Law 13/1986, of 14 April, on the Promotion and General Coordination of Scientific and Technical Research, establishes, in Chapter II, the legal system of public research bodies, including the National Institute for Agricultural and Food Research and Technology, an autonomous body attached to the Ministry of Science and Technology pursuant to Article 5 of Royal Decree 557/2000 of 27 April 2000, for the restructuring of the ministerial departments.

As regards its legal nature, Article 61 of Law 50/1998 of 30 December 1998 on fiscal, administrative and social measures provides that the National Institute for Agricultural and Food Research and Technology adopt the configuration of an autonomous body established in Article 43.1.a of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State, provided that it has the characteristics required by the nature of the activities of scientific research and technological development.

Article 61 (2) of Law 50/1998 of 30 December 1998 provides that the Government, on the initiative of the respective Ministries of Education and on a joint proposal of the Ministers of Administrations Public and Finance, shall approve the Statutes of each of the public research bodies.

This Royal Decree, in compliance with the mandates contained in the preceding laws, approves the Statute of the National Institute of Agricultural and Food Research and Technology. It defines the functions, objectives, governing bodies and organizational structure of the body. At the same time, it sets out the guidelines for the development of its activity in the management and coordination of research and its own research activity, and orders the framework of its institutional relations. The regulation of the aspects of structure and operation is intended to enable this institution to adapt without difficulty to the changes resulting from scientific and technological developments in the agricultural and food sectors. The design of the organizational system does not cost added value and tends to achieve optimal utilization of the available resources.

In its virtue, on the initiative of the Minister of Science and Technology, on a joint proposal of the Ministers of Public and Finance, in agreement with the Council of State and after deliberation of the Council of Ministers in their meeting on 1 December 2000, D I S P O N G O:

Single item. Status of the National Institute of Agricultural and Food Research and Technology.

The Statute of the National Institute for Agricultural and Food Research and Technology (INIA) is approved, the text of which is inserted below.

Single additional disposition. Public expenditure.

The application of the forecasts contained in this Royal Decree, as well as the implementation of the organizational measures deriving from it, will not imply any increase in public expenditure.

Single transient arrangement. Activities of the National Institute of Agricultural and Food Research and Technology.

In relation to the research and diagnostic activities carried out by the National Institute of Agricultural and Food Research and Technology, as a support for the agricultural and food policy of the Ministry of Agriculture, Fisheries and Food, in particular for the prevention of zoonoses, epizootic diseases and plant diseases, and as long as the Ministry of Agriculture, Fisheries and Food does not have sufficient own resources to this effect, the National Institute of Agricultural research and technology will give priority to these the objectives of the agricultural and food policy of the Government. To this end, the competent authority of the Ministry of Agriculture, Fisheries and Food may communicate directly with the National Institute of Agricultural and Food Research and Technology to ensure agility and efficiency. necessary in the performance of such activities.

Single repeal provision. regulatory repeal.

Chapter I of Royal Decree 950/1997, of 20 June, establishing the basic organic structure of different autonomous bodies of the Ministry of Agriculture, Fisheries and Food, is hereby repealed. of Royal Decree 998/1999 of 11 June 1999 amending the previous one, and any provisions of equal or lower rank in that which are contrary to the provisions of this Royal Decree.

Final disposition first. Development standards.

The holder of the Ministry of Science and Technology is empowered to lay down the rules necessary for the development and execution of the provisions of this Royal Decree, without prejudice to the powers that correspond to other Ministerial departments.

However, and in accordance with the legislation in force, the peculiarities in terms of access, posting, career, promotion and mobility of the staff referred to in Article 61 (a) of the Law 50/1998 of 30 December 1998 on fiscal, administrative and social measures shall be governed by the Royal Decree of the Council of Ministers.

Final disposition second. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

STATUTE OF THE NATIONAL INSTITUTE OF AGRICULTURAL AND FOOD RESEARCH AND TECHNOLOGY (INIA)

CHAPTER I

Nature and functions

Article 1. Legal nature, membership and purposes.

1. The National Institute for Agricultural and Food Research and Technology (INIA) is a public research body, with the character of an autonomous body, in accordance with the provisions of Article 43.1.a) of Law 6/1997, of 14 April, Organization and Functioning of the General Administration of the State, attached to the Ministry of Science and Technology through the General Secretariat of Scientific Policy.

