The Kingdom of Spain by the Instrument of Accession, given in Madrid on 28 November 2008, and its subsequent deposit with the International Maritime Organization has become a Party to the International Convention on Standards of training, certification and training for the staff of fishing vessels, done in London on 7 July 1995 (STCW-F 1995). This Convention, published in the "BOE" of 16 March 2012 and the date of its entry into force on 29 September 2012, aims to promote the safety of human life at sea and the protection of the marine environment by establishing international standards. in order to ensure that staff engaged in marine fishing vessels have the appropriate competence and competence to perform their duties.

In general, the training established in the national regulations on nautical fishing qualifications meets the requirements of the Convention. However, some sections of the Spanish training must be modified to adapt to the international standard, and as in addition the STCW-F 1995 incorporates provisions on: inspection, titles and endorsements, information communication, Recognition of foreign qualifications and waivers that national regulations do not collect, it is necessary to modify the latter in order to adapt Spanish legislation to the new developments that the Convention establishes at international level.

The professional nautical qualifications are currently regulated by Royal Decree 662/1997 of 12 May 1997 laying down the minimum requirements for the exercise of the activity of a local fishing employer and This is the case in point where the Commission has not yet taken a decision on the question of whether or not it is necessary for the Commission to be able to do so. On the other hand, the title of Captain of Fishing is governed by Royal Decree 1833/2004 of 27 August, laying down the requirements for obtaining the title of fishing captain and the privileges conferred by it; and the card of Marinero Fisherman by Royal Decree 1519/2007 of 16 November establishing the minimum knowledge and requirements for the exercise of the professional activity of seafarers on fishing vessels. In addition to the above mentioned standards, Royal Decree 2017/2004 of 11 October on the privileges of the standard of first class fishing standard for high-altitude fishing patterns is also in force.

The time since the publication of the actual decrees cited in the previous paragraph, made it necessary to introduce changes in some of them to adapt them to the evolution of the sector; as a consequence, the regulations on fishing nautical degrees has been amended several times. Royal Decree 930/1998 sets out today the changes introduced by the royal decrees: 1437/2003 of 31 October, amending Royal Decree 930/1998 of 14 May on general conditions for the suitability and titration of certain professions of the merchant marine and fisheries sector; 653/2005 of 6 June 2005 amending Royal Decree 930/1998 of 14 May 1998 on general conditions for the suitability and certification of certain professions in the merchant and the (a) fishing sector; and finally, by Royal Decree 2008/2009 of 23 December 2009, for which the amend Royal Decree 930/1998 of 14 May on general conditions for the suitability and certification of certain professions in the merchant marine and fisheries sector. For its part, Royal Decree 662/1997 was amended by Royal Decree 1548/2004 of 25 June 2004 amending Royal Decree 662/1997 of 12 May 1997 laying down the minimum requirements for the exercise of professional activity in the field of public health Local fishing pattern and multi-purpose coastal pattern. Finally, it should be noted that Royal Decree 1519/2007 was reformed by Royal Decree 884/2011 of 24 June 2011 amending Royal Decree 1519/2007 of 16 November establishing the minimum knowledge and requirements for the exercise the professional activity of a sailor on fishing vessels.

As a result of the above mentioned in the previous paragraph and the modification of the regulations in force before the years 1997 and 1998, it is the existence of a dispersed regulation which, due to the evolution of the sector, is advisable reunify and retouch.

On the other hand, the Government has issued Royal Decree 1533/2011 of 31 October establishing seven certificates of professionalism of the professional maritime family, which are included in the national repertoire of certificates of professionalism, and Royal Decree 1774/2011 of 2 December 2011 establishing four certificates of professionalism of the professional maritime family, which are included in the National Directory of certificates of professional. Both standards set out certain certificates of professionalism of the professional maritime family, and the training established in one of them, could be equivalent to that provided for in obtaining the professional qualifications of the multi-purpose coastal pattern and local fishing pattern, as well as the necessary to obtain the title of fisherman seaman. In view of the fact that the issue of fishing professional qualifications is a matter for the autonomous communities, this rule establishes the channel through which the local authorities may issue a certificate. professional to the holders of certain certificates of professionalism.

In addition, it is considered necessary to clarify the privileges of the merchant marine graduates on fishing vessels, to determine the convalidations and equivalences corresponding to the qualifications issued prior to the publication of the actual decrees 662/1997 and 930/1998, and finally provide for possible validation of qualifications issued by the Ministry of Defence; these issues are intended to be addressed by the present rule.

Taking into account the above mentioned background, it is considered necessary to adopt a new text which, as a basic rule for the qualifications of the fisheries sector, refounds the existing dispersed rules and incorporates the legal acquis The International Convention on Standards of Training, Certification and Watchkeeping for the Personnel of Fishing Vessels, made in London on July 7, 1995.

This royal decree is dictated by the provisions of article 42 of Law 3/2001, of March 26, of Maritime Fisheries of the State, which states that the Government, on a proposal from the Minister of Agriculture, Fisheries and Food, regulate the qualifications of professionals in the sector, within the framework of the general education system, by establishing the suitability requirements and the professional privileges corresponding to each qualification, without prejudice to the powers of the Ministry of Development.

In its virtue, on the proposal of the Minister of Agriculture and Environment, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting of the day of January 24, 2014,

CHAPTER I

General provisions

Article 1. Object and scope of application.

The present royal decree is intended to regulate the basic conditions for obtaining the professional qualifications required for the exercise of functions on board Spanish fishing vessels, and the privileges of each of the such hesitations on fishing vessels.

Article 2. Definitions.

For the purposes of this royal decree and development provisions, it is understood by:

1. Convention: the Convention of the International Maritime Organization on standards of certification and training for the personnel of fishing vessels, 1995 and its Annex. This rule also receives the 1995 STCW-F Convention name.

2. Training Convention, 1978 (STCW): the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, 1978, as amended.

3. STCW code: the code of training and certification for seafarers listed as an annex to the STCW Convention, approved by Resolution 2 of 1995 of the Conference of the Parties to the STCW Convention, in the version in force at the time of its application.

4. Part: any State in which the 1995 STCW-F Convention has entered into force.

5. Administration: the Government of the Party whose flag is entitled to fly the vessel.

6. Title: a professional nautical fishing title with the latter as any valid document, whatever the name with which it is known, issued, or recognised in accordance with the provisions of the 1995 STCW-F Convention, by the Administration of a State party to it, which empowers the holder to carry out the charge in the indicated, as authorized by the national regulations.

