The Public Employment Offer for 1998 maintains the selective character of new staff additions and the effort to contain public expenditure and extends its scope to all public sector personnel.

The framework defining the additions of new staff in 1998, as a general rule for all staff in the service of the public sector, is defined in Article 19 of Law 65/1997 of 30 December 1997 on Budgets. State Generals for 1998, providing that the calls for entry for new staff will be concentrated in the sectors, functions and professional categories which are considered to be absolutely priority or which affect the functioning of the system. of the essential public services, and that the number of places of new income must be lower than 25 per 100 of the effective replacement rate.

This last criterion will not apply to the staff at the service of the Administration of Justice, where the number of places will be determined according to the provisions of Law 38/1988, of 28 December, of Demarcation and Plant Judicial, not to the State Security Forces and Corps. Nor will it be applicable to public administrations with educational skills for the development of Law Organic Law 1/1990 of 3 October of General Management of the Educational System, in relation to the identification of the number of places for access to the Corps of teaching officers. Likewise, Law 65/1997, of December 30, of General State Budgets for 1998, also excludes from this limit the Armed Forces, whose public offer of employment was approved by Royal Decree 298/1998 of 27 February.

It is also possible to call for those positions or places which, being budgeted and included in their relations of jobs, catalogues or templates, are either temporarily or temporarily performed. in order to enable the process of temporary employment consolidation or temporary employment replacement, without increasing the number of staff.

The Government, with the limits that have been mentioned, will be able to authorize, through the Public Employment Offer, a favorable report from the Ministry of Economy and Finance, on a proposal from the Ministry of Public Administration and the initiative of the departments or public bodies competent in this field, the call for vacant posts which refer to the staff of the Civil Administration of the State and its autonomous bodies, civilian personnel of the military administration and their Autonomous Bodies, staff of the Social Security Administration, staff Social Security Staff Regulations, Staff of the Administration of Justice, Armed Forces and State Security Forces and Bodies, and staff of the Public Entes, State Administration of Tax Administration, Board of Directors of the National Heritage, Nuclear Safety Board, Data Protection Agency, Post and Telegraph Business Entity, as well as the posts or places referred to in the preceding paragraph.

Article 19 of Law 65/1997, of December 30, of the General Budget of the State for 1998, also states that the Ministries of Public and Economic Administrations and Finance will be able to authorize jointly, within the limitation criteria laid down in general terms, the corresponding calls for vacancies of the public undertakings and public entities not mentioned above, whether or not they are to be adapted, the unique conditions which, in accordance with the specific nature of such entities, are set out in this Royal Decree. As a result, the places whose need is essential for each public enterprise or public entity are included in the Annex to this Royal Decree, in addition to a set of places to be authorised later on the need arises, given the particular structure of public employment in this field.

At the same time, the criterion of not proceeding to the hiring of new temporary staff and appointment of interim officials is maintained, except in exceptional cases and to cover urgent and non-deferred needs. Furthermore, the fourth paragraph of Article 19 of Law 65/1997 of 30 December 1997 on the General Budget of the State for 1998 expressly incorporates the requirement for joint prior authorization by the Ministries of Public Administration and Economy and Finance for the recruitment of permanent or temporary staff abroad, either in accordance with local legislation or Spanish legislation.

In this context, it is up to the Government to authorize the public call for those places that cannot be covered with existing personnel, which are considered to be absolutely priority or essential for the the provision of public services, the coverage of which is urgent and non-deferred. All this in the overall context of budgetary restraint and the reduction in the volume of staff at the service of the public administration.

Consequently, this Royal Decree approves certain Government forecasts regarding the orientation of public employment policies in 1998 and an offer of limited places to sectors or areas of administrative concrete.

In its virtue, on the proposal of the Minister of Public Administrations, with the favorable report of the Ministry of Economy and Finance and after deliberation of the Council of Ministers at its meeting of March 27, 1998,

D I S P O N G O:

Article 1. Approval of the Public Employment Offer.

