The Kingdom of Spain through the instrument of accession, given in Madrid on November 28, 2008, and its subsequent deposit to the International Maritime Organization has become part of the International Convention on standards of training, certification and Watchkeeping for fishing vessel personnel, done at London on 7 July 1995 (STCW-F 1995). This agreement, published in the «Official Gazette» of March 16, 2012 and whose entry into force date is September 29, 2012, aims to promote the safety of human life at sea and the protection of the marine environment, establishing international standards so that staff enrolled in seagoing vessels have competition and fitness due to their duties.

Generally established in the national legislation on fishing sailing qualifications, training meets the requirements of the Convention. However, some parts of the Spanish formation must be modified to adapt to the international standard, and, as also the 1995 STCW-F includes provisions on: inspection, titles and endorsements, communication of information, recognition of foreign qualifications and waivers that national legislation does not gather, is necessary to modify the latter to adapt Spanish legislation to the new Convention establishes internationally.

Professional qualifications nautical fisheries are regulated today by Royal Decree 662/1997 of May 12, which lays down the minimum requirements for exercising the activity of local fishing and inshore fishing vessel skipper pattern, and by the Royal Decree 930/1998, of 14 may, on conditions of suitability and qualification of professions of the merchant marine and fisheries. On the other hand, the degree of master of fishing is governed the Royal Decree 1833 / 2004 of 27 August, that laying down the requirements for the degree of master of fishing and the powers conferred; and the card of sailor fisherman by the Royal Decree 1519 / 2007 of 16 November, laying down minimum requirements and the expertise to pursue the professional activity of sailor on fishing vessels. Along with the standards also cited Royal Decree 2017 is in force / 2004, of 11 October on powers of the degrees of pattern fishing, pattern of first-class fishing coastal and naval mechanic first class.

The time elapsed from the publication the royal decrees mentioned in the preceding paragraph, necessitated the introduction of changes in some of them to adapt them to developments in the sector; as a result, fishing boat qualifications regulations has been amended on several occasions. Thus, the Royal Decree 930/1998 today collects the changes introduced by the royal decrees: 1437 / 2003, of 31 of October, amending the Royal Decree 930/1998, of 14 may, on terms of suitability and qualification of professions of the merchant marine and fisheries; 653/2005 of 6 June, amending the Royal Decree 930/1998, of 14 may, on terms of suitability and qualification of professions of the merchant marine and fisheries; and, finally, by the Royal Decree 2008 / 2009, of 23 December, amending the Royal Decree 930/1998, of 14 may, on terms of suitability and qualification of professions of the merchant marine and fisheries. Furthermore, the Royal Decree 662/1997 was amended by the Royal Decree of 1548 / 2004, of June 25, amending Royal Decree 662/1997, 12 may, which establish the minimum requirements to pursue the professional activity of local fishing pattern and inshore fishing vessel skipper. Finally, note that the Royal Decree 1519 / 2007 was reformed by Royal Decree 884/2011, 24 June, amending the Royal Decree 1519 / 2007 of 16 November, laying down minimum requirements and the expertise to pursue the professional activity of sailor on fishing vessels.

Consequence described in the preceding paragraph and the modification of the regulations in force before 1997 and 1998, is the existence of a normative scattered which, due to the evolution of the sector, it is advisable to reunify and retouch again.

On the other hand, the Government has issued the Royal Decree 1533 / 2011, on 31 October, establishing seven certificates of professionalism of the professional family fishing sea included in the National Repertory of professional certificates, and the Royal Decree 1774 / 2011, of 2 December, which establishes four certificates of professionalism of the professional family fishing sea included in the National Repertory of professional certificates. Both rules collect certain certificates of professionalism of the professional family maritime and training established in any of them, may be equivalent to expected to obtain professional qualifications of inshore fishing vessel skipper and local pattern of fishing, as well as necessary to obtain the title of fisherman sailor. Taking into account that the issuing of qualifications professional nautical fisheries is competence of the autonomous communities, this standard sets the channel through which, cited or local authorities can issue a professional degree holders of certain certificates of professionalism.

In addition, it considers necessary to clarify the powers of graduates of the merchant marine on board fishing vessels, determine the validations and equivalences corresponding to qualifications issued prior to the publication of Royal Decree 662/1997 and 930/1998, and, finally, provide for possible recognition of qualifications issued by the Ministry of defence; issues these that this standard is intended to solve.

Taking into account the above-mentioned background, deemed necessary to adopt a new text which, as a basic rule in terms of degrees of the fisheries sector, recast the dispersed existing legislation and incorporate the International Convention on standards of training, certification and Watchkeeping for fishing vessel personnel, done at London on 7 July 1995 with the Spanish legal acquis.

This Royal Decree is issued pursuant to section 42 of the Act 3/2001, 26 March, maritime fishing from the State, which establishes that the Government on the proposal of the Minister of agriculture, fisheries and food, will regulate the qualifications of the professionals of the sector, in the context of the overall educational system, establishing fitness requirements and professional powers corresponding to each title , without prejudice to the competences of the Ministry of public works.

By virtue, on the proposal of the Minister of agriculture food and environment, according to the Council of State and after deliberation by the Council of Ministers at its meeting on January 24, 2014, available: chapter I General provisions article 1. Object and scope of application.

This Royal Decree is to regulate the basic conditions for obtaining professional qualifications required for the exercise of functions aboard the Spanish fishing vessels, and the powers of each of such titulosen fishing vessels.

Article 2. Definitions.

To the effects of this Royal Decree and regulations of development, means: 1. Convention: the Convention of the International Maritime Organisation on standards of training certification and Watchkeeping for personnel from vessels, 1995 and its annex. This standard also receives the name of 1995 STCW-F Convention.

2 Convention on education, 1978 (STCW): the International Convention on standards of training, certification and Watchkeeping for the seafarers, 1978, as amended.

3. STCW Code: the code of training certification and Watchkeeping for seafarers which is contained as an annex to the STCW Convention, adopted by resolution 2 of 1995 of the Conference of parties to the STCW Convention, in force at the time of your application.

4 part: all State that the 1995 STCW-F Convention entered into force.

5. Administration: the Government of the party whose flag is entitled to fly the ship.

6. title: a fishing yacht professional degree understanding the latter as any valid document, regardless of the name that is known, issued or recognized in accordance with the provisions of the 1995 STCW-F Convention, by the administration of a State part thereof, entitling the holder to the position it stated, according to authorise him to national regulations.

7 entitled: person duly provided with a title.

8. academic title: official document issued by the authority of the competent educational administration which accredits the overcoming of the theoretical training established in the Convention.

9 credential recognition of foreign qualifications: document that formalizes the competent authority resolution recognizing the approval of a foreign academic degree for a Spanish academic title.

10 civilian vessel: any vessel, boat, floating platform, with or without offset, suitable for browsing and not affection at the service of national defense.

11. fishing vessel: any vessel used for catching fish or other living resources of the Sea (art. 1, pto. 20 of Directive 2008/106/EC of the European Parliament and of the Council). This definition of exception, in any case, dedicated to recreational fishing vessels or vessels.


12. seagoing fishing vessel: a fishing vessel other than those intended to navigate exclusively in inland waters or sheltered waters, or in the vicinity of these or areas where port regulations apply.

13 warships or auxiliary vessels fishing or aquaculture activities: these are they who are enrolled in the fourth list of the register of registration of ships.

14. gross tonnage: the tonnage of the vessel expressed in GT, which is contained in the tonnage certificate issued in accordance with the International Convention of tonnage of ships of 1969.

15 power: maximum continuous drive of a vessel, measured in kilowatts (kW), which together have all their main propulsion machinery, contained in the certificate of registration of the ship.

16 crew: embarked staff providing professional services on the civilian ships.

17. fisherman: any member of the crew of a fishing vessel.

