The framework defining the incorporation of new members in 1999, as a general rule for all staff at the service of the public sector, is defined in Article 21 of Law 49/1998 of 30 December 1998. State General for 1999, when it provides that the calls for entry for new personnel will be concentrated in the sectors, functions and professional categories that are considered to be absolutely priority or that affect the operation of the essential public services, and that the number of places of new income must be lower than 25 per 100 of the effective replacement rate.

This last criterion will not apply to the Armed Forces, where the number of seats will be determined in accordance with the plans to cover the templates established by the Law. 14/1993, of 23 December, of Templates of the Armed Forces, and for the professionalization of the Armed Forces, nor to the Forces and Bodies of State Security, nor to those Autonomous Communities that are required to carry out the deployment of the Armed Forces. Autonomous Police personnel in their territory in relation to the coverage of the corresponding places.

Nor shall it be applicable to the staff of the Administration of Justice, for which it shall be determined in accordance with the provisions of Law 38/1988 of 28 December 1988, of Demarcation and of the Judicial Plant, or of Administrations public with educational competences for the development of the Organic Law 1/1990, of 3 October, of General Ordination of the Educational System, in relation to the determination of the number of places for the access to the bodies of teaching officials.

It is also possible to call for those positions or places which, being budgeted and included in their relations of jobs, catalogues or templates, are either temporarily or temporarily performed. in order to enable the process of temporary employment consolidation or temporary employment replacement, without increasing the number of staff.

Article 21 of Law 49/1998 of 30 December 1999 on the General Budget of the State for 1999, in the first paragraph of its paragraph two, states that the Government, with the limits that have been indicated, may authorize, through of the Offer of Public Employment, prior to the favorable report of the Ministry of Economy and Finance, on a proposal from the Ministry of Public Administrations and on the initiative of the Departments or Public Bodies competent in the field, the call of new entry vacancies which refer to the staff of the State Civil Administration and its autonomous bodies, civil personnel of the military administration and its autonomous agencies, personnel of the Administration of Social Security, statutory staff of Social Security, staff of the Administration of Justice, Forces Armed and State Security Forces and Corps, and staff of the public entities State Administration of Tax Administration, Nuclear Safety Council, Data Protection Agency, and Public Entity Post and Telegraph.

Article 21 of Law 49/1998, of December 30, of the General Budget of the State for 1999, in the second paragraph of its paragraph two, also states that the Ministries of Public Administration and Economic and Finance may jointly authorise, within the limit criteria laid down in general terms, the corresponding calls for vacancies of the public undertakings and public entities not mentioned above, in accordance with the specific conditions which, in accordance with the specific nature of those conditions entities, are set out in this Royal Decree. As a result, the places where the need is essential for each public or public entity are included in the Annex to this Royal Decree, in addition to a set of places to be authorised later on the need arises, given the particular structure of public employment in this field.

At the same time, the criterion of not proceeding to the hiring of new temporary staff and appointment of interim officials is maintained, except in exceptional cases and to cover urgent and non-deferred needs. In addition, the fourth paragraph of Article 21 of Law 49/1998 of 30 December 1999 of the General Budget of the State for 1999 expressly incorporates the requirement for joint prior authorization from the Ministries of Public Administration and Economy and Finance for the recruitment of permanent or temporary staff abroad, either in accordance with local legislation or Spanish legislation.

In this context, it is up to the Government to authorise the public call for those places which cannot be covered with existing staff, and in accordance with the criteria set out above for the rationalisation of the staff in the public sector as a whole and the provision of public deficit reduction.

In this context, and within the framework of the programming of human resources, the policy of relocation of troops started in 1998, which will allow in 1999 the relocation of 365 officials from other services in the country, is continuing. administrative tasks that will free up an equivalent number of police officers, to dedicate them to direct citizen security functions.

In its virtue, on the proposal of the Minister of Public Administration, with the favorable report of the Ministry of Economy and Finance, and after deliberation of the Council of Ministers at its meeting of March 26, 1999,

DISPONGO:

Article 1. Approval of the Public Employment Offer.

