Royal Decree 72/1988 of 5 February 1988 on fertilizers and related matters, as amended by Royal Decree 877/1991 of 31 May 1991, enables the Ministry of Agriculture, Fisheries and Food to report in favour of the Ministries of Health and Consumer Affairs and Industry and Energy, in order to establish the lists of fertilizers and related products that may be used for agricultural consumption, as well as the maximum and minimum contents and the characteristics of composition.

By virtue of the above, the Order of 28 May 1998, on fertilizers and related matters, was approved. Since then, new types of fertilizers have been appearing which, in the interest of Spanish agriculture, are deemed appropriate to authorize their marketing in Spain.

On the other hand, the experience accumulated in the application of the aforementioned Order advises to give a new wording to its articles 5, 10 and 11.

In the process of drafting this standard, the Autonomous Communities and the sectors affected have been consulted.

This provision has been submitted to the procedure for information on technical standards and regulations provided for in Directive 98 /34/EC of the European Parliament and of the Council of 22 June, as amended by the Directive 98 /48/EC of the European Parliament and of the Council of 20 July, which is incorporated into the national legal order by Royal Decree 1337/1999 of 31 July.

This rule is dictated by the exclusive competence of the State in Article 149.1.13.a of the Constitution, in terms of bases and coordination of the general planning of economic activity.

For the above and previous favourable report of the Ministries of Health and Consumer Affairs and Industry and Energy, I have in place:

Single item. Amendments to the Order of 28 May 1998 on fertilizers and related matters.

1. Two new paragraphs are added to Article 5, with the following wording:

" 3. Entries in the Fertilizer Register and Purposes shall be valid for five years, extendable by the appropriate application, which shall be submitted three months before the expiry date of the registration.

4. The non-renewal of the registration in the Register referred to in the preceding paragraph shall imply the impossibility of continuing to market the product. "

2. Article 10 is worded as follows:

" 1. The products of Annex III and IV in the manufacture of which raw materials of animal origin are used, unless they have undergone hydrolysis processes, shall demonstrate that they do not exceed the following maximum levels of pathogens:

Salmonella: Absent in 25 g of product produced.

Esclerichia coli: R 1000 most likely number (NMP) per gram of product produced.

2. The products of Annex III and IV originating in countries not integrated in the European Economic Area, in the manufacture of which are used as sprouts, shall also provide proof that they are free of enterobacteriaceae, according to the content of the Aerobic germs (R 1000 units forming colonies per gram of produced product). '

3. Article 11 is drawn up in the following terms

" Products of Annex III and IV in the manufacture of which raw materials of plant origin are used from countries not integrated into the European Economic Area shall be exempt from the said harmful organisms Royal Decree 2071/1993 of 26 November 1993. '

4. Annex II to the Order of 28 May 1998 is amended as follows:

(a) The fertilisers listed in Annex I to this Order shall be added to the section "1.1.1 Nitrogated" in Annex II to the Order of 28 May 1998.

(b) The fertilizers listed in Annex II to this Order shall be added to the section "1.2 Compounds" of Annex II to the Order of 28 May 1998.

5. The following shall be added to Annex

:

A) In tolerances, a new paragraph that says:

"m) DMPP nitrification inhibitor (3,4methylpyrazolphosphate): 1/10 of the content declared on the label."

B) In Table 1, paragraph I, nitrogen fertilizers, the following products and tolerances:

" Ammonium Sulfate with DMPP ..................... 0.5

Ammonium nitrosulfate with DMPP ................. 0.5

ammonium ammonium ammonium sulphate solution ... 0,4. '

Single end disposition. Entry into force.

This Order shall enter into force on the day following that of its publication in the "Official State Gazette".

An NP fertilizer without Thomas slag, calcined phosphate, aluminocalcium phosphate, partially solubilized natural phosphate, and soft natural phosphate must be guaranteed according to solubility (1), (2) or (3):

In the case where the water-soluble P2O5 does not reach 2%, only solubility (2) shall be declared.

In the case where the water-soluble P2O5 reaches 2%, the solubility (3) is declared, obligatorily indicating the water-soluble P2O5 content [solubility (1)].

The content of P2O5 soluble only in mineral acids must not exceed 2%.

The weight of the sample for the determination of solubility (2) and (3) shall be 1 g.

1. Water-soluble potassium oxide.

2. The indication 'pob re e n chloro' shall be equivalent to a maximum of 2% Cl.

3. The chlorine content may be guaranteed.

(*) The person responsible for placing the product on the market shall include in each package or accompanying documents in bulk, the complete technical information enabling the user to determine, in particular, the periods of time the use and the dose of application of the fertiliser depending on the crop to which it is intended.