In compliance with the provisions of Article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, and in Article 19 of Law 65/1997 of 30 December 1997, of the General Budget of the State for 1998 is approved the Public Employment Offer for 1998, in the terms established in this Royal Decree.

Selective calls for evidence arising from the present Public Employment Offer will have to be favourably informed by the Directorate-General of the Civil Service as a prerequisite for publication, which must be be held before the 15th of December 1998.

Article 2. Quantification of the Public Employment Offer.

The Public Employment Offer includes human resource needs with budgetary allocation that cannot be met with existing personnel, according to the criteria and according to the composition that is details in the unique annex to this Royal Decree.

Article 3. Human resource planning.

The planning of human resources in the General Administration of the State will guide the proper sizing, distribution and training of the personnel for the improvement in the provision of services. As a result, the relocation operations will have to be prioritized by the procedures provided for in the General Regulation of Income, Provision of Jobs and Professional Promotion, approved by Royal Decree 364/1995, of 10 of March.

Article 4. Provision of posts and mobility.

1. The Secretariat of State for Public Administration may authorise the call for tenders for the provision of posts to cover on a voluntary basis vacant positions in units, departments and deficit bodies. staff with officials in the areas, sectors or departments in surplus to determine the basis for the call.

2. The rereceipts to the active service for the provisional assignment of staff in a situation which does not entail a reserve of work shall be generally produced in the centres, agencies and territories identified as being in deficit with staff. In any event, the revenue from provisional duty shall be in accordance with the guidelines to be determined by the Ministry of Public Administration.

Article 5. Internal promotion.

In 1998, 110 internal promotion places from Group B to A, 350 places from Group C to B, 1,000 places from Group D to C and 40 places from Group E to D will be convened, with the distribution to be determined by the Ministry of Administrations. Public. In addition, up to 100 more places of access for internal promotion may be convened, with the distribution that the Ministry of Public Administration will also determine.

These tests for internal promotion will be carried out, in general, in calls independent of the income.

Additionally, selective processes of access to the CSIC Research Teachers Scale and to the CSIC Scientific Researchers Scale may be convened from the scientific staff scales. Also, 35 places for access to the Body of Education Inspectors may be convened according to the access procedure provided for in Royal Decree 2193/1995 of December 28.

Article 6. Labour staff.

The selective tests for work staff, which are set out in the Annex to this Royal Decree, will have to refer to posts which, in accordance with the provisions of Article 15 of Law No 30/1984 of 2 August, in the Under Law 23/1988 of 28 July and Law 42/1994 of 30 December 1994, they may be carried out by labour staff.

Prior to the authorization by the Ministry of Public Administrations of the call for selective tests for admission to the places of work personnel listed in the annex of this Royal Decree, the Departments or A number of bodies shall be required to provide evidence of budgetary allocation for seats which are vacant.

Article 7. Recruitment of work staff abroad.

The hiring of permanent or temporary staff abroad, in accordance with local legislation or, where appropriate, Spanish legislation, will require the prior joint authorization of the Ministries of Public Administration and Economy and Finance in accordance with the procedure to be determined jointly by the two departments, provided that there is a budgetary allocation for vacant posts.

Article 8. Fixed employment contracts in the public entities and public entities.

During 1998, the hiring of fixed labor personnel will be limited to covering those vacancies that are considered essential for the normal functioning of the public entities and public entities, and only with a Staff may be recruited for new jobs when it comes to the implementation of new areas of activity which are considered to be absolutely priority.

The joint authorization of the Ministries of Public and Economic Administrations and Finance referred to in the second paragraph of Article 19 of the General Budget Law of the State will be carried out in accordance with the next singular procedure consisting of two phases:

1.a Call for places to respond to the annual planning of public procurement and public law entities.

Prior study by the Ministries of Public Administrations and Economy and Finance of the forecast of hiring needs submitted by the various agencies, and taking into account the limitations established In Article 19 of the General State Budget Law for 1998, the maximum number of places that may be convened at this stage, for each public enterprise or public entity, is quantified in the ratio shown as an annex to this Royal Decree.

