Royal Decree 124/1994 of 28 January, which regulates the labelling of household appliances and the information concerning the consumption of energy and other resources of household appliances, adapted Spanish legislation to the laid down in Council Directive 92/75/EEC of 22 September, which sought, inter alia, to standardise the system of information relating to the consumption of energy and other essential resources which may appear on the labelling of household appliances.

The aforementioned regulations have been articulated as a framework standard for subsequent ones that would have to give it concrete effectiveness. In accordance with this, the European Commission has established the relevant implementing rules for the energy labelling of household dishwashers, by means of Commission Directive 97 /17/EC of 16 April.

This Royal Decree therefore comes to the incorporation of the said Community Directive into national law.

Law 26/1984 of 19 July, General for the Defense of Consumers and Users, establishes, among others, the basic right of consumers and users to the correct information about the different products placed on their available on the market, in order to facilitate the necessary knowledge about their proper use, consumption and enjoyment.

The right to information of consumers and users has been developed in our legislation through various provisions, among others, Law 21/1992, of 16 July, of Industry, and Royal Decree 1468/1988, of On 2 December, the Regulation on the labelling, presentation and advertising of industrial products intended for direct sale to consumers and users was adopted.

Furthermore, the relevant reports of the Consumer and Users ' Council and the business associations related to the sector have been completed in the procedure.

In its virtue, on the proposal of the Ministers of Health and Consumer Affairs and Industry and Energy, in agreement with the Council of State and after deliberation of the Council of Ministers at its meeting of May 8, 1998,

DISPONGO:

Article 1. Scope of application.

1. This Royal Decree will apply to household dishwashers powered by the electricity grid. Appliances that can also use other energy sources are excluded.

2. The information provided by this Royal Decree to be provided shall be determined in accordance with the relevant UNE-EN standards, the reference number of which has been published in the Official Journal of the State or in the Official Journal of the Community. Competent autonomous.

Noise information will be established as appropriate, in accordance with Royal Decree 213/1992 of 6 March, which regulates the noise specifications in the labelling of household appliances.

3. The terms used in this Royal Decree correspond to those defined in Royal Decree 124/1994 of 28 January, which regulates the labelling of household appliances and information concerning the consumption of energy and other resources.

Article 2. Content of the technical documentation.

1. The technical documentation referred to in Article 2 (3) of Royal Decree 124/1994 of 28 January 1994 shall include

a) The name and address of the provider.

b) A general description of the model that allows you to identify it unequivocally.

(c) Information, including drawings, on the main design characteristics of the model and, in particular, on the elements that have an appreciable influence on their energy consumption.

(d) Reports on the relevant measurement tests carried out in accordance with the test methods of the harmonised standards referred to in Article 1 (2) of this Royal Decree.

e) Where appropriate, the employment instructions.

2. The label referred to in Article 2 (1) of Royal Decree 124/1994 of 28 January 1994 shall comply with the specifications in Annex I to this Royal Decree. The label shall be placed on the front or top outer part of the apparatus so as to be clearly visible and not hidden.

3. The content and format of the information sheet referred to in Article 2 (1) of Royal Decree 124/1994 of 28 January 1994 shall comply with the specifications in Annex II to this Royal Decree.

4. In the cases referred to in Article 5 of Royal Decree 124/1994 of 28 January 1994, and where the offer of sale, lease or lease with option of purchase is made by means of printed communication, such as a catalogue of sale by mail, communication shall include all the information specified in Annex III to this Royal Decree.

5. The energy efficiency class of an appliance, its class of washing and drying efficiency shall be determined in accordance with the provisions of Annex IV.

Single transient arrangement. Extension of marketing.

Until 31 December 1998, the placing on the market, placing on the market and/or the exposure of household dishwashers, fed by the electricity grid, including within the scope of application of this Regulation, will be possible. Royal Decree, even if they do not comply with the provisions contained therein.

The distribution of the printed communications referred to in Article 2 (4) is also permitted, even if they do not comply with those provisions.

Final disposition first. Technical update.