7. Entitled: Person duly provided with a degree.

8. Academic title: official document awarded by the body of the competent educational administration which certifies the overcoming of the theoretical training established in the Convention.

9. Certificate of type-approval of foreign securities: document in which the decision of the competent authority is formalized, recognizing the approval of a foreign academic title by a Spanish academic title.

10. Civil vessel: any vessel, vessel, floating artifact platform, with or without displacement, suitable for navigation and not affected by the service of national defense.

11. Fishing vessel: any vessel used for catching fish or other living resources of the sea (art. 1, pto. 20 of Directive 2008 /106/EC of the European Parliament and of the Council). This definition is exempted from, in any case, vessels or vessels engaged in recreational fishing.

12. Fishing vessel for maritime navigation: a fishing vessel other than those intended to sail exclusively in inland waters, or sheltered waters, or in the vicinity of such waters or areas in which they govern port regulations.

13. Fishing vessels or vessels of fishing or aquaculture activities: these are those listed in the Fourth List of the Register of Ship Matches.

14. Gross tonnage: the tonnage of the vessel, expressed in GT, which is contained in the tonnage certificate issued in accordance with the International Convention on the Arqueing of Ships, 1969.

15. Power: the maximum continuous propulsion power of a vessel, measured in kilowatts (kW), which together have all of its main propulsion machines and which is recorded in the ship's registration certificate.

16. Crew: boarded-up personnel providing their professional services on civil ships.

17. Fisherman: any member of the crew of a fishing vessel.

18. Coastal fishing: the fishing fleet carried out by the fishing fleet for a period of less than 24 hours.

19. Master or master: the person who, in possession of the corresponding title, exercises the command and direction of the vessel, has the representation of the shipowner, as well as the other public and private functions assigned to him by the rules in force.

20. Official: a member of the crew of a vessel, other than the master or master, student or sailor who, while holding the corresponding title, exercises responsibility for bridge and deck services or machines.

21. Head of machinery: the machine officer who, while in possession of the corresponding title, exercises the direction and command of the machinery service and the main and auxiliary propulsion equipment of the vessel, as well as the other functions which he or she attribute the current regulations.

22. Bridge officer: the officer who, finding himself in possession of the title which accredits his competence in accordance with the provisions of rules II/1, II/2, II/3 and II/4 of the 1995 STCW-F Convention, exercises as an officer in charge of the navigation and port on the bridge and deck service of fishing vessels, as well as the other functions assigned to it by the rules in force.

23. First officer: the bridge officer who remains in rank with the master or skipper and who, in the event of his incapacity, will have to assume command of the ship; he also exercises the functions that the current regulations attribute to him.

24. Machinery officer: an officer who, in possession of the professional title which credits his competence, takes charge of the machine guards on the fishing vessels and exercises the other functions assigned to him by the rules in force.

25. First machine officer: the machine officer who remains in the position of the head of machinery, and who, in the event of his incapacity, shall assume responsibility for the mechanical propulsion and operation and maintenance of the mechanical and power of the vessel. In addition, it will exercise any other role that the current legislation gives you.

26. Radio operator: the person who has an appropriate title, issued or recognised by an Administration under the provisions of the Radio Regulations.

27. Radiocommunications Regulation: the Radio Regulations Annex or considered Annex, to the most recent International Telecommunications Convention that is in force.

28. Student: the person who is receiving training on board ships to acquire the appropriate maritime experience required by the provisions in force in order to obtain a professional title.

29. Sailor: any crew member of a fishing vessel who is not a master or skipper, head of machinery, officer or pupil.

30. Seafarers: any person with maritime training and in possession of a maritime professional title issued by a State.

31. Boarding period: the time elapsed between the dates of embarkation and disembarkation on board a ship, as recorded in the dispatch and endowment role or in any other official document of the ship or in the sea book.

32. Record of the training: the document issued for each student, where it is specified and records the practical training to be carried out by the students, bridge or machines, on board the ships, under the supervision and evaluation of an officer and required for the issue of a professional title.

33. Navigations close to the coast: the navigations made along the coast within the area between the coast and the 60-mile line parallel to it. They will be taken as a reference to measure the 60 miles of the straight lines established in Royal Decree 2510/1977, of 5 August

34. Length: 96% of the overall length in a float corresponding to 85% of the minimum drawing point measured from the keel line, or the length of the proel face of the roda to the axis of the rudder wick on that float, whichever is greater. For inclined keel vessels, the reference flotation to measure the length shall be parallel to the project flotation.

35. Length between perpendiculars: is the distance between the bow perpendicular (Ppr) and the aft perpendicular (Ppp).

36. Bow perpendicular: is the vertical line drawn by the intersection of the summer flotation with the bow singing of the ship's roda.

37. Aft Perpendicular (Ppp): is the vertical line whose position is defined according to the shape of the stern of the vessel. On ships with rudder and propeller in the diametral plane, or from creaking, the Ppp passes through the stern face of the popel codaste, while, on the vessels with rudder offset on the diametral plane the Ppp coincides with the axis of the rudder.

Article 3. Conditions for the exercise of the activity on board Spanish fishing vessels.

1. In order to exercise professionally on board Spanish fishing vessels as captain, head of machinery, officer or sailor, a certificate must be in force.

2. The basic training certificate, as defined in Regulation VI/1 of the STCW Convention, shall be compulsory for all members of the crew of fishing vessels larger than 24 metres in length. For vessels less than that length it shall only be necessary if the rules in force so establish.

3. The crew members of the fishing vessels shall also have the other certificates of specialty which are required in accordance with the rules in force.

CHAPTER II

From professional fishing titles

Article 4. Determination of professional fishing titles.

1. The professional fishing titles in Spain shall be as follows:

a) Fishing captain.

b) Height pattern.

c) Coastal pattern.

d) Multi-purpose coastal pattern.

e) Local fishing pattern.

f) Marinero fisherman.

g) Naval Major Mechanics.

h) Naval mechanics.

2. The titles listed in the preceding paragraph are classified in three sections: bridge section, to which the titles referred to in point (a) to (c) belong; multi-purpose section, title (d) to (f); and section of machines listed in (g) and h).

