The International Code of Botany Nomenclature (CINB) has been revised as regards the botanical name of the tomato species.

By this order, Commission Implementing Directive 2013 /45/EU of 7 August 2013 amending Council Directives 2002/55/EC and 2008 /72/EC and the Directive is hereby incorporated into the internal legal order. 2009 /145/EC of the Commission as regards the botanical name of the tomato.

It is therefore necessary to amend paragraph 1 of Annex VII to the General Regulation of the Commercial Varieties Registry, approved by Royal Decree 170/2011 of 11 February. The amendment is carried out by order based on the regulatory enablement contained in the fourth final provision of Royal Decree 170/2011 of 11 February, which empowers the holder of this Department to amend its annexes.

Annexes V and VI to the single Annex to the General Regulation on the control and certification of seed and nursery plants, approved by the Order of 23 May 1986, the single Annex to the General Regulation, are hereby amended. Technical control and certification of seed and horticultural plants, approved by the Order of 1 July 1986, and Annexes I and II to the Technical Regulation for the control of the production and marketing of vegetable and vegetable plants multiplication of vegetables other than seeds, approved by the Order of 28 October 1994, for, in all they, replace the botanical name of the tomato.

In the preparation of this order, the autonomous communities and representative entities of the sectors concerned have been consulted.

In its virtue, according to the State Council, I have:

Article 1. Amendment of the General Regulation of the Registry of Commercial Varieties, approved by Royal Decree 170/2001 of 11 February.

The General Regulation of the Register of Commercial Varieties, approved by Royal Decree 170/2011 of 11 February, is amended as follows:

In Annex VII, paragraph 1 is replaced by the botanical name: Tomate Licopersicon esculentum Mill, by Tomate Solanum lycopersicum L.

Article 2. Modification of the General Technical Regulation for the control and certification of seed and nursery plants, approved by Order of 23 May 1986.

The General Technical Regulation for the control and certification of seed and nursery plants, approved by Order of 23 May 1986, is amended as follows:

In Annexes V and VI to the single Annex, the botanical name Lycopersicon esculentum Mill is replaced by Solanum lycopersicum L.

Article 3. Amendment of the Technical Regulation for the control and certification of seed and horticultural plants approved by the Order of 1 July 1986.

The Technical Regulation for the Control and Certification of Seeds and Horticultural Plants, approved by the Order of 1 July 1986, is amended as follows:

In the single Annex, paragraph I, the botanical name Lycopersicon esculentum Mill is replaced by Solanum lycopersicum L.

Article 4. Amendment of the Technical Regulation for the control of the production and marketing of vegetable plants and vegetable propagating material other than seed, approved by the Order of 28 October 1994.

The Technical Regulation for the control of the production and placing on the market of vegetable plants and propagating material other than seeds, approved by the Order of 28 October 1994, is hereby amended as follows:

In Annexes I and II the botanical names Lycopersicon esculentum Mill and Lycopersicon lycopersicum are replaced by Solanum lycopersicum L.

Final disposition first. Incorporation of European Union law.

This order incorporates into Spanish law Commission Implementing Directive 2013 /45/EU of 7 August 2013 amending Council Directives 2002/55/EC and 2008 /72/EC and Directive 2009 /145/EC of the European Parliament and of the Council on the Commission as regards the botanical name of the tomato.

Final disposition second. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".
