The Order of 30 January 1997, as amended by the Order of 15 April 1999, regulates the composition of certain collegiate bodies of the Department, it is necessary to adapt their composition to the organizational reforms operated by Royal Decree 1449/2000 of 28 July, amending and developing the basic organizational structure of the Ministry of the Interior.

Basically, the governing body that has undergone variation in its designation and competence is the General Directorate of Security Infrastructures and Materials, including the General Sub-directories of it dependent, which has replaced the former General Directorate of Security Administration. The establishment of the Government ' s Delegation for Aliens and Immigration should also be highlighted, and its incorporation into the collegiate bodies that carry out tasks related to the tasks of the Government.

On the other hand, Royal Decree 1329/1997, of 1 August, of partial modification of the Royal Decrees 1892/1996 and 1885/1996 of 2 August, of the Basic Organic Structure of the Ministries of Public Administrations and the Interior, respectively, consolidated the General Inspectorate of Services and the General Staff Subdirectorate, under the Undersecretariat of this Ministry. This implies the need to proceed to incorporate this modification to all those organs in which the aforementioned Units are present.

Finally, the third additional provision of Royal Decree 2823/1998 of 23 December, which approved the Statute of the Administration of State Security Infrastructures, introduced amendments to the structure of the Technical General Secretariat, in such a way that the functions in the field of statistics and publications, previously attributed to the Technical Office of the Deputy Secretary-General, have shifted to the Office of the Under-Secretary-General for Studies and Institutional Relations, with the necessary addition of the new composition.

This means that, on the basis of legal security, a new Order should be issued to regulate the composition and functions of the Department ' s collegiate bodies, in accordance with the above-mentioned organizational reforms, and to repeal those of 30 January 1997 and 15 April 1999, as amended.

By virtue of this, following the approval of the Minister of Public Administrations, I have:

First. Scope of application.

1. The composition and functions of the following collegiate bodies of the Ministry of the Interior, which are attached to the Undersecretariat of the Department, constitute the subject of regulation of this Order:

The Budget Commission.

The Retribution Commission.

The Committee on Informatics and Communications.

The Publications Advisory Commission.

The Administrative and Advertising Coordination Committee.

2. The regulation of the Statistical Commission, which is attached to the Technical General Secretariat, is also subject to this Order.

Second. Budget Commission.

1. It is up to the Budget Commission to submit to the Minister the appropriate proposals regarding:

(a) The approval of the preliminary drafts of the budgets of the Department and its autonomous agencies.

(b) The formulation of priority criteria in the preparation and implementation of budgets.

(c) Revision of existing programmes.

(d) Monitoring programme implementation.

2. The Budget Commission, in plenary, shall consist of the following members:

Chairman: The Under-Secretary of the Interior.

Vice-President: The Technical Secretary-General.

Vocals:

The Director General of the Police.

The Director General of the Guardia Civil.

The Government Delegate for the National Drug Plan.

The Director General of Prison Institutions.

The Director General of Internal Policy.

The Director General of Civil Protection.

The Director General of Traffic.

The Director General of Infrastructures and Security Materials.

The Director General of Aliens and Immigration.

The Manager of the Autonomous Labour and Prison Benefits Agency.

Secretary: The Chief of the Budget Office of the Department.

3. The Standing Committee of the Budget Commission of the Department, as a delegated body that ensures the continuity of its proceedings, shall exercise the following functions:

(a) Report the budget proposals of the Department and its autonomous agencies.

(b) Report the investment programmes of the various executive bodies and agencies of the Ministry, as well as the modifications thereof.

(c) To carry out as many studies and projects as they deem appropriate in the scope of the above sections.

(d) Any other functions entrusted to it by the Minister, the Assistant Secretary or the Budget Commission, in plenary.

4. The Standing Committee of the Budget Commission shall consist of the following members:

Chairman: The Technical Secretary-General.

Vice-President: The Chief of the Budget Office of the Department.

Vocals:

The Assistant Director-General for Economic and Patrimonial Management.

The Assistant Director-General for Heritage and Economic Management of the General Directorate for Infrastructure and Security Material.

The Assistant Director General of Staff and Inspection.