18. coastal fishing: the exerted by the fishing fleet that tides of less than twenty-four hours.

19 master: the person who, being in possession of the corresponding title, exercises the command and direction of the vessel, is the representation of the owner, as well as other public and private functions that attribute you the current regulations.

20. official: a member of the crew of a ship, other than the captain or master, student or sailor who, being in possession of the corresponding title, exercises functions of responsibility in services, bridge and deck or machines.

21 Chief of machines: the engineer officer who, being in possession of the corresponding title, exercises direction and head of the service of ship main and auxiliary propulsion equipment and machines, as well as other functions that attribute you the current regulations.

22 bridge officer: the officer who, being in possession of the title certifying its competence in accordance with the rules II/1, II/2, II/3 and II/4 of the STCW-F Convention, 1995, serves as officer in charge of the guards of navigation and Harbour Bridge service and cover fishing vessels, as well as other functions that attribute you the current regulations.

23. first officer: the officer of bridge that next in rank to the master and that, in case of disability, will assume command of the ship; It also exercises the functions that attribute you the current regulations.

24 engineer officer: an officer who, being in possession of the professional title that certifies its competence, is in charge of the guards from machines on fishing vessels, and exercises other functions that attribute you the current regulations.

25. first engineer officer: officer machines next in rank to the Chief Engineer, and that, in case of disability, will assume responsibility for the mechanical propulsion and the operation and maintenance of the mechanical and electrical installations of the ship. In addition, perform any other function that has you under current legislation.

26 radio operator: the person who holds an appropriate certificate issued or recognised by the administration under the provisions of the radio regulations.

27 radio regulations: the radio regulations annex or considered annex, to the most recent international telecommunications Convention that is in force.

28. student: the person who is receiving training on board ships to acquire the appropriate maritime experience required by the regulations, in order to obtain a professional title.

29. sailor: every crew member of a fishing vessel that is not captain or master, Chief Engineer, official or student.

30 seafarer: any person with maritime training and in possession of a maritime professional title issued by a State.

31 shipping period: the time elapsed between the dates of loading and unloading on board a ship, as it will be recorded in the role of dispatch and staffing or any other official document of the ship in the maritime book.

32 book record of training: the document issued for each student, where specified and recorded practical training to be students, bridge or machines, aboard ships, under the supervision and evaluation of an officer and required for the issue of a professional degree.

33 sailing close to the coast: navigations made along the coast within the area between it and the line of 60 miles parallel to it. They will be taken as a reference to measure 60 miles the straight baselines established in Royal Decree 2510 / 1977, of 5 August 34. Length: 96% of the total length on a float corresponding to 85% of strut layout minimum measured from the line of the keel, or the length that the side thruster of the stem to the axis of the rudder stock in that float, if this is greater. In inclined keel ships, floating reference to measure the length will be parallel to the designed waterline.

35 length between perpendiculars: is the distance between the forward (Ppr) perpendicular and the perpendicular Stern (Ppp).

36. bow Perpendicular: is the vertical line drawn through the intersection of the flotation of summer with the singing of the foreside of the boat bow.

37 Perpendicular of Stern (Ppp): is the vertical line whose position is defined according to the form of the stern of the ship. In vessels with rudder and propeller in the diametral plane, or Bay, Ppp through aft of the popel stern face, while in vessels with rudder offset in the diametral plane Ppp coincides with the axis of the rudder.

Article 3. Conditions for the exercise of the activity aboard Spanish vessels.

1. exercise professionally aboard Spanish vessels as master, Chief Engineer, officer or sailor is must possess a degree in force.

2. the certificate of basic training, regulated in Rule VI/1 of the STCW Convention, will be also obligatory for all members of the crew of fishing vessels greater than 24 metres in length. On vessels under the above-mentioned length is only necessary when legislation thus establishes it.

3. the crew of fishing vessels must also have other specialist certificates which are mandatory according to legislation.

Chapter II fishing article 4 professional titles. Determination of professional fishing titles.

(1. qualifications of fishing in Spain are as follows: to) Captain of fishing.

(b) height pattern.

(c) pattern of coastline.

(d) inshore fishing vessel skipper.

(e) local pattern of fishing.

(f) sailor, fisherman.

(g) greater naval mechanic.

(h) naval mechanic.

2 the titles listed in the previous paragraph are classified into three sections: section bridge, to which belong the titles ranging from letter to) c); (multi-purpose section, titles of d) to f); (and collected the letters g machines section) and h).

3 titles listed in paragraphs a), b), c) of the previous point incorporate the minimum training requirements laid down in regulations II/1 and II/2 of the Convention.

The title indicated in paragraph d) point 1 incorporates the minimum training requirements laid down in regulations II/3 and II/4 of the Convention.

(Titles listed in paragraphs g) and h) of paragraph 1 of this article incorporates the requirements of regulation II/5 of the Convention.

For titles that are set out in paragraphs e) and f) of paragraph 1 of this article, as well as for machines of inshore fishing vessel skipper titration module, the Convention does not designate minimum training requirements.

4 each of the titles cited in the previous paragraphs, allow to carry out certain functions on board fishing vessels with the limitations set out in the title.

5. the titles regulated in this Royal Decree do not affect titles or certificates that are regulated by other regulations, as safety and health, which force crew members to be in possession of certain certificates as specialty and the health.

Article 5. Fishing captain.

1. requirements.

(a) be in possession of the title of height or the title of fishing pattern pattern.

(b) have an official form issued by a Center recognition of drivers (CRC), whereby certifying fitness Psychophysics in accordance with the requirements for the issuance of the permit ordinary driving.

The above form is not necessary if the person concerned has the medical certificate referred to in article 13 of the present Royal Decree.

(c) be at least 600 days of embarkation as captain or officer of the bridge in more than thirty metres in length fishing vessels; 300 of these days must have been made after obtaining the diploma of pattern of height or pattern of fishing of height, aboard fishing vessels on Board of fishing vessels belonging to societies appearing on the registration regulated by Royal Decree 601/1999 of 16 April, which regulates the official register of fishing companies in third countries or national.

d) have passed the appropriate examination.

2 responsibilities.

(a) control of vessels of any kind, without limitation of length or distance from shore.

b) enroll as first officer or officer of the bridge, in vessels of any kind.

Article 6. Height pattern.

1. requirements.

(a) have completed 20 years of age.

(b) have an official form issued by a Center recognition of drivers (CRC), whereby certifying fitness Psychophysics in accordance with the requirements for the issuance of the permit ordinary driving.


The above form is not necessary if the person concerned has the medical certificate referred to in article 13 of the present Royal Decree.

(c) be in possession of the academic title of senior technician in maritime transport and fishing, established in Royal Decree 1691 / 2011, 18 of November, which establishes the title of technician in shipping and fishing and fix their minimum educations; for which it is necessary to have passed an examination or examinations that include the minimum knowledge required in Appendix II/1 of the STCW-F Convention rule.

(d) have served in the section bridge of vessels in length not less than 12 metres, during a period of shipment of at least two years, of which at least 6 months should have been performed after the conclusion of the examination referred to in the preceding paragraph. This period of shipment, may be replaced by another term not inferior to 12 months, as student or sailor, making at least 6 months in activities of the guard of navigation, as part of a training programme in accordance with the requirements of section A-II/1 of the STCW Code; provided that this fact be recorded in a record book of training approved under the training agreement, 1978.

The Ministry of agriculture, food and environment may allow the substitution of embarkation periods cited in the previous paragraph, for a period of not more than one year special training, provided that the special training program is at least a value equal to the period of required boarding that replaces. The realization of such training will be made by the consultation to the Ministry of education, culture and sport.

2 responsibilities.

(a) exercise as a first officer or mate on board fishing vessels without limitation.