2. It is for the Ministry of Science and Technology, through the General Secretariat for Scientific Policy, the strategic direction, the evaluation and control of the results of the INIA activity, without prejudice to the competencies attributed to the the General Intervention of the State Administration regarding the evaluation and control of the results of public bodies in the state public sector.

3. The INIA has its own distinct public legal personality, its own assets and its own treasury, as well as its autonomy of management and full legal capacity, and within its sphere of competence, the precise administrative powers for the fulfilment of its purposes, in accordance with the terms laid down in this Statute, except for the expropriation.

4. The objectives of the INIA are the programming, coordination, allocation of resources, monitoring and evaluation of scientific and technical research activities, as well as the execution of the research and technological development functions, including those for technological transfer in agricultural and food matters.

Article 2. Legal framework.

The INIA is governed by the provisions contained in Law 13/1986 of 14 April, of the Promotion and General Coordination of Scientific and Technical Research; by Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State; by Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure; by the Royal Decree of Law 2/2000 of 16 June, by which the Recast of the Law on Contracts of Public Administrations; by the Royal Legislative Decree 1022/1964 of 23 September 1988 on the recasting of the General Budget Law; by Decree 1022/1964 of 15 April 1964 on the Law on State Heritage; by Article 61 of Law 50/1998 of 30 June 1998 on the (a) December, of fiscal, administrative and social order measures, by this Statute and, in general, by the rules implementing the provisions cited above and by those applicable to them.

Article 3. Functions.

1. The INIA functions are as follows:

a) Manage and execute the competencies of the General Administration of the State in the area of scientific research and technological innovation in agricultural and food matters, without prejudice to the competences of the Secretariat of State of Science and Technology Policy of the Ministry of Science and Technology.

b) Represent the Department to the scientific and technological bodies and bodies of national and international research in the field of agricultural and food research, without prejudice to the powers of the Secretariat State of Science and Technology Policy and the Ministry of Foreign Affairs.

(c) To promote national and international cooperation in the area of agricultural and food research, in particular with the Autonomous Communities, through the Coordinating Committee for Agricultural Research, and without prejudice to the Competence of the Secretariat of State for Scientific and Technological Policy.

d) Develop, coordinate and manage the strategic actions that correspond to it, in relation to the National Plan for Scientific Research, Development and Technological Innovation, in accordance with the guidelines formulated by the Secretary of State for Science and Technology Policy.

e) Exercise those other competencies that are legally attributed to you.

2. For the performance of the functions listed in the previous paragraph, the INIA may carry out the following activities:

a) Schedule basic objectives and general guidelines for scientific and technical research and technological development, as well as for the conservation and sustainable use of genetic resources for agriculture and food, in accordance with the guidelines formulated by the Secretariat of State for Scientific and Technological Policy.

b) Develop, promote and implement scientific and technical research projects, as well as activities for the conservation and sustainable use of genetic resources for agriculture and food.

c) Manage, coordinate and monitor agricultural and food research and development projects, and activities for the conservation and sustainable use of genetic resources for agriculture and power.

(d) Promote national and international cooperation in agricultural and food research, in particular with the Autonomous Communities, through the Committee of Agricultural Research, without prejudice to the (b) the powers conferred on the Interministerial Committee on Science and Technology with Article 8 of Law 13/1986 of 14 April.

e) Establishing Conventions with public and private bodies, both national and international, for the implementation of research projects and other scientific and technological activities, giving the Commission the Interministerial of Science and Technology, as provided for in article 15 of Law 13/1986, of 14 April, of Promotion and General Coordination of Scientific and Technical Research.

f) Promote the dissemination and use of research results by the economic or social sectors concerned, and the participation of these in agricultural and food research and development activities, without prejudice to the powers of the Secretariat of State for Scientific and Technological Policy.

g) Participate in the creation and maintenance of joint research and development units, associated or otherwise, by means of the Convention with Agricultural and Food Research Bodies of the Autonomous Communities, public bodies, universities or other institutions or entities.

h) Establish mechanisms for the transfer of the results of your research activity. To this end, the INIA will be able to collaborate with the Center for the development of the theological and industrial development, as well as with other agencies of the General Administration of the State and the Autonomous Communities. It may also propose the creation or participation in commercial companies, in accordance with Article 19 of Law 13/1986 of 14 April, and to enter into contracts with companies interested in the acquisition of the results. generated, enhancing the transfer and valuation of the technology.