2.a Call for places that respond to the needs of the exercise.

They shall be exceptional and may be authorised only in the event of vacancies occurring during the course of the year which, while not initially planned, affect posts which, due to their content and impact on the the organisation must be covered with the utmost urgency so as not to undermine the normal activity of the institution, or in the case of newly established bodies, or in which there is a substantial alteration of the powers assigned to it.

The convocation of these places will be authorized in a singular and prior manner by the Ministries of Public Administrations and the Economy and Finance, in accordance with the specific procedure to be developed by the Ministry of Public Administration. Departments, and with the limit of additional places set out in the annex of this Royal Decree.

Also, regardless of what was established in the previous paragraph and in order to enable the appropriate optimization of existing human resources in the public sector, public enterprise entities and public entities may, after joint authorization from the Ministries of Public Administrations and the Economy and Finance, hire official or permanent staff from Departments or Public Bodies falling within the scope of the Employment Offer Public, as defined by Article 19 of Law 65/1997 of 30 December 1997 on Budgets State generals for 1998. The Ministry of Public Administration will determine the procedure by which advertising and free competition will be guaranteed in this type of hiring.

Article 9. Temporary staff.

1. During 1998, no new temporary staff will be recruited or interim officials will be appointed, except in exceptional cases and to cover urgent and non-deferred needs, with joint authorization from the Ministries of Public and Economic and Finance Administrations and within the framework of the criteria established in personnel policy.

Teachers and administration staff may be appointed and staff and services to be employed in public teaching centres, as well as to cover posts of statutory staff of the Health Institutions. Social and personnel at the service of the Administration of Justice, always with the joint authorization of the Ministries of Public Administrations and of Economy and Finance.

Contracts to meet seasonal needs will automatically end when you beat your time limit.

2. The processes of replacement of temporary employment or temporary employment consolidation of a structural and permanent nature may be carried out both within the framework of the corresponding employment plans and through calls for action, requiring In the latter case the authorization of the Ministry of Public Administrations, previous favorable report of the Ministry of Economy and Finance, except in the processes expressly provided in the present Royal Decree. These processes will not, in any case, increase the number of staff.

The selective processes referred to in the preceding paragraph shall in any event respect the principles of equality, merit, capacity and publicity, and their initiative shall be the responsibility of the Departments or Agencies to which they affect the the criteria and priorities set by the Ministry of Public Administration.

3. The employment relationships of those who temporarily perform the places to be fixed in the framework of a consolidation process, will be extended until the selective processes corresponding to the call for tenders are completed. the places they were playing. To this end, the initial employment relationship may be transformed into an interim employment relationship, in accordance with the terms of Royal Decree 2546/1994 of 29 December 1994 or in the rules of public service.

Article 10. Replacement of interim employment.

1. In order to meet the needs of teaching staff, as a result of the requirements for the development of the General Organic Law of the Educational System (LOGSE), the Ministry of Education and Culture is authorized to call for selective tests for entry into the Secondary School Teachers ' Corps up to a maximum of 2,500 places, in the Faculty of Official Schools of Languages up to 35 places, in the Body of Teachers of Music and Performing Arts up to 300 places, in the Body of Teachers of Plastic Arts and Design up to 40 places, in the Body of Masters of Plastic Arts and Design up to eight places and in the Professional Training Teachers ' Corps up to 450 places, currently covered by interim staff.

2. In order to meet the needs of staff at the service of the Administration of Justice, derived from the requirements of the development of the Law of Demarcation and the Judicial Plant, the Ministry of Justice is authorized to call for selective tests for In the Body of Judicial Secretaries up to 125 places, in the Corps of Forensic Physicians up to 100 places, in the Body of Officers and Secretaries of Peace up to 300 places, in the Body of Auxiliary to 500 places and in the Body of Agents up to 380 places, as well as the call for 282 job staff, currently covered by the interim staff.