A representative, with the level of Assistant Director-General, appointed by each of the senior and executive bodies represented in the Plenary.

The Manager of the Autonomous Labour and Prison Benefits Agency.

Secretary: A staff member holding a post from the Budget Office, designated by the President.

Third. Retribution Commission.

1. The Retributions Commission shall exercise its functions in accordance with the provisions of Royal Decree 469/1987 of 3 April establishing the Inter-Ministerial and Ministerial Retribution Commissions, and in particular the following:

(a) To submit to the Inter-Ministerial Retributions Commission and its Executive Commission the proposals to be considered by them, in accordance with article 1, paragraphs 3 and 4, of the Royal Decree 469/1987, and concerning both the Department and the autonomous bodies thereof.

(b) To study and approve, where appropriate, the special or extraordinary services gratification proposals for staff members developed by the Department ' s senior, executive and autonomous bodies.

(c) Develop general criteria for the implementation of the productivity supplement in the Department and its autonomous agencies.

(d) The study, treatment and resolution of any other retribution issues, the competence of which is not expressly attributed to other bodies.

(e) The exercise of the functions entrusted to it by the Minister or the Assistant Secretary concerning the staff policy of the Department.

2. The Retributions Commission shall consist of the following members:

Chairman: The Under-Secretary of the Interior.

Vocals:

The Government Delegate for the National Drug Plan.

The Directors-General of the Department and the Technical Secretary-General.

The Presidents, Directors or Managers of their autonomous bodies.

The Director of the Cabinet of the Secretary of State for Security and the Chief of the Technical Cabinet of the Assistant Secretary.

The Chief of the Budget Office of the Department.

The Assistant Director-General for Economic and Patrimonial Management.

The Director of the General Intervention of the State Administration in the Ministry.

The Assistant Director-General for Staff and Inspection, who will serve as Secretary of the Commission.

3. Under the immediate reliance of the Ministerial Retribution Commission, a Standing Committee shall act in which it may normally delegate the exercise of the functions expressly determined.

4. The composition of the Standing Committee shall be as follows:

Chairman: The Under-Secretary of the Interior.

Vocals:

The Assistant Director General of Staff and Inspection.

The Chief of the Budget Office.

The Assistant Director-General for Economic and Patrimonial Management.

The Director of the General Intervention of the State Administration in the Ministry.

A representative, with the level of Assistant Director-General, appointed by each of the senior organs and governing bodies represented in the Plenary.

Secretary: A staff member holding a post at the General Staff and Inspection Section, designated by the President.

Fourth. Computer and Communications Commission.

1. The Committee on Information and Communications shall exercise the following functions:

(a) Report information and communications plans of the various executive bodies and agencies of the Department and monitor compliance.

(b) To serve as a liaison and technical cooperation body of the Higher Computer Council and its specialized commissions, in accordance with the provisions of Royal Decree 2291/1983 of 28 July establishing the Higher Computer Council.

(c) Supervising the inventory of computer resources of the Department and its agencies, in accordance with the guidelines of the Higher Computer Council.

(d) Report equipment acquisition and lease projects, and recruitment projects with service offices, advisory companies and technical assistance on issues related to the treatment of information and communications.

(e) Promote and promote staff training in information and communication technologies within the Department.

2. The Committee on Information and Communications shall consist of the following members:

Chairman: The Under-Secretary of the Interior.

First Vice-President: The Director-General for Security Infrastructures and Materials, who in the event of vacancy, absence or disease may be replaced by the Deputy Director-General for Planning and Control of the aforementioned General Directorate.

Second Vice-President: The Deputy Director-General of the Senior Officer and Information Systems Centre.

Vocals:

The Chief of the Economic and Technical Coordination Division of the General Directorate of Police.

The Assistant Director General of Support of the Directorate General of the Guardia Civil.

A representative of the Government Delegation for the National Drug Plan.

A representative of the Government Delegation for Aliens and Immigration.

The Assistant Director General of Staff and Inspection.

The Assistant Director General of Information Systems and Organization of Procedures.

The Assistant Director-General for Internal Policy and Electoral Processes.

The Deputy Director General of Prison Services.