(i) Manage those funds which, by their specific nature and application to agricultural and food R & D, are entrusted to it, as well as the testing of varieties or technical studies on seeds and plants of nursery.

(j) Develop, within the framework of the legal system of staff at the service of public administrations, the policy on the body's own staff, as well as develop multi-annual plans on material resources necessary for the development of the activities.

k) Grant the character of associates to research and development units belonging to other public or private institutions through the Convention.

l) Confecting programs and performing actions that promote and develop scientific and technical training, the incorporation of scientific personnel into the research and development system, public or private, and training permanent staff.

m) Conduct prospective studies on the progress and new orientations of agricultural and food research and technological development activities, as well as their organization and management.

n) Participate actively in national and international forums where issues affecting agricultural and/or food research and technology in relation to seed and nursery plants are discussed.

n) Coordinate and cooperate in international research programs, through the Secretariat of State for Scientific and Technological Policy, without prejudice to the competencies attributed to the Ministry of Foreign Affairs.

or) Any other that contributes to the fulfilment of the purposes and functions of the body.

CHAPTER II

Governing Bodies

Article 4. Governing bodies.

1. The governing bodies of the National Institute of Agricultural and Food Research and Technology (INIA) are the following:

1.o Collegiate Organs:

a) The Rector Board.

b) The Governing Board.

2.o Single-Personal Organ:

a) The President.

b) The Vice President.

c) The CEO.

2. The Governing Council and the Governing Board shall be governed by the provisions of this Statute and by the provisions of Chapter II, Title II, of Law 30/1992 of 26 November of the Legal Regime of the General Administration and of the Common Administrative Procedure, and Chapter IV, Title II, of Law 6/1997, of 14 April, of the Organization and the Functioning of the General Administration of the State.

Article 5. The Governing Council.

1. The Governing Council shall be composed of the following members:

(a) The President, who will be the Secretary of State for Science and Technology Policy who will be able to delegate to the Secretary-General for Scientific Policy.

b) Vice President 1, who will be the Director-General of the National Institute for Agricultural and Food Research and Technology.

(c) Vice-President 2.o, who will be a Director-General of the Ministry of Agriculture, Fisheries and Food, appointed by the Minister of Science and Technology, on a proposal from the Minister for Agriculture, Fisheries and Power.

d) The Vocals.

e) The Secretary, who will be the Secretary-General of the Agency.

2. They will be Vowels of the Governing Council:

(a) Three representatives of other ministerial departments or agencies of the Administration with competence in the field of scientific and technical research. They shall be appointed by the head of the Ministry of Science and Technology, on a proposal from the Inter-Ministerial Science and Technology Commission, and their term of office shall be four years.

b) Two representatives of the Ministry of Agriculture, Fisheries and Food, appointed by the Minister of Science and Technology, on a proposal from the Minister of Agriculture, Fisheries and Food. His term of office will be four years.

c) Five representatives of the Ministry of Science and Technology, appointed by the Department's holder.

Your mandate will be four years.

(d) Vice President 1 of the Committee on Agricultural Research, regulated by the Order of 8 January 1987.

e) A representative of each of the agricultural professional organizations, appointed by the head of the Ministry of Science and Technology, among those who have national implementation and at the proposal of the same. His term of office will be four years.

f) Four representatives of companies from the agricultural and food sectors, appointed by the head of the Ministry of Science and Technology, on a proposal from the Minister of Agriculture, Fisheries and Food. His term of office will be four years.

g) Three scientists of recognized prestige, appointed by the head of the Ministry of Science and Technology, on a proposal from the Committee of Agrarian Research. Of the three, at least one must be from the National Institute of Agricultural and Food Research and Technology and at least one from the Autonomous Communities. His term of office will be four years.