These places correspond to the Ministry of Justice 125 places in the Body of Judicial Secretaries, 34 places in the Corps of Medical Physicians, 175 places in the Corps of Officers, 291 seats in the Auxiliary Corps, 264 places in the Corps of Agents and 282 places of work staff. They correspond to Autonomous Communities that have received transfers of personal means the following places: 66 of the Body of Medical Physicians, 125 of the Body of Officers, 209 of the Body of Auxiliary and 116 of the Body of Agents.

According to Article 10 of the Order of March 1, 1996 on the selection, proposal and appointment of interim officials to fill vacant positions of the Corps of Forensic, Official, Auxiliary and Agents of Medical the Administration of Justice and those who provide services at the National Institute of Toxicology, the interim staff shall cease when the place they perform is covered by the official.

3. The National Institute of Health is authorised to call for selective testing for statutory staff of the Health Institutions for Social Security up to a maximum of 4,200 places of optional area specialist staff, covered currently with temporary staff.

According to the fourth additional provision of Royal Decree 118/1991 of 25 January on the selection of statutory staff and the provision of places in the Health Institutions of Social Security, temporary staff shall cease when there is a fixed statutory staff appointed to occupy those places.

Article 11. Reserve of seats for the Basic Scale of Cabos and Guards of the Civil Guard.

Of the total of 1,300 places called for the Basic Scale of the Cabos and Guards that are listed in the annex, 650 to the military of employment of the category of Troop and Marineria Professional of the Armed Forces that carry at least three years of effective services as such. The places reserved for those military personnel who are not covered for any reason may accumulate, up to a maximum of 20 per 100 of the total of those places reserved for free places.

For the students of the College of Young Guards 250 places will be reserved. Those who are left uncovered will accumulate to the quota of free places.

Article 12. Internal promotion in the Civil Guard.

The call for the following places for admission to the military training centers of training through internal promotion is authorized:

(a) 34 places on the Executive Scale and 84 on the Sub-Officer Scale for those who, not meeting the conditions set out in Articles 17.2.c) and 24.1 of Royal Decree 1951/1995 of 1 December 1995, approving the General Regulation of Income and Promotion in the Armed Forces and the Civil Guard, the transitional provision of the same will apply to them.

b) 34 places on the Executive Scale and 83 on the Subofficial Scale for those who meet the conditions set out in Articles 17 and 24 of the aforementioned Royal Decree 1951/1995 of 1 December 1995.

The places corresponding to paragraph (a) that remain unfilled shall be cumulated to those corresponding to paragraph (b) for access to the respective Escalas.

Article 13. People with disabilities.

In the selective processes for entry into Bodies and Escalations of officials and categories of labour personnel, including those for internal promotion, persons with disabilities on equal terms will be admitted. conditions with other applicants, reserving in the calls for the percentage of places corresponding to the access of applicants who have the legal status of a person with disabilities, in accordance with the rules applicable in each case.

Additional disposition first. Offer of Employment of Local Corporations.

The local corporations that approve their Public Employment Offerings must submit the agreements approving them to the State Administration in accordance with the provisions of Article 56.1 of Law 7/1985, 2 of April.

Additional provision second. Local Administration staff with national rating.

In order to address the needs of the Local Administration, the Ministry of Public Administration may call for selective testing for access to the Scale of Local Administration Officials with the national character in the following subscales: 40 places for Sub-scale of the Secretariat, upper category; 60 seats for the Interventional-Treasury Subscale, higher category; 100 places for the Interventional-Treasury Subscale, category of entry, and 150 places for the Secretariat-Intervention Subscale.

Additional provision third. Air traffic controller staff.

According to the procedure for the selection of air traffic controller staff of the Public Ente of Spanish Airports and Air Navigation, 94 contracts are authorized in practice and 96 fixed contracts for personnel.

Additional provision fourth. Participation in selective testing courts.

They will not be able to form part of selection commissions or selective testing courts for entry into the Corps or Escalations of officials or categories of labor personnel, who will have the high office of consideration in accordance with the law. The provisions of Law 12/1995, of 11 May, on Incompatibilities of the Members of the Government of the Nation and of the High Charges of the General Administration of the State.

Single end disposition. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