(b) practice as master in length fishing vessels not exceeding 50 meters, provided that, in addition to the requirements laid down in paragraph 1 of this article, I have completed a period of embarkation not less than 12 months as officer in charge of the guard's navigation or pattern on fishing vessels of not less than 18 meters length. In the event that this period of shipment be performed in vessels of length 12 metres but less than 18, you may only exercise of captain in fishing vessels of not more than 30 metres in length.

Article 7. Pattern of coastline.

1. requirements.

(a) be 18 years old.

(b) have an official form issued by a Center recognition of drivers (CRC), whereby certifying fitness Psychophysics in accordance with the requirements for the issuance of the permit ordinary driving.

The above form is not necessary if the person concerned has the medical certificate referred to in article 13 of the present Royal Decree.

(c) be in possession of the academic title of technician in navigation and coastal fishing, established in the Royal Decree 1144 / 2012, of 27 July, which establishes the title of technician in navigation and coastal fishing and fix their minimum educations; for which it is necessary to have passed an examination or examinations, including the minimum knowledge required in the Appendix of the rule II/1 of the annex to the STCW-F Convention.

(d) be served on the section bridge of vessels in length not less than 12 m during a shipment of at least two years, of which at least 6 months should have been performed after the conclusion of the examination referred to in the preceding paragraph. This period of shipment may be replaced by another term not inferior to 12 months, as student or sailor, making at least 6 months in activities of the guard of navigation, as part of a training programme in accordance with the requirements of section A-II/1 of the STCW Code; provided that this fact be recorded in a record book of training approved under the training agreement, 1978.

The Ministry of agriculture, food and environment, may permit the substitution of embarkation periods cited in the previous paragraph, for a period of not more than one year special training, provided that the special training program is at least a value equal to the period of required boarding that replaces. The realization of such training will be made by the consultation to the Ministry of education, culture and sport.

2 responsibilities.

(a) exercise as an officer or first officer in fishing vessels of not more than 50 metres in length.

(b) exercise as master on fishing vessels of length not more than thirty meters, within the area the parallel 52 ° N and 10 ° N and the Meridian 32 ° W and 30 ° E; whenever I have completed a period of embarkation not less than 12 months as officer in charge of the guard's navigation or pattern on board fishing vessels of not less than 12 meters length.

Article 8. Inshore fishing vessel skipper.

1. requirements.

(a) be 18 years old.

(b) have an official form issued by a Center recognition of drivers (CRC), whereby certifying fitness Psychophysics in accordance with the requirements for the issuance of the permit ordinary driving.

The above form is not necessary if the person concerned has the medical certificate referred to in article 13 of the present Royal Decree.

(c) have passed a test, or tests, that includes at least the matters set out in the annex I of this Royal Decree, which includes the minimum knowledge required in regulation II/3 of the annex to the Convention.

(d) have served in the section of bridge for fishing vessels of not less than 12 meters length, during a period of shipment of at least two years; However, the Ministry of agriculture, food and environment may allow:-the replacement of this period of shipment by another special training of not more than one year duration, provided that the special training program is, at least, of a value equal to the period of required boarding that replaces.

-The replacement of the period of embarkation on vessels on other consisting in a registry approved under the training agreement, 1978.

For the computation of the period's planned shipment of two years this section, will be accepted until 18 months of days of embarkation conducted prior to the scheduled test in subparagraph (c)) of point 1 of this article, the rest of the shipment should be performed, in any case, after passing the above-mentioned examination.

(e) carry out a period of shipment of 6 months in the service of a civilian ship machines.

2 responsibilities.

(a) enroll as first official or official of a navigational watch on ships engaged in coastal fishing.

(b) enroll as first engineer officer on board fishing vessels of less than 750 kW power, and as officer of the watch of machines.

(c) exercise as pattern, Captain or chief engineer on ships of up to 24 metres in length between perpendiculars and 400 kW of effective power of the machine, dedicated to coast coastal fishing, up to a distance of 60 miles off the coast. The basis for the calculation of the distance to the coast will be the straight baselines defined in Act 10/1997, of 4 January, on the territorial sea, the delimitation contained in Royal Decree 2510 / 1997, of 5 August, of territorial waters, straight baselines to their delimitation.

Order to exercise Captain function provided for in this paragraph the person concerned must have complied a period of embarkation not less than 12 months as officer in charge of the guard of navigation, or pattern, on board fishing vessels of not less than 12 meters length.

(d) exercise machines headquarters in fishing vessels not exceeding 550 kW propulsion power.

Article 9. Local fishing pattern.

1 requirements.

(a) have completed 18 years of age.

(b) have an official form issued by a Center recognition of drivers (CRC), whereby certifying fitness Psychophysics in accordance with the requirements for the issuance of the permit ordinary driving.

The above form is not necessary if the person concerned has the medical certificate referred to in article 13 of the present Royal Decree.

(c) have passed a test, or tests, that includes at least the matters provided for in annex II of this Royal Decree.

(d) have served on fishing or auxiliary vessels from fishing or aquaculture for a period of eighteen months, within which at least 6 months should be performed in the deck of vessels subsequent to the overcoming of the aptitude test. The remaining twelve months may be made prior to the celebration of the aforementioned test, having to serve at least 6 of them in the guard of machines.

2 responsibilities.

a) pattern, Captain or chief engineer, in vessels of up to 12 metres in length between perpendiculars and 100 kW of power, up to a distance not exceeding 12 miles from the baselines defined in accordance with the law 10/1977 of 4 January, about territorial sea, figure whose boundary in 2510 RD / 1977 , 5 August.

(b) Chief Engineer on vessels up to 180 kW of power.

Article 10. More naval mechanic.

1. requirements.

(a) have completed 20 years of age.

(b) have an official form issued by a Center recognition of drivers (CRC), whereby certifying fitness Psychophysics in accordance with the requirements for the issuance of the permit ordinary driving.


The above form is not necessary if the person concerned has the medical certificate referred to in article 13 of the present Royal Decree.

(c) be in possession of the academic title of senior technician in Organization for the maintenance of machinery of ships and craft, established in the Royal Decree 1075 / 2012, of 13 July, which establishes the title of technician in Organization for the maintenance of machinery of ships and craft and fix their minimum educations; for which it is necessary to have passed tests including the matters referred to in the appendix to Regulation II/5 of the annex to the Convention.

d) having participated in a course of fire fighting. For these purposes, and for fishing vessels of length less than or equal to 50 metres, shall be deemed sufficient for the overcoming of the module theoretical practical fire fight necessary to obtain the certificate of basic training, established in article 5 of the order FOM/2296/2002 of 4 September, which regulates qualifications of sailors of bridge training programs , and Patron port, as well as supporting specialist certificates of professional competence.

e) you have provided service in the engine compartment of a civilian ship, as student or sailor, during a period of embarkation not less than 12 months, of which at least 6 months has performed activities of guard of machines. This period may be reduced to 6 months or more, the Ministry of agriculture, food and the environment establish a special training that I considered equivalent to the period to be replaced.

2 responsibilities.

(a) exercise as first engineer officer in fishing vessels of not more than 3,000 kW power.

(b) practice as engineer officer of category lower than indicated in the preceding paragraph in any fishing vessel.

(c) exercise as Chief Engineer on fishing vessels of less than 750 kW propulsion power.

(d) exercise as first engineer officer on board fishing vessels of more than 3,000 kW power, provided that, in addition to the requirements set out in paragraph 1 of this article, certifying completion of a period of embarkation not less than 12 months as engineer officer on ships of between 500 and 3,000 kW propulsion power.

(e) exercise as Chief Engineer on fishing vessels of not more than 3,000 kW power; to do this, in addition to the requirements set out in paragraph 1 of this article, must register a period of embarkation not less than 24 months as officer of machines, of which at least 12 months must have fulfilled roles of first officer on ships of between 500 and 3,000 kW propulsion power.