(h) The Deputy Director-General for Research and Technology, the Director of the Spanish Plant Variety Office and the Deputy Director-General for Prospective and Coordination of Programs at INIA.

i) A representative of the Functional Coordination Committee of Autonomous Research and Experimentation Bodies, appointed by the head of the Ministry of Science and Technology, on a proposal from the Chairman of the Committee, Article 3 of Royal Decree 574/1997 of 18 April 1997, which regulates the composition and functions of the Committee for the Functional Coordination of Autonomous Bodies of Research and Experimentation.

3. The Governing Council, which shall be convened by its President, whose vote shall be settled, shall meet at least once a year in ordinary session, and in special meetings, at the initiative of its President or at the request of at least one third of the Vowels.

4. The 50 per 100 of the term of office of four years shall be renewed alternately every two years.

Article 6. From the functions of the Rector Board.

The following are the functions of the Rector Board:

(a) Approve the general lines of action of the Agency, in accordance with the guidelines of national scientific and technical policy, in the field of agricultural and food research, as well as the resources needed to achieve marked scientific and technical objectives.

b) Report the strategic actions of the National Plan for Scientific Research, Development and Technological Innovation in Agricultural and Food Matters.

c) Inform any other sector-specific programme to be developed by INIA, before being submitted to the relevant procedures for its final promotion.

d) Report on the multi-annual plans on the human and material resource needs necessary for the development of the Agency's activities.

e) To learn about the evolution of scientific and technical research programs related to the agricultural and food sectors.

f) Approve the Agency's preliminary draft budget and report annually the basic lines of its preparation.

g) Approve the Body's Annual Memory.

h) Meeting of national and international agreements signed by INIA.

i) Collaborate on the actions of technology transfer and dissemination of research results.

It is also up to you to propose the creation or participation in commercial companies, as proposed in paragraph 2 of Article 3 (2) of this Royal Decree.

(j) Any other subject to consideration by the President of the Agency.

Article 7. The Board of Directors.

1. The Board of Directors of INIA shall be composed of the Director-General of the Agency, who shall exercise the Presidency, the Secretary-General of the Institute, who shall act as Secretary, the Deputy Directors-General and the Director of the Spanish Office of Plant Varieties.

2. The Governing Board shall meet, at least once a month, at the request of its President, with the power to convene such meetings, with a voice but without a vote, to those persons who, for their experience, may provide information. relevant to topics included in the order of the day.

Article 8. From the functions of the Board of Directors.

The Board of Directors, a direct support body to the Director-General, has the following functions:

a) Develop the Agency's general lines of action, in accordance with the guidelines issued by the Governing Council.

b) Managing the elaboration and processing of the Strategic Agricultural and Food Research Actions and how many other research and development programmes of sectoral interest are requested from the Agency by the Ministry of Agriculture, Fisheries and Food, as well as programs for the conservation and utilization of genetic resources for agriculture and food.

c) Plan the needs of human and material resources necessary for the development of the Agency's activities, and to know the proposals related to calls and relation of jobs and distribution (i) functional of the staff for the best development of the Institute's competences.

d) Meeting the agenda, proposals and documentation to be presented to the Committee on Agricultural Research, regulated by Order of 8 January 1987.

e) Meeting of cooperation agreements with other bodies, public or private, national or international, for the conduct of research or cooperation activities of mutual interest.

f) Approve the guidelines and procedures for evaluating the activity of research staff and support for the research of the Agency, as well as for the conduct of the technical examination of varieties.

g) Approve the proposals for priority lines of the Agency's dependent centres and the summaries of their activities.

h) Approve the economic proposals regarding their distribution in activities and assignment to the different units with organic level of General Subdirection, dependent on the Agency, as well as know the monitoring of the budgetary management.

i) Knowing the issues that affect the Heritage of the Agency.

j) Report the Agency's proposals for inclusion in the editorial program of the Ministry of Science and Technology.

k) Any other function that is institutionally determined.

Article 9. The President of the Institute.

1. The INIA Presidency corresponds to the Secretary of State for Science and Technology Policy.

2. The President's role is the institutional representation of the Agency, the Presidency of its Governing Council, the approval of expenditure and the management of the Agency's payments in excess of 100 million pesetas (601,012 EUR); of contracts and agreements involving economic commitments exceeding 100 million pesetas (601,012,10 euro), and the accountability of the Agency.