3. The titles referred to in paragraphs (a), (b) and (c) of the previous point incorporate the minimum training requirements laid down in rules II/1 and II/2 of the Convention.

The title referred to in paragraph (d) of point 1 incorporates the minimum training requirements laid down in rules II/3 and II/4 of the Convention.

The titles listed in paragraphs (g) and (h) of point 1 of this Article incorporate the requirements set out in Regulation II/5 of the Convention.

For the titles set out in paragraphs (e) and (f) of point 1 of this Article, as well as for the machine module of the multi-purpose coastal pattern titling, the Convention does not indicate minimum training requirements.

4. Each of the titles referred to in the preceding paragraphs shall enable certain functions to be performed on board fishing vessels with the limitations laid down in the title itself.

5. The titles regulated in this royal decree do not affect certificates or certificates which are regulated in other existing rules, such as safety and health, which require the crew to be in possession of certain certificates such as those of specialty and sanitary.

Article 5. Fishing captain.

1. Requirements.

a) Be in possession of the height pattern title or the height fishing pattern title.

(b) Dispose of an official form, issued by a Driver Recognition Centre (CRC), certifying physical fitness in accordance with the requirements for the issue of the ordinary permit to driving.

The above form shall not be required if the person concerned has the medical certificate referred to in Article 13 of this royal decree.

(c) Haber completed 600 days of boarding as a master or bridge officer on fishing vessels of more than 30 metres in length; 300 of these days must have been carried out, after obtaining the title of Pattern of Height or Pattern of Fishing for Altura, on board national fishing vessels or on board fishing vessels belonging to companies listed in the Register governed by Royal Decree 601/1999 of 16 April 1999 regulating the Official Register of Enterprises Fishing in Third Countries.

d) Have passed the appropriate examination.

2. Attributions.

a) Command of fishing vessels of any kind, without limitation of length or distance to the coast.

b) Enroll as first officer or bridge officer, in fishing vessels of any kind.

Article 6. Height pattern.

1. Requirements.

a) Haber turned 20 years old.

(b) Dispose of an official form, issued by a Driver Recognition Centre (CRC), certifying physical fitness in accordance with the requirements for the issue of the ordinary permit to driving.

The above form shall not be required if the person concerned has the medical certificate referred to in Article 13 of this royal decree.

c) Being in possession of the academic title of Senior Technical in Maritime Transport and Fishing of Height, established in R.D. 1691/2011, of 18 November, establishing the title of Senior Technician in Maritime Transport and Fishing for Height and its minimum teachings; for which it is necessary to have passed an examination or examination which includes the minimum knowledge required in the Appendix to Regulation II/1 of the STCW-F. Convention

(d) To have provided service in the bridge section of fishing vessels of length not less than 12 metres, during a boarding period of at least two years, of which at least 6 months must have been carried out subsequently to the conclusion of the examination referred to in the preceding paragraph. This period of boarding may be replaced by a period of not less than 12 months, as a pupil or a sailor, at least six months in the course of activities of the navigation guard, as part of a training programme in accordance with the requirements of the of section A-II/1 of the STCW Code, provided that this is recorded in a training book approved in accordance with the Training Convention, 1978.

The Ministry of Agriculture, Food and the Environment may permit the replacement of the embarkation periods referred to in the preceding paragraph, for a special training period not exceeding one year, provided that the the special training programme is at least equivalent to the value of the required embarkation period to which it replaces. The completion of this training will be carried out through appropriate consultation with the Ministry of Education, Culture and Sport.

2. Attributions.

a) Exercise as first officer or as a bridge officer on fishing vessels without any limitation.

b) Exercise as master or skipper on fishing vessels of length not exceeding 50 metres, provided that, in addition to the requirements set out in point 1 of this Article, a loading period of not less than 12 months has been completed as an officer in charge of the navigational watch or skipper on fishing vessels of length not less than 18 metres. In the case where the said boarding period is carried out on vessels of more than 12 metres in length but less than 18 metres, it may only be capable of carrying out fishing vessels of a length of not more than 30 metres.

Article 7. Coastal pattern.

1. Requirements.

a) Haber turned 18.

(b) Dispose of an official form, issued by a Driver Recognition Centre (CRC), certifying physical fitness in accordance with the requirements for the issue of the ordinary permit to driving.

The above form shall not be required if the person concerned has the medical certificate referred to in Article 13 of this royal decree.

c) Being in possession of the academic title of Technical in Navigation and Fishing of Litoral, established in Royal Decree 1144/2012, of 27 July, establishing the title of Technical in Navigation and Fishing of Litoral and are fixed their minimum teachings; for the purpose of which it is necessary to have passed an examination or examination, including the minimum knowledge required in the Appendix to Rule II/1 of the Annex to the STCW-F. Convention

(d) to have provided service in the bridge section of fishing vessels of length not less than 12 metres during a loading period of at least two years, of which at least 6 months must have been carried out after the conclusion of the examination referred to in the preceding paragraph. This boarding period may be replaced by a period of not less than 12 months, as a pupil or a seaman, carrying out at least six months in the activities of the navigation guard, as part of a training programme in accordance with the requirements of the Section A-II/1 of the STCW Code, provided that this is recorded in a training book approved in accordance with the Training Convention, 1978.

The Ministry of Agriculture, Food and the Environment may allow the replacement of the embarkation periods referred to in the preceding paragraph, for a special training period not exceeding one year, provided that the the special training programme is at least equivalent to the value of the required embarkation period to which it replaces. The completion of this training will be carried out through appropriate consultation with the Ministry of Education, Culture and Sport.

2. Attributions.

(a) Exercise as an officer or first officer on fishing vessels of length not exceeding 50 metres.

b) Exercise as captain or skipper on fishing vessels of length not exceeding thirty metres, within the area of parallel 52 ° N and 10 ° N and the meridians 32 ° W and 30 ° E; provided that a period of embarkation has not been completed less than 12 months as the official in charge of the navigation guard or skipper on fishing vessels of length not less than 12 metres.

Article 8. Multi-purpose Coastal Pattern.

1. Requirements.

a) Haber turned 18.

(b) Dispose of an official form, issued by a Driver Recognition Centre (CRC), certifying physical fitness in accordance with the requirements for the issue of the ordinary permit to driving.

The above form shall not be required if the person concerned has the medical certificate referred to in Article 13 of this royal decree.