((f) exercise as Chief Engineer on fishing vessels not exceeding 6,000 kW driving power, when, in addition to complying with the requirements set out in the letter e), is credited to have passed the course whose content is established in annex I to the resolution of May 31, 2010, of the General Directorate of the merchant marine by which establish courses of mechanics major naval and naval mechanics accreditation for professional practice in merchant ships up to 6,000 kW. This course should have been given at an authorized training for the teaching of the academic title of senior technician in Organization for the maintenance of machinery of ships and craft.

(g) exercise as Chief Engineer in vessels without power limit, provided that, in addition to the provisions of paragraph 1 of this article, meets the following requirements: 1 pass a course in a training centre approved for the delivery of the title of technician in Organization for the maintenance of machinery of ships and craft, consisting of the duration and the matters that as a minimum, establish, in development of this Royal Decree, the Ministry of agriculture, food and environment.

2nd have completed a period of embarkation not less than 24 months as officer of machines, of which at least 12 months must have fulfilled roles of first officer on ships of between 500 and 3,000 kW propulsion power.

h) in the case that the entitled want to perform duties of chief engineer or engineer officer on board fishing vessels greater than 50 metres in length, must be in possession of the certificate advanced fire fighting provided for in article 6 of the order FOM/2296/2002 of 4 September.

Article 11. Naval mechanic.

1. requirements.

(a) have attained 18 years of age.

(b) have an official form issued by a Center recognition of drivers (CRC), whereby certifying fitness Psychophysics in accordance with the requirements for the issuance of the permit ordinary driving.

The above form is not necessary if the person concerned has the medical certificate referred to in article 13 of the present Royal Decree.

(c) be in possession of the academic title of technician in the maintenance and Control of the machinery of ships and craft, established in the Royal Decree 1072 / 2012, of 13 July, which establishes the title of technician in maintenance and Control of the machinery of ships and craft and fix their minimum educations; for which it is necessary to have passed tests including the matters set out in the appendix to Regulation II/5 of the annex to the STCW-F Convention.

d) having participated in a course of fire fighting. For these purposes, and for fishing vessels of length less than or equal to 50 metres, shall be deemed sufficient for the overcoming of the module theoretical practical fire fight necessary to obtain the basic training certificate provided for in point 4 of the annex I of the order FOM/2296/2002 of 4 September.

e) having served on a civilian ship engine room, during a period of embarkation not less than 12 months, of which at least 6 months has performed activities of guard of machines. This period may be reduced to 6 months, or more, the Ministry of agriculture, food and environment set to development of this Royal Decree, special training that I considered equivalent to the period to be replaced.

2 responsibilities.

(a) exercise as first engineer officer in fishing vessels of not more than 3,000 kW propulsion power.

(b) practice as engineer officer of category lower than indicated in the preceding paragraph in any fishing vessel.

(c) exercise as Chief Engineer on fishing vessels of less than 750 propulsive power kW.

(d) exercise as first engineer officer in fishing vessels of propulsion power not exceeding 6,000 kW, when in addition to having passed the requirements and shipping conditions referred to in paragraph 1 of this article, is credited with passing the course whose content is established in annex II to the resolution of May 31, 2010 , of the General Directorate of the merchant marine. This course should have been given at an authorized training for the teaching of the academic title of senior technician in Organization for the maintenance of machinery of ships and craft.

(e) exercise as first engineer officer in unlimited power of fishing vessels, provided that exceeded a course at an authorized training centre for the delivery of the title of technical maintenance and Control of the machinery of ships and craft, whose knowledge and minimal materials will be set by the Ministry of agriculture, food and environment.

(f) exercise machines headquarters in propulsive power equal to or less than 1400 kW fishing vessels. To do this, in addition to the requirements set out in point 1 of this article, you must demonstrate a period of shipment of at least 24 months, of which twelve should have been performed as first officer of machines.

g) in the case that the graduate wants to work functions, as chief engineer or engineer officer on board fishing vessels greater than 50 metres in length, must be in possession of the advanced fire fighting certificate laid down in article 6 of the order FOM/2296/2002 of 4 September.

Article 12. Fisherman seaman.

1. with character general fisherman sailor title possession is required to be able to exercise as a sailor, both on the machine and on the deck of a fishing vessel.

2. the requirements for the obtaining of such tituloson as follows.

(a) having served sixteen years of age.

(b) be in possession of a certificate, issued by an authorized teacher or the fisheries authority, accrediting having successfully passed the theoretical course of fisherman sailor or a test of fitness knowledge-practical minimum content set out in annex III of this standard.

3. responsibilities.

to) handle with purpose commercial vessels of less than 10 metres in length, fishing or auxiliary of aquaculture, that operate exclusively within inland ports and have a power adequate to the boat, and always that carried no passengers.

To exercise the command you shall have completed a period of embarkation not less than 6 months as a sailor, in fishing vessels or auxiliaries of aquaculture, from the date of issue of the professional title of fisherman sailor. In addition, you must have the medical certificate referred to in article 13.

(b) exercise as a sailor on fishing vessels.

Chapter III of the medical examination for maritime service article 13. Medical examination of maritime shipping.


All the crew of Spanish, to board fishing vessels, must be in possession of the medical certificate of aptitude in force, issued by the Instituto social de la Marina, pursuant to the Royal Decree 1696 / 2007, of December 14, which regulates the medical examinations of maritime shipping, declaring them suitable or fit with restrictions.

For purposes of issuing, renewal and revalidation of professional titles, when the medical certificate of maritime shipping figure the mention: «fit except for bridge and Watchtower functions» or «suitable except machines», deny the issue of professional certificates of bridge or machines respectively.

Chapter IV article 14 training. Quality of training.

1. the centres or entities that offer the training required to obtain a professional title maritime fishing, must be in possession of the appropriate authorization or approval granted by the Ministry of education, culture and sport and/or the competent body for fisheries training of the autonomous communities, as appropriate.

In the case of the autonomous communities which have not transferred the nautical training fishing, will be the Ministry of agriculture, food and environment who granted the relevant homologation Center or impartidora entity, unless this competition corresponds to the Ministry of education, culture and sport for professional education.

2. the autonomous communities shall inform the Ministry of agriculture, food and environment, a list of approved centres for imparting nautical fisheries training.

3. the Ministry of agriculture food and environment will exert high inspection on quality of nautical training fisheries in relation to the requirements in the field of training in the 1995 STCW-F Convention and, in order to ensure that instruction and practical training programs are adequate, the General Secretariat for fisheries will hold, at least every five years , an inspection of the centres referred to in the preceding paragraph to verify that they have the necessary efficiency to ensure the required competence levels. This inspection may be carried out jointly with officials of the Ministry of education, culture and sport and/or of the General Directorate of the merchant marine.

4. the inspection to check if the training conforms to the levels of competence required by the STCW-F Convention, will cover the various aspects of the system of qualifications, courses and training programmes, their corresponding exams and assessments, as well as the qualification and experience of trainers and evaluators.

5. the General Secretariat of fisheries may Commission inspections provided for in points 3 and 4 of this article to independent auditors.

Article 15. Training on board.

1 when you are performing one of the periods of shipment required to obtain the professional title as a student, the person concerned will not be part of the minimum crew of the ship's safety.

The contract to exercise as a student can be subscribed between the Assembly company and administration, and take the form of 'Convention of training at workplace between the Administration and the company'.

For shipment as students, as required by the current regulations, stakeholders must be found in possession of the certificate of basic training.

2. in the event that the period of embarkation indicated in the preceding paragraph is carried out as a sailor, stakeholders will be part of the crew of the ship in all respects.

For boarding as a sailor, as required by the current regulations, will need to be in possession of the certificate of basic training.

3. the periods of shipment, carried out within the framework of the nautical teaching machines and/or bridge, will be Computable for the obtaining of the corresponding professional title.

