Point 1 of the first provision of Royal Decree 1942/1993 of 5 November, approving the Regulation of Fire Protection Facilities (RIPCI), empowers the Minister for Industry and Energy to deliver the provisions necessary for the development and fulfilment of the Royal Decree cited.

The double regulatory requirement for portable fire extinguishers has shown the need to clearly separate the functions of these devices as means of extinction and the conditions which, as pressure devices, they must comply, so that their use is safe.

It is also appropriate to clarify the maintenance operations listed in Appendix 2 to the Regulation on Fire Protection Facilities in which the corresponding to the supply networks of the water and that, in the case of portable extinguishers, with their current wording, is generating misinterpretations about the scope of the same.

It should also be reviewed the treatment of authorized companies for the recharge and repair of fire extinguishers, in order to unify their treatment with that of the maintenance companies and thus avoid the obligation of double request to perform the same function.

There are also facilities that protect activities that, because of their uniqueness, must have specific treatment.

In short, it is a question of the fact that, in the case of portable fire extinguishers, with the simultaneous publication of this Order and of which it reviews the ITC AP5 ITC of the Regulation of Apparatus to Pressure, the duplicity of the testing, and the distinction between maintenance and reloading companies.

On the other hand, and due to the evolution of the technique, certain UNE norms that make the Royal Decree mandatory, have been modified, which makes it necessary to update the list that appears as an annex to Appendix 1 of the same.

This provision has been submitted to the procedure for information on technical standards and regulations provided for in Royal Decree 1168/1995 of 7 July 1995 implementing the provisions of the Directive 83 /189/EEC of the European Parliament and of the Council of 28 March.

In its virtue, I have:

First.-The external hydrants, which are regulated in paragraph 5 of Appendix 1 to the Regulation, are included among the equipment covered by Article 2, and the conformity marking referred to in Article 2 shall be required. in the same.

Second. -As a result of the annulment of the UNE 23402 and UNE 23403 rules relating to fire hydrants equipped, regulated in paragraph 7 of Appendix 1 to the Fire Protection Facilities Regulation, have been replaced since the entry into force of this provision, by the UNE-EN 671-1 and UNE-EN 671-2 standards for the purposes of their approval in accordance with Article 2 of the Fire Protection Facilities Regulation.

Of the hose diameters referred to in the UNE-EN 671-1 and UNE-EN 671-2 standards for fire hydrants equipped, only those equipped with 25 mm semi-irrigated hoses and 45 flat hoses shall be permitted. Millimeters, which are the only ones accepted in the Fire Protection Facilities Regulation, maintaining the same levels of safety (flow, pressure and water reserve) as set out in it.

Third. -Extinction systems by automatic water sprinklers, their characteristics and specifications, as well as the conditions of their installation, shall conform to the UNE 23590 and UNE 23595 standards which annul and replace the referred to in paragraph 9 of Appendix 1 to the Fire Protection Facilities Regulation.

Fourth. -If, as a result of the product controls on the market, the non-compliance with the requirements laid down in the Regulation of Fire Protection Facilities was verified, the manufacturer, importer, the installer or distributor of the product or equipment whose non-compliance has been revealed, shall be sanctioned in accordance with the responsibilities arising in accordance with the provisions of Title V of Law 21/1992, of Industry.

Fifth.-The maintenance set out in Appendix 2 of the Regulation shall be understood as not applicable to existing facilities in establishments regulated by the General Law of Mining Security, and in all those at risk (a) special rules which have specific rules, in which the relevant maintenance programme is established which exceeds the minimum requirements laid down in this Regulation.

Also excluded are those parts of the fire protection facilities of nuclear installations which, due to their relationship to nuclear and/or radiological risk, are subject to the requirements specific surveillance and maintenance as set out in the "Technical Specifications for Operation" document, which are collected in their respective Operating Permissions, or in other documents which may be derived from it and whose surveillance of compliance with the Nuclear Safety Board.

Sixth. -For the establishment of equivalent security affecting, in accordance with the provisions of Article 3 of the Fire Protection Facilities Regulation, marks pursuant to rules issued by a standardisation and/or certification body officially recognised in another Member State or in another State of the Agreement on the European Economic Area, documentation and reports shall be provided on:

The equivalence of the standard used in the award of the mark, with the UNE standard required by the Regulation.

Name and address of the approved certification body that grants it.

Name and address of the manufacturer and/or your representative.

Product description (type, identification, utilization ...).

Provisions to which the product is adjusted.

Specific conditions applicable to the use of the product.

Certificate authorizing the use of the Standard Compliance Mark, manual of the procedure for granting and copying the protocols of the tests to which the product has been submitted.

For the purposes of this Article, the certification bodies considered for the establishment of the principle of equivalent security shall be those with an appropriate technical and recognition level in the area. European Economic.

The validity of the equivalent security recognition given to a product referred to in Article 3 shall be subject to the conditions and validity of the certificate of origin.

Seventh. The amount of the liability insurance policy referred to in Article 11 (d) of the Regulation for the installation companies and Article 14 (d) for the holding companies shall be at least 100,000,000 pesetas per claim must be updated annually in accordance with the IPC.

Eighth.-The Annex to Appendix 1 of the Regulation contains the relationship of the UNE Standards of Obligation. That relationship shall be replaced by the ratio as Annex 1 to this Order.

Ninth. The recharge and maintenance of portable fire extinguishers shall be carried out by the maintenance companies that comply with the requirements laid down in the ITC-MIE-AP5 and are authorized in accordance with Chapter III, Section III. second, of the Fire Protection Facilities Regulation.

Tenth. Table I and Table II of Appendix 2 to the Regulation on Fire Protection Facilities, in which the minimum maintenance programme is to be carried out on the material means of fire fighting, must be include the following modifications:

Fire Extinguishers

Each year:

Checking the weight and pressure in your case.

Eye inspection of hose, nozzle or spear status, valves and mechanical parts.

Note: This annual review will not require the opening of portable dust extinguishers with permanent pressure, except that any anomalies that justify it have been observed.

Fire Water Supply System

Each year:

Annual maintenance range of engines and pumps according to the manufacturer's instructions.

Cleaning filters and dirt retention elements in water supply.

Test the battery and electrolyte load status according to the manufacturer's instructions.

Test, in the conditions of its reception, with the realization of supply curves with each source of water and energy.

11th. Additional Regulations-Authorizes the Ministry of Industry and Energy to update the relationship of UNE Standards set out in Annex 1 to this Order, by way of a review or by a review of the competent management centre. Annulment of the rules referred to in the Regulation.

12th. Transient regime.-The placing on the market, for a period of eighteen months from the entry into force of this Order, of the products that have the certificates in accordance with the UNE rules to be replaced shall be accepted.

13th. Entry into Force-This Order will take effect within three months of its publication in the "Official State Bulletin".
