to be taken.

Article 4. Notification to the Commission of the European Union, the Member States and the International Office of Epizootics.

1. The Directorate-General for Agricultural Production of the Ministry of Agriculture, Fisheries and Food shall notify the Commission of the European Union directly and directly to the Member States:

a) Before twenty-four hours:

1. The primary focus of the diseases listed in Annex I (A) that would have been declared on the national territory.

2. The deletion, after extinction of the last focus, of the restrictions that would have been applied as a result of the occurrence of the diseases listed in Annex I, paragraph A.

(b) The first working day of each week: The secondary outbreaks of the diseases listed in Annex I (A) which have been declared on the national territory. The notification will cover the week ending at midnight on Sunday preceding the notification.

These notifications shall include the information set out in Annex II to this Royal Decree to be transmitted by telex.

In the case of classical swine fever, the information provided during the 24 hours following the occurrence of the outbreak shall be given to the data set out in Annex V, and as soon as possible. send a report to the Commission in accordance with the data set out in Annex VI.

2. The Directorate-General for Health of Agricultural Production shall, on a yearly basis, notify the International Office of Epizootic Diseases of the information on the diseases listed in Annex I, listed in Annex I, to the Autonomous Communities, in accordance with the provisions of Article 3 (2) of this Royal Decree.

These notifications will contain the information required by the questionnaires sent annually by the OIE to the Ministries of Agriculture, Fisheries and Food and Health and Consumer Affairs, which in turn will transfer them to the competent bodies of the Autonomous Communities in sufficient time to enable them to carry out their annual communication within the prescribed period.

Single additional disposition. Basic character.

This Royal Decree is dictated by the jurisdiction attributed to the State by Article 149.1.16. of the Constitution, in the field of bases and general coordination of health.

Single repeal provision. Regulatory repeal.

As many provisions of equal or lower rank that are contrary to the provisions of this Royal Decree, and in particular Royal Decree 959/1986 of 25 April, establishing the list of diseases of the compulsory declaration and the rules for notification are given.

Final disposition first. Faculty of development.

The Minister of Agriculture, Fisheries and Food is empowered in the field of its powers to dictate how many provisions are necessary for the implementation and development of this Royal Decree, and in particular for the amendment of its annexes in accordance with the provisions of Community legislation and the internal health situation.

Final disposition second. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