The Assistant Director-General for Citizen Care and Assistance to Victims of Terrorism.

The Assistant Director-General for Plans and Operations of the Directorate-General for Civil Protection.

A representative of the Office for Coordination and Studies (Schengen Area) of the Secretary of State for Security.

Secretary: A staff member holding a post of the Senior Officer and Information Systems Centre, appointed by the President.

3. Under the immediate reliance of the Commission on Informatics and Communications, a Standing Committee shall act in which the exercise of the function provided for in paragraph 1 (d) of this section may be delegated on an ordinary basis, in the case of negotiated procedures without publicity in any of the cases provided for in article 182 (h), of the Refounded text of the Law on Contracts of Public Administrations, adopted by Royal Legislative Decree No. 2/2000.

4. The composition of the Standing Committee shall be as follows:

President: The Director-General for Security Infrastructures and Materials, who in the event of vacancy, absence or disease may be replaced by the Deputy Director-General for Planning and Control of the aforementioned General Directorate.

Vice-President: The Deputy Director-General of the Senior Officer and Information Systems Centre.

Vocals:

The Chief of the Economic and Technical Coordination Division of the General Directorate of Police.

The Assistant Director General of Support of the Directorate General of the Guardia Civil.

A representative of the Office for Coordination and Studies (Schengen Area) of the Secretary of State for Security.

Secretary: The Secretary of the Committee in plenary.

Fifth. Publications Advisory Commission.

1. It is incumbent upon the Publications Advisory Commission to exercise the functions set out in Royal Decree 379/1993 of 12 March of the Order of Official Publications and, in particular:

(a) To report, on a pre-reference basis to the Official Publications Coordination Board, the Department ' s proposals regarding the General Official Publications Plan, as well as the editing proposals to be integrated into the Editorial Programme of the Department.

(b) Report or propose draft standards for publications related to the Department.

(c) To guide the editorial and diffuse activities of the same, providing advice in all matters related to them.

(d) Follow up on the Editorial Program and report the annual report of the Department's publications.

(e) To advise the Department ' s senior bodies on official publications.

(f) To know the inclusions in the Editorial Program of publications that for urgent reasons have been approved by the Minister, on the proposal of the Chairman of the Commission.

2. The Publications Advisory Commission shall consist of the following members:

Chairman: The Under-Secretary-General for the Interior or, by his delegation, the Technical Secretary-General.

Vice-President: The Assistant Director-General for Institutional Studies and Relations.

Vocals:

The Chief of the Budget Office.

The Assistant Director-General for Citizen Care and Assistance to Victims of Terrorism.

A representative of each of the Department ' s senior, executive and autonomous bodies, responsible for the functions related to publications related to the proceedings relating to the Commission.

Secretary: A staff member holding a post from the General Subdirectorate for Institutional Studies and Relations, appointed by the President.

3. Vocals of the Publications Advisory Commission shall be designated by the headlines of senior or managerial bodies among officials performing tasks related to the competence of the Commission.

4. The Secretariat of the Commission shall exercise its functions in accordance with the provisions of Royal Decree 379/1993 of 12 March.

Sixth. Statistical Commission.

1. The Statistical Commission shall exercise the following functions:

(a) Propose or report the necessary rules, criteria and actions in order to coordinate the statistics of the various bodies of the Ministry, as well as to carry out data transfers between the Ministry and other public bodies.

(b) Disseminate and coordinate the standards and criteria of the National Statistical Institute among the various governing bodies.

2. The Statistical Commission shall consist of the following members:

Chairman: The Technical Secretary-General.

Vice-President: The Assistant Director-General for Institutional Studies and Relations.

Vocals:

A representative of the Technical Cabinet of the Assistant Secretary.

The Heads of Statistical Units of each senior or management body of the Department.

The Deputy Director-General of the Senior Officer and Information Systems Centre.

Secretary: The Director of Statistical Programs of the General Subdirectorate for Institutional Studies and Relations

Seventh. Ministerial Commission on Administrative Information and Publicity Coordination.

1. It is up to the Ministerial Commission on Administrative Information and Publicity Coordination to carry out the following functions:

(a) Determine common lines of action that guide the Department ' s information activity, following the criteria and guidelines set by the Inter-Ministerial Administrative Information Commission.

