Approved the Order of the Council of Agriculture and Environment of the Community of Castilla-La Mancha designating the control authority in the area of Castilla-La Mancha in the field of organic production of agricultural products and their indication of agricultural products and foodstuffs.

According to Royal Decree 3167/1982, of 24 July, of the transfer of functions and services of the State Administration to the Board of Communities of Castilla-La Mancha in matters of agriculture and animal husbandry, and the article First of the Royal Decree 1852/1993 of 22 October 1993 on organic production of agricultural products.

Whereas the Order of 22 May 1996 concerning the designation of the supervisory authority approved by the Autonomous Community of Castilla-La Mancha complies with the provisions of Regulation (EEC) No 2092/91 of 24 June 1990 on the production of organic farming and its indication in agricultural products and foodstuffs, it is up to this Ministry to know and ratify the precise Order for its defense at national and international level.

In its virtue, I have:

Article 1. º

The text of the Order of 22 May 1996, of the Council of Agriculture and Environment of the Community of Castilla-La Mancha, for which the control authority is designated in the field of Castilla-La Mancha, is hereby ratified. for organic production of agricultural products and their indication in agricultural products and foodstuffs, which is annexed to this provision, which the Ministry of Agriculture, Fisheries and Food assumes for the purposes of its promotion and defence in the field of agricultural products and foodstuffs. national and international.

Single end disposition.

This provision shall enter into force on the day following that of its publication in the Official Gazette of the State.

Order of 22 May 1996 designating the control authority in the field of Castilla-La Mancha in respect of organic production of agricultural products and their indication in agricultural products and foodstuffs

Council Regulation (EEC) No 2092/91 of 24 June lays down the rules to be applied to organic production of agricultural products and their indication in agricultural products and foodstuffs.

Organic agricultural production is that agricultural production that is basically characterized by its production without the use of elements or procedures that could impair the fertility of the earth in the short or long term, or to produce pollution for the environment, the consumer or the farmer himself.

With this regulation, common to the whole of the European Union, the objective is to ensure fair competition between producers and to avoid the anonymity of the products thus obtained on the market.

in order to ensure transparency at all stages of production and production, there must be a supervisory authority to ensure compliance with minimum Community conditions, which will be indicated in the products by an indication in accordance with the established control system.

Royal Decree 1852/1993, of 22 October, regulates the indications assigned to organic products, creates a higher advisory body at the level of the Spanish State with the participation of all the Autonomous Communities and recognises the competence of the latter to designate the authority which will implement the appropriate control regime in the field of each of them.

The adoption of this Order is therefore necessary by virtue of the above, with the transitional regime governed by the Order of the Ministry of Agriculture, Fisheries and Fisheries, which is not applicable until its entry into force. Food of 28 December 1993.

Consequently, in use of the powers attributed to me in article 23 of Law 8/1995 of the Government and the Advisory Council of Castilla-La Mancha, I have:

Article 1. º

The purpose of this Order is to lay down detailed rules for the application of Regulation (EEC) No 2092/91 and Royal Decree 1852/1993 on organic production of agricultural products and their indication on agricultural products and food, in the field of the Autonomous Community of Castilla-La Mancha.

Article 2. º

Any operator which, in the field of Castilla-La Mancha, produces, produces or imports from a third country some of the products referred to in Article 1 of Regulation (EEC) No 2092/91, which is to be marketed bearing indications In the case of an organic production method, this activity must be notified to the Ministry of Agriculture and Environment of the Castilla-La Mancha Board of Communities.

Item 3.

The Directorate-General for Agricultural Marketing and Industrialisation of the Ministry of Agriculture and the Environment shall exercise the functions of the supervisory authority provided for in Article 9 of Regulation (EEC) No 2092/91. that all undertakings of the operators who notify their activity in accordance with the preceding Article shall be subject, except in the case of the functions corresponding to the General Administration of the State for having an impact on trade matters; outside, not to mediate any of the formulas of collaboration between the Administrations Public provided for in the legislation in force.

This is why the Directorate-General for Agricultural Marketing and Industrialisation is empowered to establish additional requirements for information provided for in Regulation (EEC) No 2092/91. complementary to the supply by operators and additional checks to be made by the applicable control system.

Article 4. º

Only products that are in conformity with the control regime may refer to this in their labelling, and must bear a numbered countertag of a single use that will be provided by the Directorate-General of Marketing and Agri-Food Industrialisation to the operator carrying out the last working operation.

The Directorate-General for Agricultural Marketing and Industrialisation is empowered to establish the corresponding countertag model, in which the following terms and images will be found:

1. Castilla-La Mancha.

2. ES-CM-AE-Body for the control of organic farming.

3. Number and series.

4. Logo for organic farming production.

Article 5.

Of the infringements detected in the field of organic production, the General Directorate of Agrarian Production will be given an account, for the purpose of the initiation of the corresponding sanctioning procedure, when its Article 4 of Decree-Law No 21/1996 of 13 February 1996 on the application of Article 4 of Council Regulation (EC) No 219/96 of 13 February 1996.

First transient disposition.

As long as the provisions on specific control principles and measures applicable to organic animal production, unprocessed animal products and products intended for food are not adopted by the European Union, Human ingredients containing ingredients of animal origin, as referred to in Article 1 of Regulation (EEC) No 2092/91, shall continue to apply to these products the technical rules for production and production approved within the Council Regulator of Ecological Agriculture.

Second transient disposition.

Until 1 October 1996, the number of numbered counter-labels which would have been provided by the Regulatory Council for Ecological Agriculture will continue to be used by operators based in Castilla-La Mancha. prior to the publication of this Order.

Final disposition.

This Order shall enter into force on the day following that of its publication.