Article 10. Acts and resolutions of the President.

According to the provisions of Article 82 of Law 50/1998 of 30 December 1998, of fiscal, administrative and social order measures, the acts and resolutions of the President do not end the administrative route. To stand against the same appeal before the Minister of Science and Technology.

Article 11. The Vice President.

1. The Vice Presidency of the INIA corresponds to the Secretary-General of Scientific Policy.

2. The Vice President's role is to replace the President in cases of absence, vacancy or illness, and the performance of any duties expressly entrusted to him or delegated by the President.

Article 12. The Director General.

1. The Director General of INIA will be appointed and separated from his position by Royal Decree, on a proposal from the head of the Ministry of Science and Technology.

2. These are the functions of the Director-General:

a) Address the actions of the Agency in accordance with the guidelines established by the Rector Council and its President.

b) Develop the preliminary draft budget to be submitted to the Governing Council.

c) Exercise the management of the Agency's staff and services.

d) The signing of contracts and agreements up to a sum of 100 million pesetas (601,012,10 euros).

e) The approval of the expenditure and the management of the Agency's payments up to a sum of 100 million pesetas (601,012,10 euros).

(f) The granting of aid and public subsidies, as laid down in Article 81 of the General Budget Law.

g) Establish evaluation mechanisms for the best control of projects developed by the Agency.

h) Play the Vice Presidency 1.a of the Rector Board.

i) Chair the Board of Directors.

j) Perform as many functions as are expressly entrusted to or delegated to you by the President or the Governing Council.

3. As a support and advisory body for the performance of its duties, the Director-General shall have an Advisory Scientific Committee.

This Committee will be chaired by the Director General of the Agency and will form part four researchers of the Institute itself and six national or foreign scientists of recognized prestige and accredited experience, all appointed by the Secretary of State for Scientific and Technological Policy, on a proposal from the Director-General of INIA.

CHAPTER III

Managing, advisory, and control organs

SECTION 1. MANAGING BODIES

Article 13. Managing bodies.

1. The following units are dependent on the Director-General of INIA, with an organic level of Subdirection General:

a) General Secretariat.

b) General Subdirection for Prospective and Coordination of Programs.

c) Subdirectorate General for Research and Technology.

d) Spanish Plant Variety Office.

2. The intervention delegated to INIA, with the level to be determined in the relation of jobs, shall be attached to the Director-General of the Agency, without prejudice to its functional dependence on the General Intervention of the Status.

Article 14. General Secretariat.

1. The General Secretariat is responsible for:

a) The management of the Agency's human resources.

(b) The elaboration of the necessary work for the preparation of the preliminary draft of the Agency's budget, as well as the actions that are derived from its implementation and, in general, from the economic-financial management of the Agency.

c) Activities related to general registration, administrative procurement, and management of supplies.

d) The maintenance, conservation and security of the Institute's real estate and its equipment.

e) The coordination of legal affairs, protection of the results of the investigation and supervision of compliance with the regulations that may affect the Institute.

f) Managing the library, publications, and documentation.

g) The management of grants and grants for the training and scientific and technical training of research staff.

h) The management and administration of peripheral units.

i) The preparation of reports entrusted to it by the Presidency in the field of its competences.

j) All activities of a generic or indeterminate nature, which are not expressly attributed to the other units.

2. The Secretary-General of INIA shall replace the Director-General in cases of vacancy, absence or disease.

Article 15. Sub-Directorate-General for Prospective and Programme Coordination.

The General Subdirection of Prospective and Program Coordination develops the following functions:

a) Prospective studies on the progress and new orientations of agricultural and food research and technological development, as well as on their organization and management.

b) The elaboration, coordination and management of the programmes by the Department, in the field of agricultural research and technology and food and conservation and the use of genetic resources for agriculture and power.

(c) Coordination and monitoring of the programmes managed by the Institute and of research and conservation projects and the use of genetic resources for agriculture and food carried out through such programmes, as well as studies carried out with financial contributions from other Ministries or bodies, when they are entrusted to them.

d) Coordination with other agricultural and food research and development systems.

