Organic Law 15/1999 of 13 December on the Protection of Personal Data sets out a set of measures to ensure, and protect, in the treatment of personal data, public freedoms. and the fundamental rights of natural persons, and especially their personal and family honor and intimacy.

Article 20.1 of the aforementioned law determines that the creation, modification or deletion of files of the Public Administrations may be made only by means of a general provision published in the "Official Gazette of the State" or Corresponding Official Journal. Similarly, the additional provision of this law directs the Public Administrations responsible for files to approve the provision of the creation of such files.

Finally, in accordance with the provisions of Article 26 of the Organic Law 15/1999 of December 13, this project has been previously reported by the Spanish Data Protection Agency.

In its virtue, I have:

Personal data files of the Navy Submarine Flotilla are created, described in Annex I of this order.

Single end disposition. Entry into force.

This ministerial order shall enter into force on the day following that of its publication in the "Official State Gazette".

a) Finality of the file and the intended uses for it: Maintain and control the results of the various medical examinations of the Navy personnel destined for the Navy's Submarine Flotilla (FLOSUB). Intended uses: Management of medical records (personal and health data) of the staff who are cared for by the health services of the FLOSUB.

(b) Persons or collectives on whom data of a personal nature are intended or required to be supplied: military and civilian personnel of the FLOSUB who are required to receive medical examinations. Patients in the nursing of the FLOSUB.

c) Procedure for the collection of personal data: by means of telematics, directly from the data subject by means of an interview, the completion of forms and the files that make up your medical history.

d) Basic file structure and description of the personal data included in the file:

Description of data types:

1. Identifiers: First and last names, NIF/DNI, address, telephone, and n. Social or Mutual.

2. Personal Characteristics: Date and place of birth, physical characteristics, anthropometric measurements and age.

3. Job Details: Body/Scale and category/grade and job position.

4. Data specially protected: Health (psycho-physical tests, medical court data, medical examinations and accidents).

e) Data transfers of a personal nature and, where appropriate, transfers of data that are provided to third countries: Judicial Bodies, State Administration and Autonomous Communities under legal provision, Entities Insurers and Sanitarias and legitimate stakeholders with the limits established by Law 41/2002, of November 14, basic regulation of the autonomy of the patient and of rights and obligations in matters of information and clinical documentation and of the Law 16/2003, of Cohesion of the National Health System, article 56.

c) Procedure for the collection of personal data: Through paper forms filled by stakeholders who are subsequently transferred to a database, the BOD or the corporate personal data base of the Ministry of Defense.

d) Basic file structure and description of the personal data included in the file:

Description of data types:

1. Identifiers: First and last names, NIF/DNI.

2. º Social Circumstances: Military Situation.

3. Job Details: Body/Scale, Category/Grade and Job Position

4. Economic, Financial and Insurance: Bank and Economic Payroll Data.