4. persons who have passed the academic training necessary for obtaining the qualifications regulated in this Royal Decree shall be entitled to obtain the title of fisherman sailor. In the case of professional qualifications for which it is necessary to have an academic degree of the Ministry of education, culture and sport just have approved the first such academic training course to qualify to obtain the title of fisherman sailor.

5. students who have completed the training courses required as a prerequisite for obtaining the regulated titles in this Royal Decree, and who are in possession of the corresponding academic title or, where appropriate, a certificate of qualification of suitable examination, may be enrolled as a sailor for the realization of the required shipping period, although they are not in possession of the card of fisherman sailor.

6. vessels shall carry on board articles that collect the most recent changes in the international regulations about the safety of life at sea and the protection of the marine environment.

Article 16. Accreditation of the periods of embarkation.

(1. shipment periods necessary for obtaining the qualifications are taken into account the applicant should submit the following documentation: to) a statement on the model provided for in annex IV, including vessels on which he has served.

(b) a certificate, in the model of annex V, for each of the ships which has rendered service, signed by the master or by the representative of the shipping company. In the case of foreign vessels this certification may be issued in English.

(c) certified photocopy of the maritime book that includes the seats of embarkation and disembarkation. In the case that the shipment has been made in foreign ships, also copies of contracts of work and official documentation of enrollment in each vessel must be attached.

Article 17. Simulators.

1 taking into account the recommendations set out in resolutions 2 and 3, of the International Conference on standards of training, certification and Watchkeeping for fishing vessel personnel, 1995, training centres issuing qualifications that allow to obtain the titles of Captain of fishing, pattern height and pattern of coastline should be training relative to the guards of navigation with the help of simulators.

2. simulators mentioned in the preceding paragraph, if they have been installed since the year 2002, shall comply with the provisions of section A/12 of the STCW Code.

3. in the case of the titles of inshore fishing vessel skipper and local fishing pattern, if the Center does not have simulators these may be replaced by maneuver roses accompanied, if possible, by a warship of practices.

Chapter V issue, renewal, renewal and registration of qualifications article 18. Professional titles.

1. the titles will be issued as a general rule in the model set out in annex VI, except as provided in paragraph 5 of this article.

2. certificates shall be issued at least in Spanish and in English language.

The autonomous communities with another official language in addition to Castilian, may issue qualifications in his language, provided that in addition the document is drafted in Spanish and English.

3 two models of endorsement are set: to) the model of annex VII of this Royal Decree, which endorses the Spanish professional titles that are within the scope of the STCW-F Convention, 1995.

(b) the model of annex VIII of this Royal Decree, which confirms the recognition of a degree, on the other hand, issued pursuant to the provisions of the STCW-F, 1995.

4. characteristics of the titles and endorsements will be those established in annex IX of the present Royal Decree.

5. the title of local fishing pattern, as well as fisherman sailor and renewals of titles of second-class coastal fishing pattern, pattern of local fishing and coastal mechanic may continue to issue in the formats established in Royal Decree 662/1997 and 1519 / 2007.

Article 19. Revalidation and renewal of titles.

1. certificates and endorsements that allow exercise as captain or officer in seagoing vessels revalidate every five years. So the renewal may be made and extension of a title will be necessary to have an official form issued by a CRC, certifying fitness Psychophysics in accordance with the requirements for the issuance of the permit ordinary driving.

The previous certificate will not be necessary if the graduate has the medical certificate referred to in article 13 of the present Royal Decree. In addition, the applicant must meet one of the following requirements: to) have done a period of embarkation, pattern or official, at least one year in the last five, or three months in the last year.

(b) exceed a test or a course whose content will be determined by the Ministry of agriculture, food and environment in collaboration with the autonomous communities.

(2 test or review and update course prescribed in paragraph b) of the above, shall take into account the texts that pick up the recent changes in the international regulations about the safety of life at sea and the protection of the marine environment.

Article 20. On the issuance, renewal and revalidation of titles.


1. the issuance, renewal and revalidation of diplomas will correspond to the autonomous communities competent in the matter. Residents in regions which have not transferred the competence to issue, renew or revalidate titles, these shall be issued, renewed and revalidated by the autonomous community that they realized the formation or was originally issued the title. In the case of Ceuta and Melilla, lacking cities of attributions in the field of fisheries nautical qualifications, and so far that respective competencies, the titles are transferred you fishing nautical professionals will be issued, renewed and, where appropriate, revalidated by the General Secretary for fisheries.

3. the certificates issued by the Kingdom of Spain to nationals of third countries who are not resident in Spanish territory, will be renewed or revalidated by the Ministry of agriculture, food and environment.

Article 21. Dispensations.

1. in very exceptional circumstances and agree with what have the regulations in force, the maritime authority may provide a waiver to enable a person lacking the appropriate certificate to perform a position aboard a fishing vessel. The maritime authority may only provide such waiver if it does not involve danger to persons, property or the environment, which must be substantiated expressly in the administrative act that granted it, with attention to each specific case.

2. the waiver in any case may affect the radio operators who must be in possession of the certificate of operator of the global system relief and maritime safety as applicable.

3. the dispensation granted for a post, only will be awarded to anyone qualified to fill the post immediately below, and its maximum term will be six months without you can proceed with the extension of the same. However, new dispensations may be granted.

4. any exemption granted by the maritime authority for a year must be notified to the General Secretariat of fisheries before January 31 of the following year.

Article 22. Registration of professionals of the fishing sector.

1. in accordance with the provisions of article 44 of the law 3/2001, State maritime fishing, all persons who are or have been in possession of a nauticalfisheries card or will be registered in the registry of professionals of the Sector fisheries of the Ministry of agriculture, food and environment, without prejudice to the registration in other records legally provided for the exercise of their profession.

The register will contain all titles or endorsements issued, expired, revalidated, lost, suspended or cancelled, as well as any exemption granted.

At the request of another party the Ministry of agriculture, food and environment will provide information on the nature of such titles, endorsements and dispensations.

2. the keeping of the register will be decentralized, the same corresponding to the competent autonomous communities in their respective territories.

3. the autonomous communities move to the General Secretariat of fisheries, for inclusion in the registry of professionals of the fishing Sector, details concerning registration and low of fishing professionals which occur. Remission of data will take place within a maximum period of two months from the issue of the certificates and will contain, at least, the data shown in annex X of this standard.

Article 23. Owners of credential recognition of foreign qualifications.

Holders of a credential recognition of foreign qualifications, may apply for the issuance of the corresponding professional title of fishing before the competent autonomous community. To do this, they will present such credential instead of the corresponding academic title.

Article 24. Technical cooperation.

The Ministry of agriculture, food and the environment, in consultation with the International Maritime Organization, will seek to assist other parties which request technical assistance regarding: to) training of administrative staff or technical.

(b) the establishment of institutions for the training of the staff of fishing vessels.

(c) the provision of equipment and services for the training institutions.

(d) the development of appropriate training programmes, including practical training in seagoing vessels.

(e) facilitation measures and provisions aimed at improving the competence of fishing vessel personnel.

Chapter VI recognition of foreign professional qualifications article 25. General rules for the recognition of certificates issued by other States.

1. it may recognise qualifications issued by third countries provided that they are part of the STCW-F Convention and met the conditions prescribed in this Royal Decree. Not be accepted for recognition, endorsements of certificates issued by a different State than that issued the respective title.

2. foreign citizens shall be the recognition of a title to access the jobs of allocations of Spanish fishing vessels. This obligation except for cases where a fisheries agreement obliging embark a particular number of nationals of the country that has signed such an agreement, in this case the qualifications required for the shipment will be required by the legislation of that third country. This exception, it will only remain while the vessel fishing in the exclusive economic zone of the country that has signed the agreement of fishing, and in the transit from the fishing grounds to the first port of arrival and from this to the fishery.

