The establishment of the European Higher Education Area (EEES) has led to the complete renovation of university studies in Spain, which are now structured in the three differentiated levels of Grade, Master and Doctorate. In this restructuring our country opted, unlike most of the European States, for a model of Grades of 240 ECTS credits, which will be able to be followed by Master's studies of between 60 and 120 ECTS credits of duration. However, some university degrees, due to the requirements of the applicable European guidelines, have a higher extension. This is the case for studies of medicine and other qualifications, usually in the field of health sciences, which give access to regulated professions. The requirement that these qualifications enable for a profession sometimes involves the acquisition of Master's level skills, and allows access to doctoral studies, either directly or through the improvement of certain supplements. training.

The purpose of the present reform is to implement a system for the specificity of these university studies in the case of qualified qualifications for the understanding of sufficient Master's level credits. This measure will facilitate the movement abroad of graduates of Spanish universities in this type of degree of special qualification.

The ideal instrument for giving a way to this membership is the Spanish Framework for Qualifications for Higher Education (MECES), which is regulated in Royal Decree 1027/2011 of 15 July, which establishes the Spanish Framework for Qualifications for Higher Education (MECES), the purpose of which is to enable the classification, comparability and transparency of higher education qualifications in the Spanish education system, in particular to make it comprehensible to other educational systems. The four levels in which the MECES is structured give way to the teachings that constitute higher education in our country, which are assigned to each of these levels according to their learning requirements. In other words, it is the learning outcomes that characterise the qualifications obtained which determine their link to one of the levels of the qualifications framework.

The four levels are currently defined in such a way that the level of the Superior Technician is constituted at Level 1, the Grade Level 2, the Master level at Level 3 and the Doctor at Level 4. However, it is clear that there are degrees of degree which exceed the threshold of the 240 minimum ECTS credits required in Spain in general for these studies and that, in the case of containing at least 60 ECTS of Master's level, they could aspire to the Level 3 rating. They are titles whose definition of their curricula and competencies imply the achievement of learning outcomes that characterize the qualifications of this Level 3. In addition, they share with the titles linked to this level the effects of direct access to the titles or qualifications of the higher Level 4, as provided for today by art. 6.2.b) of Royal Decree 99/2011 of 28 January, which regulates the official teaching of doctorate.

It is not a question of giving a double degree of degree and a Master's degree to those who pass a more extensive degree-a question that does not allow our legal order-but to recognize that certain degrees They provide a specific level of professional qualification, different from the one they nominally evoke.

The adoption of this measure involves, first, the amendment of the Annex to Royal Decree 1027/2011 of 15 July, in the sense of including, in the table of qualifications, the entry to Level 3 (Master) of the Degree of at least 300 ECTS credits comprising at least 60 ECTS credits at the Master's level and having obtained this level of qualification by means of a decision of the Council of Universities, together with the degrees of Master's and Master's degree in artistic teachings.

From this modification is derived the need to reform, second, Royal Decree 1393/2007, of October 29,, by which the ordination of official university teachings is established, to incorporate into the the possibility that a degree certificate may be awarded to this level of qualification 3. As an essential complement, an additional provision is introduced which contains the procedure to be followed in order to achieve the aforementioned qualification, in which compliance with the above requirements must be ensured.

Finally, the amendment to the Annex to the aforementioned Royal Decree 1027/2011, dated July 15, is used to comply with the case-law established by the Supreme Court's Court of Justice 3. numerous judgments annulling articles 7.1, 8, 11, 12, and the seventh additional provision of Royal Decree 1614/2009 of 26 October establishing the ordination of higher artistic teachings governed by the Organic Law 2/2006, of 3 May, of Education. Consequently, the reference in the Annex to the "Graduate degree of higher artistic teachings" is replaced by the "Higher Title of Higher Art Teachings".

In the process of drawing up this royal decree, the Autonomous Communities have been consulted within the General Conference of University Policy and have been issued by the Council of Universities, the Superior Council of Artistic teachings, the General Council of Vocational Training and the School Board of the State.

Also, the professional corporations affected by the content of the provision have been granted a hearing.

In its virtue, on the proposal of the Minister of Education, Culture and Sport, with the prior approval of the Minister of Finance and Public Administrations, in agreement with the Council of State and after deliberation of the Council of Ministers at their meeting on 14 February 2014,

DISPONGO:

Article first. Amendment of Royal Decree 1027/2011 of 15 July, establishing a Spanish Framework for Qualifications for Higher Education (MECES).

Royal Decree 1027/2011 of 15 July establishing the Spanish Framework for Qualifications for Higher Education (MECES) is amended as follows:

One. A paragraph 4 is added to Article 7, with the following content:

" 4. The degree of qualifications required by European Union law requirements to be at least 300 ECTS credits, provided that they comprise a minimum of 60 ECTS credits participating in the characteristics of the descriptors referred to in paragraph 2 of this Article. precept, they will be able to obtain the subscription to the Level 3 (Master) regulated in this royal decree. The rules on the ordination of official university teaching will establish the procedure to be followed to obtain this membership. "

Article 2. Amendment of Royal Decree 1393/2007 of 29 October establishing the ordination of official university teaching.

Royal Decree 1393/2007 of 29 October is amended as follows:

One. A paragraph 10 is added to Article 12 with the following content:

" 10. The degree to which the European Union rules require at least 300 ECTS credits, of which a minimum of 60 are involved in the characteristics of the descriptors corresponding to the Master's level, may obtain the Membership of the MECES level 3 (Master). To this end they must submit to the procedure provided for in the additional fourteenth provision of this royal decree. "

Two. The additional fourteenth provision is renumbered as thirteenth and a new additional fourteenth provision is added with the following wording:

" Additional disposition fourteenth. Membership of the MECES Level 3 (Master) of certain degree titles.

Grade titles of at least 300 ECTS credits comprising a minimum of 60 Master level ECTS credits may be awarded to MECES Level 3 (Master) by resolution of the Council of Universities.

The universities that seek the aforementioned title of their titles must submit the corresponding application to the Council of Universities through the Secretariat of that Authority for their processing.

The Board of Universities will adopt within 6 months the appropriate resolution after the verification of compliance with the conditions required to achieve the said membership, prior to the favorable report of the ANECA or Autonomous agencies with competence for the verification of official titles. In the event of a lack of resolution and in-time notification the application shall be deemed to be rejected.

From the resolutions of the Council of Universities will be transferred to the Register of Universities, Centers and Titles (RUCT) referred to by Royal Decree 1509/2008, of 15 September, for the purpose of its constancy in the same.

Once the membership of the MECES Level 3 (Master) is obtained, it will have effects for all graduates of the qualification with the curriculum evaluated, regardless of the date of completion of their studies, except that In order to obtain them, modifications have to be made to the curriculum, in which case it shall only apply to graduates after such an acquisition.

When the modifications made to a degree of degree attached to Level 3 of the MECES involve the loss of any of the conditions necessary for the membership at this level, the ANECA or the agency competent for its (a) processing shall include this in its assessment report in order to enable the Council of Universities to decide on the revocation of such recognition and, where appropriate, the relevant transfer to the RUCT.

Against the decisions of the Council of Universities in this field, the complaint provided for in Article 25 (9) may be brought. "

This royal decree will enter into force on the day following its publication in the "Official State Gazette".