The Ministers for Health and Consumer Affairs and Industry and Energy, in the field of their powers, are hereby authorised to amend the Annexes to this Royal Decree in order to adapt them to technical progress.

Final disposition second. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

IX. Water consumption, in litres, per standard cycle in accordance with the test methods of the harmonised standards referred to in Article 1 (2).

X. Where applicable, noise during the standard cycle in accordance with the provisions of Royal Decree 213/1992 of 14 March 1992.

ANNEX II

Tab

The tab will collect the information listed below. The data may be presented in a table which includes several appliances supplied by the same supplier, in which case they shall be provided in the prescribed order, or shall be accompanied by the description of the apparatus.

1. Supplier's trademark.

2. Identification of the supplier's model.

3. Model class for its energy efficiency as set out in Annex IV, expressed as 'Energy efficiency class ... on a scale covering A (more efficient) to G (less efficient)'. If this information is presented in a table, it may be expressed in another form provided that it is clearly understood that the scale varies from A (more efficient) to G (less efficient).

4. If the data are presented in a table and some of the appliances listed in this table have been awarded a Community label in accordance with Regulation (EEC) No 880/92, this information may be entered in this section. In this case, the heading shall bear the title: "Community eco-label" and shall include a reproduction of the eco-label (the flower). This provision is without prejudice to the requirements of the Community eco-label award scheme.

5. Name, code or manufacturer's indication for the 'normalised' cycle to which the information is referred to on the label and the fiche.

6. Energy consumption in kWh per standard cycle in accordance with the test methods referred to in Article 1 (2), described as ' Energy consumption XYZ kWh per cycle, on the basis of the result obtained in a cycle normalised using a load of cold water '. Actual consumption depends on the conditions of use of the device.

7. Class of the model for its washing efficiency as set out in Annex IV, expressed as 'Class of washing efficiency ... on a scale covering A (higher) to G (lower)'. This information may be expressed in another form provided that it is clearly understood that the scale varies from A (higher) to G (lower).

8. Model class for its drying efficiency as set out in Annex IV, expressed as 'drying efficiency class ... on a scale covering A (higher) to G (lower)'. This information may be expressed in another form provided that it is clearly understood that the scale varies from A (higher) to G (lower).

9. Capacity of the apparatus in number of cutlery, in accordance with the definition set out in footnote VIII of Annex I.

10. Water consumption per standard cycle, in accordance with the definition set out in footnote IX of Annex I.

11. Time of the standard cycle programme, in accordance with the harmonised standards referred to in Article 1 (2).

12. Suppliers may include the information set out in paragraphs 5 to 11 for other cycles.

13. Estimated annual consumption of energy and water on the basis of 220 standard cycles with the consumption expressed in paragraphs 6 (energy) and 10 (water). It shall be expressed as "estimated annual consumption (220 cycles)".

14. Where applicable, noise during a standardised cycle, in accordance with Royal Decree 213/1992 of 14 March.

The information in the label may be collected in a reproduction of the label, either in color or in black and white.

ANNEX III

Remote selling by mail or other means

The mail-order catalogues and other types of printed communication referred to in Article 2 (4) of this Directive shall contain the following information in the order specified:

1) Energy efficiency class (Annex II, paragraph 3).

2) Name of the "standard cycle" (Annex II, paragraph 5).

3) Energy consumption (Annex II, paragraph 6).

4) Washing efficiency class (Annex II, paragraph 7).

5) Class of drying efficiency (Annex II, paragraph 8).

6) Capacity (note VIII of Annex I).

7) Water consumption (Annex I, note IX).

8) Estimated annual consumption "220 cycles" (Annex II, paragraph 13).

9) Where appropriate, noise (Annex I, note X).

Where other data contained in the product information sheet are supplied, they shall be submitted in accordance with the provisions of Annex II and shall be included in the list above in the order prescribed for the information sheet.

ANNEX IV

Energy Efficiency Class

1. The energy efficiency class of an appliance shall be determined as follows:

a) An efficiency consumption C will be calculated as follows:

where S is the capacity of the apparatus in number of cutlery (note VIII of Annex I).
