Royal Decree 58/2005 of 21 January adopting protective measures against the introduction and dissemination in the national territory and the European Community of organisms harmful to plants or plant products, as well as for export and transit to third countries, it incorporated into national law Council Directive 2000 /29/EC of 8 May 2000 on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against its spread within the Community.

Commission Implementing Directive 2014 /78/EU of 17 June 2014 amending Annexes I, II, III, IV and V to Council Directive 2000 /29/EC on protective measures against the introduction into the European Union of the the Community of organisms harmful to plants or plant products and against its spread within the Community, considers that it is necessary to make certain modifications as to the mention in the directive of certain organisms harmful in Annexes I and II in line with the level of risk and the situation of the risk level in the Union European, as well as making certain amendments to the special requirements set out in Annex IV. In addition, certain inspection requirements for plants and plant products which should therefore be listed in Annex V should be introduced. The Directive should also be adapted to reflect the latest revision of FAO's NIMF 15 and to adapt the names of certain harmful organisms to the revised scientific name. It is also considered necessary to adapt the provisions of Directive 2000 /29/EC relating to potato cyst nematode to the requirements of Council Directive 2007 /33/EC. Finally, the amendment reflects certain changes relating to protected areas in the European Union with regard to certain harmful organisms.

Furthermore, Commission Implementing Directive 2014 /83/EU of 25 June 2014 amending Annexes I, II, III, IV and V to Council Directive 2000 /29/EC on protective measures against the protection of the environment and the protection of the environment The introduction into the Community of organisms harmful to plants or plant products and against its spread within the Community, considers it necessary to make further changes in relation to the protected areas of the European Union. for certain harmful organisms, and to amend the scientific name of the harmful organism Ceratocystis fimbriata by that of Ceraticystis platani, while some provisions concerning this harmful organism are reviewed.

It is also appropriate to incorporate into the Royal Decree the correction of errors in Directive 2000 /29/EC published in the Official Journal of the European Union on 27 June.

This order is dictated by the habilitation established in the final disposition of the aforementioned royal decree, which empowers the Minister of Agriculture, Fisheries and Food, current Minister of Agriculture, Food and Agriculture. and the Environment, in order to adapt the Annexes to the amendments which are introduced into them by Community provisions.

In the preparation of this provision, the Autonomous Communities and the representative entities of the sectors concerned have been consulted.

In its virtue, according to the State Council, I have:

This order incorporates into Spanish law Commission Implementing Directive 2014 /78/EU of 17 June 2014 amending Annexes I, II, III, IV and V to Council Directive 2000 /29/EC on the measures to protect against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community, and Commission Implementing Directive 2014 /83/EU of 25 June 2001 on the introduction into the Community of harmful organisms 2014 amending Annexes I, II, III, IV and V to Council Directive 2000 /29/EC on the measures to protect against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community.

Final disposition second. Entry into force.

This order will take effect on October 1, 2014.