(c) Having passed an examination, or examination, including, at least, the matters set out in Annex I to this royal decree, in which the minimum knowledge required by Regulation II/3 of the Annex to the Convention is collected.

(d) To have served in the bridge section of fishing vessels of length not less than 12 metres, during a period of embarkation of at least two years; however, the Ministry of Agriculture, Food and Environment may allow:

-The replacement of this boarding period with a special training period of not more than one year, provided that the special training programme is at least equivalent to that of the boarding period required to which you replace.

-The replacement of the shipping period on fishing vessels by another one consisting of a register approved in accordance with the Training Convention, 1978.

For the calculation of the two-year boarding period provided for in this paragraph, up to eighteen months of embarkation days prior to the examination provided for in paragraph 1 (c) of this paragraph shall be accepted. This article, the rest of the shipment must be carried out, in any case, after the passing of the said examination.

e) Perform a 6-month shipping period on the machine service of a civilian vessel.

2. Attributions.

(a) Enroll as first officer or officer in charge of the navigation guard on vessels engaged in coastal fishing.

b) Enroll as the first officer of machines on fishing vessels of less than 750 kW, and as the officer in charge of the machine guard.

c) Exercise as captain or master and/or head of machines, on vessels up to 24 metres in length between perpendiculars and 400 kilowatts of effective machine power, dedicated to coastal coastal fishing, up to a distance of 60 miles from the coast. The basis for the calculation of the distance to the coast will be the straight lines defined in Law 10/1997, of 4 January, on territorial sea, whose delimitation is contained in Royal Decree 2510/1997, of 5 August, of jurisdictional waters, lines a straight base for delimitation.

In order to be able to exercise the function of captain provided for in this paragraph, the person concerned must have completed a boarding period of not less than 12 months as an officer in charge of the navigation guard, or patron, on fishing vessels of length not less than 12 metres.

d) Exercise the head of machines on fishing vessels with propellant power not exceeding 550 kilowatts.

Article 9. Local fishing pattern.

1. Requirements.

a) Haber served 18 years of age.

(b) Dispose of an official form, issued by a Driver Recognition Centre (CRC), certifying physical fitness in accordance with the requirements for the issue of the ordinary permit to driving.

The above form shall not be required if the person concerned has the medical certificate referred to in Article 13 of this royal decree.

(c) Having passed an examination, or examination, which includes at least the subjects listed in Annex II to this royal decree.

(d) to have served on fishing vessels or fishing vessels or aquaculture vessels for a period of 18 months, within which at least 6 months shall be carried out in the bridge section of fishing vessels with after the aptitude test has been exceeded. The remaining 12 months may be carried out prior to the conclusion of the said test, at least six of which must be observed on the machine guard.

2. Attributions.

(a) Captain or master and/or head of machinery, in fishing vessels up to 12 metres in length between perpendiculars and 100 kilowatts of power, up to a distance not exceeding 12 miles from the base lines defined according to Law 10/1977, of 4 January, on territorial sea, which is set out in RD 2510/1977 of 5 August.

b) Head of machines on fishing vessels up to 180 kW of power.

Article 10. Naval major mechanic.

1. Requirements.

a) Haber turned 20 years old.

(b) Dispose of an official form, issued by a Driver Recognition Centre (CRC), certifying physical fitness in accordance with the requirements for the issue of the ordinary permit to driving.

The above form shall not be required if the person concerned has the medical certificate referred to in Article 13 of this royal decree.

(c) Hälse in possession of the academic title of Superior Technician in the Organization of the Maintenance of Machinery of Ships and Embarks, established in Royal Decree 1075/2012 of 13 July, establishing the title of Technical Superior in the Organization of the Maintenance of Machinery of Ships and Vessels and their minimum teachings are fixed; for the purpose of which it is necessary to have passed examinations which include the materials mentioned in the Appendix of Rule II/5 of the Annex to the Convention.

d) Haber participated in a fire fighting course. For these purposes, and for fishing vessels of less than or equal to 50 metres, it shall be considered sufficient to exceed the practical theoretical module for fire-fighting required to obtain the basic training certificate laid down in the Article 5 of Order FOM/2296/2002 of 4 September 2002 regulating the training programmes of professional titles of the Mariners of Puente and of the Portuguese Patron, as well as the certificates of specialty of the professional competence.

(e) to have provided service in the machinery chamber of a civil vessel, as a pupil or a seaman, for a period of not less than 12 months, of which at least six months have been carried out on guard activities; machines. This period may be reduced to at least 6 months, when the Ministry of Agriculture, Food and the Environment provides for special training to be considered equivalent to the period to be replaced.

2. Attributions.

(a) Exercise as first officer of machines on fishing vessels of not more than 3,000 kW.

(b) Exercise as an officer of machines of a category lower than that specified in the previous paragraph on any fishing vessel.

(c) Exercise as head of machines on fishing vessels of a propellant power of less than 750 kW.

d) To exercise as the first officer of machines on fishing vessels of more than 3,000 kW, provided that, in addition to the requirements set out in point 1 of this Article, you have completed a shipping period not less than 12 months as an official of machines on ships powered by a power of between 500 and 3,000 kW.

(e) Exercise as head of machines on fishing vessels of a power not exceeding 3,000 kW; for this purpose, in addition to the requirements laid down in paragraph 1 of this Article, an embarkation period of not less than 24 must be credited months as an official of machines, of which at least 12 months must have fulfilled them by performing the duties of first official, on vessels of power between 500 and 3,000 kW.

f) To exercise as Head of machines on fishing vessels of propulsion power not exceeding 6,000 kW, when, in addition to complying with the requirements laid down in point (e) above, the course of which the content of which the content is is set out in Annex I of the Resolution of 31 May 2010, of the Directorate General of the Merchant Marine, establishing the accreditation courses for Naval and Naval Mechanics Major Naval Mechanics for the professional exercise in ships merchant up to 6,000 kW. This course must have been taught in an approved training center for the teaching of the academic title of Superior Technician in the Organization of the Maintenance of Machinery of Ships and Embarks.

g) Exercise as head of machines on fishing vessels without power limit, provided that the following requirements are met, in addition to the provisions of paragraph 1 of this Article:

1. Superar a course, in an authorized training center for the imparting of the title of Superior Technician in the Organization of the Maintenance of the Machinery of Ships and Embarks, consisting of the duration and the materials that, The Ministry of Agriculture, Food and the Environment, as a minimum, establishes the Ministry of Agriculture, Food and the Environment.

