The Menéndez Pelayo International University, as a continuator of the Santander Summer University, founded by Decree of 23 August 1932, was created by Decree of 10 November 1945, as a centre of high culture international and inter-regional contemporary, in order to accommodate cultural currents through the coexistence of teachers and students of different nationalities. Because of the importance of the aims entrusted to this International University, Royal Decree 261/1980, of 11 January, provided the necessary flexibility in its operation through its transformation into an autonomous body of character On the order of 12 August 1982, its Statutes were approved.

Royal Decree 41/1998, of 16 January, partially modified the aforementioned Statutes with a double purpose: on the one hand, to update the composition of the Board of Trustees, which until that moment had not been constituted and no longer was The Commission has been in a position to adopt a more flexible and operational structure for the University's Board of Government, which is now on a provisional basis, while the latter has been adapted as a result of its constitution. In its virtue, on the initiative of the Minister of Education, Culture and Sport and on the proposal of the Ministers of Public and Finance, in agreement with the Council of State and after deliberation of the Council of Ministers in their meeting on 5 April 2002,

Single item. Approval of the Statute of the International Menéndez Pelayo University.

The Menéndez Pelayo International University Statute is approved, the text of which is inserted below.

Single repeal provision. Regulatory repeal.

The Order of 12 August 1982 which approved the Statutes of the International University of Menéndez Pelayo, as well as Royal Decree 41/1998 of 16 January, which partially modified the previous one, is hereby repealed.

Single end disposition. Entry into force.

This Royal Decree shall enter into force on the day following that of its publication in the "Official Gazette of the State".

MENENDEZ PELAYO INTERNATIONAL UNIVERSITY STATUTE

CHAPTER I

General provisions

Article 1. Purpose.

The Menéndez Pelayo International University, a university of high culture, research and specialization in which various degrees and university specialties converge, has a mission to disseminate the culture and science, to promote the relations of exchange and scientific and cultural information of international and interregional interest and the development of activities of high research and specialization. To this end, it shall organise and develop third-cycle lessons to be established with the corresponding official qualifications of Doctor and other postgraduate diplomas and diplomas awarded by the latter.

Article 2. Legal nature.

The Menéndez Pelayo International University is an autonomous body, attached to the Ministry of Education, Culture and Sport, with its own legal personality and its own heritage. acts of management and disposition for the fulfilment of its purposes, without any limitations other than those established by the laws.

The Menéndez Pelayo International University will also enjoy autonomy for the exercise of its cultural, research and teaching skills and will carry out appropriate activities within the legal system.

Article 3. Legal regime.

The Menéndez Pelayo International University will be governed by the provisions of the Organic Law 6/2001, of 21 December, of Universities, which apply to it; by Law 6/1997, of April 14, of Organization and Operation of the General Administration of the State; by Law 30/1992, of 26 November, of the Legal Regime of Public Administrations and of the Common Administrative Procedure; by the Royal Legislative Decree 1091/1988, of 23 September, approving the recast text of the General Budget Law; by the Royal Legislative Decree 2/2000, of 16 June, approving the recast of the Law on Contracts of Public Administrations; by Royal Decree 432/1999 of March 12, adapting various autonomous bodies to the provisions of Law 6/1997 referred to in paragraph 1 above, and other implementing provisions to the autonomous bodies of the General Administration of the State, as well as by this Statute.

Article 4. Headquarters.

The Menéndez Pelayo International University will be based in Madrid. Among its activities of a permanent nature will highlight the summer courses, of which Santander will be the traditional academic venue, without prejudice to how many activities are organized and celebrated in other campuses of Spanish or foreign localities.

Article 5. Functions.

They are the functions of the International Menéndez Pelayo University, in the specific field of the missions entrusted to it, according to Article 1 of this Statute, the generation and transmission of knowledge in all its fields.

Article 6. Activities.

For the fulfillment of its purposes, the Menéndez Pelayo International University, by itself or in collaboration with other Spanish or foreign universities or institutions, will promote international or interregional relations of cooperation through:

1. Joint research programmes.

2. Holding courses for foreigners.

3. International and inter-regional courses and work meetings aimed at the study of problems or specific areas of research.

4. Promotion of research centres.

5. Third-cycle teaching organization.

CHAPTER II

Governance and representation organs

Article 7. Structure.

For the fulfillment of its purposes, the Menéndez Pelayo International University is structured in the organs mentioned in the following articles.

Article 8. Collegiate and single-person bodies.

