The framework defining the incorporation of new personnel in the year 2001, with a general character for all staff at the service of the public sector, is defined in Article 22 of Law 13/2000, of December 28, of Budgets General State for the year 2001, when it is available that the calls for new staff places will be concentrated in the sectors, functions and professional categories which are considered to be absolutely priority or which affect the functioning of the essential public services and that the number of places of new income must be less than 25 per 100 of the rate of replacement.

This last criterion will not apply to the staff at the service of the Administration of Justice, so that the number of places will be determined according to the provisions of Law 38/1988, of 28 December, of Demarcation of Judicial plant, nor to public administrations with educational competences for the development of the Organic Law 1/1990, of 3 October, of General Management of the Educational System, in relation to the determination of the number of places for the access to the bodies of teaching officers, and the staff of the prevention and extinction services of fires.

In addition, in order to promote stability in employment, it is possible to call on those posts or places which, while being budgeted and included in their relations of jobs, catalogues or templates, are they are either temporarily or temporarily performed in order to enable, without increasing the number of staff, the processes for the consolidation of temporary employment or the replacement of temporary employment.

Article 22 of Law 13/2000 of 28 December, in the first subparagraph of paragraph 3, provides that the Government, with the limits set out above, may authorise, through the offer of employment public (OEP), after favourable report of the Ministry of Finance, on a proposal from the Ministry of Public Administrations and on the initiative of the Departments or Public Bodies competent in the field, the call for vacancies again (a) entry concerning the staff of the Civil Administration of the State and its Autonomous Bodies; civil personnel of the military administration and its autonomous organizations; personnel of the Administration of Social Security; statutory staff of Social Security; staff of the Administration of Justice; Armed Forces and Forces and Bodies State Security, and staff of the public entities State Agency of Tax Administration, Nuclear Safety Council, Data Protection Agency, and the public entities Post and Telegraph and Lotteries and Gambling State, as well as the posts and places that are held interim or temporarily.

In parallel, paragraphs 2 and 3 of Article 22 also maintain the criterion of not proceeding to the recruitment of temporary staff or the appointment of interim officials, except in exceptional cases and to cover urgent and non-deferred needs, with joint authorization from the Ministries of Public Administrations and Finance. In addition, the fourth paragraph expressly sets out the requirement for joint prior authorization by the Ministries of Public Administrations and Finance for the recruitment of permanent or temporary staff abroad, either on the basis of the local legislation or Spanish legislation.

In this context, it is up to the Government to authorize the public call for those places which cannot be met with the existing staff, and in accordance with the criteria set out above, which are addressed to the rationalisation of the staff in the public sector as a whole and the provision of public deficit reduction.

Similarly, similar to the 2000 offer, the publication of the Royal Decree on the offer of public employment is advanced, in order to facilitate the planning of human resources and increase the management period of the offer of employment. Measures are also set out to improve the distribution of the publication of calls to avoid the accumulation of such publication at the end of the financial year.

In its virtue, on the proposal of the Minister of Public Administrations, with the favorable report of the Ministry of Finance and after deliberation of the Council of Ministers at its meeting on 9 February 2001,

D I S P O N G O:

Article 1. Approval of the offer of public employment.

1. In compliance with the provisions of article 18 of Law 30/1984, of 2 August, of Measures for the Reform of the Civil Service, and in Article 22 of Law 13/2000, of 28 December, of the General Budget of the State for 2001, it is approved the offer of public employment for 2001 in the terms set out in this Royal Decree.

2. Calls for selective testing of civil servants and employees arising from the present offer of public employment should be reported in advance by the Directorate-General for the Civil Service.

For these purposes, calls for official staff shall be sent before 15 May 2001 to that Directorate-General.

3. The calls for selective testing resulting from this offer should be published in the "Official State Gazette" before 30 September 2001, with the exception of calls for work staff in duly justified cases and prior authorisation from the Directorate-General for the Civil Service.

Article 2. Quantification of the public employment offer.

The public employment offer includes human resource needs with budgetary allocation that cannot be met with existing personnel, according to the criteria and according to the composition that is details in the article and in the unique annex to this Royal Decree.

Article 3. Human resource planning.

1. The planning of human resources in the General Administration of the State will be oriented to the adequacy of the volume and the improvement in the distribution and training of the personnel for the more effective delivery of the services. Article 4. Provision of posts and mobility.

1. Article 5. Internal promotion.

Article 6. Labour staff.

Article 7. Recruitment of work staff abroad.

The hiring of permanent or temporary staff abroad, in accordance with local legislation or, where appropriate, Spanish legislation, will require the prior joint authorization of the Ministries of Public Administration and Hacienda, in accordance with the procedure established jointly by the two departments, provided that there is a budgetary allocation for the vacancies.

Article 8. Fixed employment contracts in public entities and public entities.

Article 9. Temporary staff.

Article 10. Temporary job consolidation.

1. 3. Article 11. Replacement of interim employment.

These places correspond to the Ministry of Justice 180 places in the Body of Judicial Secretaries, 200 seats in the Officers ' Corps, 400 seats in the Auxiliary Corps, 200 seats in the Corps of Agents, 95 seats in the Corps of Faculty Technicians of the Institute of Toxicology, 25 places in the Technical Corps of the Institute of Toxicology and 75 places in the Laboratory of Auxiliary Laboratory of the Institute of Toxicology.
