The Ministerial Order of 27 July 1994 ("Official State Gazette" of 29) regulated for the first time the automated files of personal data of the central services and autonomous bodies of the Ministry of Economy and Finance, in compliance with the mandate contained in the second provision of the Organic Law 5/1992 of 29 October ("Official State Gazette" of 31), of regulation of the Automated Treatment of Personal Data which provided for the regulation by the Public Administrations responsible for the files The law of the Law of the European Union of the Member States of the European Union

In turn, the Ministerial Order of 26 July 1994 (Official Gazette of the State of July 27) also regulated the automated files of personal data of the extinct Ministry of Commerce and Tourism.

Subsequently repealed the Organic Law 5/1992, of October 29, of regulation of the Automated Treatment of Personal Data, by the Organic Law 15/1999, of December 13, of Protection of Data of Character Staff, and also repealed Royal Decree 1884/1996, of 2 August, of basic organic structure of the Ministry of Economy and Finance, and replaced by the Royal Decrees 1.371/2000, of July 29, and 1.330/2000, of July 7, that they develop the respective organic structures of the Ministries of Economics on the one hand, and of

Finance on the other hand, it is imposed in compliance with article 20 of Law 15/1999, to proceed to the creation, modification or deletion of the files of public ownership whose responsibility corresponds to the Management Bodies of the central organisation of the Ministry of Economy, as well as certain public bodies attached to it, by means of a general provision published in the "Official Gazette of the State".

Therefore, and in accordance with the additional provision of the Organic Law 15/1999, of 13 December, of Protection of Personal Data, and Royal Decree 1371/2000, of July 7, of the development of the structure organic from the Ministry of Economy, and in use of the privileges conferred, I have:

First. Scope of application.

Automated files containing personal data existing in the Ministry of Economy, as well as in certain Public Bodies attached to it, are those listed in Annex I to this Order. ministerial.

Second. Deletion of files.

The automated files of personal data created by the Order of 27 July 1994, regulatory of the automated files of a personal nature of the Central Services and Autonomous Bodies of the Ministry of Economy and Finance, which are listed in Annex II to this Order.

Third. Management and organisational measures.

The owners of the organs responsible for each automated file will take the necessary management and organizational measures to ensure the confidentiality, security and integrity of the data, as well as the drivers to make effective the guarantees, obligations and rights recognized in Organic Law 15/1999, of December 13, and in its implementing rules.

Fourth. Data disposals.

Without prejudice to the data transfers provided for in the description of each file in Annex I, the transfer of the data from the automated files that are regulated by this Order to the National Institute of Statistics, for the performance of the functions attributed to it in article 26 of Law 12/1989, of May 9, of the Public Statistical Function, to the statistical services of the ministerial departments for the functions that the Article 33 of the same Law, and the statistical services of the Autonomous Communities under the conditions setting out Article 40 (2) and (3) of the abovementioned Law.

Repeal provision. Repeal of previous orders.

The Ministerial Order of 26 July 1994, of automated files of personal data of the Central Services and Autonomous Bodies of the extinct Ministry of Commerce and Tourism, is hereby repealed.

The Order of 27 July 1994 is also repealed with regard to the powers of the Ministry of Economy.

Final disposition. Entry into force.

This Order shall enter into force on the day following that of its publication in the Official Gazette of the State.