(b) To monitor and coordinate the information activities carried out by the Department ' s information units, its executive bodies and public bodies linked or dependent on the Department, including the territorial offices, enhancing the exchange of information available to each of them, through the connection of their databases or through any other existing means and promoting concrete actions that improve the quality of care to the citizen.

(c) Design and propose a training programme for staff in the Department ' s information units.

(d) Report and propose policy projects that directly affect information within the Department.

(e) Monitor the design of communication strategies, establish general publicity objectives and criteria, on issues related to the Department and collaborate in the programming processes of the advertising campaigns of the Department ' s senior and management bodies.

(f) Monitoring the realization and dissemination of each advertising action.

2. The Ministerial Commission on Administrative Information and Publicity Coordination will operate in plenary and Standing Committee.

3. The Plenary shall consist of the following members:

Chairman: The Under-Secretary-General for the Interior or, by his delegation, the Technical Secretary-General.

First Vice-President: The Assistant Director-General for Citizen Care and Assistance to Victims of Terrorism.

Second Vice-President: The Director of the Office of Information and Social Relations.

Vocals: A representative, with the rank of Assistant Director-General, by each of the Department ' s senior, executive and autonomous bodies.

Vocals of the Commission may be appointed representatives of the territorial bodies of the Department in a number not exceeding three.

The President may be interested in attending his meetings, on the basis of Vocales, those staff members whose assistance is advisable on the basis of matters to be dealt with.

Secretary: A staff member holding a post from the General Citizens ' Care and Assistance to Victims of Terrorism, appointed by the President.

4. The Standing Committee shall exercise the functions delegated to it by the plenary, and shall consist of the following members:

President: The Assistant Director-General for Citizen Care and Assistance to Victims of Terrorism.

Vocals: Five Vocals of the Commission appointed by the Plenary on the proposal of the Chairman.

Secretary: The Secretary of the Plenary of the Committee.

In addition, when the Standing Committee will deal with specific advertising initiatives, the Vocal representative of the relevant senior or executive body will participate in the meetings.

First additional provision.

In cases where the representatives of any of the Department ' s higher organs, directors or Autonomous Agencies are not a party to the meetings of any of the above-mentioned bodies, the representatives of such bodies, or agencies, shall, on the basis of Vocals, be summoned, when they are to be heard of files processed by their respective units, or of matters whose competence is specific to them. Staff members and advisers may also be summoned as appropriate.

Second additional provision.

Within the regulated collegiate bodies, working groups may be established for the study of specific issues or the development of specific programmes.

Transitional provision.

Until the Recruitment Board of the Ministry of the Interior is regulated, in accordance with the consolidated text of the Law on Contracts of Public Administrations, approved by Royal Legislative Decree 2/2000 of 16 June, and Royal Decree 390/1996 of 1 March, the Purchase Board will continue, maintaining its competences, with the following composition:

Chairman: The Under-Secretary of the Interior or, by his delegation, the Assistant Director-General for Economic and Patrimonial Management.

Vocals:

The Deputy Director-General of the Senior Officer and Information Systems Centre.

One representative for each of the Department ' s senior and management bodies, whose procurement is to be proposed or made at each meeting convened.

Secretary: A staff member holding a post of the General Sub-directorate for Economic and Patrimonial Management, appointed by the President.

When the Board acts as a Recruitment Officer, the Head of State Law in the Department and the Delegate of the General Intervention of the State Administration in the Department shall be part of it.

Derogatory provision.

The orders of 30 January 1997 and 15 April 1999, which regulate the composition and functions of certain collegiate bodies of the Ministry of the Interior, as well as any provisions of equal or lower rank that are contrary to the provisions of this Order, are repealed.

Final provision first.

The collegiate bodies regulated by this Order shall be governed by the provisions of articles 22 to 27 of Act No. 30/1992 of 26 November on the Legal Regime of Public Administrations and the Common Administrative Procedure, as well as by the internal rules and instructions emanating from the organs themselves.

Final provision second.

This Order shall enter into force on the day following its publication in the Official Gazette of the State.