The government, representation and administration of the Menéndez Pelayo International University will be exercised through the following bodies:

1. Collegiate bodies:

a) Patronate.

b) University Cloister.

c) Governing Council.

2. Single-person organs:

a) Rector.

b) Vice-chancellors.

c) Secretary-General.

d) Deputy Secretary-General.

e) Manager.

f) Directors of the Teaching and Research Centers.

g) Coordinator of Studies and Programs.

h) Director of University Services.

i) Director of Courses for foreigners.

j) Director of Major College Las Llamas.

Article 9. Employer.

1. The Board of Trustees is the society's participation organ in the fulfillment of the goals of the International University Menéndez Pelayo.

2. The functions of the Board shall be as follows:

a) Propose those measures that it deems necessary for the fulfillment of the purposes of the International University Menéndez Pelayo.

b) To elect the Rector and to demand responsibility by, if necessary, a motion of censure approved by three fifths of the members of the Rector. In this case, in the maximum period of one month, elections shall be called to Rector. During that time he will take over the position of Rector the Vice-Rector referred to in Article 13.1 of this Statute.

c) Approve the preliminary draft annual budget of the International University Menéndez Pelayo.

d) Approve the economic memory and activities of the International University of Menéndez Pelayo.

e) To promote the financing of the activities carried out by the Menéndez Pelayo International University and to obtain all types of aid that are deemed necessary for the achievement of the tasks assigned to it.

f) Promote the establishment of research agreements between the Menéndez Pelayo International University and other public or private institutions, Spanish or foreign, and coordinate international activities that.

g) Reglamenting its internal operation.

h) Propose the reform of the Statute.

3. The President of the Board of Trustees will be the Secretary of State for Education and Universities and the Vice President will be the Director-General of Universities.

The Board of Trustees shall be composed of a number of members not exceeding 15, appointed by the Minister of Education, Culture and Sport among persons of recognized prestige in the field of university teaching, research, culture and economic and social life.

4. Members of the Board of Trustees shall be appointed for a maximum period of six years.

5. The Rector will attend with a voice and vote to the Board of Trustees, and the Secretary-General, who will act as Secretary of the Board, with voice and no vote.

Article 10. Cloister.

1. It is the highest organ of representation of the University. He will be composed of the Rector, who will chair him, Vice-Chancellors, General Secretary, Deputy Secretary-General, Coordinator of Studies and Programs, Director of Courses for foreigners and Directors of the Teaching and Research Centers.

2. Corresponds to the Cloister:

(a) Attend the solemnities of university life and other acts of a similar nature that require university presence.

b) Report and know the general guidelines of the academic functioning of the University.

c) Advise the governing bodies of the University on how many academic issues are raised by the Rector.

3. He will be Secretary General of the University.

Article 11. Governing Council.

1. The Governing Council shall be composed of the Rector, who shall preside over him, the Vice-Chancellors, the Coordinator of Studies and Programs, the Manager and the Secretary-General, who shall act as Secretary of the Board.

2. The functions of the Governing Council shall be:

a) Attend and advise the Rector on all matters.

b) Develop the preliminary draft budget of the International Menéndez Pelayo University, for its elevation to the Board of Trustees.

c) Report the appointments of Secretary-General, Manager, Directors of the Teaching and Research Centers, Coordinator of Studies and Programs, Director of University Services, Director of Courses for foreigners and Director of Major College Las Llamas.

d) Inform teaching and research plans.

e) Approve the multi-annual programming of the Menéndez Pelayo International University.

f) Distribute courses and activities among the educational and research centers, as well as the different student scholarships.

g) Approve the economic memory and activities developed by the Secretary-General, for his elevation to the Board of Trustees.

h) Report collaboration agreements with other entities.

Article 12. Rector.

1. The Rector of the International University Menéndez Pelayo will be a University Professor elected by the Board of Trustees and appointed by the Government, on a proposal from the Minister of Education, Culture and Sport.

2. The Rector's term of office will be four years, reelectable for one time.

3. The Rector of the International University Menéndez Pelayo will have the privileges and treatments of the Rectors of the Spanish public universities.

4. The Rector of the International University of Menéndez Pelayo may, in the name and representation of the same, celebrate all contracts and legal acts necessary for the development of the purposes and missions of that, according to the legislation in effect.

5. It is up to him to carry out the administrative acts of authorization and provision of expenditure and the ordering of payments necessary for the implementation of the budget.

The Court of Auditors is also responsible for accountability through the General Intervention of the State Administration.

6. The Rector will hold the University's representation and preside over all academic acts of the same to those he attends.