2. No haber has completed a boarding period of not less than 24 months as an officer of machines, of which at least 12 months must have fulfilled them by performing duties of first official, on ships of propellant power between 500 and 3,000 kW.

(h) In the event that the entitled wishes to perform functions as head of machinery or officer of machines on fishing vessels greater than 50 metres in length, he must be in possession of the Advanced Certificate in the fight against fires established in Article 6 of Order FOM/2296/2002 of 4 September 2002.

Article 11. Naval mechanic.

1. Requirements.

a) Haber turned 18 years old.

(b) Dispose of an official form, issued by a Driver Recognition Centre (CRC), certifying physical fitness in accordance with the requirements for the issue of the ordinary permit to driving.

The above form shall not be required if the person concerned has the medical certificate referred to in Article 13 of this royal decree.

(c) Hälse in possession of the academic title of Technician in Maintenance and Control of the Machinery of Ships and Embarations, established in Royal Decree 1072/2012 of 13 July, establishing the title of Technician in Maintenance and Control of the Machinery of Ships and Vessels and their minimum teachings are fixed; for the purpose of which it is necessary to have passed examinations which include the materials specified in the Appendix to Regulation II/5 of the Annex to the Convention STCW-F.

d) Haber participated in a fire fighting course. For these purposes, and for fishing vessels of less than or equal to 50 metres, it shall be considered sufficient to exceed the practical theoretical module for fire fighting necessary to obtain the basic training certificate laid down in the Point 4 of Annex I to Order FOM/2296/2002 of 4 September 2002.

(e) To have provided service in the machinery chamber of a civil vessel, for a period of not less than 12 months, of which at least six months have performed machine-guard activities. This period may be reduced to at least 6 months when the Ministry of Agriculture, Food and the Environment establishes, in the development of this royal decree, a special training which is considered equivalent to the period to be replaced.

2. Attributions.

(a) Exercise as first officer of machines on fishing vessels of propulsion power not exceeding 3,000 kW.

(b) Exercise as an officer of machines of a category lower than that specified in the previous paragraph on any fishing vessel.

c) Exercise as head of machines on fishing vessels of a propellant power of less than 750 kW.

(d) to exercise as the first officer of machines on fishing vessels of propulsion power not exceeding 6,000 kW, when in addition to having exceeded the requirements and conditions of boarding referred to in paragraph 1 of this Article, (a) proof that the course is exceeded, the content of which is set out in Annex II to the Resolution of 31 May 2010, of the Directorate-General of the Merchant Navy. This course must have been taught in an approved training center for the teaching of the academic title of Superior Technician in the Organization of the Maintenance of Machinery of Ships and Embarks.

(e) to exercise as the first officer of machines on fishing vessels without a power limit, provided that a course is exceeded, in an approved training centre for the delivery of the title of Technician in Maintenance and Control of the Machinery for ships and ships, whose knowledge and minimum materials will be fixed by the Ministry of Agriculture, Food and the Environment.

f) Exercise the head of machines on fishing vessels of propulsion power equal to or less than 1400 kW. To this end, in addition to complying with the requirements set out in point 1 of this Article, you must credit a shipping period of at least 24 months, of which twelve must have been made as the first officer of machines.

g) In the event that the holder wishes to perform duties, as head of machinery or machinery officer on fishing vessels greater than 50 metres in length, he must be in possession of the advanced certificate in the fight against fires set out in Article 6 of Order FOM/2296/2002 of 4 September 2002.

Article 12. Fisherman sailor.

1. In general, possession of the fishing sailor's title is mandatory to be able to exercise as a sailor, both on the machine and on the deck, of a fishing vessel.

2. The requirements for obtaining the said title are as follows.

a) Haber turned sixteen years old.

b) to be held in possession of a certificate, issued by an approved teaching centre or by the fishing authority, which proves that the fishing sailor's course has been satisfactorily completed or an aptitude test for the practical theoretical knowledge, the minimum content of which is set out in Annex III to this standard.

3. Attributions.

(a) To handle vessels less than 10 metres in length, engaged in fishing or aquaculture aid, for commercial purposes only operating within the inland waters of the ports and having an adequate power to the vessel, and provided that it does not carry passengers.

To exercise the command, you must have taken a boarding period of not less than 6 months as a sailor, on fishing vessels or aquaculture auxiliaries, from the date of issue of the professional title of fisherman. In addition, the medical certificate referred to in Article 13 shall be available.

b) Exercise as a sailor on fishing vessels.

CHAPTER III

Maritime Shipping Medical Recognition

Article 13. Medical maritime boarding recognition.

All crew members of Spanish fishing vessels, for boarding, must be in possession of the medical certificate of fitness in force, issued by the Social Institute of the Navy, as established in the Royal Decree 1696/2007 of 14 December 2007 on the medical examinations of sea boarding, which declares them fit or fit with restrictions.

For the purposes of issue, renewal and revalidation of professional qualifications, where the medical certificate of sea boarding includes the words "except for bridge and function of vigia" or "suitable except machines", it shall be refused the issue of professional bridge or machine titles respectively.

CHAPTER IV

From Training

Article 14. Quality of training.

1. Institutions or institutions which provide the training required in order to obtain a professional maritime fishing title must be in possession of the relevant authorization or approval granted by the Ministry of Education, Culture and sport and/or the competent body in the field of fisheries training of the autonomous communities, as appropriate.

In the case of the autonomous communities that do not have transferred the nautical fishing training, it will be the Ministry of Agriculture and Environment that grants the relevant approval to the center or entity impartido, except that this competence corresponds to the Ministry of Culture and Sport as a regulated professional training.

2. The Autonomous Communities shall communicate to the Ministry of Agriculture, Food and the Environment a list of approved centres for the provision of nautical fishing training.

3. The Ministry of Agriculture and Food will carry out the high inspection of the quality of the nautical fishing training in relation to the requirements laid down in the STCW-F 1995 Convention and, in the case of ensure that the training and training programmes are appropriate, the General Secretariat for Fisheries shall carry out, at least every five years, an inspection of the centres referred to in the previous paragraph to verify that they are effective necessary to ensure the required levels of competition. This inspection may be carried out jointly with officials from the Ministry of Education, Culture and Sport and/or the General Directorate of the Merchant Navy.