In compliance with the provisions of Article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service and in Article 21 of Law 49/1998 of 30 December 1998, of the General Budget of the State for 1999, the Public Employment Offer is approved for 1999 in the terms set out in this Royal Decree.

Selective calls for evidence arising from the present Public Employment Offer will have to be favourably informed by the Directorate-General of the Civil Service as a prerequisite for publication, which must be be held before the 15th of December 1999.

Article 2. Quantification of the Public Employment Offer.

The Public Employment Offer includes human resource needs with budgetary allocation that cannot be met with existing personnel, according to the criteria and according to the composition that is details in the unique annex to this Royal Decree.

Article 3. Human resource planning.

The planning of human resources in the General Administration of the State will be geared to the adequacy of the volume and the improvement in the distribution and training of the personnel for the more effective delivery of the services. As a result, the relocation operations will have to be prioritized by the procedures provided for in the General Regulation of Income, Provision of Jobs and Professional Promotion, approved by Royal Decree 364/1995, of 10 of March, which for 1999 will initially assume 365 more troops for the National Police by relocating other personnel to administrative tasks that are of their own.

Article 4. Provision of posts and mobility.

1. For the purpose of obtaining a better distribution of the staff of the General Administration of the State, the Secretariat of State for Public Administration may authorize the call for tenders for the provision of directed jobs. officials in certain areas, territories, sectors or departments which require the rebalancing of their templates.

2. Rereceipts to the active service for the provisional assignment of staff in administrative situations which do not entail a reserve of work shall be carried out in general in the centres, agencies and territories in need of staff. In any event, the revenue from provisional duty shall be in accordance with the guidelines to be determined by the Ministry of Public Administration.

Article 5. Internal promotion.

In 1999, up to 110 internal promotion places from Group B to A, up to 350 places from Group C to B, up to 800 places from Group D to C and up to 20 places in Group E to D, with distribution by Corps and Scales, will be convened. determine the Ministry of Public Administration. In addition, up to 320 more places of access to internal promotion may be convened, if the Ministry of Public Administration considers it appropriate in accordance with the needs arising from the planning of human resources, with the the distribution to be determined by the Ministry of Public Administration. Also, the call for up to 520 internal promotion places is authorised in the Public Business Entity Post and Telegraph with the following distribution: Up to 20 places from group B to A, up to 300 places from group C to B and up to 200 places from group D to C.

These tests for internal promotion will be carried out, in general, in calls independent of the income.

Additionally, selective access processes for internal promotion to the Research Teachers Scale of the Scientific Research Council (CSIC) and to the Scale of Scientific Researchers of the CSIC, from the Escalas de Personal Scientific Investigator regulated in Royal Decree 1804/1983, of 23 May, in accordance with the provisions of article 22.2 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service.

In addition, and on an exceptional basis, selective processes may be called for access by internal promotion to the Escala de Ciescias Titulares of the CSIC, from the Specialized Higher Graduates ' Scale of the Agency itself.

Article 6. Labour staff.

The selective tests corresponding to the work staff listed in the Annex to this Royal Decree must relate to posts which, in accordance with the provisions of Article 15 of Law 30/1984, of 2 August, in the given wording by Law 23/1988 of 28 July, and by Law 42/1994 of 30 December, may be carried out by labour personnel.

Prior to the authorization by the Ministry of Public Administrations of the call for selective tests for admission to the places of work personnel listed in the annex of this Royal Decree, the Departments or (a) the establishment of a budgetary allocation for the places in which vacancies are to be found.

The job vacancies listed in the annex to this Royal Decree will be covered preferably by the opposition system.

Article 7. Recruitment of work staff abroad.

The hiring of permanent or temporary staff abroad, in accordance with local legislation or, where appropriate, Spanish legislation, will require the prior joint authorization of the Ministries of Public Administration and Economy and Finance in accordance with the procedure laid down jointly by the two departments, provided that there is a budgetary allocation for vacant posts.