(e) The report and, where appropriate, a proposal for the subjects which, in the field of agricultural and food research and technological development and the conservation and utilization of genetic resources for agriculture and food, shall be submit to the deliberation and agreement of the Committee of Agricultural Research. Relations of cooperation, exchange and promotion of research and development with Spanish scientific and technological bodies, without prejudice to the powers conferred on the Inter-Ministerial Commission on Science and Technology in Article 8 of Law 13/1986 of 14 April.

(f) Coordination and cooperation in relation to Community and international research and agri-food technology programmes, without prejudice to the powers conferred on the Ministry of Foreign Affairs.

Article 16. Sub-Directorate-General for Research and Technology.

To the General Research and Technology Subdirectorate, the following functions correspond to:

(a) The coordination of scientific and technical activities of research and development centers and units of support to them.

b) Monitoring and evaluation of the activities carried out in the General Research and Technology Subdirectorate, as well as those of the staff assigned to it.

c) The implementation of proposals, both of projects and of other research and development activities, to the convening bodies.

d) Actions to promote the dissemination and use of research results by the sectors concerned, as well as their participation in agricultural research and development activities.

e) The proposal of agreements and contracts with other public or private entities in the field of research and development.

(f) The authorization for the provision of research and development activities and services, to entities and companies, in accordance with the provisions in force, as well as for the participation of their staff in initiatives of Research and development in agricultural and food matters.

g) The proposal of how many measures to encourage staff training and other initiatives consider appropriate to optimise the activity of research centres.

h) Control of the management of the activities of the centres and the support units, as well as ensuring the proper functioning of their facilities and facilities, under the supervision of the General Secretariat of the Agency.

Article 17. Spanish Office of Plant Variety.

The Spanish Plant Variety Office is responsible for:

a) Research and experimentation activities related to commercial and protected varieties of seed and nursery plants.

b) The performance of studies, trials and analyses in the field and laboratory, in relation to the registration of commercial varieties, with the protection of plant varieties and in relation to seed and nursery plants, as the issuance of certificates from the International Seed Trials Association (ISTA).

(c) The action as a Technical Examination Office, on behalf of the Community Plant Variety Office, in relation to the Community plant variety right.

d) Coordination and cooperation in relation to Community and international programmes in the field of research and experimentation on plant varieties, without prejudice to the powers conferred on the Ministry of External.

e) The proposal of stimulus measures for the training of personnel and other necessary initiatives that it considers appropriate to optimize the activity of its technical functions.

SECTION 2. ADVISORY AND CONTROL BODY

Article 18. The Research Council.

1. The Research Council is constituted as a collegiate body for the advice and control of INIA.

2. The Research Council shall be composed of the Director-General of the Agency, who shall exercise the Presidency, the Deputy Director-General for Research and Technology, the Secretary-General, and the Directors of the centres and coordinators of the departments, acting as Secretary, with a voice but without a vote, the Technical Adviser of the Scientific Unit of the General Subdirectorate of Research and Technology.

3. The Research Council shall meet at least once every two months after a call by its President.

Article 19. Functions of the Research Council.

The Research Council will have the task of advising the Director-General of INIA, in all matters relating to the research and development activities carried out in the research units of the INIA. body, draw up proposals from and approve the annual report on the activities of the Subdirectorate-General for Research and Technology.

CHAPTER IV

Structure and operation of research and development centers

Article 20. I + D centres of INIA.

The execution of the research and development activities in the INIA are developed in research centers, organically assigned to the Subdirectorate General of Research and Technology, and its creation will be carried out, according to Article 10.2 of the Law on the Organization and the Functioning of the General Administration of the State, by Order of the Minister of Science and Technology, after approval by the Minister of Public Administration.

Article 21. Of the structure of the centers.

1. The research centers of INIA are the organic units in which the activities of research and the provision of scientific and technical services will be developed.

2. From the operational point of view, the research and development activities carried out in the centres will be grouped in departments which will carry out research and development activities and technological development services. shall provide the scientific and technical services necessary to complete the research actions or to enable the implementation of the results of the research activities in their early stages of transfer.