4. The inspection to check whether the training is in line with the levels of competence required by the STCW-F Convention shall cover the various aspects of the certification system, the training courses and programmes, their examinations and evaluations, as well as the qualification and experience of trainers and evaluators.

5. The General Secretariat for Fisheries may order the inspections provided for in points 3 and 4 of this Article to independent auditors.

Article 15. Training on board.

1. Where one of the loading periods necessary for obtaining the professional title is being carried out as a pupil, the person concerned shall not be part of the minimum safety crew of the vessel.

The contract to exercise as a student may be concluded between the shipowning company and the Administration, and take the form of the "Training Convention at Work Centres between the Administration and the Company".

For boarding as students, as long as the current regulations require, the persons concerned must be in possession of the basic training certificate.

2. In the event that the embarkation period referred to in the previous paragraph is carried out as a seaman, the persons concerned shall be part of the crew of the vessel for all purposes.

For shipping as a sailor, as long as the current regulations require, it will be necessary to be in possession of the basic training certificate.

3. The periods of embarkation, carried out in the course of the nautical teaching of machines and/or bridge, shall be made available for the relevant professional title.

4. Persons who have passed the academic training necessary to obtain the securities regulated in this royal decree will have the right to obtain the title of fisherman. In the case of professional qualifications for which an academic degree is required to be obtained from the Ministry of Education, Culture and Sport, the first course of such academic training is sufficient to have the right to obtain the title of fisherman seaman.

5. Students who have passed the training courses required as a condition for obtaining the securities regulated in this royal decree, and who are in possession of the corresponding academic title or, where appropriate, a certificate of examination with Qualification of suitable, may be wound in quality of sailor for the performance of the required boarding period, even if they are not in possession of the fishing sailor card.

6. The vessels shall carry on board the texts which pick up the most recent changes, introduced in international regulations, on the safety of human life at sea and the protection of the marine environment.

Article 16. Accreditation of the embarkation periods.

1. In order for the boarding periods necessary for obtaining the titles to be computed, the applicant must present the following documentation:

(a) A declaration in the model provided for in Annex IV, comprising the vessels in which it has provided service.

(b) A certificate, in the model set out in Annex V, for each of the vessels on which it has served, signed by the master or by the representative of the shipping company. In the case of foreign vessels, this certification may be issued in English.

(c) Comppressed photocopy of the sea book including seagoing and landing seats. In the event that the shipment has been carried out on foreign vessels, it shall be accompanied by certified copies of the work contracts and the official rolling documentation on each vessel.

Article 17. Simulators.

1. Taking into account the recommendations set out in Resolutions 2 and 3 of the International Conference on Standards of Training, Certification and Watchkeeping for the Staff of Fishing Vessels, 1995, the training centres which issue the Academic qualifications to obtain the titles of fishing captain, height pattern and coastal pattern shall be provided by the training of the navigation guards with the help of simulators.

2. The simulators referred to in the preceding paragraph, if they have been installed after the year 2002, shall comply with the provisions of Section A/12 of the STCW Code.

3. In the case of a multi-purpose coastal pattern and a local fishing pattern, if the centre does not have simulators, they may be replaced by wiggle roses accompanied, if possible, by a traineeship.

CHAPTER V

Issue, revalidation, renewal and registration of professional qualifications

Article 18. Professional titles.

1. The titles shall be issued in general in the model set out in Annex VI, except as provided for in point 5 of this Article.

2. The titles shall be issued at least in English and in English.

Autonomous communities with another official language, in addition to Spanish, will be able to issue professional titles in their language, provided that the document is also written in Spanish and English.

3. Two models of endorsement are set:

(a) The model in Annex VII to this royal decree, which endorses the Spanish professional titles within the scope of the STCW-F Convention, 1995.

(b) The model in Annex VIII to this royal decree, which endorses the recognition of a title, issued by another Party, pursuant to the provisions of the STCW-F, 1995.

4. The characteristics of the titles and the endorsements shall be as set out in Annex IX to this Royal Decree.

5. The title of the local fishing pattern, as well as the fishing sailor's title and the renewals of the second-class coastal fishing pattern titles, local fishing pattern and littoral mechanic may continue to be expiated in the formats established in the Royal decrees 662/1997 and 1519/2007.

Article 19. Revalidation and renewal of titles.

1. The titles and endorsements to be exercised as master or officer on fishing vessels for sea navigation shall be revalidated every five years. For the revalidation and extension of a title to be carried out, it shall be necessary to have an official form, issued by a CRC, certifying physical fitness in accordance with the conditions required for the issue of the permit. Ordinary driving.

The above certificate shall not be required if the certificate has the medical certificate provided for in Article 13 of this royal decree. In addition, the data subject must meet one of the following requirements:

(a) Have made a shipping period, as a pattern or official, of at least one year in the last five, or three months in the last year.

b) Overcome a test or course whose content will be determined by the Ministry of Agriculture, Food and Environment in collaboration with the Autonomous Communities.

2. The test or course of review and updating prescribed in paragraph (b) above shall take into account the texts of the recent changes introduced in the international regulation on the safety of human life at sea and the protection of the marine environment.

3. The titles shall be renewed at the age of 50 years of the person concerned and thereafter every five years. For renewal, it is necessary to comply with the requirements set out in point 1 of this Article.

Article 20. On the issue, renewal and revalidation of titles.

1. The issue, renewal and revalidation of the securities shall be the responsibility of the autonomous communities responsible for the matter. In the case of residents in autonomous communities who do not have the competence to issue, renew or revalidate certificates, they shall be issued, renewed and revalidated by the autonomous community in which the training was carried out or originally issued the title. In the case of Ceuta and Melilla, cities with no privileges in respect of fishing nautical degrees, and until the time when the corresponding powers are transferred to it, the professional nautical titles shall be issued, renewed and, where appropriate, revalidated by the General Secretariat for Fisheries.

2. In order to be awarded a certificate, the applicant shall comply with the requirements laid down in the article of this standard to regulate the required qualification.

3. Certificates issued by the Kingdom of Spain to third-country nationals who do not reside in Spanish territory shall be renewed or revalidated by the Ministry of Agriculture, Food and the Environment.

Article 21. Waivers.

1. In very exceptional circumstances and in accordance with the provisions in force, the maritime authority may provide a waiver for a person who is not entitled to be able to perform a position on board a fishing vessel. The maritime authority may provide such a waiver only if it does not present a danger to persons, property or the environment, which shall be expressly stated in the administrative act which grants it, with due regard to each case concrete.