Article 8. Fixed employment contracts in public entities and public entities.

During 1999, the hiring of permanent staff will be limited to covering those vacancies that are considered essential for the normal functioning of public entities and public entities, and only with a Staff may be recruited for new jobs when it comes to the implementation of new areas of activity which are considered to be absolutely priority.

The joint authorization of the Ministries of Public Administrations and of the Economy and Finance referred to in the second subparagraph of Article 21 (2) of Law 49/1998, of 30 December, of the General Budget of the Status for 1999, will be performed according to the following singular procedure, consisting of two phases:

1. Call for places to respond to the annual recruitment planning of public entities and public entities:

2. Convocation of places that respond to over-sold needs during the exercise:

The convocation of these places must be previously authorized by the Ministries of Public Administrations and Economy and Finance, in accordance with the specific procedure established by these Departments, and with the limit of additional places set out in the Annex to this Royal Decree.

Also, regardless of what was established in the previous paragraph and in order to enable the appropriate optimization of existing human resources in the public sector, public entities and public entities may contract, after joint authorization from the Ministries of Public and Economic and Finance Administration, to a fixed official or permanent staff from the Department, or public bodies falling within the scope of the Employment Offer Public, as defined in the first subparagraph of Article 21 (2) of Law 49/1998, of 30 December, of the General Budget of the State for 1999. The Ministry of Public Administration will determine the procedure by which advertising and free competition will be guaranteed in this type of hiring.

Also, the call for temporary employment consolidation processes of a structural and permanent nature is authorized in the following agencies: Consortium of the Special Area of the Canary Islands, National Commission of the Electrical System, Commission of the Telecommunications Market, Instituto "Cervantes" and Ente Manager of Railway Infrastructures. The basis of the calls must be informed by the Directorate-General of the Civil Service.

Article 9. Temporary staff.

During 1999, no new temporary staff will be recruited or interim officials will be appointed, except in exceptional cases and to meet urgent and non-deferred needs, with joint authorization of the Ministries of Public Administrations and Economy and Finance.

The appointment of interim teaching officers and the temporary recruitment of administration and service staff to public teaching centres, as well as the temporary coverage of statutory staff positions in the In any case, the health institutions of social security and personnel at the service of the administration of justice will demand the joint authorization of the ministries of public administration and the economy and the treasury.

Article 10. Temporary job consolidation.

1. The process of consolidation of temporary employment of a structural and permanent nature can be carried out both within the framework of the corresponding employment plans and through calls for action, requiring in the latter case the Authorization of the Ministry of Public Administration, prior to the favorable report of the Ministry of Economy and Finance. These processes will not, in any case, increase the number of staff.

The selective processes referred to in the preceding paragraph shall in any event respect the principles of equality, merit, capacity and publicity, and their initiative shall be the responsibility of the Departments or bodies to which they affect the the criteria and priorities set by the Ministry of Public Administration.

2. The employment relationships of those who temporarily perform the places to be fixed in the framework of a consolidation process, will be extended until the selective processes corresponding to the call for tenders are completed. the places they were playing. To this end, the initial employment relationship may be transformed into an interim employment relationship, in accordance with the terms of Royal Decree 2720/1998 of 18 December 1998 or in the rules of public service.

Article 11. Replacement of interim employment.

1. In order to meet the needs of teaching staff, as a result of the requirements for the development of the General Organic Law of the Educational System (LOGSE), the Ministry of Education and Culture is authorized to call for selective tests for entry into the Masters Corps up to a maximum of 1,200 seats, currently covered by interim staff.

2. In order to meet the needs of staff at the service of the Administration of Justice, derived from the requirements of the development of the Law of Demarcation and the Judicial Plant, the Ministry of Justice is authorized to call for selective tests for To 124 places, in the Corps of Forensic Physicians up to 101 places, in the Corps of Officers and Secretaries of Peace up to 444 places, in the Body of Auxiliary to 706 places and in the Body of Agents up to 346 places, as well as the call for 132 job staff, currently covered by the interim staff.