3. the professional title whose recognition is sought shall include, subject to the rule I/7 of the aforementioned Convention STCW-F, endorsement of the State which issued it.

4. the recognition of diplomas, which is applicable to the STCW-F Convention, issued by other States parties, will be held at the request of the person concerned or the shipping company, and shall be granted through the issuance of the corresponding endorsement.

5. the recognition of titles that enable to serve as master or chief mate, will require passing a test on knowledge of Spanish maritime and fisheries law. For heads / first officers of machines, it may also require the overcoming of a test. The content of the test shall be determined by the Ministry of agriculture, food and environment.

6 If the professional a rubber stamp to title is subject to any limitation, the endorsement shall not exceed, in any case, the limits laid down in the original.

7. If the circumstances so require the maritime administration may be authorized to the interested party to exercise, in Spanish fishing vessels, the functions inherent in the title a rubber stamp for a maximum period of three months. To do so, the Secretariat-General of fisheries issued documentary proof that the request for an endorsement in accordance with rule I/7 of the STCW-F Convention has been.

To be able to issue the authorization provided for in this paragraph the fishing company must demonstrate convincingly that you have subscribed through specific policy or protection and indemnity of the vessel, insurance, or that it has an endorsement with a credit institution, either it has made provision covering the period mentioned, the civil liability for the exercise of functions and retention on Board of a holder of the professional title subject to recognition.

Article 26. Recognition of certificates issued by Member States of the European economic area.

1. the autonomous communities, processed professional fishing titles issued by a Member State of the European economic area, in accordance with community and national rules for applying.

2. recognition will be formalized through the issuance of the corresponding professional title of fishing or the proper endorsement. The possession of one of the aforementioned documents will be required to gain access to a job as crew of a Spanish fishing vessel.

3. the citizens of the European economic area, as well as their families that do not have Spanish nationality, who possess a professional degree with sufficient powers issued by a Member State may exercise the command of Spanish fishing vessels overcome once the proof of knowledge of legislation sea fisheries Spanish. 5. sailors of the European economic area, who have a valid and sufficient, issued by a Member State, that it empowered them to serve as sailors on board a fishing vessel and request the issuance of the title of fisherman sailor, they are entitled to the same and it will be issued by the autonomous communities following the procedure have established in this regard.

Article 27. Rules for the recognition of certificates issued by States not members of the European economic area.

1. the Ministry of agriculture, food and environment, through the General Secretariat for fisheries may recognize certificates issued by third countries provided that they are part, have a reconnaissance in force by the European Commission and on a list of third countries published in the official journal of the European Union.

2. to be able to recognize a title on fisheries, in addition to the above provisions, it will be necessary that previously the Ministry of agriculture, food and environment and the competent authority of the third country has signed an agreement of recognition of fishing titles. This agreement can only subscribe after the aforementioned Ministry that the third country fully complies with the requirements relating to the competition rules and the issuance and endorsement of fishing titles.

3. when the third country has signed an agreement of recognition with the Ministry of public works in the field of titles of the Merchant Navy, the Ministry of agriculture, food and environment may consider it valid also for the purpose of fishing, if in that country there is a differentiation between the merchant qualifications and fishing.

4. once recognized the title of the third country, the autonomous communities will be the competent for the issuance of the corresponding endorsement in accordance with the specimen given in annex VIII.

Chapter VII inspection, infringements and penalties article 28. Generalities.

Infringements and sanctions that have place in relation to the activities referred to in this Royal Decree shall be governed, at all times, by the provisions of chapter III of title V, of law 3/2001, 26 March, State maritime fishing, or standard that will replace it, and by the provisions of title IX of the law 30/1992 26 November, legal regime of public administrations and common administrative procedure.

The disciplinary procedure applicable shall be that laid down in the Royal Decree 747/2008, of 9 may, whereby the regulation of the penalties in the field of maritime fishing in foreign waters, as well as collected in the regulation on sanctioning procedure, developed in the Royal Decree 1398 / 1993, of 4 August, which approves the regulation of the procedure for the exercise of the powers to impose penalties; and, where appropriate, legislation established by the autonomous communities.

Article 29. Inspection of fishing vessels with the flag of a party.

1. fishing vessels flying the flag of a party in Spanish ports will be subject to inspection by duly authorized officers of the fisheries administration. Such inspection shall have as object: to) verify that the staff performing jobs for which 1995 STCW-F requires a qualification (pattern, mate, Chief Engineer, engineer officer and radio personnel) is in possession of an appropriate certificate or a valid dispensation.

The titles or waivers will be accepted, unless there are substantial grounds to suspect that the title has been obtained from fraudulently, or that the owner is not the person who originally was issued the document.

b) determine whether the staff of fishing vessels the fitness required to observe the rules on watchkeeping prescribed in the 1995 STCW-F Convention, when there are grounds for suspecting that such standards are not observed because: i. the ship has been involved in an approach or it aground.

II. has been a discharge of illicit substances in accordance with international conventions.

III. the ship has maneuvered so irregular or dangerous, have not followed the traffic regulation measures adopted by the International Maritime Organization or practices and procedures for safe navigation.

IV. the operation of the ship is a danger to persons, property or the environment.

2 when anomalies are observed in the wake of the provisions of paragraph 1 of this article, the officer making the inspection shall immediately in writing to the pattern of the ship and to the Administration, so that appropriate measures. Such notice, shall be specified in the details of the deficiencies found and the reasons why the inspection determines that these deficiencies constitute a danger to persons, property or the environment.

3. among the deficiencies that may be deemed constitute a danger to persons, property or the environment, they are the following: i. persons who should be entitled without titles or relevant dispensations.

II. the way in which the guard navigation or machines has been organized does not conform to prescribed by the Administration for the vessel concerned.

III. the absence in the guard of a competent person who can operate equipment essential for the safety of navigation, safety radio communications or the prevention of pollution.

IV. lack of staff rested for the first watch at the start of the journey and for the following Guards.

4. when the inspection: to) will be avoided as far as possible that the ship is detained or delayed unduly. If so, it shall be entitled to claim compensation for loss or damage.

(b) the rules shall apply with the same discretion to staff of foreign ships and national vessels.

5. in compliance with the provisions of paragraph 4 of article 8 of the STCW-F Convention, the application of this article is subject to, in any case, vessels flying the flag of a party to be treated more unfavorable than vessels of States that are not parties.

Article 30. Prevention of fraud and malpractices.

Autonomous or communities, in the field of its competences, the Ministry of agriculture, food and environment, carry out the necessary procedures for the impartial investigation of reported cases of incompetence, actions or omissions which may constitute a direct threat to the safety of human life or property at sea or to the marine environment , personnel with fishing titles issued by Spain in the exercise of the functions conferred upon the aforementioned titles them, in order to withdraw, suspend or cancel for this reason these titles and prevent fraud.

Article 31. Offences and penalties.

1. fishing offences and penalties in the field of nautical titles will be the common in the Marine Fisheries Act, without prejudice to the provisions of the criminal code.

2. in the case of knowledge of criminal offences, the General Secretary of fishing implement them knowledge of the public prosecutor's Office.

3. when a party communicates its intent to take action against a natural or legal person of Spanish nationality, for alleged offences in the field of fisheries nautical titles, the Ministry of agriculture, food and environment collaborate as much as possible with the quoted part.

First additional provision. Radio operators.

All captain or officer to deal with of a navigational watch on a fishing vessel played host to the world system of relief and maritime security, must be in possession of the certificate of radio operator who appropriate those specified in articles 9 and 10 of the order FOM/2296/2004, of 4 September, which regulates training programmes of the professional titles of bridge and machines of the Merchant Navy sailor , and Patron port, as well as supporting specialist certificates of professional competence.

Second additional provision. Graduates of machines of the merchant marine.