2. The waiver shall in no case affect the radio operators who must be in possession of the relevant global system operator certificate and maritime safety.

3. The waiver granted for a post shall only be granted to the person who is duly qualified to fill the post immediately below, and the maximum validity shall be six months without the extension of the post. However, new waivers may be granted.

4. Waivers granted by the maritime authority for one year shall be notified to the General Secretariat for Fisheries by 31 January of the following year.

Article 22. Register of professionals in the fisheries sector.

1. In accordance with the provisions of Article 44 of Law 3/2001, of State Maritime Fisheries, all persons who are or have been in possession of a nautical-fishing title or card shall be registered in the Register of Professional Fisheries Sector of the Ministry of Agriculture, Food and the Environment, without prejudice to their registration in other legally provided registers for the exercise of their profession.

The Registry shall contain all titles and/or rebrains issued, expired, revalidated, lost, suspended or cancelled, as well as any waivers granted.

At the request of another Party the Ministry of Agriculture, Food and Environment shall provide information on the nature of such titles, endorsements and waivers.

2. The conduct of such registration shall be decentralised, corresponding to the competent autonomous communities in their respective territories.

3. The autonomous communities shall transfer to the General Secretariat of Fisheries, for inclusion in the Register of Professional Fisheries Professionals, all data relating to the registration and casualty of professionals in the fishing sector. The data shall be transmitted within the maximum period of two months from the date of issue of the securities and shall contain at least the data set out in Annex X to this standard.

Article 23. Holders of a certificate of approval of foreign securities.

The holders of a certificate of approval of foreign securities may apply for the issue of the corresponding professional fishing title with the competent autonomous community. To do so, they will present such a credential instead of the corresponding academic title.

Article 24. Technical cooperation.

The Ministry of Agriculture, Food and Environment, in consultation with the International Maritime Organization, will seek to assist other Parties requesting technical assistance with respect to:

a) Training of administrative or technical personnel.

b) The establishment of institutions for the training of the staff of fishing vessels.

c) The provision of equipment and services for training institutions.

(d) The development of appropriate training programmes, including practical training in maritime seagoing vessels.

e) The facilitation of other measures and provisions aimed at improving the competence of the staff of fishing vessels.

CHAPTER VI

Recognition of foreign professional titles

Article 25. General rules for the recognition of certificates issued by other states.

1. Professional qualifications awarded by third countries may be recognised provided that they are a Party to the STCW-F Convention and the conditions laid down in this royal decree are fulfilled. They shall not be accepted for recognition, rebraking of certificates issued by a State other than the State to which the respective title has issued.

2. Foreign nationals shall specify the recognition of a diploma in order to gain access to the jobs of the Spanish fishing vessels. This obligation is exempted from cases where a fishing agreement requires a certain number of nationals of the country with whom the agreement has been signed, in this case the required qualification for boarding will be required in the legislation of this third country. This derogation shall be maintained only as long as the vessel operates within the Exclusive Economic Zone of the country with which the fishing agreement has been concluded, and on the transits from the fishing grounds to the first port of arrival and from the port to the fishing grounds.

3. The professional title whose recognition is requested shall include, in accordance with Rule I/7 of the STCW-F Convention, the endorsement of the State that issued it.

4. The recognition of diplomas, to which the STCW-F Convention is applicable, issued by other States Parties, shall be made at the request of the interested party or the shipping company, and shall be granted by issuing the corresponding endorsement.

5. The recognition of qualifications that they enable to exercise as captain or first officer of bridge, will require the overcoming of a test on knowledge of the Spanish maritime and fishing legislation. In the case of Heads or first officers of machinery, it may also be necessary to exceed a test. The content of the test will be determined by the Ministry of Agriculture, Food and Environment.

6. If the professional title to be endorsed is subject to any kind of limitation, the endorsement shall in no case exceed the limits established in the original.

7. If the circumstances so require, the maritime administration may authorise the person concerned to exercise, on Spanish fishing vessels, the functions inherent in the title to be endorsed for a maximum period of three months. To this end, the General Secretariat for Fisheries shall issue a documentary evidence that the application for a endorsement has been submitted in accordance with Regulation I/7 of the STCW-F. Convention

In order to be able to issue the authorization provided for in this paragraph, the fishing undertaking must prove that it has subscribed to insurance, by means of a specific policy or of the protection and compensation of the vessel, or an endorsement by a credit institution or has made provision covering, within the period referred to above, civil liability arising out of the exercise of the duties and permanence on board the holder of the professional title subject to recognition.

Article 26. Recognition of certificates issued by Member States of the European Economic Area.

1. Autonomous communities shall process professional fishing titles issued by a Member State of the European Economic Area, in accordance with Community and national implementing provisions.

2. The recognition shall be formalised by the issue of the relevant professional fishing title or appropriate endorsement. The possession of one of the above documents shall be necessary for access to a job as a crew member of a Spanish fishing vessel.

3. Citizens of the European Economic Area, as well as their family members who do not have Spanish nationality, who hold a professional title with sufficient privileges issued by a Member State may exercise the command of fishing vessels. Once the Spanish fishing legislation has passed the test of knowledge of the Spanish fishing legislation. The cases in which, in accordance with Article 253.2 of the recast text of the Law on Ports of the State and the Merchant Navy, approved by the Royal Legislative Decree 2/2011 of 5 September, shall be exempted from this recognition. the Spanish Maritime Administration considers that these jobs can only be carried out by Spanish citizens, by involving the effective and customary exercise of public power prerogatives that do not represent a very small part of their activities.

4. In accordance with the provisions of Royal Decree 1837/2008 of 8 November incorporating Directive 2005 /36/EC of the European Parliament and of the Council of 7 September 2005 and Directive 2006 /100/EC of the European Parliament and of the Council of the European Parliament and of the Council on Council of 20 November 2006 on the recognition of professional qualifications and certain aspects of the exercise of the profession of lawyer; the content of proof of knowledge of maritime and fisheries legislation Spain shall be determined by the General Secretariat of Fisheries of the Ministry of Agriculture, Food and Environment.

5. Seamen of the European Economic Area, who have a valid and sufficient document issued by a Member State, which entitles them to exercise as seamen on a fishing vessel and apply for the issue of the title of fisherman, shall be entitled to the same and shall be issued by the Autonomous Communities in accordance with the procedure laid down in this respect.