Article 13. Vice Chancellors.

1. For specific matters on a permanent or temporary basis, the Rector may delegate, in accordance with the legislation in force, its competence in the Vice-Chancellors. In the event of absence or illness, the Rector shall be replaced by a Vice-Rector who is a University Professor, designated for that purpose.

2. The Vice-Chancellors will be appointed by the Minister of Education, Culture and Sport, on a proposal from the Rector, between Catedráticos and Professors Titulares de Universidad.

3. At the Menéndez Pelayo International University there will be four Vice-Chancellors.

4. Vice-Chancellors will be able to request partial waiver of teaching obligations in their Universities of provenance. The responsibilities they assume at the Menéndez Pelayo International University will have the same treatment, in any case and for all the effects, as those of similar rank in any other of the Spanish public universities.

Article 14. Secretary-General.

1. The Secretary-General shall be a university professor appointed by the Minister of Education, Culture and Sport on a proposal from the Rector, after the Governing Council has been informed.

2. The General Secretariat of the University will be responsible for the issue and certification of the Council documents and agreements; the drafting and custody of the record books; the custody and management of the University's administrative file; the organization of the solemn acts of the university, and the Secretariat of the collegiate organs of the University.

3. The Secretary-General will direct and coordinate the performance of the university residences that are dependent on the International University, located both in national territory and beyond. He will also be responsible for implementing the appropriate measures to implement the decisions that the University's governing bodies adopt to promote the expansion of centers, residences and university activities abroad.

The Secretary-General may request partial waiver of teaching obligations at his University of provenance in the terms set out in Article 13.4 of this Statute.

4. A Deputy Secretary-General, who will be a University Professor appointed by the Rector, will replace the Secretary-General in cases of absence, vacancy or illness and perform the duties entrusted to him.

Article 15. Manager.

1. The Manager shall be appointed by the Minister of Education, Culture and Sport among career officials of the General Administration of the State who belong to bodies or scales to which the title of Doctor, Licenced, is required for his entry. Engineer, Architect or equivalent, on a proposal from the Rector, after report of the Governing Council and heard by the Board of Trustees.

2. It will be up to the Manager, under the immediate dependency of the Rector, the economic-administrative management of the University, the Head of the non-teaching staff of the University, the execution of the agreements in administrative or economic matters, and how many are delegated by the Rector in their specific areas of competence.

3. There shall be the office of Vice-Secretary of the University, whose holder shall be appointed by the Rector among career officials of the General Administration of the State who belong to bodies or scales to which the title of the Doctor, Licentiate, Engineer, Architect or equivalent, on a proposal from the Governing Council. It shall have the functions of assisting the Manager or those entrusted to it, replacing him in the case of a vacant vacancy or absence and exercising the executive powers as in the delegate.

CHAPTER III

Academic Organization

Article 16. Structure.

1. For the realization of cultural functions, researchers and teachers on campus located outside Santander, the International University of Menéndez Pelayo will be structured in educational and research centers.

2. The educational and research centers will be those that are established on a permanent basis for the realization of activities of this nature in Spanish and foreign localities. They will depend directly on the Rectorate and will be created by the International University Menéndez Pelayo or by agreement between it and other public or private institutions, Spanish or foreign. The Directors of the Teaching and Research Centres will be appointed by the Rector, after a report from the Governing Council, between the Catedraptics and the University's Professors.

3. The Coordinator of Studies and Programs will be a University Professor appointed by the Rector, prior to the report of the Governing Council. He will be responsible for coordinating academic activities in collaboration, if any, with the Secretary-General.

4. The Director of the University Services shall be appointed by the Rector, after a report of the Governing Council, among career officials of the General Administration of the State who belong to bodies and scales to which it is required for their admission. the title of Doctor, Licensed, Engineer, Architect or equivalent.

5. The Director of Courses for foreigners will be a university professor appointed by the Rector, after a report of the Governing Council. He will be responsible for drawing up the general programme of courses for foreigners, as well as monitoring them, once approved by the Governing Council, and may propose the measures that it deems appropriate for its correct implementation.

6. The Director of the Major College of Appeal will be appointed by the Rector, after a report of the Governing Council, among career officials of the General Administration of the State that belong to bodies and scales to which the Title of Doctor, Licensed, Engineer, Architect or equivalent.

7. For the fulfillment of its specific missions, the Menéndez Pelayo International University will have the necessary services to perform the functions of support and complement to the cultural, research or teaching activities that in it organize.