Of these places correspond to the Ministry of Justice 124 places of the Body of Judicial Secretaries, 32 places of the Body of Medical Physicians, 285 places of the Body of Officers, 406 places of the Body of Auxiliary, 205 places of the Corps of Agents and 132 job staff. They correspond to Autonomous Communities that have received transfers of personal means the following places: 69 of the Body of Medical Physicians, 159 of the Corps of Officers, 300 of the Body of Auxiliary and 141 of the Body of Agents.

According to Article 10 of the Order of March 1, 1996 on the selection, proposal and appointment of interim officials to fill vacant positions of the Corps of Forensic, Official, Auxiliary and Agents of Medical the Administration of Justice and those who provide services at the National Institute of Toxicology, the interim staff shall cease when the place they perform is covered by the official.

3. The National Institute of Health is authorized to call for selective testing for statutory staff of the Health Institutions for Social Security up to a maximum of 1,271 optional staff, 3,800 of health personnel optional and 2,500 non-sanitary staff, currently covered with temporary staff.

In accordance with the provisions of the fourth Royal Decree-Law 1/1999, of 8 January 1999, on the selection of statutory staff and the provision of seats in the Health Institutions, the temporary staff shall cease when the statutory staff appointed to occupy those places are incorporated.

Article 12. Reserve of seats for the Basic Scale of Cabos and Guards of the Civil Guard.

Of the total of 1,253 places called for the Basic Scale of Cabs and Guards that are set out in the annex, 626 are reserved for the military of employment of the category of Troop and Marineria Professional of the Armed Forces that carry at least three years of effective services as such. The places reserved for those military personnel who are not covered for any reason may accumulate, up to a maximum of 20 per 100 of the total of those places reserved for free places.

For the students of the College of Young Guards 250 places will be reserved. Those who are left uncovered will accumulate to the quota of free places.

Article 13. Internal promotion in the Civil Guard.

The call for the following places for admission to the military training centers is authorized through internal promotion: 120 places on the Executive Scale and 260 places on the Subofficial Scale.

The applicants for these places must meet the conditions required in the regulations in force on the date of the end of the period of admission of applications to be fixed in the respective call.

Article 14. People with disabilities.

In the selective processes for entry into Bodies and Escalations of officials and categories of labour personnel, including those for internal promotion, persons with disabilities on equal terms will be admitted. conditions with other applicants, reserving in the calls for the percentage of places corresponding to the access of applicants who have the legal status of a person with disabilities, in accordance with the rules applicable in each case.

Additional disposition first. Offer of Employment of Local Corporations.

Local Corporations that approve their Public Employment Offerings will have to forward the approval agreements to the State Administration, in accordance with the provisions of Article 56.1 of Law 7/1985, 2 of April.

Additional provision second. Local Administration staff with national rating.

In order to address the needs of the Local Administration, the Ministry of Public Administration may call for selective testing for access to the Scale of Local Administration Officials with the national character in the following Subscales: 30 places for Sub-scale of Secretariat, higher category; 100 places for the Subscale of Interventional-Treasury, entry category, and 100 places for the Subscale of Secretariat-Intervention.

Additional provision third. Air traffic controller staff.

According to the procedure for the selection of air traffic controller staff of the Public Airport Spanish Airports and Air Navigation, 96 fixed contracts are authorized for this staff. In the case of a second group of trainee drivers being enabled during 1999, the corresponding fixed contracts may be formalised after joint authorization from the Ministries of Public and Economic and Social Finance.

Additional provision fourth. Participation in selective testing courts.

They may not be part of selection commissions or selective testing courts for entry into the Corps or Escalations of officials or categories of labor personnel who have the high office of consideration in accordance with the law. The provisions of Law 12/1995, of 11 May, on Incompatibilities of the Members of the Government of the Nation and of the High Charges of the General Administration of the State.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".