3. At the front of each centre there will be a Director, assisted by a Board of Centre, of which will be its President. The Director shall coordinate, supervise and manage the activities and facilities of the Centre, without prejudice to the powers reserved for the coordinators of projects in the management of projects, all under the supervision and control of the Deputy Director-General for Research and Technology.

4. In each department there will be a coordinator who will perform functions of support to the management of the center in the direction, coordination, supervision and management of the research and development activities of his department, without prejudice to the skills reserved for project coordinators in the management of projects. The Department Coordinators shall be appointed by the Director-General of INIA, on a proposal from the Deputy Director-General for Research and Technology, for a period of four years.

5. Each centre shall, within the scope of the Agency, have the necessary human and material resources for the development of the scientific and technical activities of the departments, technological development services and support units. that they integrate.

6. In order to create the centres, the above aspects shall be detailed; in the light of the special characteristics of their activities, specific features may be envisaged for their organisation and operation.

CHAPTER V

Creating R & D Units

Article 22. Creation of R & D units

INIA will be able to establish agreements with universities and public administrations bodies for the temporary organization or adaptation of their own research and development units that are necessary to achieve the the objectives of a National Programme, Sectoral or Autonomous Communities, described in Article 6.2 of Law 13/1986, for the Promotion and General Coordination of Scientific and Technical Research.

Article 23. INIA participation in shared ownership R & D units.

1. The INIA may participate in the creation and maintenance of joint research and development units and shared ownership with universities and other public or private bodies.

2. The INIA may, by agreement, associate research and development units with universities or research organisations without losing their membership of the Institute.

3. It may also, by agreement, associate its centres, research and development units and services from universities or other research bodies. They shall have regard to units associated with INIA, without losing their membership to the body of origin.

4. INIA may create other forms of institutional collaboration to meet new needs or demands that may arise in the context of its institutional relations.

5. The Governing Board shall regulate the conditions and procedures for the creation, management, modification and, where appropriate, the deletion of the arrangements for institutional collaboration referred to in the previous paragraphs.

Article 24. Association of R&D units from INIA to other public bodies.

1. In order to carry out research programmes which are considered to be of particular interest to the Ministry of Science and Technology, INIA may constitute R & D units by means of agreements with various ministerial departments, Autonomous, local entities or autonomous bodies and business public entities. These R & D units will be governed by a Board of Trustees.

2. The Governing Board shall regulate the general conditions and procedures for the creation and participation of INIA in these R&D units, as well as the functions of the respective employers.

CHAPTER VI

Economic and Personal Regime

Article 25. Economic and heritage regime

1. The economic resources of INIA may come from the following sources:

(a) The assets and values that constitute their assets, as well as the products and income of the equity.

(b) The annual allocations to the General Budget of the State.

(c) Contributions from the European Union for the development of its purposes.

(d) Rates or other public revenue from your activity.

e) The grants and income obtained as a result of concerts or agreements with public or private entities or other contributions.

(f) Donations, legacies and other contributions from private and private entities, without prejudice to the provisions of Article 24 of the State Heritage Act.

g) Any other resource that can legally be shared by you.

2. The INIA may have, in addition to its own heritage, the assets and rights of the State Heritage that are assigned to it for the purpose of its purposes.

The patrimonial regime of all these assets and rights will be established for the autonomous organizations in Article 48 of Law 6/1997 of April 14, of the Organization and the Functioning of the General Administration of the State, and in the State Heritage Act and complementary legislation.

Article 26. Arrangements for procurement, control and accounting and budgetary and economic arrangements.

1. The INIA shall be governed by the general rules for the procurement of public administrations, in accordance with the provisions of Article 49 of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State. Article 27. Staff scheme.

1. The INIA staff consists of:

(a) The official staff assigned to the INIA, including the investigator.

(b) The scientific and technical staff employed in accordance with Article 17 (a) of Law 13/1986.

c) The contracted investigators, in the practice mode, in accordance with Article 17.b) of Law 13/1986.

d) The permanent and temporary staff employed by INIA.

2. The INIA shall select and recruit temporary staff in accordance with the regulations and in accordance with the procedures in force in this field.

3. The training staff will not have a legal/working relationship with INIA and will be integrated by those who develop activities to extend their training through pre-doctoral, post-doctoral and research grants, or any other nature, in accordance with its specific rules.