Article 17. Teaching and research centers.

1. The Directors of the teaching and research centres shall be responsible for the organisation, direction and orientation of all activities carried out within each centre.

2. The Directors shall propose to the Rector the annual preliminary draft of the programme of activities of its centre, as well as the staff necessary for its implementation.

3. Each centre shall be composed of all the teaching staff and research staff attached to it.

4. The teaching and research centres will be governed by an internal regulation approved by the University's Governing Council.

5. In addition to the specific teaching and research function, the educational and research centres will have the task of carrying out studies, opinions, advice and projects entrusted to them by institutions or legal persons, public or private. private, in subjects typical of their activity.

Article 18. Students.

1. In the academic activities of the Menéndez Pelayo International University, it will be possible to take part as many people request, provided that they meet the requirements that in each case are established.

2. For special and summer courses, the Rectorate will be able to offer scholarships for students who will be duly disseminated, especially in the universities. The grant of scholarships will be preferential for all those graduates who had obtained an extraordinary prize in any Spanish university faculty and who had duly attended the call. The remaining scholarships, if any, shall be granted by the Governing Council to the academic merits of the applicants.

3. The Rectorate will be able to do awards and research grants.

Article 19. Certificates and diplomas.

1. The attendance at the different courses organized by the International University Menéndez Pelayo will give the right to obtain the corresponding diploma or certificate, in accordance with its character and according to the provisions of the legislation in force.

2. The Universidad Internacional Menéndez Pelayo will be able to award the Honoris Causa Doctorate to people who enjoy prestigious prestige in the fields of research, culture and teaching.

CHAPTER IV

Human, economic, financial, wealth, and resource resources regime

Article 20. Human resources.

1. The staff of the Menéndez Pelayo International University will be composed of:

a) Career officials from the General Administration of the State, teachers, researchers, and non-teachers who are assigned to the University.

b) University's own officials.

c) Teaching, research and non-teaching staff hired.

2. The International Menéndez Pelayo University will develop the project for the relation of jobs in accordance with the provisions in force at every moment in this matter.

Article 21. Budget.

1. The economic and financial activity of the University will be accommodated in an annual budget, which will be included in the General Budget of the State.

2. The preliminary draft budget shall be prepared by the Manager, following the guidelines established by the Governing Council and in accordance with the forecasts and needs of the University and the teaching and research centres.

3. The preliminary draft budget shall be submitted for approval by the Board of Trustees, after consideration by the Governing Council. It will subsequently be upgraded to the Ministries of Education, Culture and Sport and Finance for final approval by the Government.

4. The structure of the budget shall be in accordance with the provisions of the recast text of the General Budget Law.

Article 22. Economic resources and heritage.

1. The economic resources for the development of its activities shall be:

(a) The specific consignations assigned to them in the General Budget of the State.

b) Transfers of Autonomous Communities, Local entities or contributions from public entities.

c) Donations, legacies, and other contributions from private and private entities.

d) The income that will be provided by the teachings you organize or the students of your Residences.

2. The patrimonial regime shall be the one established in Article 48 of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State.

Article 23. Economic-financial regime.

The budgetary, economic, financial, accounting, intervention and financial control regime will be established by the recast text of the General Budget Law for Autonomous Bodies.

The agency will be subject to the internal control of its economic and financial management to be carried out by the Delegate Intervention of the General Intervention of the State Administration, which will have the level to be determined in the corresponding job relationship.

Article 24. Recruitment scheme.

The legal regime applicable to procurement shall be that laid down in the law of public administration contracts, subject to the provisions of Article 49 of Law 6/1997 of 14 April of the Organization and Operation of the General Administration of the State, and other regulations applicable to the General Administration of the State.

Article 25. Resources.

Put an end to the administrative path of the acts and resolutions of the Rector and the agreements of the Governing Council, the Cloister and the Board of Trustees of the Menéndez Pelayo International University, in accordance with the provisions of the Additional provision 15th of Law 6/1997 of 14 April of the Organization and the Functioning of the General Administration of the State.

Against such acts and agreements, it is possible to bring an administrative dispute, without prejudice to the replacement of the powers provided for in Law No 30/1992 of 26 November 1992 on the legal system of administrations. Public and the Common Administrative Procedure.

Single additional disposition. Scales of the Higher Council of Scientific Research.

To all intents and purposes, the mentions of University Professors and Catedratics contained in the above articles will be extended to the staff of the Research Professors and Scientific Researchers scales, respectively, in the Higher Council of Scientific Research.