Graduates of machines of the Merchant Navy may exercise the powers that grants them their qualification on board fishing vessels. However, prior to shipment, they must prove to the autonomous community, or, where appropriate, to the Ministry of agriculture, food and environment, who are in possession of a professional card merchant machines, in order to be included in the registry of professionals of the fishing Sector. Only graduates of the Merchant Marine in the register may exercise their functions in fishing vessels. The General Secretariat for maritime fisheries and the General Directorate of the Merchant Marine to draw up the protocols that are required for automatic communication, by electronic means, to incorporate such registration to graduates of machines of the merchant marine. Until the computer may not have been enabled, the General Directorate of the Merchant Marine will report monthly through electronic support existing graduates.

Third additional provision. Graduates of bridge of the merchant marine.

1. the captains and pilots of the Merchant Navy may exercise functions on board fishing vessels within the conditions and powers listed in the order of February 28, 1976 by which establish the conditions requiring the Merchant Navy officers to play squares in fishing vessels.


2 obtain the degree of fishing, by captains and pilots of the Merchant Navy Captain, will be held in accordance with the order referred to in the preceding paragraph.

3. patterns of height and coastline of the Merchant Navy may apply to the autonomous communities the issuance of the corresponding fishing title. These local authorities issued it, but in the event that the applicant not accrediting the required period of shipment as official in vessels laid down in articles 6 and 7 of the present Royal Decree, the title will be issued with a restriction that prevents the exercise of command of the ship. 4. the holders of the professional title of the merchant marine port pattern may exercise as a pattern in vessels, not more length 12 meters and that more than 3 miles from a port or area of refuge, not depart whenever they prove a shipment of at least 12 months as a sailor in the deck of vessels subsequent to obtaining the professional title of port pattern , and are enrolled in the registry of professionals of the fishing Sector. You may simultaneously exercise command of the vessel and the service of machines, if permitted by the characteristics of the vessel and the propulsive power does not exceed 100 kW.

5. in the case of auxiliary ships of the aquaculture, port employers may exercise the powers conferred on them by his professional title without further condition to be included in the registry of professionals of the fishing Sector.

6. with the aim of to comply with the provisions in point 2 of rule I/6 of the agreement, graduates of the merchant must be included in the registry of professionals of the fishing Sector to be able to exercise the powers that fishing vessels granted this additional provision.

Fourth additional provision. Fishing bridge titles obtained in accordance with the law prior to the publication of the Royal Decree 930/1998.

Professional titles of first-class coastal fishing pattern and pattern of fishing, will move to coast pattern and pattern of height and will, on fishing vessels, the powers inherent in the new denomination since entering into force the present Royal Decree.

Fifth additional provision. Fishery machines titles obtained in accordance with the law prior to the publication of the Royal Decree 930/1998.

Sixth additional provision. Titles under the bridge and machines obtained in accordance with the legislation prior to the publication of the Royal Decree 662/1997.

1. possess titles of second-class coastal fishing pattern, pattern of local fishing and coastal mechanic will keep powers conferring them with the rules prior to the publication of the present Royal Decree.

2 the titles cited in the preceding paragraph, owners may apply for the issue of certificates set out in the present Royal Decree under the following conditions: to) who are in possession of the titles of local fishing pattern and mechanic of the coast, may directly obtain the title of local fishing pattern. If the person concerned does not have the title of coast mechanic, but is in possession of the naval biker and has five years of navigation, of which at least two have been made exercising this last qualification request also redemption.

(b) those who are in possession of the titles of pattern of second class of coastal fishing and naval mechanic 2nd class may directly obtain the title of inshore fishing vessel skipper.

3 a titles holders nautical fishing vessels referred to in paragraphs 1 and 2 of this additional provision, who wish to pursue studies to obtain the titles of inshore fishing vessel skipper or local fishing pattern, you will be validated following professional modules: to) those who are in possession of the title of local fishing pattern, be them validated all modules , except for machines, the degree of local fishing pattern.

b) is be to those who are in possession of the title of mechanical of coastal machines of the degree of local fishing pattern module.

Seventh additional provision. Obtaining the qualifications of inshore fishing vessel skipper, of local patron of fishing and fisherman sailor through certificate of professionalism.

Inshore fishing vessel skipper, local pattern of fishing and fisherman seaman titles, also will be available through the recognition of the relevant certificates of professionalism by the competent body in matter of fishing qualifications of the autonomous community. Once passed the validation of a certificate of professionalism the autonomous community shall issue the corresponding title.

Carrying out the aforementioned validation will require that the applicant has passed scrutiny, in a Centre accredited by the autonomous community or public service employment, including the materials referred to in annex I for the titling of inshore fishing vessel skipper, in annex II to the local pattern of fishing and annex III for the title of fisherman sailor. In addition, in the event that the autonomous region has given provisions developing State regulations, validation is only possible if meets the cited provisions of development. To obtain the professional title, besides the previously mentioned knowledge, students must prove the completion of the period of shipment laid down in articles 8 or 9 of the present Royal Decree for each title.

In the event that an autonomous community or the public State employment service credited a center to provide certificates of professionalism, it shall communicate this fact to the Ministry of agriculture, food and environment.

The eighth additional provision. Recognition of qualifications issued by the Ministry of defence.

The members of the Navy, and to those persons who, having belonged to the same, are in possession of the qualifications of technical military declared equivalent with the academic qualifications of technician intermediate specific vocational training in fishing and maritime transport and operation, Control and maintenance of machines and naval facilities by the ECD/3869/2003 order December 18, which establish equivalences between the titles of military-technical and technical titles corresponding to the specific vocational training, be validated modules that are consistent with those established for local fishing and inshore fishing vessel skipper pattern titles and other fishery sector that apply.

Determination of the modules that are coincident for purposes of recognition provided for in the preceding paragraph shall be established by law a joint proposal of the Ministers of agriculture, fisheries and food and defense.

Ninth additional provision. Graduates embarked on Spanish vessels which remain more than 6 months without arriving at a national port bridge and machines.

Every four months, Spanish vessels that remain more than 6 months without making the firm at a national port shall communicate, either directly or through the owner's to the Secretariat-General of fisheries a list showing the name, national document of identity and qualifications of the captain, the Chief of machines and the officers.

Tenth additional provision. Fundamental principles that should be observed in the guards of navigation on board fishing vessels.

Owners or shipowners shall ensure that their ships carried a copy of the principles relating to the guards who are established in the annex on the bridge XI of this Royal Decree.

The pattern of all fishing vessel shall ensure that appropriate measures are taken to keep a guard of safe navigation. During the periods in which they are on call, and under the general authority of the master, the officers of this service are responsible for ship to navigate safely, ensuring especially that not suffering any collision or stranding.


For good compliance with prescribed in the preceding paragraph, the pattern and the officers who are on duty should take into account the principles set out in annex XI of the present Royal Decree.

Eleventh additional provision. Responsibilities of the qualified nautical fishing ships or auxiliary vessels fishing or aquaculture activities.

The holders of the titles set out in article 4 of this standard will, on ships or auxiliary vessels fishing or aquaculture activities, the same powers which granted the present Royal Decree for fishing vessels.

Twelfth additional provision. Validation of studies.

1. anyway, professional qualifications of fishing captain, pattern height and pattern of coastline, as well as the extinct of pattern height and pattern of first-class coastal fishing fishing, will be used to validate all training modules, except for machines, inshore fishing vessel skipper and local pattern of fishing titles. First transitional provision. Academic qualifications prior to the entry into force of this standard.