Article 27. Rules for the recognition of certificates issued by non-member states of the European Economic Area.

1. The Ministry of Agriculture, Food and the Environment, through the General Secretariat of Fisheries, may recognize certificates issued by third countries provided that they are a Party, have a recognition in force carried out by the Commission European and appear in a list of third countries published in the Official Journal of the European Union.

2. In order to be able to recognise a fishing title, in addition to the provisions of the previous point, it will be necessary for the Ministry of Agriculture, Food and the Environment and the competent authority of the third country to have signed a Agreement on the recognition of fishing titles. This agreement can only be signed after the Ministry has been assured that the third country fully complies with the requirements relating to the competition rules and to the issue and endorsement of fishing titles.

3. Where the third country has concluded an agreement for recognition with the Ministry of Development in the field of securities of the merchant navy, the Ministry of Agriculture, Food and the Environment may also consider it valid for fishing purposes, if there is no differentiation between the merchant and the fishing qualifications in that country.

4. After recognition of the title of the third country, the autonomous communities shall be competent to issue the corresponding endorsement in accordance with the model set out in Annex VIII.

CHAPTER VII

Inspection, violations, and sanctions

Article 28. Generalities.

The infringements and penalties that take place in relation to the activities referred to in this royal decree shall be governed, at all times, by the provisions of Chapter III of Title V of Law 3/2001 of 26 March 2001. Sea fishing of the State, or of the standard that replaces it, and as laid down in Title IX of Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure.

The applicable sanctioning procedure will be the one set out in Royal Decree 747/2008 of 9 May, establishing the regulation of the system of penalties for sea fishing in external waters, as well as the in the regulation on sanctioning procedure, developed in Royal Decree 1398/1993 of 4 August, approving the Rules of Procedure for the exercise of sanctioning powers; and, where appropriate, the legislation established by the Autonomous Communities.

Article 29. Inspection of fishing vessels flying the flag of a Party.

1. Fishing vessels flying the flag of a Party which are located in Spanish ports shall be subject to the inspection of duly authorised officials of the Fisheries Administration. Such inspection shall be as follows:

(a) Verify that the staff employed for whom STCW-F 1995 requires a degree (master, bridge officer, chief engineer officer, machine officer and radio communications staff) is in possession of a diploma suitable or a valid waiver.

The titles or waivers will be accepted, unless there are reasonable grounds to suspect that the title has been obtained fraudulently or, that the holder is not the person to whom the document was originally issued.

(b) Determine whether the personnel of the fishing vessels meet the necessary fitness to observe the rules relating to the guards prescribed in the 1995 STCW-F Convention, where there are reasonable grounds for suspecting that they are not observed such rules because:

I. The vessel has been involved in an approach or has been stranded.

II. A discharge of illicit substances has occurred in accordance with international conventions.

III. The ship has manoeuvred in an irregular or dangerous manner, having not followed the traffic regulation measures adopted by the International Maritime Organisation or the safe navigation practices and procedures.

IV. The operation of the vessel constitutes a danger to persons, property or the environment.

2. Where, as a result of the provisions of paragraph 1 of this Article, anomalies are observed, the official carrying out the inspection shall immediately inform in writing the master of the vessel and the Administration, in order to take appropriate measures. The notification shall specify the details of the deficiencies found and the reasons why the Inspection determines that these deficiencies constitute a danger to persons, property or the environment.

3. Among the deficiencies which may be considered to be a danger to persons, property or the environment, are the following:

I. The persons to be entitled are without the relevant titles or waivers.

II. The manner in which the navigation or machinery guard has been organised does not comply with the requirements of the Administration for the vessel concerned.

III. The absence at the guard of a competent person who can handle essential equipment for the safety of navigation, safety communications or pollution prevention.

IV. The lack of staff rested for the first guard at the beginning of the trip and for the following guards.

4. When performing the inspection:

(a) The vessel shall be prevented from being detained or unduly delayed. If so, you will be entitled to claim compensation for the loss or damage suffered.

(b) The rules shall apply with the same discretion to the staff of foreign vessels and to the staff of national vessels.

5. Pursuant to Article 8 (4) of the STCW-F Convention, the application of this Article shall be subject to the fact that, in no case, ships flying the flag of a Party are treated more favourably than ships. of states that are not a Party.

Article 30. Prevention of fraud and malpractice.

The Autonomous Communities or, in the field of their competences, the Ministry of Agriculture, Food and the Environment, will carry out the necessary procedures for the impartial investigation of the notified cases of incompetence, actions or omissions which may constitute a direct threat to the security of human life, or property at sea, or to the marine environment, of personnel with fishing certificates issued by Spain in the exercise of the functions which the said titles confer on them, in order to withdraw, suspend or cancel for such reason titles and prevent fraud.

Article 31. Infringements and penalties.

1. Infringements and penalties in respect of fishing nautical titles shall be as defined in the Maritime Fisheries Act, without prejudice to the provisions of the Criminal Code.

2. In the case of knowledge of criminal offences, the General Secretariat of Fisheries shall inform the Prosecutor's Office.

3. When a Party communicates its intention to initiate proceedings against a natural or legal person of Spanish nationality, for alleged infringement of the nautical titles of the fisheries, the Ministry of Agriculture, Food and the Environment will collaborate as much as possible with that party.

Additional disposition first. Radio operators.

Any captain or officer who is responsible for sailing on a fishing vessel with the World Maritime Safety and Security System shall be in possession of the appropriate radio operator's certificate of those prescribed in Articles 9 and 10 of Order FOM/2296/2004 of 4 September 2004 on the programmes for the training of professional titles of the Marinero de Puente and the Machines of the Merchant Navy, and of Patron Portuario, as well as certificates of professional competence in the field of professional competence.

Additional provision second. Graduates of merchant marine machines.

Graduates of merchant marine machines may exercise the privileges granted to them by their certification on board fishing vessels. Characteristics of the format of fishing nautical titles

1. Security and print of the professional title.

ANNEX XI

Fundamental principles to be observed in navigation guards on board fishing vessels

1.1 Organization of the navigation guard.

1.2 Aptitude for the service.

1.2.1 The system of guards will be such that the efficiency of the personnel assigned to them will not be diminished by the fatigue. 1.3 Navigation.

1.7 Protection of the marine environment.

1.8 Weather Conditions.