Holders of academic degrees in: «Technician in navigation, fishing and maritime transport», «Technician in Supervision and Control of machines and facilities of the ship», «technical fishing and maritime transport» and «in operation, Control and maintenance of machines and facilities of the ship»; regulated, respectively, by the royal decrees: 721/1994, of 22 April, by which establishes the title of technician in navigation, fisheries and maritime transport and the corresponding minimum teachings; 722/1994, of 22 April, which establishes the title of technician in Supervision and Control of machines and facilities of the ship and the corresponding minimum teachings; 724/1994, of 22 April, which establishes the title of technician in fisheries and maritime transport and the corresponding minimum teachings and 725/1994, of 22 April, which sets the title of technician in operation, Control and maintenance of machines and facilities of the ship and the corresponding minimum teachings, may obtain the relevant professional qualifications always that they have fulfilled the shipping periods established in the present standard.

In the event that holders of qualifications mentioned in the preceding paragraph, have started their service at sea, in the section of the vessel to do reference the academic title, prior to the September 29, 2012, may qualify for the duration that is indicated in the Royal Decree 930/1998, 14 may for the same provided that this period this concluded and the expedition of the professional title has been requested until five years have elapsed since the entry into force of the Convention.

Second transitional provision. Examination certificates of the qualification of inshore fishing vessel skipper, with pre-qualification, obtained prior to the entry into force of the Convention.

Holders of an examination certificate of the degree of inshore fishing vessel skipper with qualification of suitable, issued prior to the entry into force of the Convention, may obtain the corresponding professional title, provided that they have fulfilled the embarkation periods established in this standard.

The holders of the certificate provided in the preceding paragraph, that started the shipment period prior to September 29, 2012, may benefit from the duration that is indicated in the Royal Decree 662/1997, 12 may, provided that that period is completed and the qualification is requested until five years have elapsed since the entry into force of the Convention for the same.

Third transitional provision. Recognition of certificates issued by third countries.

Until the European Union published the list referred to in point 1 of article 27 of this standard, the countries that has recognized systems of certification and training in fisheries, the Ministry of agriculture food and environment can use for recognition of degrees fishing the one dictated under the protection of the Directive 2008/106/EC of the European Parliament and of the Council , November 19, 2008, on the minimum level of training for maritime professions.

Fourth transitional provision. Issue of certificates on the model provided for in annex I of Royal Decree 930/1998.

The autonomous communities may continue to issue qualifications in the form set out in annex I of Royal Decree 930/1998, of 14 may, during a period not exceeding 2 years, starting from the entry into force of the STCW-F Convention.

Fifth transitional provision. Graduates of the old formation of adults.

Persons who, having passed the final exams of the old formation of adults, have not been able to obtain the corresponding professional title for not having made shipping periods prior to December 31, 2008, and started his service in the sea section of the vessel indicating the examination certificate, before the September 29, 2012 There will be 5 years from the latter date to prove the realization of such periods and ask for the corresponding professional title.

Sixth transitional provision. Exchange of securities of competition of sailor.

1. the holders of the certificate of competence of sailor in force may obtain the professional title of fisherman sailor requesting the redemption before the autonomous community corresponding.

2. such an Exchange may carry out for indefinite time. Those workers who, having requested redemption of the certificate of competence of sailor by the title of fisherman sailor, had not yet received the latter may continue joining fishing vessels with the certificate referred to acceptance of the aforementioned title.

3 a time to make the referral Exchange, in relation to the provisions of the second subparagraph of the paragraph to) point 3 of article 12 of this standard, periods of shipment made under cover of the certificate of competence of sailor will be Computable.

Repealing provision.

All provisions of equal or lower rank who are opposed to provisions in the present Royal Decree and specifically the following shall be repealed: a) the Royal Decree 662/1997, 12 may, which establish the minimum requirements to pursue the professional activity of local fishing pattern and inshore fishing vessel skipper.

(b) the Royal Decree 930/1998, of 14 may, on terms of suitability and qualification of professions of the merchant marine and fisheries).

(c) the Royal Decree 1833 / 2004 of 27 August, that laying down minimum requirements for the degree of master of fishing and the powers conferred.

d) the Royal Decree 2017 / 2004, of 11 October on powers of the degrees of pattern fishing, first-class coastal fishing and naval mechanic first class pattern.

e) the Royal Decree 1519 / 2007 of 16 November, laying down minimum requirements and the expertise to pursue the professional activity of sailor on fishing vessels.

(f) the order of the Ministry of Commerce of January 21, 1975, on the conditions in which there is regulatory embarkation to access professional qualifications of the merchant marine and fisheries).

(g) the order of 29 April 1988 by establishing the qualifications approval procedure nautical fishing, bridge and machines to those set forth in the Executive order 2596 / 1974 and Royal Decree 1611 / 1987.

First final provision. Skill-related title.

This Royal Decree is basic standard of management of the fisheries sector, and is issued pursuant to the provisions of article 149.1.19. ª of the Constitution. Excepted from the above the articles 6.1. c), 7.1. c), 10.1. c) and 11.1. c), relating to the access to the professions of height pattern, pattern of coastal, more naval mechanic and naval mechanic, whose regulation covers in the competence attributed to the State by article 149.1.30. ª of the Constitution for the regulation of the conditions of procurement, issuance and recognition of academic and professional qualifications.

Second final provision. Compliance with the 1995 STCW-F.

This Royal Decree is run in compliance with the provisions contained in the International Convention on standards of training, certification and Watchkeeping for fishing vessel personnel, done at London on 7 July 1995. (STCW-F 1995).

Third final provision. Faculty of development.

It authorizes the Minister of agriculture, food and environment to enact provisions that are specific to the development of this Royal Decree, as well as, to carry out the modifications that may be suitable in the content of the annexes thereto when modifications are carried out to adapt them to international standards.

Fourth final provision. Entry into force.

This Royal Decree shall enter into force the day following its publication in the "Official Gazette".

The Minister of agriculture, food and environment, MIGUEL ARIAS CANETE annex I knowledge minimum required to obtain the degree of inshore fishing vessel skipper course to impart the knowledge needed to obtain the title of inshore fishing vessel skipper will have at least one duration of 600 hours and, as a minimum, will be taught the following subjects: A. section bridge.

1. Navigation: 1.1 planning the crossing and navigation in all conditions: 1. following the methods generally accepted path of defeats;

2. in restricted waters;

3. with low visibility;

4. by the traffic separation schemes; and 5. In areas affected by tides or currents.

3.2 demonstrate knowledge of the fundamental principles collecting chapter IV of the STCW-F on the realization of navigation officers.

4 navigation radar: 4.1 using radar Simulator or, when not available one, with the help of the rose of maneuver, demonstrate knowledge of the fundamentals of radar and ability to operate and use the radar and to interpret and analyze the information obtained with this equipment, including the following: 1. factors affecting performance and accuracy;

2. pre-fit and conservation of the image;

3. detection of deficiencies in the presentation of information, false echoes, echoes of the sea, etc.;

4 scope and marking;

5. identification of critical echoes;

6 course and speed of other vessels;

The corner top left will be placed a photograph of 21 × 29 mm.

All documents issued must be numbered. The numbering will be Arabic and sequential and were just below and to the left of the box that collects the capabilities and limitations of the title.

2. Personalization: Printed data.

Legend has it that collects the name of Spain will be in bold and Arial 14, the specification of whether title or endorsement and the name of the Convention will appear in bold capital letters and Arial 10. The translation of this into English will appear in Arial 9, with letters capital letters and centered with respect to the previous.

Annex XI fundamental principles that should be observed in the guards of navigation on board fishing vessels 1. En route to or from fishing.

1.1 Organization of a navigational watch.

1.1.1. the composition of the Guard will be at all times sufficient and appropriate to the prevailing circumstances, and to determine it will take into account the need to maintain a proper lookout service.

1.1.2 when determining the composition of the guard shall be taken into account, among others, the following factors: 1. the need for that at any moment the wheelhouse is without Endowment;

10. the operational status of the instruments and controls of the wheelhouse, including alarm systems;

11. the size of the ship and the field of view from the steering station;
